The Court of Justice of the European Union

Kapsis, Ilias January 2016 (has links)
No / This chapter examines the Court of Justice of the European Union (CJEU), which consists of three courts: the Court of Justice (or ‘the Court’), the General Court, and the Civil Service Tribunal. It focuses on issues of structure and procedure, the extent of the Courts’ jurisdiction, and their role in the promotion of European integration. The chapter also discusses the criticism directed at the CJEU for the way it exercises its judicial powers, which allegedly involve political considerations normally unacceptable for a judicial body. Lastly, the chapter looks at the main challenges facing the courts.

The Determinants of Supreme Court Decision-Making: An Ideal Point Analysis

Glennon, Colin Ross 01 August 2011 (has links)
The relationships among governmental institutions are some of the most studied phenomena in political science. Yet these complex interactions remain largely unexplained due to the difficult task of developing accurate measures that lead to quantifiable tests that enhance explanation and prediction. This work centers on the interactions of United States Supreme Court justices with other political actors. The goal of this dissertation is to better understand the relationship between the Supreme Court and its institutional environment. In short, I ask: What factors affect Supreme Court justices’ voting decisions? I approach this question from several different angles while making use of a unique dependent variable—Yearly Supreme Court justice ideal point. This variable is a variant of the ideal points calculated by Michael A. Bailey of Georgetown University (Bailey, 2007). My empirical models consider the effects of numerous independent variables on this dependent variable. One of the unique aspects of this study is that it considers the effects of a wide variety of factors purported to affect judicial behavior. There are four main theories of judicial decision-making, and my empirical analyses test notions exported from all of them. In designing and testing my models, I draw especially on the developing approach of new institutionalism—an approach to the study of judicial politics that emphasizes the influence of external, non-judicial political actors on judicial behavior. Ultimately this work will show what factors constrain the actions of Supreme Court justices and to what degree they do so. This research has many implications for larger theoretical concerns of political science, specifically formulating questions about the independence of the judiciary and contains relevant questions for democratic theory as well.

No. of bitstreams: 1 versão - biblioteca_2.docx: 1481466 bytes, checksum: 11094ff065f489e48891c814fdae1ae6 (MD5) Previous issue date: 2018-06-25 / Esta dissertação investiga a nomeação de peritos judiciais no processo civil. / This dissertation investigates the appointment of court experts in civil proceedings. The purpose of this study was to analyze improprieties identified in the way in which the legal relationship between the Judge-State and the individual takes shape at the time of the election of the court expert and throughout the execution of their technical services. Professional observation, coupled with academic research, made it possible to ascertain that the legal and regulatory treatment of a typical procedural act as established by the New Civil Procedure Code and by the Conselho Nacional de Justiça (CNJ) evokes deep questions about its suitability for the dynamics of business conflict resolution in the contemporary context — an unexpected reality, given that the appointment of judicial experts is a type of evidence which has enduringly been contemplated in the national legal system, having been employed in thousands of lawsuits every year. In view of the imperative nature of the act, the identified deficiencies have the potential of spreading misconducts in the Judiciary, considering the magnitude of financial resources and economic interests involved in a large number of lawsuits. Furthermore, they create legal uncertainty for all actors involved: magistrates, court experts and parties, with reference to the business relationships of service provision encapsulated. This generates, thus, damages to the jurisdictional exercise as well as a discouragement to the development of a promising business market for the advisory industry. In order to critically evaluate the subject, a comparative assessment of the particularities of the appointment of court experts was carried out, with regard to the following elements: (i) complex legal proceedings; (ii) legal obligations; (iii) civil contracts; and (iv) administrative contracts, observing the distinctive signs of each of these categories, having reached the conclusion that it would be judicious to rethink the qualification of the appointment of court experts — a reality, which, if accepted, would require a new characterization of the court expert activity. Hence, lege lata propositions were developed as possible directives to be given to the subject, guided by the principles of Public Administration, aiming to encompass the legal reflection on the current interpretation of the legislation and the adequacy of the CNJ regulations: all with a view to improve the model in effect in the national legal system, thus inhibiting misconducts and allowing for contractual legal certainty.

The Gavel and the Ghost

Smit, Reynard January 2013 (has links)
This thesis explores an alternative method of making Architecture based on ideas presented by Bruno Latour in “Give me a gun and I will make all buildings move” and concepts discussed by Peter Eisenman within “Diagram: An Original Scene of Writing.” The static nature of representation within Euclidian Space requires a re-evaluation of the generative qualities inherent within diagrams. Managed through an identified mechanism, the thesis investigates the excavation of potential within Pretoria Central’s lost spaces by generating programme, response and resolution from elements inherent in the diachronic context. / Dissertation MArch(Prof)--University of Pretoria, 2013. / Architecture / MArch(Prof) / Unrestricted
