Integrated offender administration through correctional case management

The research into case management was made necessary by the emphasis that the South African prison authorities of today placed on the rehabilitation of offenders. The lack of respect for human dignity, the need to reduce crime in South African prisons and the successful reintegration of offenders into the community are some of the reasons why the research became important. The idea behind introducing case management is to bring back humanity to the offender; to make the offender part of a team which is working towards a mutual goal: to promote the well being of the offender. Topics addressed include the case management process as a sub-system of sentence planning, the role of the correctional officer and the role of the offender and the community in the successful implementation of case management in prisons. The philosophy of case management is also spelled out in the study, covering the implementation of case management within the criminal justice system in Australia, Canada, United States of America, South Africa and the United Kingdom. During any process of incarceration, documentation forms an integral part of the process and in the situation of the case management process, it is just as important. In this study, the researcher discussed those documents that form part of the case file and which play an important role in the successful implementation of case management. The importance of case management in prisons as well as the fact that it can be implemented without the support of the unit management approach cannot be overemphasised. The research contributes largely to scientific knowledge in stressing the importance of sentence planning for each offender within the Criminal Justice System. The case file, which includes the individual sentence plan and the active involvement of the correctional officer and the offender, forms a vital part of the management of the rehabilitation of the offender in today's prison systems. / Penology / D. The employment of ex-offenders in local enterprise development in Mthatha

Crime in South Africa is one of the serious challenges facing post- apartheid democracy. As a result, many people find themselves jailed for different crimes which impact their ability to obtain formal employment upon release from jail. Therefore, employment is considered to be a significant contributor to an ex-offender not returning to offending behaviour. It is thus proposed that society has an essential and active role to play in attempts to lower recidivism rates. The hypothesis of this research was that lack of job opportunities for ex-offenders contributes to them breaking parole conditions. Also, communities where ex-offenders come from are not well prepared to welcome them back as transformed people. This treatment of ex-offenders contributes to them reoffending. Furthermore, the brick making industry plays a crucial role in the lives of ex-offenders by giving them an opportunity to be employed after serving their sentences. Finally, employment in the brick making business brings dignity back to the lives of ex-offenders. This study used qualitative research methods to address the research questions and gather relevant data. The use of a qualitative approach was adopted as it allows a deeper exploration of the different research objectives and questions of the study. Thematic content analysis was used to analyse the data. The findings of this study have revealed that the brick making business in the Mthatha region, in the Eastern Cape region of South Africa, is making a big difference in the lives of ex-offenders by offering them the opportunity to gain paid employment, thus contributing to their proper reintegration in their communities.

Thesis( M. A. ( Criminology and Criminal Justice)) -- University of Limpopo, 2021 / The VOM and FGC programmes have become valuable instruments for the rehabilitation of offenders. These programmes bring crime victims and offenders together to reach agreements for restitution and community healing. Moreover, the NICRO, a Non-Profit Organisation (NPO) in Polokwane, Limpopo Province, offers these programmes to offenders and their victims. Therefore, the purpose of this study was to evaluate the effectiveness of VOM and FGC programmes on recidivism in Polokwane Municipality, Limpopo Province. The study sought to identify factors contributing to recidivism in Limpopo Province, to explore associated challenges in response to recidivism by the local NICRO and to determine strategies employed by NICRO in response to recidivism in the province. The qualitative research approach was used in the study. This study further assumed a phenomenological design, which aims to describe, understand and interpret the meaning that participants give to their everyday life. The non-probability sampling technique was used to select participants of the study. One-on-one semi-structured interviews were used to collect data from adult male and female offenders and their family members who participated in VOM and FGC programmes. Data was also collected using one-on-one semi structured interviews from Social Workers at NICRO. Based on the transcribed data, themes were extracted and analysed using Thematic Contents Analysis (TCA). This allowed for an all-inclusive view to be gained of participants' opinions about insights into the topic. The design of the questionnaire was based on the objectives of the study. This study established that there are factors that contribute to reoffending and challenges in response to recidivism. The findings of the study showed that factors such as unemployment and substance abuse can lead to reoffending. The study recommended that these programmes should address the criminogenic needs of offenders as a measure to respond to recidivism. It has been discovered that VOM and FGC programmes help many offenders to acknowledge and understand the impact of the crime committed to parties.

Punishment and therapy : a progressive synthesis

The moral justification of punishment is the fundamental concern of this thesis. It is argued that a moral response to crime has to be a civilised response; therefore, the notion of "civility" is defined and discussed. Punishment is then defended in such a way that it accords with being a civilised response to crime. It is argued that in order to be such a response, and thereby qualify as a moral response, punishment must have a certain structure, i.e. it must fulfil seven necessary conditions, which, it is argued, together constitute the sufficient condition for morally justified punishment. In arguing for each of the necessary conditions, different onedimensional theories of punishment are dealt with (retributivism, utilitarianism, deterrence theory, rehabilitationism, a paternalistic theory of punishment, and restitutionalism}, indicating that each fulfils some of the criteria for morally justified punishment. None of the onedimensional theories fulfils all the necessary conditions, however, and hence none on its own fulfils the sufficient condition for morally justified punishment. This is not to argue that a straightforward theory could never on its own fulfil the conditions for morally justified punishment, but I have not been able to conceive how this could be done. The theory I here present is therefore a hybrid approach, incorporating elements of all the above-mentioned theories into a unitary theory. In doing so, it fulfils all the necessary conditions for being a civilised response to crime, thereby fulfilling the sufficient condition too, and hence providing a morally defensible account of punishment. Finally, the question of how this theory can be put into practice is addressed. Because the objective of punishment ought to be a civilised response, thereby benefiting both society as a whole and those being punished and rehabilitated, the thesis may be seen as a progressive synthesis of the various approaches examined. / Philosophy, Practical & Systematic Theology / D. The goal of this study was to explore and describe the challenges facing social workers rendering rehabilitation services to male offenders in a maximum correctional centre and to explore and describe strategies to address the challenges. The researcher used the eight steps provided by Tesch (in Creswell, 1994:155) to analyse the data systematically. In this study the statutary and policy making management methodology of parole by correctional systems and parole boards is couched in an overview of literature, using the historical development of parole as the general point of departure. Countries included in the research are, the United States of America, Australia and Britain with specific reference to Alabama, New York, Georgia, New South Wales, Queensland and Western Australië respectively The overview of literature and concommittant empirical investigation, defines and discusses specific and relevant legislation that culminates in the operationalisation and management of the granting of parole. The contemporary operationalisation applicable to the re-integration and treatment of the offender in the community is discussed and the reality in the practical exercise of supervision and control over the offender on parole, is also incorporated into this study. Halfway houses as a mechanism for the reintegration of offenders

The Department of Correctional Services sees the need for intensive preparation of inmates for reintegration into the community after release. Presently the Department of Correctional Services conducts pre-release preparation programmes in larger institutions. The inmates are, however, detained in institutions where the influence from other inmates is not conducive to the effective preparation of inmates for adjustment in free society after release or placement on parole. The use of halfway houses can combat the latter problems and play an important role in providing educational and training programmes. Specialised services such as social work; religious work, counselling, psychological treatment and psychiatry receive attention. Summaries in English and Afrikaans / This research project was undertaken to establish what influence the lack of discipline amongst prisoners and members of Correctional Services has on the rehabilitation of offenders. A complete literature study was done to investigate the current lack of discipline amongst prisoners and members. Discipline is also brought into relationship with community based sentences such as Correctional Supervision as well as the involvement of the community in the release of prisoners. Positive rehabilitation can lead to crime prevention but the Department of Correctional Services and the community will have to take hands to reach this common goal. This subject needs further research in order to make recommendations to promote rehabilitation of off enders and to uplift the standard of discipline within the Department of Correctional Services. / Hierdie ondersoek is onderneem om die invloed van gevangenes en personeeldissipline binne die Departement Korrektiewe Dienste in verband te bring met die invloed wat dit het op die rehabilitasie van oortreders. 'n Volledige literatuurstudie is gedoen om die huidige tendens van swak dissipline onder gevangenes sowel as lede te ondersoek.
