Trestné činy v souvislosti s insolvenčním řízením / Criminal acts in connection with insolvency proceedings

Criminal activity is mapped in this thesis, which subjects can commit in connection with insolvency proceedings. Czech Criminal Code No. 40/2009 Coll. lays down a total of six crimes, while the Swedish Criminal Code (Brottsbalk) has seven such crimes. The current legal regulation of bankruptcy offenses in the Czech Republic is analyzed in the theoretical part. In the practical part, the foreign legislation is analyzed and several proposals de lege ferenda are set on the basis of this analysis.

Omissions in Crimial Law Abstract The submitted thesis represents a relatively comprehensive, and given the contemporary state of the domestic criminal law theory, also a quite complex elaboration of questions associated with the phenomenon of omission in criminal law. From my point of view, the text itself deals with all significant problems related to criminal liability for omissive conduct. This concerns in particular the subject matter associated with the institution of omission within the doctrine of substantive criminal law, the term of omission in criminal law and the reason and historical evolution of criminalization of omission. Furthermore, the thesis deals with the individual types of criminal omissions and questions associated therewith, including a note of the differences between the traditional dual distinction on the one hand and the newer triple distinction of criminal omissions on the other, while comprising the emphasis of shortcomings of the traditional approach and the advantages of the newer concept. Saying that, in the most part the thesis focuses on the newer approach towards criminal liability for omission and it describes the foundation points thereof in great detail, since I consider it to be the key subject of this dissertation. Reviewing the Non-Financial Reporting Directive : An analysis de lege lata and de lege ferenda concerning sustainability reporting obligations for undertakings in the EU

The Non-Financial Reporting Directive (“NFRD”),[1]is an important contributor to the European Union’s (EU) goal of creating a more sustainable future for all. By requiring large public-interest entities to report non-financial information relating to sustainability matters, the NFRD increases business transparency and gives stakeholders the opportunity to make more informed investment decisions, monitor corporate activities and initiate discussions based on current practices. The purpose of this thesis is to analyze the NFRD as it stands today and to analyze in what way the NFRD has the potential to improve by chiefly using the legal dogmatic method. The thesis reached its completion with an appropriate timing (January 2021) as the EU has announced its ambition to revise the NFRD by the first quarter of 2021. The conclusion drawn is that the NFRD should be revised on a series of points. Most importantly, reliability of the provided information should be secured through a stronger verification mechanism. Other areas for improvement concern the enlargement of the scope of the NFRD and the implementation of further measures securing comparable data.  [1]Directive 2014/95/EU.

PROTECTION OF PERSONALITY IN SCOPE OF LEGAL PHILOSOPHY AND APPLICABLE LAW 1. Summary We can see law from two main perspectives. Law is either complex of written regulations, which are prepared by human beings based on some interests or it is a complex of rules, which altough are written, but its nature are originating from higher normative system. First is a present perspective. Current law science is prefering valid law as complex of regulations published in statute book. What is not banned by law, is allowed. Though this law philosophy is leading to instability in society. Every year legislator is making hundreds of amendements and create new laws to cover new circumstances which appear in the society. Despite legislator effort is society further unsatisfied with legal state. Society claims that law is enforceable for those who are able to hire big law firms, which can find neccesary grey areas. Immanuel Kant among the first draw a problem between legality and legitimacy. But it is not only matter of legislator whether he acts legitimately or legally, but as well as of receiver of law norm.
