Interpretativní fenomenologická analýza prožívání osob ohrožených trestným činem obchodování s lidmi / Interpretative phenomenological analysis of the experience of trafficked people

This thesis focuses on the topic of human trafficking and exploitation from the perspective of the trafficked persons themselves. Using the interpretative phenomenological analysis seeks to determine the lived experience of these people. Data were obtained through semi-structured interviews with 4 respondents who are clients of the organization La Strada ČR. These interviews were recorded and they were subsequently analyzed according to IPA. Trafficking and exploitation had a significant impact on the lives and experiences of these people. Interpersonal relationships are affected the most, especially the ability to establish contacts with strangers. Also relationships with families are disturbed because of fear of rejection and misunderstanding of what you went through. People live in fear for their safety and future. Interpersonal relationships are on the other side one of the elements helping to manage the traumatic event and their absence deepens negative experiences. L'interdiction de l'esclavage moderne en droit international et européen : la modernisation nécessaire des cadres juridiques contemporains / The prohibition of modern slavery in international and European law : the necessary modernization of the contemporary legal frameworks

Tragédie humaine et crime que l'on préfère croire d'un autre temps, l'esclavage n'a jamais été aussi prospère que depuis la proclamation officielle de son abolition. Dès lors, son éradication se heurte à un manque flagrant de juridictionnalisation et à l'absence de mise en oeuvre de politiques publiques concrètes. Dans le même temps, l'intervention vigoureuse des forces de l'ordre est entravée, ce qui permet aux trafiquants de jouir d'une relative impunité. De prime abord, il peut paraître simple de définir ce qu'est l'esclavage tant la notion semble entendue et le sujet d'actualité. Mais au-delà de cette image d'Epinal véhiculée par la traite transatlantique négrière, l'esclavage perdure et ses avatars modernes se superposent à ses formes anciennes. La nature transnationale de ce crime, l'anonymat de ces auteurs facilité par l'évolution des technologies et la difficulté d'en identifier ses victimes amènent à se demander si la sphère internationale n'est finalement pas la plus à même de lutter contre les pratiques esclavagistes. De plus, faire respecter l'interdiction des pratiques esclavagistes passe aujourd'hui par une approche multidisciplinaire du phénomène qui doit être réalisée à l'échelle internationale de manière à saisir pleinement l'envergure de ce qu'est réellement l'esclavage, mais implique toutefois une coopération des Etats. En effet, bien plus qu'une simple problématique juridique, fut-elle d'envergure internationale, la lutte contre l'esclavage contemporain implique également une prise de conscience de la sphère politique et un engagement de la société civile sans lesquelles aucunes mesures ne pourraient être efficacement appliquées. / Human tragedy and crime that we prefer to think of another time, slavery has never been so prosperous since the official announcement of its abolition. Therefore, its eradication is facing a serious lack of jurisdictionalisation and a lack of enforcement of specific public policies. At the same time, the vigorous intervention of the authorities is obstructed that which allow a relative impunity to the traffickers.Prima facie it may seem easy to define slavery as the concept seems to heard and the current topic. But beyond this idyllic picture conveyed by the transatlantic slave trade, slavery persists and its modern avatars overlap with its ancient forms. The transnational nature of this crime, the anonymity of the authors facilitated by technological developments and the difficulty of identifying his victims, lead us to wonder if the international sphere is not actually the best able to fight against slavery. Furthermore, enforcing the prohibition of slavery going on today by a multidisciplinary approach to the phenomenon which must be done internationally in order to fully grasp the scale of what slavery really is, but involves, however, cooperation of States. Indeed more than a simple legal question, even with an international scope, the fight against contemporary slavery also involves an awareness of the political sphere and a commitment of the civil society without which no measures could be effectively applied.

Anti-Trafficking Policy Formulation in Georgia Policy Network Analysis

<p>“Trafficking” is not a thing. It is not an event. You cannot point a finger at it or take a photograph of it. “Trafficking” is a convenient, simple and useful label attached not to a single phenomenon but to a complex series of states and events that individually may or may not be harmful or wrong.”1Increasing attention has been given to the issue of trafficking in human beings worldwide because it is a gross violation of human dignity and human rights. Hundreds of thousands of women and children are now commodities sold on an international market to be exploited in prostitution, pornography and forced labour. No country is immune because trafficking is a problem that goes beyond national borders. This thesis focuses on the example of one country, namely Georgia, and its position in the fight against trafficking in human beings. The thesis employs a qualitative research strategy and a case study research design. As a developing country, Georgia greatly depends on assistance from various stakeholders from the international community and local civil society. Thus, the thesis examines a network of cooperation for the formulation of anti-trafficking policy with the help of foreign governments, international organizations and local non-governmental organizations. The conclusions drawn from the conducted research can be summarized as follows: anti-trafficking policy is a specific policy area where issue experts having knowledge about various aspects of this phenomenon count as much as establishments possessing political, economic and organizational power. Thus, anti-trafficking policy formulation and development in Georgia can serve as an example of an issue network.</p>

According the data of different researches carried out in Lithuania, almost 90% of people depart abroad due to financial reasons. This research may contribute to revealing the deep reasons and motives of labour migration, and its founding might be used dealing with the problem how to recapture the emigrants to Lithuania, and how to suppress a flow of emigrants from our country.

EU policy in the fight against trafficking in human beings: A representative example of the challenges caused by the externalisation of the Area of Freedom, Security and Justice

The European Union has developed since the mid-1990's its own policy to prevent and fight against trafficking in human beings (THB). This phenomenon constitutes a threat to the internal security of the European Union, and it also entails severe violations of fundamental rights of its victims. While taking into account the evolution of the definition of THB, as well as the development of a EU multidisciplinary, integrated and holistic approach to THB, my doctoral research focuses on the external dimension of this policy. It is divided in three main parts. Firstly the analysis of the EU acquis in this field allows to determine the external competences at its disposal to promote the transposition of its standards beyond its borders. Special attention is given to the EU's externalisation efforts towards the candidate and potential candidate countries of the Western Balkans. The second part focuses on the interactions between the European Union and the other actors active in this field, being intergovernmental organisations, civil society organisations, or States. The objective is here to demonstrate that their interactions lead to the emergence of harmonized objectives and measures to combat THB in a comprehensive way. Finally the third part aims at assessing the implementation of European and international standards in national legal orders. Organized crime - Trafficking in human beings This thesis deals with the criminal offence of trafficking in human beings under Sec. 168 of the Czech Criminal Code. A trafficking in human being is not a frequent criminal offence but with its consequences belongs to the most dangerous crimes. After the Velvet revolution the relevance of this crime has raised subsequently and therefore the regulation of this crime requires particular attention. It is important to find new ways and improve current methods to be readier to detect and investigate the cases of trafficking in human beings. The aim of this thesis is to provide an analysis of legal regulation of trafficking in human beings, organized crimed and methods of investigation and some related issues such as problematic of the protection of the witness. This thesis consists of three chapters. The first one deals shortly with the organized crime. It analyzes the term of the organized crime, because trafficking in human beings is usually committed by organized groups. I try to explain some basic terms related to this topic. The thesis topic ``Requirements for telephone crisis intervention for victims of human trafficking{\crq}q was chosen because of the author{\crq}s personal experience. The thesis aims to map out a comprehensive picture of a specialised helpline for trafficked persons and to compare its requirements with those of the helpline for the general public. Human trafficking is a criminal act which entails an abusive breach of human rights. Recent expansion in Europe is often connected with a specific migration situation, so it is a current topic. Human trafficking is widespread throughout the whole of the Czech Republic, and as the victim is prevented from moving freely and is torn from their familiar surroundings, it is important that they have unlimited access to a contact. For that reason, initial contact with victims of human trafficking is often made through telephone crisis intervention, which must be highly professional. The working theory deals with telephone crisis intervention, human trafficking, workers and clients. It explains TCI in the context of clarification of formats and different types of services. Online counselling is described further, help-line working methods are clarified and the basic service principles are outlined. Another area of focus is help-line workers and their training, cooperation and supervision. The next chapter concerns human trafficking and explores legislative problems, the human trafficking mechanism, forms, routes, causes and consequences. The final aspect is clientele, and explains the use of the term trafficked person and victim of human trafficking, and describes the risks to clients who contact help-lines. The aims of this thesis were to clarify the characteristics of telephone crisis intervention for issues of human trafficking; to compare the conditions of a worker dealing with specialised telephone crisis intervention with general telephone crisis intervention for the whole population; to map out the working procedures within telephone crisis intervention; to map out the working procedures within online counselling. The author believes that aims of the thesis were met. Qualitative research was used to achieve the aims of the thesis. Data was obtained through interviews conducted by the author. The data gathering technique used was to conduct a semi-structured interview with open question. The interviews lasted for approximately one hour and were composed of two parts. The research sample included two groups of participants {--} workers providing telephone crisis intervention services. The first group was made up of 10 workers who work on specialised help-lines directed at human trafficking. The second group was comprised of 10 workers providing telephone crisis interventions for the general populace. The author formed three hypotheses based on the results of this qualitative research. There is the same need to complete the basic course of crisis intervention for consultants working on the ordinary help lines as for the consultants working on specialised help lines. Consultant on specialised help lines is more focused on providing a service of legal information than the consultant working on the ordinary help lines. Younger help-line consultants on the help lines for victims of trafficing don't see exactly the specifics of that line. The author believes that the work could be useful for organisations providing specialised help-lines for victims of human trafficking.

Questa tesi versa sull'interrelazione tra due fenomeni criminali: tratta di esseri umani, particolarmente donne e bambini allo scopo di sfruttamento sessuale, e corruzione in Brasile. Lo studio è basato su quattro fonti diverse di dati empirici: tre fonti secondarie e un questionario (survey). Il capitolo I esplora l'importanza del tema, i problemi affrontati nello studio e gli obbiettivi della tesi. Il capitolo II presenta la letteratura scientifica sulla quale la tesi è basata, l'ipotesi principale, la metodologia applicata e i dati utilizzati. Il capitolo III analizza i risultati empirici provenienti dalle quattro fonti di dati, i quali dimostrano 1) la dipendenza della tratta di esseri umani sulla corruzione; 2) i punti più vulnerabili per la corruzione durante la catena della tratta e la catena della giustizia penale; 3) le differenze regionali e la tendenza della tratta di esseri umani e della corruzione in Brasile. L'analisi multivariata é utilizzata per dimostrare la forza della correlazione tra i due fenomeni. La dipendenza della tratta di esseri umani sulla corruzione è analizzata attraverso l'utilizzo del metodo qualitativo. Il capitolo V discute i risultati e presenta le conclusioni. / This thesis deals with the interrelationship between two criminal phenomena: trafficking in human beings, particularly women and minors for the purpose of sexual exploitation, and official corruption in Brazil. The study is based on empirical data from four different sources: three sets of secondary data and a survey. Chapter I highlights the importance of the study, the problems addressed by the thesis, as well as its objectives. Chapter II explores up-to-date scientific literature, the working hypothesis, applied methodology, and research design. Chapter III presents the empirical findings of each set of data which shows: 1) the dependence of Trafficking in Human Beings on Corruption; 2) the most vulnerable points for corruption during the trafficking and criminal justice chains; 3) and regional differences and trends on THB and Corruption in Brazil. Multivariate analysis is used: 1) to highlight the strength and of the interrelationship between Trafficking in Human Beings and Corruption; 2) and to establish predictability. The dependence of Trafficking on Official Corruption is analysed by means of qualitative method. Chapter V discusses the results and presents conclusions.

The thesis deals with problems of trafficking in human beings, especially concerning prevention. The theoretical part characterizes forms of trafficking in human beings and their appearance in the Czech Republic. Further the impact of trafficking in human beings on the trafficked subjects and the specificity of social work in the sphere of trafficking in human beings are described. In the end of the theoretical part organizations engaged in prevention of trafficking in human beings in the Czech Republic are introduced. The aim of the diploma thesis was to map České Budějovice youth's knowledge of trafficking in human beings. The subaim of the diploma thesis was to prepare and carry out lectures on prevention of trafficking in human beings at secondary schools and secondary educational establishment and subsequently to map if studentś information about trafficking in human beings increases after the lectures. In the practical part this research used quantitative investigation, method of questioning, questionnaire technology. Youth's information about trafficking in human beings in České Budějovice was not better than the hypothesis, which arose pursuant to the results of the pilot research, assumed. By means of following questioning, which ran at intervals from 3 to 6 months after the lecture, it was found out, that students´ knowledge of trafficking in human beings increased however the partial hypothesis was not confirmed. The lecture on prevention of trafficking in human beings with special intention on working migration abroad and prevention of its risk, done by the author, is stated in the part Apendices.

The thesis called Illegal work deals with illegal employment of foreigners in the Czech Republic, which is in most cases connected with trafficking in human beings for the purpose of forced labor. The first chapter is generally devoted to the definition of the concept of illegal work under Act No. 435/2004 Coll. on Employment and Act No. 262/2006 Coll. Labour Code. The second chapter brings the view of the employee, employer and the state on illegal work. The following third chapter focuses on the sectors in which illegal work occurs most often. The fourth chapter describes the working conditions of employees who are illegally employed and are exploited in every possible way, especially in terms of pay, working conditions or working hours. The fifth chapter contains factors that affect the exploitation of migrant workers and trafficking in human beings for the purpose of forced labor.
