Čakarová, Rosica January 2015 (has links)
The diploma thesis focuses on description and analysis of the current situation on the market for franchise companies. Namely the conditions for cooperation, currently offered by the operators of the franchise concepts in the gastronomy field. For clarification, the work is divided into several chapters depicting the main aspects of franchise business, to which should pay attention every potential franchisee. The introduction summarizes the main characteristics of the franchising, focusing on characteristics of the franchise business, franchising forms available on the Czech market and advantages and disadvantages of operating on both parts. As following, there are discussed financial and tax aspects of the franchise businesses in the Czech Republic and the available options for financing the enterprises. There is a chapter also devoted to possible pitfalls of franchising and a conflict from the perspective of the competition laws. The next section of this thesis focuses on analysis of the advantages of franchising in terms of gastronomy, putting an emphasis on the main factors affecting the franchisees, such as support for the franchisee, franchise fees, return on investment, length of the contracts and franchise expansion strategy of the concepts. The last chapter of the analytical part of the diploma thesis is devoted to practical example which purpose is to compare the profitability of the two possible options of entrance to a gastronomic franchise concept. The conclusion is dedicated to a summary of the overall profitability of franchise business in general and specifically in the selected area. Furthermore, all the introductionary-defined hypotheses are either verified or disapproved.

The role of leadership in creating excellence in a diagnostic radiography programme through curriculum restururing

Thulo, Antoinette Mabatho 06 February 2007 (has links)
Democratic principles and values in South Africa and technological innovations influence the design of educational programmes provided by higher education institutions. The diagnostic radiography programme at the Medunsa Campus of the University of Limpopo has to align itself with policy requirements and the requirements of the world of work. Against this background this study aims at answering these questions: How has Radiography changed as a science and what demands are placed on practitioners to meet competence requirements in a changing working environment? What impact does the changing role of the radiographer have on the academic department in terms of curriculum development and curriculum management? What strategies should curriculum leadership use to improve the quality of the programme offered in terms of expectations essential to a competitive and changing working and teaching environment? A qualitative study was used where structured personal interviews were conducted with academe and clinical personnel to answer these questions. The responses were coded to facilitate the process of data analysis. The findings of this investigation indicate that changes in the Department of Education and the Department of Health transformation have an impact on the curriculum. The investigation has also revealed that there is lack of collaboration between the academic and the clinical personnel. It also indicates that professional development should be made more relevant in terms of focusing on areas that affect radiographers, for instance clinical personnel need to be aware of principles of primary health care and lifelong learning. In line with the changing nature of leadership, the proactivity of the academe cannot be underestimated as this could help in maintaining quality and excellence in the programme. / Dissertation (M.Ed (Maximising Potential))--University of Pretoria, 2007. / Curriculum Studies / unrestricted

An analysis of strategic-military issues in the ending of Civil wars : a case study of the Democratic Republic of the Congo, 1994 – 2004

Alusala, Nelson January 2015 (has links)
This study is an analysis of how military issues can contribute to a sustainable ending of civil wars particularly in Africa. The continuous warfare in the Democratic Republic of the Congo (DRC) between 1996 and 2004 is used to understand the nature of civil wars and how they relate to classical strategic theory of war in general and their termination in particular. According to classical strategic military theory, war must always be guided by clear political objectives. Without this, war becomes an irrational act and spins out of control. Tactical victory gained in the battlefield over an opponent must be translated into strategic victory for war to end sustainably. This can only be done if the political objective of the war has been attained. But also crucial are the terms and conditions of peace that the victor offers the defeated opponent. Not all wars end with a tactical victory in the battlefield. In many instances of modern wars, and in particular with the current civil wars in Africa, there is a stalemate. This forces the belligerent parties to negotiate. Within the context of the DRC, the first war (1996-1997) ended in a tactical victory for the Rwandan alliance (composed of Rwanda, Uganda and Burundi) over the regime of President Mobutu. However, this victory was not translated into strategic victory (long term peace). The alliance, despite having installed a new leader (Laurent Kabila) in the DRC, remained an occupying force, with the Rwandan military commander taking over the role of the DRC’s military chief of staff. This was in part because the political objectives of the Rwandan alliance had changed from revenge on Mobutu for sheltering and supporting the perpetrators of the genocide in Rwanda, to economic exploitation of the abundant natural resources of the DRC. The outcome was that the proxy (Kabila) turned against his backers as he sought to gain legitimacy and support from his fellow Congolese citizens. President Kabila ordered the Rwandan alliance out of the country. The alliance then started a second war (1998-2002) aimed at deposing the former proxy and establishing new proxies. The situation had however changed as the old proxy (Kabila) had acquired new partners (Angola, Namibia and Zimbabwe). This, apart from transforming the DRC war into Africa’s first continental war (in terms of the number of countries that were eventually involved), turned into a stalemate. This resulted in negotiations that took a long time to complete. The first round of negotiations produced the Lusaka Ceasefire Agreement (LCA) in 1999 with two independent tracks that led to two levels of agreements: inter-state agreements and intra-state agreements. None of these were implementable until 2002 when the DRC negotiated with Rwanda and with Uganda separately on military issues of the conflict. These negotiations produced the Pretoria Accords between the DRC and Rwanda, and the Luanda Accords between the DRC and Uganda. The withdrawal of the militaries of Rwanda and Uganda from the DRC paved way for their proxies, The Rally for Congolese Democracy - Goma (Rassemblement Congolais pour la Démocratie - RCD-Goma) and the Movement for the Liberation of Congo (Mouvement de Libération du Congo – MLC) to join the Inter-Congolese National Dialogue (ICND) which ended in 2004 without a conclusive agreement on military issues. / Thesis (PhD)--University of Pretoria, 2015. / tm2015 / Political Sciences / PhD / Unrestricted

Desajustes identificados em relatórios de estudos de impactos ambientais em empreendimentos hidrelétricos focando os grupos de aves e mamíferos silvestres / Discrepancies identified in environmental impact assessment reports for hydropower projects focused on analyses of wild birds and mammals

Adriana Akemi Kuniy Kamogawa 19 March 2013 (has links)
Environmental Impact Assessment (EIA) studies were legally institutionalised in Brazil in the 1980s, and their elaboration is based on guidelines established by Terms of Reference (TR) which define the main directives to be followed by each project\'s EIA, but often do not determine the faunal groups to include and the methods to be employed choices which are then left at the discretion of the company proposing the project and their hired consultants. In order to analyse whether this procedure does or does not result in an absence of standardisation among Terms of Reference and EIA studies, as well as in other disparities which may impair the effectiveness of EIA reports, this work compared 9 EIA reports for hydro-power projects from the 1980s, 1990s and 2000s. The reports were compared with regard to such information as compliance with the requirements set by the TRs and methodology used (including sampling methods, sampling effort, study of bird and mammal groups dependent on specific habit types, reliability of the fauna lists provided and data analysis). The appropriateness of the RAPELD sampling design for Hydro-power environmental impact assessments was also analysed. The results indicated incongruities as to the sampling effort and the methodologies employed for the studies, as well as an absence of information required according to the Terms of Reference and a paucity of data specifically dealing with fauna groups associated with environments to be directly affected by the projects and with mammals and birds dependent on alluvial environments. The RAPELD sampling design is often considered inappropriate for highly human-modified regions, but it is noted that its recommendation by environmental agencies for some of the cases analysed indicates a recent improvement in sampling designs. This work\'s findings may serve as indicators of the overall state of the effectiveness of EIA studies as tools for the society to assess the effects of interventions in the environment.

Physiological Responses to Affective Stimuli of Obese and Nonobese Females Differing in Dietary Restraint

Framer, Edward Marc 05 1900 (has links)
The present study translated the major theories of obesity into physiological terms, then tested for the ways these theories might find physiological expression. Theoretical positions included the psychoanalytic perspective, emphasizing intrapsychic processes; psychosomatic perspective, emphasizing food as an anxiolytic agent; and Schachterian perspective, emphasizing heightened sensitivity to external stimuli. Additionally, two classificatory distinctions, age at onset of obesity and extent of dietary restraint, were examined. The later distinction suggested that Schachterian findings on obese behavior were due not to obesity, but to a dieting life style.

Uzavírání adhezních smluv podnikatelem / Boilerplate contracts made by an entrepreneur

Chalabi, Robin January 2021 (has links)
Boilerplate contracts made by an entrepreneur Abstract The diploma thesis thematically focuses on an issue of contracts of adhesion which are concluded by entrepreneur in the course of trade. Contracts of adhesion are characterised by a specific, adhesive, method of entering into contracts based on the principle of take it or leave it which relies on the fact that the basic terms of contract are determined by one of the contractual parties which results in reducing the options of the weaker contractual party to full acceptance of unilaterally determined basic terms of contract or to the rejection of the contract as a whole. The aim of this diploma thesis is the presentation of a comprehensive analysis of the legal institute of contracts of adhesion de lege lata which is completed by synthesis of the insights in question into relevant theoretical and practical conclusions, including considerations de lege ferenda. The legal institute of contracts of adhesion with regard to the aim of the diploma thesis is subjected to theoretical analysis from the point of view of historical development, from the point of view of definition of the thematically relevant legal concepts de lege lata which are entrepreneur, weaker entrepreneur, consumer or legal regimes of contractual relations, from the point of view of...

Obchodní podmínky a doložky v obchodních vztazích / Commercial terms and clauses in business transactions

Hošna, Vojtěch January 2020 (has links)
Commercial terms and clauses in business transactions Abstract The master thesis is focused on the topic of commercial (standard) terms and clauses in business transactions. With respect to increased demands on the entrepreneur, the relevant provisions will be interpreted differently in the business relationship than in the case of a consumer relationship. Standard terms standardize the contracting process and reduce costs. Legislation of commercial terms remains concise but it contains some news. Significant change is the express regulation of the knock-out rule, which is used to determine the final content of a contract in the case of conflict between standard terms. Section 1752 newly contains express regulation for unilateral change of standard terms. A major novelty is specific content/formal control of standard terms which is regulated section 1753. Party is protected against the terms with which that party would scarcely have accepted had it been aware of them. Surprising terms are ineffective. The thesis is dedicated to problematic aspects, which arise in the case of contracting under standard terms. The thesis uses descriptive and comparative methods for accomplishment that goals. Firstly I will try to define the notion of commercial terms. In the second chapter are presented requirements for valid...
