Köpenhamnsdilemmat : En debattanalys av EU:s normativa konflikt

Europeiska Unionens arbete är mångsidigt, och innefattar även normativa delar. Principer om demokrati, rättssäkerhet och mänskliga rättigheter finns exempelvis fördragsstadgade i Artikel 2 i Lissabonfördraget. Trots EU:s normativa värderingar har vi de senaste åren sett hur situationer utvecklats i ett flertal medlemsländer där dessa värderingar på olika sätt kränkts, exempelvis i Ungern, Rumänien och Polen. Utvecklingen kan få stora konsekvenser dels inom unionen men också för EU:s legitimitet som en normativ internationell aktör. Det är oklart hur dessa situationer kan hanteras av EU, och problemet som uppkommit har kommit att kallas Köpenhamnsdilemmat. Syftet med denna uppsats är att belysa den debatt som pågår kring Köpenhamnsdilemmat, genom att urskilja, beskriva och analysera debattens huvudståndpunkter och de argument som först fram.  Uppsatsen urskiljer 4 huvudståndpunkter i debatten: EU bör ej ingripa, EU bör ingripa genom juridiska institutioner, EU bör ingripa genom politiska institutioner, och EU bör ingripa genom oberoende institutioner. Ståndpunkterna och deras argument utkristalliseras och beskrivs genom en beskrivande idéanalys samt undersökts närmare i en jämförande analys.  Undersökningen har funnit att de tre ståndpunkter som anser att EU bör ingripa har en liknande problembeskrivning. EU anses först och främst ha en normativ sida, där principer om rättsäkerhet, demokrati och mänskliga rättigheter bör upprätthållas i samtliga medlemsländer. Aktörerna pekar dessutom ut en bristande efterlevnad av dessa principer, vilket anses vara ett problem för både EU och unionens medlemsländer. EU bör således ingripa när medlemsländer bryter mot principerna, men saknar idag effektiva mekanismer för att göra så. Aktörerna föreslår därför en rad olika lösningar, som utgör grunden för indelningen av de tre ståndpunkterna. Bland de aktörer som anser att EU inte bör ingripa återfanns ett flertal argument: att EU inte har mandat att intervenera, att ingripanden kränker medlemsländernas suveränitet, och att EU har hanterat processerna felaktigt då deras kritik är politiskt motiverad, debatten elitistisk eller anklagelserna orättvisa och felaktiga. Dessa aktörers lösningsförslag blir följaktligen att EU inte bör ingripa, antingen gällande samtliga eller enbart specifika situationer, när medlemsländer anses bryta mot principerna om rättsäkerhet, demokrati och mänskliga rättigheter. Den jämförande analysen fann att aktörernas lösningsförslag väl följer deras problembeskrivning. En bild av problemet som övergripande följs exempelvis av ett lösningsförslag bestående av en bred mekanism, medan en mer specifik bild av problemet återföljs av en snävare fokuserad mekanism. Analysen fann även att debattens aktörer vanligtvis har en antingen pragmatisk eller idealistisk utgångspunkt, och att deras problembeskrivning, argumentation och därmed även lösningsförslag påverkas av denna utgångspunkt.

La protection européenne des données à caractère personnel traitées à des fins judiciaires / The european protection of the personal data processed for judicial purposes

Dans notre société que l’on peut appeler «société de l’information » ou également société de « surveillance électronique », il est désormais essentiel d’assurer la protection de données à caractère personnel. La mise en place d’une réglementation en matière de protection de données n’a pas toujours été aisée et, dans certains domaines, demeure complexe. Le domaine judiciaire est un exemple marquant de secteur d’activité où il a été difficile de mettre en place des règles spécifiques et appropriées pour la protection de données personnelles. Dans les années quatre-vingt-dix, la question s’était posée de savoir si une protection spécifique des données traitées à des fins judiciaires était nécessaire. Les conclusions avaient été diverses : d’un côté, certains avaient estimé qu’une réglementation spécifique était opportune, d’un autre côté, d’autres considéraient que l’idée de mettre en place une telle réglementation devait être abandonnée. Cette étude semble avoir été – à un certain point – abandonnée. Compte tenu de l’évolution des technologies et de l’évolution des textes européens, il semble essentiel de poser à nouveau cette question et de s’interroger sur la place à conférer aux données traitées à des fins judiciaires dans le système européen actuel de protection de données à caractère personnel. Cette nécessité est corroborée par la jurisprudence de la Cour de Strasbourg. Cette dernière a en effet, été saisie de cas de violations des droits fondamentaux liés à un traitement inapproprié des données dans le domaine judiciaire. De plus, des projets de réforme du système de protection de données personnelles sont actuellement en discussion au niveau européen. En effet, le Conseil de l’Europe et l’Union travaillent actuellement sur la modernisation des textes existants en matière de protection des données à caractère personnel. Il est donc intéressant de s’interroger sur la place réservée à la protection des données judiciaires dans le cadre de ces réformes. La thèse veut tout d’abord rappeler l’importance de protéger les données à caractère personnel en tout temps, en tout lieu et dans n’importe quel domaine d’activité, y compris le domaine judiciaire. Elle a pour but principal, d’une part, de mettre en évidence les problèmes existants en matière de protection de données judiciaires et, d’autre part, d’essayer de répondre à la question de savoir si une réglementation spécifique dans ce domaine doit aujourd’hui être élaborée au niveau européen. Dans la première partie les textes du Conseil de l’Europe et de l’Union européenne en matière de protection des données et leur applicabilité au domaine judiciaire sont tout d’abord analysés. Compte tenu du fait que les textes actuellement en vigueur au niveau du Conseil de l’Europe et de l’Union ont, à première vue, un contenu identique, il a été nécessaire d’analyser ces textes avec un esprit comparatif afin de comprendre comment ceux-ci se concilient et de vérifier leur applicabilité aux données judiciaires. The implementation of regulations on data protection has not always been easy, and in some areas, remains complex. The judiciary is a striking example of an area where it has been difficult to establish specificand appropriate rules for the protection of personal data. In the years ninety, the question was raised whether a specific protection for judicial data was necessary. The findings were different: on the one hand, some have estimated that a specificregulation was appropriate, on the other hand, others felt that the idea of establishing such rules must be abandoned. This study seems to have been - at some point - quitted. Given the improvements in technology and the evolution of European legislation, it seems essential to renew this question and try to find out which level of protection is given to judicial data in the current European system of protection of personal data. The importance to renew this question is proven by the case law of the Strasbourg Court. The latter has indeed been referred to cases of human rights violations due to improper processing of data in the judiciary. In addition, plans to reform the system of protection of personal data are currently under discussion at European level. Indeed, the Council of Europe and the European Union are currently working on the modernization of existing texts on the protection of personal data. It is therefore interesting to examine the place reserved for the protection of judicial data in the context of these reforms. The thesis recall the importance of protecting personal data at any time, in any place and in any field of activity, including the judiciary. Its main aim, on the one hand, is to highlight existing problems in the protection of judicial data and, on the other hand, to answer the question of whether a specific regulation in this area must nowadays be developed at European level. In the first part Council of Europe and the European Union’s texts on data protection and theirapplicability to the judicial data were analyzed. Given the fact that the texts currently into force at the Council of Europe and at the European Union, at first glance, have the same content, it has been necessary to analyze them with a comparative approach in order to understand their interoperability and verify their applicability to judicial data. Despite the multitude of texts on data protection present at European level (those of the Council of Europe and of the European Union), a marginal space is reserved to judicial data. The basic principles stated in these texts are in theory applicable to judicial data but in concrete those are not applied. In any case, those texts do not provide effective protection of judicial data. [...] / Nella nostra società, che può essere chiamata “società dell'informazione” o anche società di “sorveglianza elettronica”, è ormai indispensabile garantire la protezione dei dati personali. L'attuazione della normativa in materia di protezione dei dati non è sempre stata cosa facile, e per alcuni settori di attività, essa risulta tutt’ora un’operazione complessa. Il settoregiudiziario ne è un esempio. In effetti, si tratta di un settore in cui è stato difficile elaborare ed attuare regole specifiche ed adeguate per la protezione dei dati personali. Negli anni novanta, ci si è chiesti se fosse necessario provvedere all’adozione di regole specifiche per la protezione dei dati trattati a fini giudiziari. Secondo una prima teoria una regolamentazione specifica risultava opportuna, tuttavia secondo un’altra teoria l'idea di creare una regolamentazione per la protezione dei dati personali trattati in ambito giudiziario doveva essere accantonata. Lo studio di tale questione sembra essere stato - ad un certo punto - abbandonato. Dati i miglioramenti tecnologici intervenuti negli ultimi anni e l'evoluzione della legislazione europea in materia di protezione dei dati, sembra indispensabile porsi nuovamente la questione dell’opportunità di una regolamentazione specifica per il settore giudiziario. Sembra altresì opportuno interrogarsi sull’importanza che attualmente viene attribuita alla protezione dei dati trattati per finalità legali nell’ambito dell’attuale sistema europeo di protezione dei dati personali. Tale necessità sembra essere corroborata dal contenuto della giurisprudenza della Corte di Strasburgo. Quest'ultima è stata, infatti, spesso adita per casi di violazioni dei diritti fondamentali dovuti ad un trattamento illecito dei dati personali per ragioni di giustizia. Inoltre, dei progetti di riforma del sistema di protezione dei dati personali sono attualmente in discussione a livello europeo. Infatti, il Consiglio d'Europa e l'Unione europea stanno attualmente lavorando sulla modernizzazione dei testi esistenti in materia di protezione dei dati personali. E 'quindi altresì interessante esaminare quale importanza è data alla protezione dei dati giudiziari nel contesto di dette riforme. Oltre a ricordare l'importanza della protezione dei dati personali, in qualsiasi momento, in qualsiasi luogo e in qualsiasi settore di attività, tra cui quello giudiziario, l’obiettivo principale delle tesi è, da un lato, di evidenziare i problemi esistenti in materia di protezione dei dati giudiziari e, dall’altro, di valutare l’opportunità dell’esistenza a livello europeo di una normativa specifica per questo settore. Nella prima parte i testi del Consiglio d'Europa e dell'Unione europea in materia di protezione dei dati e la loro applicabilità al settore giudiziario sono analizzati. Tenuto conto del fatto ch i testi attualmente in vigore presso il Consiglio d'Europa e l'Unione europea hanno, di primo acchito, lo stesso contenuto, è stato necessario analizzarli con un’ottica comparatistica al fine di capire come essi si conciliano e di verificare la loro applicabilità ai dati giudiziari.

Japan's Push to Rearm: Neo-Militarism or Self-Preservation

This piece tries to determine whether or not Japan’s movement towards rearmament is indicative of a renewed militaristic sentiment or driven by the necessity of improving its defense in view of mounting threats from its age-old enemy, China. The goal of this work is to create a framework using both international events and domestic responses in which to ascertain whether or not the reformation of Article 9 is, in of itself, a reemergence of pre-war bushido/nationalist sentiment or a response to both outside and inside influences necessitating the need for a “normalized” state. The work focuses on three distinct time periods – early 2000s, latter 2000s, and the 2010s – in which to highlight the initial development, progression, and foreseeable resolution to the Article 9 debate. These stages emphasize several elements persistent in Japan’s quest for a more normalized state, including: the hostile external environment created by the rise of foreign assertiveness, and internal domestic pressures (which to some extent are driven by external pressures) along with its own desire to seek a more normalized position in the international community as well as to gain an enhanced sense of national pride. Additionally a brief synopsis of both the foreign and domestic entities which have contributed to the Japanese reformation movement has been included for better foundational understanding of the question at hand. In general, results suggested that, though there is some merit towards a reemergence of pre-WWII nationalistic sentiment (especially in the case of the Net Uyoku), the reformation of Article 9 is primarily driven in response to growing tensions – both within East Asia as well as world-wide – as well as a need to assert some semblance of nationalistic identity (an area seriously lacking in Japanese society). Results further implicate that, though the process of reforming Article 9 and thereby revising Japan’s anti-war policy may not be immediate, movement within the Japanese state towards constitutional reformation is indeed on the rise – rearmament being the primary target of said reforms.

Promotion of the Availability and Accessibility of Misoprostol under the CEDAW: Postpartum Haemorrhage among the Rural Women of the Kyrgyz Republic

Maternal mortality in Kyrgyzstan is a discrimination of women not only based on sex, but also on rural/urban setting. Rural women are most likely to die of haemorrhage than urban women in Kyrgyzstan. Postpartum haemorrhage constitutes 45 per cent of all maternal deaths in Kyrgyzstan. This work concentrates on the obligations of Kyrgyzstan under articles 12 and 14.b of the Convention on Elimination of all Forms of Discrimination against Women (CEDAW). The work analyses the nature and scope of state obligations under respective articles. Kyrgyzstan has obligations to respect, protect and fulfill rural women’s human rights to address discriminations against rural women, provide appropriate health services and ensure availability and accessibility of misoprostol to rural women. Misoprostol is more suitable to the conditions of rural area than traditionally used oxytocin. Therefore, the availability and accessibility of rural women to misoprostol will prevent avoidable maternal deaths in haemorrhage.

The main theme of this thesis is the category of determination in the Spanish language. Considering that this category is very large in spanish language we have focused in detail on the article, especially the indefinite article. This work is devided into two parts, the theoretic and the practical part. The theoretic part has been devoted to definitions and main characterization of the article, primarily the indefinite article. This issue is looked upon from the point of different publications that discuss it more or less thoroughly. Considering that the category of determination itself does not exist in the Czech language we briefly draw other mediums to express this phenomenon, especially the word order. For the practical part the qualitative methods were used.In this part the use of determinants was analyzed in administrative and legal texts, specifically in two texts from the web page www.Eur-Lex.eu, in one text from Boletín Oficial del Estado and in one law of the Czech Ministry of Education.

Classic Kaposi’s sarcoma with multifocal gastrointestinal involvement. A case report

Although intestinal involvement occurs in more than half of the cases with KS that are HIV positive, it is uncommon in the classical form, as it occurs in approximately 10% of the patients. We present the case of a 60-year-old male patient with a one-year disease time characterized by having violaceous lesions on the feet and the hands, slightly pruritic and 2 months of epigastralgia and constipation with weight loss of approximately 12 percent of his total body weight. In the physical examination multiple violaceous papule-like lesions are shown on the hands and the feet, some coalescing to form plaques. Laboratory tests revealed a mild normocytic normocytic anemia, the serology for viral hepatitis B and C was negative, HIV negative and ELISA test too. An upper endoscopy was performed and multiple maculopapular and erythematous-violaceous lesions were observed in the esoph-agus, the stomach and the duodenum. In the colonoscopy, multiple lesions with similar characteristics in the ileum, throughout the colon and in the rectum were recognized. The biopsy result was compatible with the KS in all lesions and it was confirmed with the positive HVV-8 immunohis-tochemistry. This case highlights the likelihood of presenting GI SK in elderly patients with gastrointestinal compromise and cutaneous findings, HIV negatives as well as the need to realize an adequate discarding by performing endoscopic studies with the biopsies to optimize treatment. / Revisión por pares

Reducering av transportsträckor i lagerverksamhet med hjälp av ABC-klassificerad artikelplacering

Purpose – The purpose of this study is to investigate how ABC-classified article placement can reduce transport distances within warehouse operations, which do not use volume-based article placement. Based on the purpose, two research questions have been formulated: [1]   How can an ABC-classified article placement be established in order to minimize transport distances within warehouses? [2]   How much can transport distances be reduced by using an ABC-classified article placement instead of a non-volume based storage? Method – The methods that have been used to collect data have been a case study and a literature review. The case study has been performed on Sherwin-Williams’ distribution centre in Nässjö and has mainly been based on two months of picking data. Interviews and observations have supplemented the document study. The literature review has resulted in a theoretical framework in which the relevant theories of the study have been presented. The collected data was analysed by comparing the different results against each other. Further comparisons analysed the empirical data against the theoretical framework. Findings – The study has resulted in a model of how ABC-classified article placement with the purpose to reduce transport distances can be designed. The model is based on a few steps that are: pilot study, performance of an ABC-analysis based on the articles picking rate, and zone division. According to the case study ABC-classified article placement can reduce up to 35 % of internal transportation distances and according to the theoretical framework of up to 55 %. Implications – Warehouses that want to use the study can proceed from the steps presented in the analysis section. Furthermore, the practical implications of the study results in a system configuration and the movement of goods to the introduction of the ABC-classified article placement. The study implies theoretically that the volume-based article placement minimizes transport distances. The existing theories stating this is evidenced in this study which also shows that warehouses with less skewed ABC-curves can benefit from placing high frequency goods near the loading area. The study contributes with a new model that has been developed by compiling theories in the studied area. Limitations – The study has been limited to a single case study. The calculations made in the study have excluded items that require special storage, small package picking and distance between the pallets that are retrieved together. Transport distances have been calculated from the loading area and has excluded the distance between the racks and unload area.

The Question of Remilitarization: Is Japan's Pacifist Nature in Danger of Reform

Though Article 9 has not been revised since it was implemented in 1947, the past two decades have seen an increase in Japanese military capability due to the government’s loose interpretation of Article 9 and its limitations to allow for Japanese involvement in collective security operations internationally. As a result, a number of Japanese political scholars and newspapers have projected the possibility of not only Japanese constitutional revision but also the re-militarization of Japan as well. Interested in finding out whether or not this projection has any likelihood of success in the future, I have posed the following question: Why has the constitution and the pacifism that it enshrines been so resistant to change despite a changing political context, and does the increase of Japanese public support for constitutional revision necessarily mean re-militarization for Japan? Taking a constructivist approach, I will argue that although pro-constitutional revision forces in Japan have tried to use fear politics and the revival of a Japanese “national spirit” to promote constitutional revision and ultimately re-militarization, the Japanese public has been relatively unreceptive to their ploy due to the integration of pacifism into the Japanese collective identity.
