La persistance des fraudes financières depuis les origines de la création de la bourse conduit au constat selon lequel la sanction est un élément fondamental du bon fonctionnement des marchés financiers. En l’état actuel du droit positif, notre système de sanction repose pour l’essentiel sur l’Autorité des marchés financiers. À première vue, le droit français offre le visage d’une architecture moderne. Pourtant, l’actualité n’en finit pas de démontrer l’existence d’affaires et de fraudes sensibles affectant drastiquement la confiance des investisseurs dans le système. En vue d’une amélioration de notre système de sanction, la comparaison avec le droit canadien se révèle très enrichissante. Il en ressort que le système de sanction en droit des marchés financiers français pourrait être rendu plus efficace par la création d’une juridiction spécialisée à laquelle serait confiée l’ensemble du contentieux relatif aux marchés financiers. Une telle réforme favoriserait l’harmonisation et la cohérence du système de sanction. / The persistence of financial frauds since the creation of the stock exchange has made it clear that sanctions are a fundamental aspect to ensure the effective functioning of financial markets. Currently, our sanction system relies, for the most part, on the action of the financial regulator, the Autorité des marchés financiers. At first sight, French law offers a very modern system. However, frauds keep on happening, affecting drastically the trust of the investors in the system. In order to improve our sanction system, the comparison with Canadian law has revealed to be very rewarding. It is possible to make our system more efficient by implementing a special jurisdiction, which would be responsible for all the financial markets disputes, in order to make our sanction system more coherent and unified.

The purpose of the diploma thesis "Duty of care, skill and dilligence in Czech court case law" is to analyze the approach of Czech courts case law to the selected issues related to the duty of care, skill and dilligence and to evaluate it with regard to the interpretation of legal regulation, doctrinal interpretation, theoretical and historical knowledge. The thesis consists of two main chapters which deals with research of two actual questions selected to the purpose of the thesis. The first chapter deals with the question whether the duty of care, skill and dilligence can be considered as an objective or subjective standard, i.e. according to which standard should the actions of persons who are obliged to act with the duty of care should be measured. Based on the performed analysis, the author's own opinion on the issue is expressed and subsequently the approach of the Supreme Court of the Czech Republic in its individual decisions is evaluated. The concept of care as a subjective sharpening of the objective standard is critically evaluated. The second chapter is devoted to the issue of the nature of the duty of care, specifically the question of whether it can be considered lawful or contractual with regard to changes in the law of liability after the recodification of civil law. The dissertation titled "Protection of property rights in the decision-making practice of courts in the Czech Republic" gives a holistic view of the decisions of courts of general judicial system and the Constitutional Court of the Czech Republic in matters relating to the conditions, manner, and limits of the property rights protection. The topic is understood as an interpretation of various institutes in which the courts' decisions claims the most, and as a summary of judgments reflecting every single institute. The dissertation captures the judicial decision-making practice, taking into account the state of the legislation in force until 31 December 2013. The empirical part of the dissertation which corresponds to the selected assignment is preceded by a necessary interpretation of theoretical, doctrinal and historical bases of the topic. The dissertation also reminds the in time-varying insight into the nature, meaning and object of property rights and on the level and ways of protection in the Roman law jurisprudence and civil codes that directly affected the courts application practice in the territory of the present-day Czech Republic. Šiame ribotos apimties magistro baigiamajame darbe analizuojama žmogaus teisių apsaugos institucijų sistema. Didelis dėmesys skiriamas nacionalinės žmogaus teisių institucijos, veikiančios pagal Jungtinių Tautų Generalinės Asamblėjos patvirtintus Paryžiaus principus, sampratos analizei. Pateikiama užsienio šalių nacionalinių žmogaus teisių institucijų analizė (Airija, Danija, Vokietija, Lenkija). Darbe darytina išvada, kad Lietuvoje turėtų būti steigiama nacionalinė žmogaus teisių institucija, kuri vykdytų žmogaus teisių padėties stebėjimą, didintų visuomenės žinomumą, konsultuoti valstybės valdžios institucijas žmogaus teisių klausimais, bendradarbiautų su tarptautinėmis institucijomis, užtikrintų Lietuvoje tarptautinių žmogaus teisių standartų laikymąsi, nagrinėtų individualius asmenų skundus dėl visų žmogaus teisių pažeidimų tiek viešoje, tiek privačioje srityje. Special focus is placed on the concept of national institutions operating in compliance with the Paris Principles approved by the United National General Assembly. An analysis of foreign national human rights institutions (Ireland, Denmark, Germany, Poland) is also offered. The study made leads to the conclusion that a national institution should be established in Lithuania to monitor the human rights situation, improve public awareness, consult state authorities on human rights issues, cooperate with international institutions, ensure compliance with international human rights standards in Lithuania, and examine complaints by individual persons regarding any violation of human rights in both public and private sectors. The thesis also analyzes the activities of traditional and specialized ombudsmen and the role they play in the protection of human rights, based on a detailed overview of the activities of Scandinavian ombudsmen. The goal of the present thesis is to prove that the workload intensification process has become one of the most decisive and crucial element to be tackled by the social workers class if they want to work fewer hours. Consequently, time and working activities are presented as vital aspects to be examined carefully when dealing with the inherent financial characteristics of the capital used in the productive and service sectors as well as in the restructuring of the public policies and working classes conditions. Within this context, the professional activity in the Court of Law was understood as the job performed itself and the social worker as the employee who performs a paid job and suffers the consequences of the economic conditions and working tendencies of all over the world. The relationship between the Law and the Legal System were objects of this study because they have a strong influence on the performance of the social workers’ daily activities due to the frequent law requisitions resulted from infringement acts which are treated at the Special Children and Juvenile Court of Law every single day. All the data collected for this paper were analysed in terms of their quality and quantity worth. Based on a semi-structured guide, ten social workers from the Court staff were interviewed face to face and asked to answer a written survey. Among the research findings, it was realised that the employees have been working under pressure due to the huge intensification of their workload and harmful working conditions, worsened by the organisational structure, rhythm and pace of the Court of Law, which reaffirm that the private sector entanglements are influencing the state public sector. Furthermore, it was also discovered that new social workers are not being hired because of the workload intensification of the current employees due to the reduction in the number of social workers who leave the job either from removal or retirement. Therefore resilience strategies are being held individually and collectively as well as internally and externally as an effective way to avoid the workload intensification of the social workers. However, it is still a challenge to be faced. In conclusion, this study shows that it is essential for the ones involved in this process to discover innovative legal means to prevent the social workers to be overloaded by work and give them useful tools to fight against capitalist exploitation / Essa tese analisa as condições de trabalho das Assistentes Sociais no Fórum das Varas Especiais da Infância e Juventude do Tribunal de Justiça do Estado de São Paulo, com o objetivo de apreender o seu processo de intensificação nesse espaço sócio-ocupacional, conferindo centralidade à categoria tempo de trabalho como um elemento determinante da luta histórica da classe trabalhadora pela redução da jornada de trabalho. Por isso, tempo e trabalho se apresentaram como dimensões relevantes a serem analisadas, notadamente na atual etapa de financeirização do capital que se refrata no setor produtivo, nos serviços, na reconfiguração das políticas públicas e nas condições de trabalho. Nesse âmbito, o exercício profissional no Tribunal de Justiça foi apreendido como trabalho e o/a assistente social como trabalhador/a assalariado/a, sofrendo as injunções das tendências gerais do mundo do trabalho. As relações entre Direito e Sistema de Justiça foram objeto de tematização por atravessarem e condicionarem o trabalho desenvolvido pelas assistentes sociais, por meio das interfaces com as requisições decorrentes do ato infracional a partir do fluxo de atendimento no Fórum das Varas Especiais da Infância e Juventude. A metodologia da pesquisa, de natureza qualitativa e quantitativa, envolveu a aplicação de questionários e entrevistas, com base em roteiro semiestruturado, com dez Assistentes Sociais que compõem a equipe técnica. Entre os achados da pesquisa constatou-se forte presença da intensificação do trabalho, percebida pela maioria das trabalhadoras por meio das precárias condições de trabalho e também pela própria estrutura do Judiciário em seus ritmos, velocidade e carga de trabalho, que reafirmam os ditames privados adentrando o espaço público-estatal. Identificou-se também a ampliação da jornada de trabalho, ainda mais estimulada pela redução do número de assistentes sociais na equipe técnica do Serviço Social em função do processo de remoção e de aposentadoria, que não têm levado a novas contratações. Estratégias de resistência - individuais e coletivas, internas e externas - são mobilizadas, mas resta o desafio de avançar com novas propostas contra a intensificação do trabalho, por meio de dispositivos no contrato de trabalho que possam vincular previamente o grau de intensidade do trabalho a ser realizado, a depender do fortalecimento das lutas coletivas do trabalho contra o capital
