A partir da teoria do escopo formulada por Katharina Reiß e Hans Vermeer em Grundlegung einer allgemeinen Translationstheorie (1984) e de uma expansão do modelo de análise textual de relevância tradutória apresentado por Christiane Nord em Textanalyse und Übersetzen (1988), a presente tese de doutorado apresenta um novo modelo teórico para a execução da TRADUÇÃO RETROSPECTIVA, definida como a tradução a posteriori de um TP (texto precursor) ainda inédito na cultura-alvo que mantenha uma relação de influência e/ou precedência cronológica com um TS (texto sucessor) já traduzido anteriormente para a cultura-alvo, de maneira que a tradução de TP cause a impressão de ser anterior e/ou de ter influenciado a tradução de TS. A tradução retrospectiva tem por objetivo simular, na culturaalvo, a relação existente entre o original de TP e o original de TS na cultura-fonte através de uma inversão das relações de influência literária segundo os moldes propostos por Jorge Luis Borges no ensaio “Kafka y sus precursores”. Uma vez exposto o modelo teórico, o trabalho apresenta um estudo de caso sobre o volume O grande deus Pã, totalmente concebido em função de uma tradução retrospectiva do TP The Great God Pan, de Arthur Machen, feita com uma visada sobre o TS “The Dunwich Horror”, de Howard Phillips Lovecraft, traduzido anteriormente por mim. / By building on the Skopos theory proposed by Katharina Reiß and Hans Vermeer in Grundlegung einer allgemeinen Translationstheorie (1984) and on an expansion of the model for text analysis in translation presented by Christiane Nord in Textanalyse und Übersetzen (1988), this doctoral dissertation introduces a new theoretical model for RETROSPECTIVE TRANSLATION, defined as an a posteriori translation of a PT (precursor text) still unpublished in the target culture which in turn maintains a relationship of influence and/or chronological precedence with an ST (successor text) previously translated in the target culture, so that the translation of PT may seem to have anticipated and/or influenced the translation of ST. The objective of a retrospective translation is to simulate, in the target culture, the existing relation between the original of PT and the original of ST in the source culture by promoting an inversion of traditional literary influence relations inspired by Jorge Luis Borges's essay “Kafka and his precursors”. Once the theoretical model is laid out, there follows a case study of the volume O grande deus Pã, entirely conceived around a retrospective translation of the PT The Great God Pan, by Arthur Machen, done with a backward glance toward the ST “The Dunwich Horror”, by Howard Phillips Lovecraft, previously translated by me.

Embora o conto tenha mais de vinte traduções diferentes para o português brasileiro, a necessidade de uma nova tradução justifica-se pela insuficiência de todas aquelas existentes no que diz respeito ao tratamento literário dos problemas especiais suscitados pelo criptograma e pela decifração deste no interior da narrativa. A importância da criptologia na gênese, na recepção e na posterior influência de “The Gold- Bug” é demonstrada através de exemplos e argumentos, e a seguir uma nova tradução do criptograma é proposta com o objetivo de produzir em português brasileiro um texto dotado das mesmas qualidades literárias e raciocinativas que resultaram na imensa popularidade do conto e na elevação de Poe ao status de gênio ainda no século XIX. / This paper presents a brief summary of the Skopostheorie proposed by Katharina Reiß and Hans Vermeer in Grundlegung einer allgemeinen Translationstheorie (1984) in order to assess the way in which the concepts of “communicative translation” and “equivalent translation” could be applied to a new translation of the cryptogram found in Edgar Allan Poe’s short-story, “The Gold-Bug” (1843). There are over twenty translations of the story into Brazilian Portuguese, but a new effort is nonetheless in order in view of the insufficiency of all existing translations with regard to the literary treatment of the special problems posed by the cipher and Legrand’s decipherment. The important role played by cryptology in the genesis, reception and later influence of “The Gold-Bug” is demonstrated by means of examples and arguments, and finally a new translation of the cryptogram is proposed with the aim of producing, in Brazilian Portuguese, a text with the same literary and ratiocinative qualities which eventually led to the tale’s immense popularity and Poe’s rise to the status of “genius” still in the 19th century.

A tese cuida do problema da limitação da responsabilidade civil, investigando, em especial, a teoria do escopo da norma ou teoria do escopo de proteção da norma. Analisa-se o seu desenvolvimento do direito delitual alemão, contextualizando-a nos problemas teóricos e práticos do BGB (o Código Civil alemão) e analisando sua funcionalidade para o direito da responsabilidade civil por ato ilícito no Código Civil brasileiro. O trabalho é constituído de quatro capítulos. O primeiro dedica-se ao problema da fundamentação e da limitação da responsabilidade no direito delitual alemão; o segundo, às teorias da causalidade, em especial a teoria da equivalência das condições e a teoria da causalidade adequada; o terceiro, à teoria do escopo da norma no direito alemão; e o quarto à sua aplicabilidade na responsabilidade por ato ilícito do Código Civil de 2002. Também são discutidos aspectos relativos à responsabilidade contratual. / Die Dissertation behandelt das Problem der Begrenzung der zivilrechtlichen Haftung, insbesondere die Normzweck- oder Schutzzwecktheorie. Die Entwicklung dieser Theorie wird im Zusammenhang mit den theoretischen und praktischen Fragen des deutschen Deliktsrechts untersucht und ihre Anwendbarkeit im brasilianischen Deliktsrecht geprüft. Die Dissertation besteht aus vier Kapiteln. Das erste Kapitel stellt die Probleme der Haftungsbegründung und -ausfüllung im deutschen Deliktsrecht dar. Im zweiten Kapitel werden die Theorien der Kausalität erläutert, insbesondere die Bedingungs- und die Adäquanztheorie. Das dritte Kapitel stellt die Normzwecktheorie im deutschen Zivilrecht dar. Im vierten geht es um die Anwendbarkeit der Theorie im brasilianischen Deliktsrecht. Daneben werden einzelne Aspekte der Vertragshaftung behandelt.
