Devising an adequate system of regional and domestic rights applicable to the gypsy/traveller minority in Scotland

This thesis identifies existing legislation that can provide an adequate system of regional and domestic rights based on a critique of existing protections applicable to Gypsy/Travellers in Scotland. A definition of Gypsies/Travellers is established and analysis of ethnicity undertaken focusing on race relations legislative definition and anthropological/sociological ethnicity definition, identifying obstacles to recognition, however concluding that all Gypsies/Travellers could satisfy these definitions. It is however identified that, to achieve equality, additional measures are necessary in the interpretation and application of existing human rights law with a need for positive action to achieve equality not only in law but in fact. International law is examined regarding minority protection and racial discrimination examining their relevance domestically in the United Kingdom. Regional legislation is similarly examined, in particular developing ECHR jurisprudence, the European Social Charter, the Framework Convention for the Protection of National Minorities and potential remedies in EU legislation. The Human Rights Act 1998 is also examined as potentially offering a compliance mechanism regarding obligations contained in the ECHR. Domestic race relations legislation is examined, particularly regarding positive duties and mechanisms for ensuring compliance with these duties, identifying shortcomings. Lastly future domestic equality legislation is examined and shortcomings identified in the current proposals of the United Kingdom. Legislation and case law referred to is correct at 1 November, 2008.

Water ways : becoming an itinerant boat-dweller on the canals and rivers of South East England

This thesis draws from data collected over thirteen months of fieldwork working with “Boaters”, a boat-dwelling itinerant group on the waterways of Southern England. In the first of three parts, the thesis focusses on the individual motivations (economic, personal and political) behind becoming a travelling Boater, and on how one acquires the requisite skills and knowledge to become part of a community of practice on the waterways. Boaters on the whole do not have a sense of being an ethnically distinct group and, as such, this thesis interrogates what kind of an identity is being created or reinforced when individuals recognise themselves as Boaters. This part further deals with the specific temporal experience of boating (commonly known as “boat time”) that creates a shared experiential pattern between Boaters, and also examines the informal networks of trade, exchange and barter which enmesh Boaters in a web of reciprocal relationships. In the subsequent part, the focus of the thesis widens to take in the boating “community” as it is imagined. It asks how the concept of community is rhetorically constructed and corporately enacted on the inland waterways and identifies the creation of an emic and local conception of community. In the third part, the focus widens further still in order to interrogate the troubled relationships between Boaters and sedentary populations and between Boaters and agents of the State. By looking at Boaters’ different (essentially nomadic) understandings of locality and political organisation, this thesis attempts to more broadly explain the fraught relationship between state agencies and itinerant populations. The thesis concludes that the community of Boaters is constructed through the shared understandings which emerge due to the Boaters experiencing much of their world as being flexible, fluid and unfixed. Boaters are bound by acts of dwelling together on the waterways, acts that emerge from the specific material conditions of boat life, and further from acts of support where Boaters bind together for the security of the group against antagonistic outsiders and the interventions of agencies of the state.

It examines how gender norms and patriarchal system may affect women’s mobility and interactions with other cultures, all while being firmly rooted in a variety of feminist viewpoints. Historically confined to domestic roles, women have resiliently reclaimed their right to travel and freedom, leading to a rise in solo female travellers. Incorporating a feminist perspective, the study delves into the complexities and triumphs of these experiences, using image analysis and interviews for comprehensive data collection. Nomads in the liberal state : liberal approaches to the problem of Roma and traveller itinerancy

May the state, from a liberal point of view, operate laws and institutions that impede the mobile lifestyle of nomadic Roma and Travellers, or should the state take steps to accommodate their nomadic way of life? This is the essence of the problem of Roma and Traveller itinerancy and the question that is at the heart of this three-partite dissertation. The first part of the dissertation looks at public policy in France and the United Kingdom and describes the six public policy problems that constitute the problem of Roma and Traveller itinerancy. These problems concern the education of children, the French travel permits system, the legal conditions for voter registration and for GP registration, the housing benefits system, and the public provision of halting sites. The second part looks at liberal political theory. It suggests that contemporary liberalism divides into two strands that take different views on the entitlements of cultural and religious minorities, and it provides a detailed outline of the prime articulations of each approach, namely the multiculturalist liberalism of Kymlicka and the classic neutrality liberalism of Barry. The third part investigates what the two said liberalisms imply for the six policy problems from part 1. These analyses suggest that the two liberalisms have slightly diverging implications for the halting sites problem, the housing benefits problem and the problem of GP registration. They suggest furthermore that the two accounts converge on the question of voter registration and agree that the voter registration system must accommodate nomads, and may not make the possession of a fixed residence an absolute condition for voter registration. And the analyses suggest finally that the two liberalisms also converge over the education question and the travel permits question, but here support polices that are potentially inimical to Roma and Traveller itinerancy. The broader implications of these findings are that liberalism is potentially, but not necessarily and not intrinsically, inimical to Roma and Traveller nomadism, and that the disagreement between classic neutrality liberalism and multiculturalist liberalism is weak insofar as public policy is concerned.

À partir d’une approche ethnographique collaborative entre chercheur et enquêtés, mêlant observation participante, récits de vie, entretiens auprès de jeunes vivant dans un squat et auprès de travailleurs sociaux, de commerçants, de riverains nous avons tenté de saisir ce qui dans les trajectoires des acteurs favorisait l’inscription dans cet univers de la rue qu’est la Zone et dans sa culture, ce qui jouait dans les divers inclinements identitaires zonards. Différents modes d’être « jeune en errance », ou plutôt zonard ont été repérés. En usant des théories de la socialisation, de la déviance, des interactions goffmaniennes et de l’ethnicité, nous avons pu mettre à jour des logiques synchroniques et diachroniques explicatives. L’orientation vers la Zone ne s’effectue pas sans les influences de la famille, de l'institution scolaire, du contexte écologique. Ils provoquent des désajustements auxquels la socialisation juvénile de pairs répondra par la pratique d’activités délinquantes. Le positionnement plus ou moins engagé dans la Zone dépend par ailleurs de certaines spécificités biographiques et de l'investissement dans la carrière zonarde. Des facteurs exogènes comme le traitement sanitaire et social en direction de ces jeunes et les représentations du sens commun qui leurs sont attachées, concourent à un étiquetage social, une discrimination, qui associés aux expériences passées des acteurs favorisent alors la pérennisation de l’identité zonarde et accentuent sa déviance en érigeant des frontières entre zonards et normaux. / To study French young homeless we use an ethnographic collaborative approach with one population of the following study fields: young homeless of one squat (interviews, participant observation, life interviews) ; and interviews, reunion observations with social workers, storekeepers and local residents. We tried to understand which street youth life trajectories facilitated the enrolment in that street world that is designated: "the Zone" and what contributes to "zonard" identity and culture. Various ways to be "wandering youth", or rather "zonard" were located. By using socialization, deviance, Goffman’s interactions and ethnicity theories, we were able to shed light on synchronic and diachronic logics leading them to it. The Zone orientation needs specific family, school, ecological, and neighbourhood backgrounds, which provoke adjustment problems. We find that young peers socialization and it activities answer to background life tensions. The position of being more or less committed in the Zone depends on actors’ biographies specificities and on their Zone careers investment. Exogenous factors such as the sanitary and social treatments, the common sense representations of youth street contribute to a social labelling, a discrimination. Associated with past backgrounds, they encourage the Zone identity continuation, increase deviant practices and build borders between normals and Zonards.
