The role of volunteers in the transformation of the South African criminal justice system

The history of the criminal justice system in South Africa, in the last decade is a history dominated by the desire for change and transformation. It will be remembered that we are talking of a system which, in the past, formed part of the State apparatus of a minority government which included racist elements and highly restrictive legal regime in dealing with communities, crime and criminals. The criminal justice system is constituted by four core departments, namely: the South African Police Services; Department of Justice, Correctional Services and Welfare. The argument is whether the volunteers from the community should be involved at all in the fight against crime or not. Some people feel that a system· of justice should be controlled by professionals, who are accountable for their decisions, namely: the Police, Justice, and Correctional Services. However, the research revealed that a system which excludes the community from participating, will render itself ineffective and open to abuse. This topic should be further researched within each department in the criminal justice system in order to explore possibilities of attracting volunteers in the transformation of their respective departments. / Penology / D.Litt. et Phil. Gender Disparity: A view of Florida’s Correction System

Disparity in sentence length has long been a topic of discussion (Spohn, 2009). Though most research is aimed at disparity due to race, few studies utilize sex as a focal point (Crow & Kunselman, 2009; Embry & Lyons, 2012; Gavin, 2014; Hartley, Kwak, Park & Min-Sik Lee, 2011; Hasset-Walker, Lateano, Di Benedetto, 2014; Messing, 2008; Steffensmeier, Ulmer & Kramer, 1998). The focus of this study is to examine the effect of sex on sentence length, controlling for characteristics derived from the evil woman hypothesis, chivalry hypothesis, and focal concerns theory, to discuss the potential paternalism of the criminal justice system, which may cause potential sentence disparities (Daly, 1989; Nagel & Hagen, 1983; Steffensmeir, Ulmer, & Kramer, 1998). The findings indicate that women always receive a reduced sentence compared to male offenders, regardless of the crime type of past criminal offenses. The statistically significant results indicate that there is a need to review the criminal justice system and implement new polices such as judicial review to help stymie the differing sentences given (Spohn, 2009). O presente trabalho tem como objetivo a análise da ressocialização na execução penal, com especial destaque ao ordenamento jurídico brasileiro. Partindo de uma concepção legitimadora do sistema penal, é feito o estudo das posições fundamentais sobre a finalidade da pena desenvolvidas pelas doutrinas filosófica e penal, com ênfase à finalidade de ressocialização. Seguindo o estudo, são expostos diversos argumentos contra a idéia de ressocialização como única finalidade da pena e também contra sua viabilidade como finalidade da pena no âmbito da execução penal. Por fim, analisa-se o ideal ressocializador nos institutos da Lei de Execução Penal brasileira. São estudados os institutos da execução penal tradicionalmente ligados à idéia de ressocialização e também aqueles cujo enfoque de aplicação muda quando desprezamos tal idéia. Conclui-se o trabalho sustentando-se, em suma, que o ideal ressocializador da execução penal é incompatível com qualquer ordenamento jurídico democrático. / This study\'s goal is to analyze resocialization in corrections, with special emphasis on the Brazilian legal system. Beginning with a legitimating concept of the criminal system, a survey is conducted on the ground theories concerning the purpose of punishment as developed by the philosophical and criminal doctrines, with emphasis on the purpose of resocialization. Thereafter, a number of arguments are exposed that are against the idea of resocialization as the sole finality of punishment and also against its viability as one of the goals of punishment in corrections. Last, the resocialization ideal presented by the Brazilian corrections law is appraised. This appraisal encompasses correctional concepts traditionally related to the idea of resocialization as well as concepts whose application focus changes when one dismisses that notion. The conclusion argues, in short, that the correctional ideal of resocialization is incompatible with any democratic legal system.

Prison overcrowding in the South African correctional services: a penological perspective

Incarceration of offenders has been relied upon as the dominant sentence option through the years to address the objectives of punishment. Research has shown that the above-mentioned approach does not match the current lifestyle anymore. Correctional centres (prisons) not only in South Africa, but across the board are faced with the same challenge. This is of course not a problem of the Department of Correctional Services alone, but that of the entire justice system. It is therefore obligatory for Justice to join hands with society in accordance with the White Paper on Corrections in South Africa (2005:63-68). Playing a major role in all above-mentioned bodies is Parliament, without which the whole justice system would not exist, let alone functioning. The victims of crime would most probably not condone any soft approach towards treating offenders, worse with alleviating overpopulation by releasing inmates from correctional centres. It is the researcher's submission that the effects of overpopulation coupled with inmate's human rights, as entrenched in the Constitution becomes the major driving force to address overcrowding in our correctional centres. / Penelogy / (M.A. (Penelogy))

Le Modèle Standard Supersymétrique Minimal (MSSM), le plus étudié des modèles de Nouvelle Physique, contient un candidat à la matière noire : le neutralino. Un des mécanismes qui permet de réduire la densité relique de neutralino jusqu'à l'intervalle expérimental de WMAP et de Planck est la coannihilation entre le neutralino et le stop. Dans cette thèse nous étudions deux aspects différents liés à la prédiction de la densité relique dans la région de coannihilation neutralino-stop, ainsi qu'au calcul des sections efficaces d'annihilation et de coannihilation correspondantes. Nous présentons tout d'abord la matière noire en tant que WIMP ainsi que le Modèle Standard de la Physique des Particules, puis nous abordons le MSSM ainsi la phénoménologie de la densité relique de neutralino. Nous étudions ensuite la phénoménologie de la violation de saveur non minimale dans le secteur des squarks dans le contexte de la densité relique de neutralino. Nous considérons des termes violant la saveur dans le secteur des squarks up et down de chiralité droite et de troisième génération et montrons qu'ils peuvent avoir un impact important sur les sections efficaces d'annihilation et de coannihilation du neutralino, et en conséquence sur la densité relique. Finalement, nous nous intéressons à la possibilité d'améliorer la précision avec laquelle la densité relique est prédite, en calculant les sections efficaces d'annihilation et de coannihilation à l'ordre supérieur dans la théorie des perturbation. En se basant sur des travaux antérieurs qui ont montré que l'impact des corrections SUSY-QCD à une boucle pour l'annihilation de neutralino était supérieur à l'incertitude expérimentale, nous avons calculé de telles corrections dans le cas de la coannihilaiton neutralino-stop en bosons de jauge électrofaibles et bosons de Higgs. / The Minimal Supersymmetric Standard Model (MSSM), the most famous model of Physics beyond the Standard Model, provides a good dark matter candidate: the neutralino. One of the mechanisms which can reduce the predicted relic density of neutralino to the experimental range of WMAP and Planck is the coannihilation between the neutralino and the stop. In this thesis, we study two different aspects related to the prediction of the relic density in the neutralino-stop coannihilation region and the calculation of the corresponding annihilation and coannihilation cross sections. We first make short reviews of WIMP dark matter and the Standard Model of particle Physics, introduce the MSSM and discuss the phenomenology of neutralino relic density. We then study the phenomenology of Non Minimal Flavor Violation in the squark sector in the context of neutralino relic density. We consider flavor violating terms in the sectors of right handed third generation up and down squarks and show that they can have an important impact on the thermally averaged (co)annihilation cross section of the neutralino, and therefore on its relic density. Finally, we focus on the issue of improving the precision with which the relic density is calculated, by computing (co)annihilation cross sections at Next-to-Leading Order. Following earlier work in the calculation of one-loop SUSY-QCD corrections to the annihilation of neutralinos, which have shown that the impact of such corrections was larger than the experimental uncertainty, we have calculated similar corrections for the neutralino-stop coannihilation into electroweak gauge and Higgs bosons.
