Využití zobecněného lineárního modelu k analýze splácení retailových úvěrů / Retail loan repayment analysis using generalized linear models

This Diploma thesis concern with generalized linear models and their application in bank practice. Especially to analyze retail loan repayment. First of all we see into theoretical viewpoint of generalized linear models. We shortly try to summarize problems of clasical linear model restrictions and after that we apply to theory on which generalized models are based. We introduce an overview of generalized linear models and after that we concern models, where dependent variable have multinomial and gamma distribution in detail. Main part this thesis is dedicated to data analysis about bank retail loans repayments. In this analysis we use those early mentioned models. We try to create good statistical models on which base the risk ratio of current bank clients could be predicted. The risk ratio is measured by two main indicators, which are: "overdue time" and "overdue amount". For analysis is used statistical software SAS.

During the beginning of the cinema media era around the turn of 20th century, a debate prevailed in Sweden about the film’s harmful and negative moral impact on children and young people. This study aims to investigate the debaters’ knowledge claims regarding a preview of a publicly shown film and if it is related to their morality. The following questions were asked: 1. What knowledge claims are made in connection with the need for prior control over the film that is shown in public? 2. What is presented as the basis for the legitimacy of these knowledge claims? 3. How do these knowledge claims change during its path to legal text? 4. What was the relationship between the presented knowledge claims and a moral perception prevailing among the debaters? A debate paper, a parliamentary motion from 1909 and the public inquiry before the decision to create the Swedish Agency of Movie Censors were analysed with argumentation analysis and thematic analysis with a perspective of history of knowledge. This study points at various aspects such as medical, psychological, social structure and moral arguments, which were put forward as arguments for a regulation of the new film medium. The knowledge claims were justified by professional expertise, general knowledge, experiences from other countries and the debaters’ prior knowledge of the subject. A strong fear of ruining a good existing moral conception that exists in the growing generation emerges. The analysis describes a change in knowledge claims: the moral arguments diminish along the way towards the legal text. Furthermore, the study points at the necessity for continued research to increase the understanding of how legitimacy of knowledge is created by an influential group and then passed on.

In the Western States, a pecuniary punishment represents a proven alternative to (un)conditional imprisonment. By joint effort of the Supreme Public Prosecutor's Office and the Supreme Court, the pecuniary punishment has become a trend over the last few years also in the Czech Republic. Why should criminal justice bodies strive for more frequent imposition of the pecuniary punishment? In which cases is the pecuniary punishment an appropriate criminal sanction? And how is, or rather should be, the pecuniary punishment imposed and enforced? The submitted master's thesis draws attention to the obstacles of effective legal regulation and its inconsistent application. It deals with substantive and procedural aspects of the matter, relevant case law and statistical data. Conscious of the limits of comparisons in criminal law, the author also takes into account the law of Germany, Austria and the Netherlands. The first part of the thesis deals with the pecuniary punishment in general. The diploma candidate describes its purpose, position in the system of criminal sanctions and basic characteristics. A closer look is taken at the new way to satisfy the injured person, which was introduced on 1 January 2018 by Act No. 59/2017 Sb., on the use of financial resources from proprietary criminal sanctions imposed...

In light of recent persuasive appeals which promote a food product's health or nutritional benefits in advertisements, this exploratory study investigates the ways in which individuals read and understand health and nutrition-related claims in advertising and make subsequent judgments about the product, brand, and purchase intentions. Using the Elaboration-Likelihood model of persuasion, this study looks at how motivational (e.g., health consciousness, need for cognition) and ability (nutrition knowledge) factors influence attitudes toward three food products following exposure to manipulated advertisements containing a nutrition-related claim. Although the results do not demonstrate much support for the predicted relationships, the findings nonetheless provide researchers useful information that may benefit future studies. / Master of Arts

Claims are special kind of property. They are tangible property, where its owner has limited possibilities of its exploitation. They ae property, which is bailed to another person without compensation. Claims are interest-free commercial credit granted to a debtor. High share of claims in total circulating property can affect negatively on trend of conditions for economic activity. Claims tie sources necessary to acquisition stock needful for production or business activity. In case of irrecoverable claims is possible to reach indirect reduction their evaluation in accounting by way of adjusting items. Claims are the only property, where is creation of adjustment on fulfilment of a condition tax deductible cost. On the limiation of claim do not arise obligation for creditor to eliminate claim from the property. Creditor can willingly decide of elimination of claim anytime. On fulfilment of conditions fixed in the Income Tax Act is junk value of claim tax deductible. When the lawful conditions are not fulfiled, in the case of claim retirement is not the cost incurred by the write-off tax deductible. Here is also the possibility to transfer a debt to another person. In this way is danger of default of payment eliminated. Achievement of claim settlement is also possible by inclusion mutual claims between creditor and debtor.

This diploma thesis with the titled Creditors' claims in Insolvency proceeding deals with the possibility of setting up the claims of creditors in case that the court declared the debtor insolvent and was therefore initiated insolvency proceeding according to the Act no. 182/2006 Col., on Insolvency and Its Resolution (Insolvency Act). The introduction of the thesis also pays attention to other possibilities of enforcing and lodging the claims whether in extrajudicial proceedings or in proceedings before the court by filing an action against the debtor or in proceedings before the court or arbitration and subsequent recovery options of enforceable claims. The main aim of this thesis is to present a detailed analysis of the process of submission of claims in insolvency proceedings from the moment of initiation of the proceeding through submission of the claims to the insolvency court to their reviewing and their possible denial (together with adversary disputes) or their finding and final satisfaction. The chapter that describes the different types of claims is also closely related to the process of submitting, reviewing and satisfaction of claims as the type of the claim may determine whole process of its submission and satisfaction in the insolvency proceeding. Last chapters describe the satisfaction of admitted claims depending to the chosen method of the insolvency resolution and the destiny of unsatisfied of claims when the insolvency proceeding is over. At the end of the thesis is a practical example that should illustrate the procedure of filling the Claim submission form, including all elements of formal and content requirements.

La cession de créance en droit français et en droit colombien

La cession de créance est un mécanisme consacré tant en droit commun français qu’en droit commun colombien. Conformément à l’analyse classique dans ces deux systèmes juridiques, la cession de créance est un contrat translatif d’obligation envisagée activement. Ainsi, l’obligation passerait, telle qu’elle est, du patrimoine du cédant à celui du cessionnaire. Le débiteur de la créance cédée n’aurait donc rien à craindre, car l’obligation ne subirait aucune modification du fait de la cession. Il resterait tenu envers le cessionnaire dans les mêmes termes qu’il l’était envers son créancier initial : le cédant. La cession de créance opérerait donc un banal transfert d’un bien incorporel. Malgré le caractère ancré de cette conception, elle est critiquable. L’obligation reste avant toute chose un lien juridique de sorte que l’idée de sa transmissibilité, au moins par acte entre vifs, n’est pas convaincante. En réalité, on s’aperçoit que la cession de créance opère une modification de l’obligation par changement de créancier, et cela sans le consentement du débiteur, sujet passif du lien juridique. Le débiteur subit donc une telle modification, laquelle n’est jamais sans conséquence sur sa situation juridique, ce qui explique qu’il mérite une protection spéciale. C’est pourquoi les tentatives classiques de qualification du débiteur de partie ou de tiers à la cession et, par conséquent, la question de savoir si la cession produit à son égard un effet relatif ou un effet d’opposabilité se révèlent inopportunes.Cependant, cette analyse ne doit pas cacher une autre vérité : la cession de créance est également un acte translatif de créance, bien incorporel qui ne se confond pas avec l’obligation, même si les rapports entretenus entre la créance et l’obligation sont étroits. En tant qu’acte translatif de créance -bien incorporel-, la cession présente des spécificités qui empêchent de la cantonner à un acte juridique déterminé. En effet, la cession permet la réalisation de différentes opérations juridiques, ce qui explique sa nature polyvalente. En outre, la nature incorporelle de la créance explique la spécificité de certaines règles régissant le rapport entre les parties et la cession et celui concernant les tiers et la cession ; notamment celles relatives à l’étendue du transfert et à la garantie due par le cédant au cessionnaire, ainsi que celles portant sur l’opposabilité du transfert aux tiers. / The assignment of claims is a mechanism enshrined in both French ordinary law and Colombian ordinary law. According to the classical analysis in these two legal systems, the assignment of claims is a contract transferring the obligation considered active. Thus, the obligation would pass as it is from the patrimony of the assignor to that of the assignee. The debtor of the assigned claim would therefore have nothing to fear as the obligation would not be affected by the assignment. He would remain liable to the assignee in the same terms as he was to his original creditor: the assignor. The assignment of a claim would thus operate a mere transfer of an intangible property. Despite the anchored nature of this conception, it is open to criticism. The obligation remains above all a legal bond so that the idea of its transmissibility, at least by inter vivos transaction, is not convincing. In fact, we can notice that the assignment of claim creates a modification in the obligation by change of creditor, without the debtor's consent, the passive subject of the legal bond. The debtor thus undergoes such a modification, which is never without consequence on his legal situation, which explains why he deserves special protection. Hence the classical attempts to qualify the debtor of a party or third party in the assignment and, consequently, the question whether the assignment produces a relative effect or an enforceability effect in his regard is undesirable.However, this analysis must not hide this other truth: the assignment of a claim is also an act transferring of the claim, which is intangible property, not to be confused with the obligation, even if the relationship between the claim and the obligation is narrow. As an act transferring of the assignment, intangible property, the assignment presents specificities which prevent it from being framed in a particular legal act. Indeed, the assignment allows the realization of different legal operations, which explains its versatile nature. Moreover, the intangible nature of the claim explains the specificity of certain rules governing the relationship between the parties and the assignment and that relating to third parties and assignment, in particular, those relating to the extent of the transfer and the guarantee owed by the assignor to the assignee as well as those concerning the effectiveness of the transfer to third parties.
