Legal Models of Development Planning - A Comparative Inquiry in Dialogue with China and Europe

Why should a legal scholar be interested in development plans? The present work begins and evolves with such question in mind. In order to provide an answer, the research focuses on certain major epiphanies of modern development planning and tries to isolate their legal characters. Therefore, the first issue to be addressed is the identification of “legal models” of development planning. The legal nature and legal effects of planning acts is still not clear and moves along fuzzy borders between traditional categories of mid-twentieth century planning (socialist and nonsocialist) and modern soft law planning documents and guidelines. In the first place, the research will try to assess the notion of planning in a legal perspective as well as the legal features of the planning acts/planning norms. The objective of this phase is to decide whether or not, and to which extent, socio-economic development planning may be thought of legally. In order to do so, I will carry out an analysis from the perspective of legal anthropology. In the second place, the research will focus on the definition of the legal features of modern development planning in the People’s Republic of China, through the analysis of the relevant legal formants, with the purpose of determining whether or not the identification of a Chinese “development planning law” is logically feasible. In the third place, I will question and verify the existence of development planning acts and norms in European Law. The purpose of the phase is on one hand to reconstruct and define the legal value of the regulatory framework for the functioning of European development policies. On the other hand, at this stage certain categories and practical solutions verified on the “Chinese front” may be applied to the European context. In the fourth place, i.e. in the conclusive chapter, I will try to draw some results of the comparative analysis carried out, as well as to trace an evolutionary pattern, determining how legal models of development planning affect, on a global scale, the changes in the role of the state in its relationship with the market.

Regionální diferenciace Německa se zaměřením na nové spolkové země / Regional disparities of Germany with focus on new federated states

The main aim of the thesis is to give a complex overview of different types of financial sources, from which new federated states can take benefits, and to give an opinion on the created effectiveness. Additional aims are to sum up the situation of the East German economy after WW2 and also the progress in its reforming during the 90s. Different historical development of the both former divided parts of nowadays Germany is essential because of understanding the economic situation of East Germany in 1990 and the nowadays problems. The first chapter sums up the economic consequences of the post war period, the influence of reparations, demontages and their dimension. In the second chapter follows an evaluation of the main topics of the beginning in the 90s - monetary reform and privatization. The third chapter goes on with the topic of economic reforms in the 90s and defines basic financial programs which are a long-term support to new federated states. Fourth chapter compares main chosen macroeconomic indicators of Germany and EU-27 and then of the old and new federated states. First, economic level of the whole Germany is being analysed and then its regional disparities. The last, fifth, chapter monitors the situation of Germany and its new federated states in the point of structural funds of the European Union.

ES regioninės politikos tikslas - sumažinti įvairių ES valstybių regionų ekonominio ir socialinio išsivystymo skirtumus ir skatinti tolygią ES plėtrą. Ši politika yra pagrindinė ekonominės plėtros ir aukšto gyvenimo lygio užtikrinimo priemonė. Lietuvai tapus Europos Sąjungos nare, ji gavo teisę naudotis ES struktūrinių fondų, per kuriuos vykdoma regioninė politika, finansine parama. Didžiausią nerimą Lietuvoje kelia skirtumų tarp regionų didėjimas ir svarbiausiųjų centrų, ypač sostinės, atotrūkis nuo šalies vidurkio. Kadangi pagal ES regionų klasifikaciją Lietuva laikoma vienu NUTS II regionu, svarbiausias dėmesys darbe skiriamas Lietuvos regioninei politikai, jos teisinei bazei, įgyvendinimo administravimui, regioninės dimensijos įsisavinimui ir iš to kylančioms problemoms analizuoti ir apibendrinti. Darbo tikslas – išanalizuoti Europos Sąjungos vykdomą regioninę politiką ir atskleisti regioninį aspektą 2004 – 2006 m. ir 2007 – 2013m. ES struktūrinės paramos programavimo dokumentuose. Darbe analizuojama jau baigiama įsisavinti 2004 – 2006 m.ES struktūrinių fondų paramos regioninė dimensija, įgyvendinama šalies savivaldybėse. Daromi apibendrinimai ir palyginimai su 2007 – 2013 m. ES struktūrinės paramos programavimo dokumentais, prioritetais, priemonėmis ir jų įgyvendinimo regioniniu aspektu. / The aim of the regional policy is to lessen the difference of EU countries in economic and social development and to promote equal EU development. This policy is the main measure vouching for economic development and high living standards. Since joining EU , Lihuania has got the right to use EU structural funds, which execute both regional policy and financial support. The greatest anxiety is caused by the growth of difference between regions and the most important centres, as the capital and regions. According to EU regional classification, Lithuania is considered as NUTS II region, so the greatest impact of the work is based on Lithuania’s regional policy, its law system, administrative work, implementation of regional dimension, analyses and justifications of the problems. The aim of the work is to analyze the implementation of EU regional policy and to reveal the regional aspect in the EU structural support’s programming documents of 2004 – 2006 and 2007 – 2013. The work analyses the final stage of regional dimension’s implementation of EU structural funds 2004 – 2006 in the country’s municipalities. It summarizes and makes comparisons with the structural support programming documents of 2007 – 2013, priorities, measures and their implementation in regional aspect.

Darbo tikslas - nustatyti pagrindines 2004-2006 m. ES struktūrinės paramos administravimo klaidas ir jų priežastis, ir, išanalizavus 2007-2013 m. ES struktūrinės paramos administravimo sistemą įvertinti, ar naujoji paramos administravimo sistema leis išvengti ankstesnio paramos periodo klaidų. Tiriant nustatytos pagrindinės 2004-2006 m. ES struktūrinės paramos administravimo klaidos ir įvardintos jų priežastys, išskirtos pagrindinės 2004-2006 m. paramos administravimo sistemos probleminės sritys. Išanalizuota 2007-2013 m. ES struktūrinės paramos administravimo sistema (apžvelgiant institucinio valdymo modelio, paramos administravimo procedūrų tinkamumą ir jas reglamentuojančių teisės aktų kokybę), ji palyginta su 2004-2006 m. paramos administravimo sistema. Lyginant didžiausias dėmesys skirtas 2004-2006 m. paramos administravimo sistemoje užfiksuotoms probleminėms sritims. Vertinant, ar naujojoje paramos administravimo sistemoje išvengta ankstesnio paramos periodo klaidų konstatuota, jog 2007-2013 m. paramos administravimo sistema efektyvesnė – stebima institucinio valdymo modelio dalinė decentralizacija, nustatytos efektyvesnės paramos administravimo procedūros ir patobulinti teisės aktai. Atsižvelgiant į neišspręstas problemas, pateiktos bendrosios rekomendacijos 2007-2013 m. paramos administravimo sistemai tobulinti, jos efektyvumui gerinti. / The objective of the thesis is to identify main problems of EU structural assistance system for 2004-2006 in Lithuania and to assess whether the new structural assistance system for 2007-2013 will allow to avoid problems and will be more efficient in terms of EU funds management system (institutional management structure: integrated/differenciated, centralized/decentralized ), structural assistance procedures, and quality of legal acts.

During counseling, the farmers provide information that may assist with the actual economic situation, the understanding of the essence to choose the right solution for economic development, investment, participation in support programs, the environment, animal welfare and other requirements of the implementation. Counseling beneficiaries trained skills for more effective activities, counseling helps to adhere to the standards of farming land, food and forestry.
