This study is an application of the political theory of Michael Oakeshott aimed at enhancing understanding of the South African state. Oakeshott posits that the modern state is comprised of two separate modes of association, namely societas and universitas. Universitas refers to an association to attain a specific substantive purpose, while societas is an association based on common submission to the recognition of, and adherence to, prescribed formal laws. Each tends towards self‐destruction when the character of a given state is reflected by that mode of association exclusively. The presence of both modes of association in tension with each other produces a stable state. The South African state has been shown to reflect a dominantly universitas character, but, since a monopolar state cannot exist, it follows that the societas understanding of the state must also be present. In this study, the Constitution of the Republic of South Africa, Act 108 of 1996, is assessed to determine whether it reflects a societas understanding of the state. Two formal conditions for a societas are identified in the work of Oakeshott, namely a system of rules and norms, and the recognition of this system as being authoritative. Ce travail propose une histoire du gouvernement de la ville de Cavaillon entre le milieu du XIIIe siècle et le début du XVe siècle. L’analyse conjugue deux perspectives : d’une part celle de la construction de son territoire par l’universitas et, d’autre part, celle du recours à l’écrit comme outil de gestion et de gouvernement. Cette approche permet de saisir les motifs et les outils de l’affirmation de la communauté et de comprendre les processus qui font évoluer les rapports sociaux qui la sous-tendent. La reconnaissance juridique de l’universitas par ses seigneurs ouvre la voie à la production d’un droit local dont l’application requiert la définition du territoire à l’intérieur du Comtat Venaissin. C’est ce processus qui, en associant le droit et l’écrit à la construction de l’espace, donne à la communauté d’habitants la possibilité d’exister à l’intérieur du système seigneurial et du gouvernement pontifical, en développant de nouvelles modalités d’appartenance sociale. / This study reconstructs the history of the urban government of Cavaillon between the mid-13th and the early 15th century from two complementary perspectives : on the one hand, through the building of a territory by the universitas and, on the other hand, through the use of written records in governments and administrative practices. This methodology enables a detailed understanding of the aims and means of assertion of the community and of the processes at work in the social relations which underlie it. The legal recognition of the universitas by its lordship opens towards the possibility of developing a local right, the enforcement of which requires the definition of a territory with set boundaries within the Comtat Venaissin. It is this process which, by associating legislation and records in the framing of a territory, allows the community to develop within the feudal and papal contexts by creating new definitions of social identity.

Con il presente lavoro ci si pone l’obiettivo scientifico di dotare di una adeguata dogmatica giuridica quella complessa realtà che è costituita dal configurarsi delle relazioni interne al Collegio episcopale, avanzando anche nella comprensione dell’aspetto intrinsecamente comunitario dell’ufficio episcopale quale risultato del rapporto di unitaria successione all’ufficio apostolico di diritto divino. Leggendo l’appartenenza al Collegio di quei membri che lo compongono uti universi attraverso il fondamentale valore ecclesiologico che ha l’inserimento sacramentale di essi nel “simbolismo dei Dodici” (cap. I), si giunge a configurare la compagine di coloro che sono uniti nel ministero episcopale nei termini di “universitas collegialis personarum inaequali iure" (cap. III), appurando - appunto a partire dalla questione terminologica di “collegium” (cap. II) - come sia effettivamente possibile dar vita a riflessioni sempre più pregnanti sul contributo che il pensiero teologico fornisce ai fini della strutturazione anche giuridica dell’empiria interna al carattere normativo della Chiesa. Può risultare così più agevole individuare le relazioni tra quei nuclei di significato che hanno condotto, in ambito cattolico, sia ad una nuova messa a punto e valorizzazione (teorica e pratica) della dottrina della collegialità episcopale in seno al Concilio Vaticano II sia al sempre più vivace prospettarsi di interessanti orizzonti in sede di riflessione canonistica ed ecclesiologica attuale. / The present work has the scientific aim of endowing with an adequate juridical dogmatics the complex reality that is constituted by the configuration of the internal relations of the College of Bishops, advancing also in the understanding of the intrinsically communitarian aspect of the episcopal office as a result of the relationship of unitary succession to the apostolic office of divine law. By interpreting the belonging to the College of those members who make it up uti universi through the fundamental ecclesiological value of their sacramental insertion in the "symbolism of the Twelve" (chapter I), one arrives at configuring the group of those who are united in the episcopal ministry in terms of "universitas collegialis personarum inaequali iure" (chapter III), demonstrating - starting precisely from the terminological question of "collegium" (chapter II) - how it is possible to give rise to increasingly pregnant reflections on the contribution that theological thought provides for the purposes of structuring, also juridically, the empirical internal normative character of the Church. In this way, it will be easier to identify the relationships between those nuclei of meaning that have led, in the Catholic sphere, both to a new development and enhancement (theoretical and practical) of the doctrine of episcopal collegiality within the Second Vatican Council and to the increasingly lively prospect of interesting horizons in the current canonical and ecclesiological reflection.
