(Eng) The submitted master's thesis discusses non-conventional signs and trade marks, which have grown in significance, especially from the perspective of marketing, traders and law, as was demonstrated by the recent amendments of the European trade mark law. The main aim of this thesis is to identify the particularities of non-conventional signs and obstacles to their registration from the perspective of the selected jurisdictions and consequently, to evaluate the reasons and justifications of the countries' approach. After a historical overview of trade mark functions and the development of law in the studied jurisdictions, the thesis is concerned with outlining the theoretical legal basis of trade mark protection in the European Union, Canada, Australia and the United States of America. The main focus of the thesis lies in the specific effects of the law on the individual types of non-conventional signs and trade marks, with a particular emphasis on the decisions of offices and courts, especially the Court of Justice of the European Union. The analysis includes sounds, scents, shapes and colours, as well as motion marks, holograms, position marks and tactile signs. Thus it is justified to analyze the technical and procedural apparatus of guardianship satisfativa urgency and instrumental ensemble of effectively protective of trademark rights, detecting the characteristics and requirement of substantive law, to identify and provide appropriate forms of applicability of these techniques if the prompt granting to judicial review. With doctrinal and jurisprudential research, the aim is to examine the effective and sensitive to the legal reality of trademark rights, in order to present an effective judicial remedy procedural strategies. We adopted this approach to design a constructive new perspective in which configures the Civil Procedure Law, the use of procedural techniques as suitable for the protection of rights instruments. The methodological procedures of this research leave from literature and legislative review on the subject, later the jurisprudential analysis. After performing these procedures, sistematizaremos the use of procedural technique to institute substantive law, simultaneously highlighting the construction of the Civil Procedure Law as an instrument of efficiency of trademark rights. The basic research techniques used are the jurisprudential literature and documentary. The literature will be developed from prominent works on the subject, and specialty papers, both directed to specific public jurists. The desk research will involve the study of relevant documents held as normative acts related to the topic and current jurisprudence of the main courts dealing with these problems. In short, like the findings, initially highlights aspects such as overcoming paradigm in civil procedural law, the collaboration of doctrinal, jurisprudential and legislative debates on this aspect, as well as show how the judicial protection of urgency was a standard of effectiveness. In another room, we present the specific interpretation of the relevant rules to that legal protection, with the goal of leading the reader to a different compression on the applicability, effectiveness and imperative nature of technical procedural points. Assim se justifica analisar o aparato técnico-processual da tutela de urgência satisfativa como conjunto instrumental efetivamente de protetivo dos direitos de marca, detectando as características e exigência do direito material, para identificar e apresentar formas adequadas de aplicabilidade dessas técnicas caso seja fundamental a concessão imediata de tutela jurisdicional. Com investigações doutrinárias e jurisprudenciais, almeja-se examinar as estratégias processuais efetivas e sensíveis à realidade jurídica dos direitos de marca, com a finalidade de apresentar uma tutela jurisdicional efetiva. Adotou-se neste projeto uma abordagem construtiva da nova perspectiva em que se configura o Direito Processual Civil, a da utilização das técnicas processuais como instrumentos idôneos para a tutela dos direitos. Os procedimentos metodológicos desta pesquisa partem da revisão bibliográfica e legislativa acerca do tema, posteriormente a análise jurisprudencial. Após realizados estes procedimentos, sistematizaremos o uso da técnica processual ao instituto de direito material, destacando concomitantemente a construção do Direito Processual Civil como instrumento de eficácia dos direitos de marca. As técnicas básicas de pesquisa adotadas são a bibliográfica e documental jurisprudencial. A pesquisa bibliográfica será desenvolvida a partir de obras de destaque quanto ao tema, e artigos científicos especializados, ambos dirigidos a público específicos, os operadores do direito. A pesquisa documental consistirá no estudo detidos de documentos relevantes, como diplomas normativos referentes ao tema e jurisprudências atualizadas dos principais tribunais que se ocupam com estes problemas. Em síntese, como resultados obtidos, inicialmente se destaca aspectos como a superação de paradigma no direito processual civil, a colaboração da doutrinária, jurisprudencial e debates legislativos sobre esse aspecto, assim como apontar como a tutela jurisdicional de urgência se constituiu um standard da efetividade. Noutro espaço, apresentam-se pontos específicos da interpretação das normas atinentes à referida tutela jurisdicional, com o objetivo de conduzir o leitor a uma compressão diferenciada quanto à aplicabilidade, eficácia e imperatividade da técnica processual. Throughout this comparison, the work will show how Brazilian law system disrespects its own Constitution, and goes the other way from the international regulation of trademarks when restricts its protections only to symbols that are visual perceived, letting behind other kinds of symbols which accomplish the same goals. As a result, the paper proposes changes in Brazilian law to protect these nonconventional symbols (as to say, nonvisual symbols) in order to reach an harmony with the international law, no matter how these symbols can be perceived. By protecting such nonconventional symbols, fair trade will be assured and more consumers will be included in the market, as they have the right to be informed about the different products and services offered to them. / O presente estudo busca inquirir a política nacional de proteção jurídica das marcas, tendo em perspectiva os sinais não convencionais, partindo de sua evolução histórica à análise comparativa de regulamentação jurídica com os Estados Unidos da América (EUA) e com importantes tratados internacionais do qual o Brasil é signatário, a exemplo da Convenção da União de Paris e o Acordo sobre aspectos dos direitos de propriedade intelectual relacionados ao comércio ¬¿ TRIPS. A partir desse cotejo, buscar-se-á destacar que a legislação brasileira, ao resumir o sinal protegido como marca apenas aos visualmente perceptíveis, olvida do tratamento constitucional e internacional dado a matéria, e com isso deixa órfão de proteção outros signos que possuem forma de apresentação distinta, mas não deixam de cumprir as funções axiais do instituto. Diante disso, mostrar-se-á a necessidade de reforma da legislação para, em harmonia com o direito constitucional e internacional, proteger outros sinais suficientemente distintivos, independente da sua forma de apresentação sensorial. Protegendo esses diferentes sinais, estar-se-á melhor tutelando a concorrência, promovendo maior inclusão e exaltando os direitos do consumidor, que, entre outras prerrogativas, possui o direito de ter acesso a informação suficiente e clara sobre os diferentes produtos e serviços colocados no mercado.

Jau nuo seno geografinės nuorodos savo koncepcija išsivystė kaip pirmieji prekių ženklai. Intensyvėjant bei sudėtingėjant komerciniams santykiams geografinės nuorodos ir prekių ženklai tapo skirtingomis kategorijomis žymenų, kurių registraciją, apsaugą bei naudojimą reglamentuoja intelektinės nuosavybės teisės normos. Visgi, nors tai skirtingi pramoninės nuosavybės teisės institutai, geografinės nuorodos ir prekių ženklai sutampa daugeliu aspektų. Visų pirma, šie žymenys, naudojami komercinėje aplinkoje, sutampa jiems priskirtomis funkcijomis, t.y. jie abu atlieka prekių ar paslaugų atskyrimo, kilmės šaltinio identifikavimo, kokybės identifikavimo bei vartotojų informavimo funkcijas. Be šios sutapties, geografinės nuorodos ir prekių ženklai yra panašūs, nes privalo turėti skiriamąjį požymį, o taip pat sutampa ir jų išraiškos formos bei apsaugos galiojimo laikas. Visi išvardinti panašumai, išreiškiantys ryšį tarp geografinių nuorodų ir prekių ženklų, gali lemti painiavą rinkoje bei pramoninės nuosavybės išimtinių teisių pažeidimus, todėl teisiniai mechanizmai, skirti reguliuoti šių žymenų registraciją, apsaugą ir naudojimą yra įtvirtinti siekiant išlaikyti pusiausvyrą tarp vartotojų ir gamintojų, išimtinių teisių turėtojų interesų. Numatyti teisėti geografinių nuorodų ir prekių ženklų naudotojai dėl pažeistų teisių gali remtis skirtingais būdais. As the commercial relations become more intensive and complex, geographical indications and trade marks has become two different categories of signs, the registration, protection and usage of which is governed by the rules of intellectual property law. Nonetheless, even though geographical indications and trade marks are different institutes of industrial property law, they coincide in a majority of aspects. First of all, the fore-mentioned signs used in commercial environment coincide in the attributed functions, i.e. both of them perform the functions of distinguishing goods or services, identification of the source of origin, identification of quality and information of customers. In addition to the considered coincidence, geographical indications and trade marks are similar, since both of them must have a distinctive character; furthermore, their forms of expression and term of protection are in coincidence. Magister Legum - LLM (Private Law) / A trade mark is defined as a sign that is capable of distinguishing the goods or services of one enterprise from those of other enterprises. Trade marks, copyright, patents and designs are some of the forms of intellectual property. Trade marks can be divided into traditional trade marks and non-traditional trade marks. Traditional trade marks are capable of being represented graphically, for example logos, service marks or company names. Non-traditional trade marks are generally not capable of being represented graphically. Examples of these marks are inter alia, scent, taste, touch and sound marks. Technology is changing the way business is being conducted. The registration of nontraditional trade marks has grown exponentially as businesses seek to use innovative ways to protect their brands. Non-conventional trade marks may be visible signs, examples of which include colours, shapes, moving images, holograms and positions or non-visible signs such as sounds, scents, tastes, textures. Visible signs may easily be registered since they satisfy the requirement of graphical representation. Non-visible marks do not generally meet this requirement which makes their registration more complicated. An example of a registered visible non-traditional trade marks is the four finger shape of Kit Kat chocolates.

The object of this master thesis is criteria, which can be significant defining trade mark as well-known trademark. Using comparative, analytical, systematic – logical, historical, linguistic methods were analyzed international, European Union and national law acts/certificates, foreign and Lithuanian court practice, researches of law professionals. En este presente informe se abordará el Expediente Administrativo N° 676684-2016 en donde se analizará la oposición marcaria dentro de la normativa del derecho de marcas. Empieza el presente caso cuando el señor Andrew Michell Olivares solicita el registro de una marca denominada “Candelaria Pilsener”, la cual para el correcto registro se presentó todos los documentos y se realizó los pagos correspondientes. Posteriormente a ello, la empresa Unión de Cervecerías Backus y Johnston, titular de la marca “Pilsen Callao”, presenta su escrito de oposición marcaria toda vez que podría causar riesgo de confusión a los consumidores. En ese sentido, habiendo una oposición marcaria compete a la Comisión de signos distintivos del INDECOPI evaluar y resolver sobre el asunto materia de conflicto. Esta autoridad resuelve, entre otros, declarar fundada la oposición interpuesta y denegar el registro de marca. Ahora bien, teniendo por rechazada el registro de “Candelaria Pilsener”, el señor Michell presenta recurso de apelación bajo el principal fundamento de que el término “Pilsener” es solo una expresión descriptiva que no debería de considerarse para el examen comparativo entre ambas marcas. Finalmente, el Tribunal de Defensa de la competencia y de la Propiedad Intelectual resuelve, entre otros, revocar la resolución de primera instancia y otorgar el registro de la marca “Candelaria Pilsener”. / This report will address Administrative File No. 676684-2016 where trademark opposition will be analyzed within the regulations of trademark law. The present case begins when Mr. Andrew Michell Olivares requests the registration of a trademark called “Candelaria Pilsener”, which for the correct registration all the documents were presented and the corresponding payments were made. Subsequently, the company Unión de Cervecerías Backus y Johnston, owner of the "Pilsen Callao" trademark, presents its trademark opposition statement since it could cause a risk of confusion to consumers. In this sense, if there is a trademark opposition, it is the responsibility of the INDECOPI Distinctive Signs Commission to evaluate and resolve the matter of conflict. This authority resolves, among others, to declare the opposition filed founded and to deny the registration of the trademark. Now, considering that the registration of “Candelaria Pilsener” was rejected, Mr. Michell filed an appeal on the main grounds that the term “Pilsener” is only a descriptive expression that should not be considered for the comparative examination between both brands.
