Le personnage biblique de Joseph, le fils préféré de Jacob, jouit d'une postérité universelle. Son récit vient de peuples et de textes plus anciens que lui et engendrera d'autres textes et d'autres communautés. L'étymologie de Joseph en fait plus qu'un nom: un principe d'augmentation, d'autorité, de conseil. Une foule d'individus, de phénomènes peuvent donc être décrits comme joséphiques. Dans cette narration modèle, Joseph, malgré les accusations mensongères, échappe aux processus victimaires en les comprenant et en pardonnant; cette singularité définit l'élection et fait de Joseph un éminent conseiller politique. Ce récit donne à la fois la formation de la nationalité juive et la formule du Juif parmi les Nations. Anticipant par son comportement les lois de Moïse, Joseph représente leur portée universelle et l’ambiguïté de leur universalisation. Cette universalité va favoriser l’adoption de cette figure messianique par les traditions chrétienne et musulmane.Il assume ainsi une riche postérité théologico-politique où la notion de conseil a une place cardinale: incarnation de la philosophie politique pour Philon d'Alexandrie, figure de l'élu dans la théologie et la politique de Calvin, confirmation des principes de la théorie du contrat social de Hobbes, formation de « l'humanisme de l'avenir » dans la narration mythique de Thomas Mann. Il constitue donc une matrice du conseil qui intéresse la philosophie politique. / The biblical character of Joseph, the beloved son of the patriarch Jacob, is granted a universal posterity. His story comes from more ancient peoples and texts than itself, but gives birth to more stories and communities. Joseph's etymology makes him, more than a name, a principle of increase, authority and counsel. If so, a lot of individuals and phenomena could be described as josephic. In this model narrative, Joseph, despite mendacious accusations, escapes from victimal processes by understanding them and forgiving; this singularity defines the election and makes Joseph a prominent political counsellor. This narration provides simultaneously the forming of the Jewish nationality and the epitome of the Jew among the Nations. Announcing by his behaviour the laws of Moses, Joseph represents their universal significance and the ambiguity of their universalisation. This universality will allow the adoption of this messianic figure by the Christian and Muslim traditions.Thus he assumes a rich theologico-political posterity in which the notion of counsel is capital: embodiment of the political philosophy for Philo of Alexandria, figure of the chosen one in the theology and the politics of Calvin, confirmation of the principles of the Hobbesian social contract theory, formation of “the humanism of the future” in Thomas Mann's mythical narrative. As a saving figure that enables one to escape from evil, he also enables one to conceive of a new institution for the survivors. The josephic counsel questions thus the relations between counsel and commandment, and between political unity and spiritual unity. It is therefore a matrix of counsel that concerns the political philosophy.

A evolução das relações sociais, o acelerado avanço tecnológico e a dinâmica das relações comerciais fizeram com que o conhecimento e a informação se tornassem bens de inegável valor em um mundo globalizado e em constante transformação. Como conseqüência, a informação constitui instrumento essencial para o desenvolvimento das relações humanas, e sua transmissão pauta-se, em regra, pela confiança depositada nos diversos interlocutores. No entanto a troca de informações pode acarretar a quebra dessa confiança, causando danos à pessoa ou ao patrimônio e dando origem à obrigação de repará-los. O presente trabalho, desenvolvido a partir de compilação doutrinária e jurisprudencial, objetiva proceder à análise e discussão da responsabilidade daqueles que dão informações, conselhos ou recomendações a outrem, em especial no que tange às relações entre particulares. O exercício potencialmente danoso do dever de informar, a negligente transmissão de um parecer ou de um simples esclarecimento e os prejuízos daí decorrentes justificam o estudo mais detalhado deste tema. Assim, pretende-se discorrer sobre os fundamentos do dever de informar, de dar conselhos ou recomendações, tomando-se por base a ordem de valores de nosso ordenamento, alicerce necessário para o desenvolvimento das relações pessoais e fonte de um dever ético de conduta, a fim de demonstrar a existência de uma responsabilidade pela quebra da confiança depositada no sistema jurídico brasileiro, cuja violação gera a obrigação de reparação dos danos que dela decorram. Sobre essa base valorativa, nosso trabalho objetiva proceder à análise da responsabilidade pelos danos causados nas relações entre particulares, em virtude de conselhos, recomendações ou informações, seja na fase que antecede a formação do contrato, seja na fase de sua conclusão e execução ou até mesmo posteriormente à sua extinção. / The development of social relationships, the swift technological advancements, and the dynamics of business relations have turned knowledge and information into invaluable assets in an ever changing, globalized world. As a result, information has become a fundamental tool in the development of human relations. Disclosure of information is currently subject to the mutual reliability exercised by the several actors involved in the process. However, exchanging information may lead to a failure in complying with such reliability, which is likely to cause ultimate damage to persons or assets and therefore result in the obligation to repair. This paper was prepared on the basis of data gathered from case law and legal rules, and aims to review and discuss the liability assigned to those who provide information, counseling and recommendations to third parties, particularly within the framework of private parties. The reasons for a more detailed approach to this issue lie on the potentially damaging nature of the obligation to inform and the damage that is likely to result from the reckless rendering of either an opinion or more specific information. This paper will approach the fundamentals of the obligation to render information, counseling or recommendations on the basis of the Brazilian legal system, which is not only a pillar of personal relations development, but also a source for ethical conduct obligation. To a larger extent, it aims to provide evidence that liability stems from relying on the Brazilian legal system, and that failure to comply with said system will lead into the obligation of repairing the damage incurred. Based on these values, this paper will further review the liability derived from providing counseling, recommendations or information within the scope of private parties relationships. This applies to the initial stages of an agreement as well as the termination and settlement thereof and the procedures following thereafter.

The elusive professionnalisation of political counsel : a study of prime ministerial advisers in democratised Poland (1989-2014) / L'introuvable professionnalisation du conseil politique : étude des conseillers du Premier ministre dans la Pologne démocratique (1989-2014)

Le thème des conseillers est quasiment absent des études de l’échiquier politique en Pologne, bien que la présence de ces acteurs sélectionnés et non élus dans la configuration de gouvernance s’ajoute à la complexité des questions de légitimité et de représentation. Cette thèse vise à combler ce vide, en explorant l’ancrage institutionnel, les traits sociodémographiques, les carrières et les rôles des conseillers des premiers ministres polonais de 1989 à 2014. Elle propose également un recadrage de la problématique du conseil, en l’intégrant dans le contexte des processus de délimitation de champs et de professions. L’analyse est orientée par les concepts de professionnalisation, trajectoire et boundary work, et repose sur la mobilisation de méthodes qualitatives et quantitatives. Les résultats montrent que l’institutionnalisation de l’informel au sein des cabinets politiques devenus dispositifs de conseil, les irrégularités dans les parcours professionnels et la liquidité du rôle façonné par des préférences contingentes rendent les frontières entre les conseillers et les autres catégories d’acteurs floues et négociables. Dans le même temps, la consolidation des cabinets politiques dans le paysage institutionnel, les convergences de profils de conseillers, l’adaptabilité de leur rôle et leur auto-identification comme conseillers suggèrent que plusieurs composantes de professionnalisation sont présentes. Le conseil politique apparaît comme un ensemble des pratiques variées, différemment placées sur les axes du formel et de l’informel, de l’expertise et de la confiance, de la science et de la politique, dont l’opposition est aussi discutée et contestée dans ce travail. / The theme of advisers is virtually absent from analyses of the Polish political system, although the presence of these selected and non-elected actors in the configuration of governance adds to the complexity of questions of legitimacy and representation. This thesis aims to fill the gap by exploring the institutional affiliation, sociodemographic features, careers and roles of advisers to the prime ministers of Poland active between 1989 and 2014. It also suggests a reframing of the question of political counsel by embedding it in the context of delimitation of fields and professions. The analysis is oriented by the concepts of professionalisation, trajectory and boundary work, and it relies on a combination of qualitative and quantitative methods. The results indicate that the institutionalisation of informality within advisory units, the irregularities in professional trajectories and the liquidity of the role shaped by changing preferences blur the boundaries between advisers and other categories of actors. At the same time, the consolidation of political cabinets in the institutional landscape, the convergences in advisers’ profiles, the adaptability of their role, and their self-identification as advisers suggest that multiple components of professionalisation are present. Political counsel appears thus as a set of diversified practices positioned in a variety of ways on the axes of the formal versus the informal, trust and expertise, science and politics, whose contradictory nature is also discussed and contested in this work.

Summary: Counsel in the Criminal Proceedings The objective of my thesis is to describe the position of a defense counsel during a criminal procedure and analyze the currently valid law governing the counsel's position in the criminal proceedings, and how is law applied in real life and also describe duties and obligations of defense counsel. I choose this topic, because during studies of criminal law I was intrigued by the complexity of criminal trial a by the role of the defense counsel in it. I wanted to gain deeper knowledge of rights and obligations of the defense counsel and research limits of criminal defense. Fair trial is considered as one of the fundamental basics of democratic state. The objective of criminal trial is to reach a proper and rightful verdict as a result of fair trial. Criminal trial could be considered fair only if both sides, the defendant and the prosecutor, are both provided with equal rights. Defendant is often a person without thorough legal knowledge and thus is considered to be in disadvantaged position. As opposed to prosecutor, defendant finds himself in new, unknown position, and his basic rights and his future life are endangered. The right of deffencee is one of the most important fundamental rights of a person against whom the criminal proceedings is brought. The role of defence counsel in preliminary procedure is essential. He has to be an advocate only and a member of Bar Association, consequently a person with a juristic education and qualified to this job. Defence counsel must defend a laws of accused by all the tolerable ways and work on his behalf. In my work I direct my attention towards the legal status of counsel under current Czech legal regulation, issues of the compulsory defence, legal position of chosen and court-appointed counsel, designation of the counsel by the Bar Association, rights and duties of counsel. Also I direct my attention towards preliminary procedure and on various aspects of defender's participation in preliminary procedure and his tasks in it.
