Genuine Use of Trade Marks

Michael, Feuerstein January 2018 (has links)
Pursuant to the European legislation it is required to use a registered trade mark genuinely. However, it does not directly follow from that legislation what exactly does the term “genuine use” represents. Finding of the proper meaning of the concept of genuine use requires profound analysis of the case-law of the CJEU which has made many comments to this issue in dozens of its decisions. Since these decisions usually deal with different specific questions relating to the concept of genuine use, the relevant case-law seems fragmented. However, putting these decisions together, it is possible to get fairly clear idea about the concept and what it requires. Therefore, this thesis provides its reader with a complex description and analysis of the concept of genuine use within the EU and its interpretation as presented by the CJEU. Besides, the thesis clarifies certain procedural aspects connected with the concept of genuine use, namely these related to proving of genuineness of a use of a trade mark and also these related to utilization of the concept of genuine use in various trade mark proceedings. Finally, the thesis analyses the relationship between the concept of genuine use and trade mark licenses.

Le droit de marque appréhendé à travers sa finalité / The trade mark law accross his purpose

Martin, Nicolas 26 November 2010 (has links)
Since its early case law by balancing the free movement of goods and trade mark law, the Court of Justice has continued to reshape the trademark right. She has discovered a competitive purpose, as a guarantee of origin and a specific object. They don't appear in any texts but it uses to determine the content of the right brand and its operating conditions. She mentioned several years ago some new features of this right and it has recently listed and expressly incorporated in the content of the right. To understand the trade mark right now, we should be to seek the contribution of these new functions to the right, possible amendments to the purpose that it engenders and how they influence its content. Considering that the purpose is the starting point for creating a right we'll collect the purpose of trade mark rights in order to apprehend him.

The Sustainability of EU Trade mark law : A research into the degree to which EU Trade mark law is tailored to achieve the EU Sustainable Development Goals

Pietjouw, Rinder January 2023 (has links)
The EU Sustainable Development Goals have long been a resemblance of the urgent call forclimate action and sustainable development. With increasing attention for climate change anda subsequent call for action from states, consumers’ preferences have now also changedtowards opting for sustainable goods and services. The fact that sustainability has becomeincreasingly important to consumers has not gone unnoticed by manufacturers and sellers ofgoods and services. Consequently, trade marks are increasingly used to label goods asenvironmentally sound and to create a sustainable image. With trade marks, certification marksand geographical indications being a valuable source of information, capable ofcommunicating this green reputation, there is also a significant risk of consumer deceptionthrough greenwashing. Nevertheless, trade mark law is used as a means of fosteringsustainable development. Consequently, trade mark law is concerned with sustainability. Thisbegs the question to what degree EU trade mark law is tailored to achieve the EU SustainableDevelopment Goals. To answer this question, a thorough assessment is made of the currentlegal framework of EU trade mark law. Multiple aspects of this system are discussed with afocus on descriptive and deceptive marks, as well as the right to repair, certification marks andgeographical indications. The assessment comprises of a look into the influence on sustainabledevelopment, together with the discerning of shortcomings in the way the respective aspectsof EU trade mark law can add to the achievability of the EU Sustainable Development Goals. After the individual assessments it is argued that there are multiple points of improvement.Further, solutions are introduced to remedy these points of improvement. In specific, aguideline including a non-exhaustive list of terms that should be avoided when registering atrade mark, CJEU recognition of sustainability as a characteristic through which the public canbe deceived and the introduction of sustainable production standards for EU certificationmarks and GIs, possibly through governmentally issued certification marks and GIs, are the keyimprovements of the EU trade mark regulatory system to improve the achievability of the SDGs.It is concluded that EU trade mark law is to a great extent tailored to achieve the EU SustainableDevelopment Goals, but that with the help of the suggested remedies, EU trade mark law canbecome a true catalyst of sustainable development.

Právní ochrana domén ve vztahu k právům na označení / Legal protection of domains in relation to the right of indication

Karlec, Jan January 2013 (has links)
Legal protection of domains in relation to the right of indication The subject of this thesis is a legal protection of domain names. Domain names are used as humanly memorable names for Internet and serve as simple address to access websites. Each domain name has to be unique, it is not possible to register two or more identical names. This makes them very valuable and worth of protecting. The registration process of domain names is very simple and cheap, mostly based on the principle "first come, first served". No one has an automatic right to a particular name. This cause many conflicts, because the principles of registration are often abused by domain speculators. However, the domain names are not subject of special legal regulation in the most countries (Czech republic included). The thesis is composed of two parts. The first part is divided in five chapters. Initiative chapters are focused on defining the concept of domain names, their technical aspects, hierarchical structure and types. In this part is also mentioned Internet Corporation for Assigned Names and Numbers (ICANN) and its Uniform Dispute Resolution Policy (UDRP). Further, this part contains a description of the registration process of domain names under the country-code top level domain ".cz" (ccTLD.cz) and the legal aspects of domain...
