Developing African art : innovation and tradition seen through the work of two artists; Lamidi Fakeye and Ahmed Shibrain

The dissertation explores the work of two African artists: Lamidi O. Fakeye a Yoruba wood carver, and Ahmed M. Shibrain a Sudanese painter, as an exemplary development within African art during the second half of the 20th century. It examines their works through the sense of "tradition" as it is seen within the context of their cultures and their histories. It considers their works to be a reflection of their time, a hybrid art and a new tradition emerging within their respective cultures as a result of change in their societies. It argues against the notion that separates their art from their traditions and their histories based on the artificial barriers of "authenticity" in the literature on African art and the various categories that are related to it. It ponders on the contradictions and complexity that this situation has created and demonstrated that these categories negate historical realities. The dissertation is in two parts. The first part describes and analyses some of Lamidi's Christian and secular carvings. His work is placed in its appropriate historical perspective by revealing its close relationship to the carvings of his predecessors in terms of themes, design, content and clients. Innovation and change in his work through time and space is revealed. In the second part, the dissertation defines the connectivity of Shibrain's work to his tradition and its history, and that of his fellow artists who contributed to the development of a new trend in Sudanese art. It discusses their work on the basis of the 'idea' of art in Islam, their training and their heritage of decorative art and Arabic calligraphy. It argues that innovation, influence, borrowing and adaptation, are part of progress in art through the ages.

"We will do it our own ways": a perspective of Southern Sudanese refugees resettlement experiences in Australian society.

The main purpose of my thesis is to understand, from the perspectives of Southern Sudanese themselves, their resettlement experiences in Australia, to provide knowledge about how their experiences of exile reshape their thinking of home, place, identity, gender roles, and traditional practices, to explore the extent of their resettlement and integration into Australian society, and to inform policy on the resettlement of refugees and the settlement services offered to them. The thesis explores the range of interactions and relationships among Southern Sudanese and between them and their Australian hosts. It demonstrates how these interactions and relationships shaped and reshaped the Southern Sudanese sense of identity and belonging in resettlement in Australia. The thesis also provides insights into the relationships between the war that forced them out of their homeland, their flight, life in refugee camp or in exile, and how these affected their ability to resettle. To understand these, I have listened to how they described their lives before and during the war, while seeking refuge, and of their present and future life in Australia. From this I will show how they reproduce and maintain some aspects of their culture within the context of the Australian society, as well as how they are adapting to some aspects of life in that society. In this thesis I also explore the concepts of place, home and identity. In order to understand these concepts and how fluid they are in the current transnational era, I follow Thomas Faist’s (2000) thinking about the causes, nature and the extent of movement of international migrants from poorer to richer countries (also Cohen 1997; Kaplan 1995; Appadurai 1995). Faist in particular examines the process of adaptation of newcomers to host countries and the reasons why many migrants continue to keep ties to their home or place of origin. These ties, according to Faist, link transnational social spaces which range from border-crossing families and individuals to refugee diaspora. In this, I argue that resettlement involves complex interactions between newly arrived Southern Sudanese and members of Australian society. These complex interactions include firstly an array of social interactions occurring between Southern Sudanese and the staff of support organisations delivering settlement services to them. I show how the Southern Sudanese perceived the services they receive vis-à-vis the staff’s perceptions of Southern Sudanese as recipients of their services. Secondly they include various kinds of social interactions, relationships and networks among the Southern Sudanese and between them and members of Australian society through making friendships, home visitations, joining social and cultural clubs, and becoming involved in professional associations and churches which are predominantly Australian. I show how these social relations and networking are being enacted and maintained and/or fall apart over time. I ascertain whether these relationships have enhanced their resettlement or not. Thirdly, the thesis shows the impact of a shift in gendered roles and intergenerational conflicts between parents and children on family relationships and how these in turn affect their actual settlement. This thesis is based on these themes and on the analysis drawn from detailed qualitative ethnographic research which I conducted over a period of fourteen months between January 2006 and March 2007 and from the literature. In keeping with the traditions of ethnographic fieldwork practices, I carried out structured and unstructured in-depth interviews and Participant Observation of informants during the fieldwork. The subjects of this thesis are the Southern Sudanese refugees who resettled in South Australia and some staff of organisations which delivered settlement services to them. The fundamental questions which these ethnographic explorations attempt to answer are how do the Southern Sudanese experience resettlement in Australian, interact with members of their host society, construct their identities in relation to their notions of home and place, and negotiate shifting gender roles and relationships in the family. I show how their previous life experiences in Southern Sudan, their plight, their flight from war, their life in refugee camps and/or in refugee settings in other countries, their personal socio-economic and historical backgrounds, have affected their resettlement in Australia. I also explore their current and ongoing relations with their homeland and other Southern Sudanese diaspora and show how this perpetuates their identity as Southern Sudanese. I argue that success or failure in resettlement hinges mostly on the Southern Sudanese ability or inability to understand and speak the English language, their access to employment and stable housing, relationships with Australians, and the quality and quantity of settlement services which they access and receive. I assert that the interplay between/among these factors have combined to influence significantly the settlement processes and the extent of integration of Southern Sudanese into Australian society. Les armes, les femmes et le bétail : une histoire sociale de la guerre civile au Sud Soudan (1983-2005) / Women, guns and cattle : a social history of the second civil war in South Sudan

Cette thèse montre que la violence a suivi une géographie et un calendrier particuliers au cours de la deuxième guerre civile au Sud Soudan. Elle n'a par conséquent pas affecté les Sud Soudanais de manière uniforme, en particulier les femmes. Dans les zones contrôlées par le SPLA (Sudan People 's Liberation Army), la guérilla entretenait une relation essentiellement extractive avec les civils, en particulier avec les femmes. Même si la guérilla essaya de limiter les violations des droits de l'homme, elle instrumentalisa et marchandisa néanmoins les femmes pour soutenir sa lutte. Elle créa aussi, à terme, de nouvelles classes sociales, grâce à l'expansion des liens de parenté. L'inclusion des femmes au sein du SPLM/A confirma la marchandisation des femmes et la formation de nouvelles classes sociales. Le SPLA ne remit pas en cause les structures sociales du Sud Soudan, et les femmes participèrent à la lutte essentiellement dans des rôles de soutien au combat. Néanmoins, la guérilla créa une élite féminine à travers les liens de parenté. Cette nouvelle élite féminine agrandit son statut au milieu des années 1990 grâce à la démocratisation du mouvement, à son accès aux arènes internationales favorables au SPLA, et à l'expansion du rôle des femmes dans les processus de paix. Après la guerre, les différences sociales entre les femmes furent amplifiées par la constitution de l'Etat semi-autonome. Le comportement des troupes du SPLA pendant la guerre influença par la suite les nouvelles structures de pouvoir et, combiné à l'accès nouveau aux ressources de l'Etat, il participa à la consolidation des classes sociales. / This dissertation illustrates that violence followed a particular geography and timeline during the second civil war in Southern Sudan. Therefore it did not affect Southerners, and women in particular, uniformly. In the SPLA-held areas, the guerilla had a mostly extractive relationship with civilians and particularly women. Although it tried to curb human right abuses, the guerilla still instrumentalized and commodified women to support its struggle and to ultimately create new social classes through the expansion of kinship ties. The inclusion of women in the SPLM/A continued to demonstrate women's commodification and the formation of new social classes. Given its superficial and circumstantial Marxism ideology, the SPLA did not question the Southern Sudanese social structures, and women supported the struggle mostly in combat-support roles. Nevertheless, the guerilla created a female elite through kinship ties. This new female elite expanded its status in the mid-1990s, thanks to the movement's democratization and to their access to international arenas that were favorable to the SPLA and to expanding women's roles in peacemaking. After the war, social difference between women were amplified through the formation of the semi-autonomous state. The legacy of the SPLA troops behavior during the war influenced new power structures and, combined with access to new state resources, consolidate social classes.

Assessing the compatibility of the right to a fair trial under Sudanese law with international human rights law

This thesis investigates the compatibility of a crucial aspect of Sudanese criminal justice, namely, the compatibility of the right to a fair trial with two main sources of this right: international human rights law and Shari’a law. The right to a fair trial is a cornerstone for any society and serves to observe the rule of law and other rights of citizens. The study illustrates that the right to a fair trial could play a significant role in the protection of human rights in Sudan. The main aim of this study is to establish ways in which the right to a fair trial can be strengthened in Sudan. The thesis has examined the work emanating from the international level by reviewing decisions, providing general comments and analysing other jurisprudence emanating from bodies such as the African Commission on Human and Peoples’ Rights and the Human Rights Committee. The decisions, general comments and other jurisprudence from these bodies are juxtaposed against Sudan’s laws to establish the extent to which the right to a fair trial is upheld at the domestic level in Sudan. The study critically examines the sources of the right to a fair trial in Sudan. The main sources of right to a fair trial in Sudan are the Constitution, the Criminal Procedure Act, the Penal Code, Shari’a law and international human rights law. It seeks to answer the question whether Sudanese fair trial rights are compatible with international standards. The study establishes that one of the sources of law that govern the right to a fair trial in Sudan is Shari’a law. The main principle in Islam is that nothing is unlawful, unless it is expressly forbidden by law. However, the Shari’a law in Sudan has not been properly implemented as is illustrated through the rigid and traditional implementation of some of its provisions. The selective and rigid implementation of provisions of Shari’a law has resulted in a conflict with the accepted international standards of fair trial rights. What the study establishes is that a more progressive interpretation of Shari’a law can potentially solve the contradictions with international human rights law that currently exist. The study identifies a number of factors that have affected the development of the right to a fair trial in Sudan. Among these factors are the lack of political will, poverty, the lack of awareness about rights, laws that are contrary to the right to a fair trial, laws that inadequately protect victims and witnesses, impunity, corruption, the lack of resources both human and financial, abuse of power, existence of military and special courts, institutional constraints, discrimination against women, and the refusal or resistance of the executive branch of government to implement decisions of the courts. This study concludes that some pre-trial, trial and post-trial rights and standards in Sudan are not in conformity with international and regional standards. Conversions from Islam to Christianity in the Sudan

This research project focuses on conversions from Islam to Christianity in the Sudan. It first gives a biblical and theological understanding of conversion and then introduces the sociological and psychological understanding of such a change in religious affiliation. It discusses conversion as a spiritual decision process and develops a spiritual decision matrix for evaluating conversion processes of Muslims. The heart of the study is an analysis of the conversion processes of six converts with a Northern Sudanese background from different Muslim tribes. The interviews that were conducted with these converts are analysed in terms of five parameters: reasons for conversion; factors that led to conversion; stages in the conversion processes; problems encountered during the conversion processes; and results of the conversion.
