Contratação direta: análise crítica do sistema e o caso dos serviços advocatícios / Direct hiring: critical analysis of the system and the specific case of legal services

O presente trabalho oferece uma análise crítica das hipóteses de contratação direta previstas na Lei Geral de Licitações e Contratos brasileira, Lei Federal n.º 8.666, de 21 de junho de 1993, com atenção especial para o caso da contratação direta de serviços advocatícios. A dissertação encontra-se dividida em quatro partes. A primeira delimita o tema do trabalho no estágio atual de evolução do Direito Administrativo brasileiro. A segunda parte do trabalho explora o tema da licitação e sua importância para o Direito Administrativo. Nessa etapa, são apresentados os princípios norteadores da licitação e sua importância para o ideal republicano, tal qual previsto pela Constituição Federal. A terceira parte do trabalho analisa as hipóteses de contratação direta previstas na Lei 8.666/93, procurando identificar suas possíveis razões e as características em comum que existem entre elas. Elaborou-se uma classificação própria aglutinando os incisos do artigo 24 da Lei 8.666/93 em 6 categorias, a saber: a) dispensa de licitação em função do valor do objeto contratado; b) dispensa de licitação em função de situação excepcional; c) dispensa de licitação em função de problemas em contratação anterior; d) dispensa de licitação em função dos atores envolvidos; e) dispensa de licitação em função de políticas de fomento; e f) dispensa de licitação em função de especificidades do objeto. A quarta parte do trabalho contém uma análise sobre o caso da contratação direta de serviços externos de advocacia nos tribunais superiores: o Supremo Tribunal Federal e o Superior Tribunal de Justiça. Ao olhar para as decisões proferidas por essas Cortes, espera-se alcançar dois objetivos: captar os argumentos usados pelas partes que tomam posição nesse debate e identificar o posicionamento das maiores instâncias do Poder Judiciário sobre o tema da contratação direta de serviços advocatícios e o dever de licitar. Não se trata, portanto, de uma análise de jurisprudência, que foi usada como fonte de pesquisa para identificar situações reais envolvendo a contratação direta de serviços advocatícos, suas razões, e os argumentos forenses favoráveis e contrários a ela. / This paper offers a critical analysis of the cases of direct hiring as prescribed by the Brazilian General Law of Public Bids and Contracts, i.e., Federal Law No. 8.666, of June 21, 1993, with due regard for the direct hiring of legal services. The paper is divided into four parts. The first defines the theme of the paper viewed from the current standpoint of evolution of the Brazilian Administrative Law. The second part of the paper analyzes the issue of bidding per se, and its importance to Administrative Law. At this stage the bidding guiding principles and their importance to the republican ideal are presented, as set forth in the Brazilian Federal Constitution. The third part of the paper looks into the cases of direct hiring set out under Law No. 8.666/93, seeking to identify the possible reasons therefor and the common characteristics existing among them. Under a specific classification the items of article 24 of Law number 8.666/93 were combined in order to fall under six categories: a) waiver of bidding in view of the amount of the contracted object; b) waiver of bidding due to exceptional circumstances; c) waiver of bidding due to problems occurred in previous hiring; d) waiver of bidding due to the players involved; e) waiver of bidding based on development policies; and f) waiver of bidding based on the specific characteristics of the object. The fourth part of the paper analyzes the case of external legal services directly hired, as viewed by the higher courts, i.e., the Supreme Court and the Superior Court of Justice. When looking into the decisions handed down by these courts, two goals are expected to be met: to raise the arguments used by the parties involved in this debate and identify the standing of the Judiciary Branch highest instances on the subject of directly hiring legal services, as well as and the duty to promote competitive bids. This is not an analysis of case law, which was used as a research source to identify real situations involving direct hiring of legal services, their reasons, and forensic arguments for and against them.

A análise dos efeitos indiretos externos dos precedentes do STF e STJ (1996 a 2011) acerca da Lei de Diretrizes e Bases de 1996 (LDB-1996) parte do conteúdo e natureza do direito à educação que definem a posição jurídica dessa lei nacional materialmente constitucional, que tem promovido mutação universalizante-focalizante do direito à educação previsto na Constituição. Resultantes do caráter abstrativizado do precedente judicial das cortes superiores, os efeitos indiretos externos (indirect effect external) configuram o impacto político das decisões judiciais, no momento pós-decisões judiciais (the aftermath of judicial decisions), verificando-se nos casos em que o governo generaliza uma decisão da corte, mediante a alteração da política pública e, para alguns autores, têm a potencialidade de beneficiar aqueles que não têm recursos para litigar (GAURI; BRINKS). No ciclo de judicialização das políticas públicas (the life-cycle of public-policy litigation), a eficácia expansiva do precedente implica comandos que influenciam a ampliação do direito social àqueles potenciais demandantes. No contexto de ativismo judicial e buraco negro legislativo, a questão se o Judiciário prejudica ou contribui para a política democrática é analisada segundo os conceitos de accountability e responsividade diante dos impactos políticos dos precedentes judiciais a exigir o diálogo interinstitucional entre os poderes. Empiricamente, analisam-se os casos paradigmáticos das cotas raciais do STF de 2012 e os efeitos indiretos externos dessas decisões configurados na resposta política dada pela aprovação da Lei nº 12.711/12 e do Decreto nº 7.824/12. Metodologicamente, após o mapeamento temático dos acórdãos do STJ e do STF de 1996 a 2011 acerca da LDB-1996 (obtidos através da pesquisa com o critério legislativo nos sites www.stf.jus.br e www.stj.jus.br), afere-se a potencialidade desses efeitos políticos nos casos paradigmáticos do STF e STJ a evidencisar como/se promove: restrição/ampliação de políticas públicas; (des)consideração dos recursos financeiros; efeito multiplicador; e/ou acesso ou qualidade do ensino. / The analysis of indirect effect external of Supreme Federal Court STFs and Superior Court of Justice STJs cases in the period of 1996-2011 about the 1996 National Education Law (LDB-1996) begins with the right to education content and nature that define the substantial constitutional position, which has promoted informal interpretation changes based on the focalization and universalization of the constitutional right to education. Resulting from the abstract character of higher courts rulings and considering, the aftermath of judicial decisions, specifically its indirect effect external, shapes its political impact that and take place \"where government generalizes a decision of the court, by changing public policy\" and, for some authors, with the potential to benefit those who can not afford to litigate (GAURI; BRINKS). In the life-cycle of public-policy litigation the expansive compliance implies commands that influence the expansion of social rights to those potential plaintiffs. In the context of judicial activism\" and Congress \"black hole\", the question whether the judiciary contributes to democratic policy is analyzed with the accountability and responsiveness of those rulings that demand institutional dialogue between powers. Empirically, the 2012 STF racial quotas cases illustrate the indirect effect external by the approval of the Law No. 12,711 and Decree No. 7,824 of 2012. Methodologically, after the thematic mapping of STF and STJ rulings from 1996 to 2011 about the LDB-1996 (legislative research criteria on www.stf.jus.br and www.stj.jus.br websites) it is assessed its potential political effects with the following questions: the ruling promotes a restriction/extension of public policies?; does/not considers of financial resources?; has demonstratate \"multiplier effect\"; or/and decides about education access/quality.

The thesis seeks to answer the question whether the European Union (EU) constitutional treaty offers improved protection for human rights in the EU jurisdiction. Within this context, it first seeks to find out what the incorporation of the Charter of Fundamental Rights in the constitutional treaty promises for the human rights&rsquo / field. Furthermore, it examines how the possible accession of the EU to the European Convention on Human Rights will affect this field. Then, it focuses on what the constitutional treaty offers for third countries concerning human rights. Finally, in the light of the recent developments on the treaty, the discussion enlightens the role of the constitutional treaty on protecting and developing human rights in the EU.

“You Want To Capture Something that Will Make People Change”: Rhetorical Persuasion in The Cove, Whale Wars, and Sharkwater.

Dolphins, whales, and sharks are some of the world’s most iconic animals. Yet, many people will only ever see these animals via the media. The media, then, hold significant power in creating, modifying, or reaffirming the imaginaries around various species which, in turn, influences how much concern is given to matters related to their welfare and conservation. Given the environmental and ecological concerns presently facing the ocean, protecting, conserving, and preserving the marine ecosystem is vital, and time is of the essence. Through the work of activists, three specific marine wildlife issues have received a lot of publicity across various forms of mainstream media: the killing of dolphins in Taiji, Japan for their meat; Antarctic whaling; and the practice of shark-finning. Three activist films, namely The Cove (2009), Whale Wars (2008-), and Sharkwater (2006), are centred on these issues, and filmmakers attempt to compel viewers to support the activists’ protectionist cause. In order for this goal to have a chance of coming to fruition, rhetorical arguments must be carefully crafted. Yet, the study of rhetoric in animal-focused activist films is still an understudied research area. This thesis contributes to this area of research by using the aforementioned films as case studies by applying Aristotle’s rhetorical proofs of ethos, pathos, and logos to analyse the rhetorical arguments. Ethos is demonstrable when the activists construct themselves as credible, moral heroes and the animals as possessors of positive traits worth protecting, and the hunters as immoral villains. The graphic imagery of animal death appeals to pathos to stir strong bodily and emotional responses such as sadness, and disgust in order to mobilize audience support for cause. Lastly, these films appeal to logos through the use of culturally authoritative discourses such as those of biology, western conventional medicine, and the legal system. This thesis essentially argues that these texts work rhetorically and discursively to persuade audiences to feel a connection with and sympathy towards the animals; to be supportive of the activists; and to prompt antipathy towards the hunters and industry spokespeople.

Magistriniame darbe, naudojant mokslinės literatūros, aprašomąjį analitinį, teisės aktų ir dokumentų analizės metodus, analizuojamas ES Laisvo darbo jėgos judėjimo principo įgyvendinimas, apibrėžiama laisvo darbo jėgos judėjimo sąvoka, jos taikymo sritis, išskiriami pagrindiniai trukdžiai laisvam asmenų judėjimui ir įsteigimo laisvės įgyvendinimui. Siekiant atsakyti į iškeltus uždavinius pirmoje darbo dalyje pristatomos Europos integracijos teorijos: neofunkcionalizmas, liberalusis ir realistinis tarpvyriausybiškumas, taip pat paaiškinamos viršvalstybiškumo ir tarpvyriausybiškumo sąvokos. Antroje darbo dalyje supažindinama su sąvokos “darbuotojas” taikymo sritimi, jos apibrėžimu ir apžvelgiama kaip laisvas darbo jėgos principas apibrėžtas Europos Sąjungos teisės aktuose. Šioje darbo dalyje taip pat plačiau pristatoma Bosmano byla, kuri panaikino visas kliūtis profesionalių sportininkų iš Europos Sąjungos narių valstybių judėjimui bei taip pakeitė profesionalų sportą. Trečioje darbo dalyje apžvelgiami Europos Teisingumo Teismo sprendimai bylose, kuriose buvo įvardinamos pagrindines laisvės veikimo sritį pažeidžiančios, diskriminuojamosios priemonės, neutralios priemonės, apskritai trukdančios patekti į rinką, pristatomos problemos, kylančios iš valstybių teisės skirtybių. [toliau žr. visą tekstą] / The master thesis, using the scientific literature, descriptive analytical and document analysis methods analyses the implementation of the principle of free movement of workers in the EU, describes „free movement“ notion, its fields of action, excepts the most important disturbances for its implementation. Seeking to fulfill the set tasks, in the first part of the theoretical part are presented theories of European integration: neofunctionalism, liberal and realistic intergovernmental theories. In the second part is discribed „employee“ notion and its use, also is presented legislation of the EU, which controls the implementation of the principle of free movement of workers. In this part also is presented Bosman case. This case changed football transfer markets, because football players from the EU members are allowed play where they want without any limitation. In the third part are presented verdicts of the European Court of Justice which related with discrimination of workers from others members of the EU. In the fourth part are discribed social policy of the EU, its use and fields of action. In this part also are presented the National measures to new members of the EU, its fields of action and mechanism how contries can instal the National measures, its terms. Regulation of free movement of workers in the EU is very specific, because are important verdicts of the European Court of Justice, Treaty of Rome and other legislation of the EU.

L'influence du contexte conjoncturel sur la fonction intégrative de la cour de justice des communautés européennes dans le domaine de la libre circulation des marchandises

Le rôle intégratif que la Cour de justice des Communautés européennes (CJCE) a joué dans la construction européenne est bien connu et très documenté. Ce qui l'est moins ce sont les raisons qui l'ont motivé, et le motivent encore. Si certains se sont déjà penchés sur cette question, un aspect a néanmoins été complètement négligé, celui de l'influence qu'a pu avoir à cet égard le contexte conjoncturel sur la jurisprudence communautaire et plus précisément sur l'orientation que la Cour a choisi de lui donner. Dans ce cadre, les auditoires de la Cour ont un rôle déterminant. Pour s'assurer d'une bonne application de ses décisions, la Cour est en effet amenée à prendre en considération les attentes des États membres, des institutions européennes, de la communauté juridique (tribunaux nationaux, avocats généraux, doctrine et praticiens) et des ressortissants européens (citoyens et opérateurs économiques). Aussi, à la question du pourquoi la CJCE décide (ou non) d'intervenir, dans le domaine de la libre circulation des marchandises, en faveur de l'intégration économique européenne, j'avance l'hypothèse suivante: l'intervention de la Cour dépend d'une variable centrale : les auditoires, dont les attentes (et leur poids respectif) sont elles-mêmes déterminées par le contexte conjoncturel. L'objectif est de faire ressortir l'aspect plus idéologique de la prise de décision de la Cour, largement méconnu par la doctrine, et de démontrer que le caractère fluctuant de la jurisprudence communautaire dans ce domaine, et en particulier dans l'interprétation de l'article 28 du traité CE, s'explique par la prise en compte par la Cour des attentes de ses auditoires, lesquels ont majoritairement adhéré à l'idéologie néolibérale. Afin de mieux saisir le poids - variable - de chaque auditoire de la Cour, j'apprécierai, dans une première partie, le contexte conjoncturel de la construction européenne de 1990 à 2006 et notamment le virage néolibéral que celle-ci a opéré. L'étude des auditoires et de leur impact sur la jurisprudence fera l'objet de la seconde partie de ma thèse. Je montrerai ainsi que la jurisprudence communautaire est une jurisprudence « sous influence », essentiellement au service de la réalisation puis de l'approfondissement du marché intérieur européen. / The integrative role played by the Court of Justice of the European Communities (CJEC) in the construction of Europe is well known and documented. However the reasons that have motivated the CJEC in this role are far less known. Although some studies have been conducted on this topic, one aspect has been completely ignored: the influence of the conjunctural context on the European Community case law, and more precisely the orientation that the Court has chosen to give to the latter. Within this scope the Court's audiences play a determining role. To ensure that its decisions are well followed, the CJEC takes into consideration the expectations of the Member States, the European institutions, the judicial community (national tribunals, Advocates General, doctrine and practitioners), and the European citizens and economic operators. In regard to the question as to whether or not the CJEC decides to intervene in the domain of free movement of goods, in favour of the European economic integration, I argue the following hypothesis: the intervention of the Court depends on a central variable, that of the audiences, of which the expectations (and their relative weight) are determined by the conjunctural context. My objective is to point out the ideological aspects of the Court's decision making, mostly unknown to legal scholarship, and to demonstrate that the fluctuating character of case law in this domain, and more precisely in the interpretation of Article 28 of the CE Treaty, is explained by the Court’s taking into consideration the expectations of its audiences, which are mainly committed to the neoliberal ideology. In order to evaluate the varying weight of each audience of the CJEC, the first part of the thesis will delve into the conjunctural context and the European construction from 1990 to 2006 where in particular, we observe a turn towards neoliberalism. The study of the audiences and their impact on EC case law will be the subject of the second part of the thesis. I will show that this case law is "under influence", essentially to the service of the development and the strengthening of the European internal market.
