(International Commercial Law) / Legal judgements against unsuccessful defendants are handed down around the world on a daily basis, but their enforcement can become a complicated matter when the enforcement of the judgement must occur outside the territorial boundaries of the state from which it emanates. The purpose of this paper is to determine the enforceability of judgements of the European courts whereby the jurisdiction of the court was determined in terms of Brussels I. This paper begins with an in-depth discussion of the principles of recognition and enforcement of foreign judgements and the purpose it serves within the context of private international law. The second chapter discusses recognition and enforcement of foreign judgements in South Africa. The requirements and the criteria necessary to fulfil such requirements will be discussed under this heading. The third chapter considers the various grounds of jurisdiction available to the plaintiff in approaching a court of a European Union State. Each ground will be followed by a discussion on the enforceability of a judgement, founded on such a ground of jurisdiction, in terms of the South African principles of recognition and enforcements of foreign judgements and whether the requirements discussed in the preceding chapter have been met. Chapter 4 provides concluding remarks relating to the matters discussed in the body of this paper.

L'internement administratif en Provence - Côte d'Azur à la libération / Administrative internment in Provence‐Côte d’Azur during the liberationDuguet, Laurent 14 November 2013 (has links)
Le sujet de cette thèse traite des seize camps d’internement administratif implantés dans les six départements de la région Provence Côte‐d’Azur entre la Libération et décembre 1945. Dans cette région libérée, mais économiquement exsangue et encore en guerre dans sa partie orientale jusqu’en mai 1945, nous nous demanderons si l’internement administratif, un outil de l’épuration quasiment absent de l’historiographie régionale, est déconnecté des tensions propresà ce territoire ou si, au contraire, il les cristallise. Dans un premier temps, nous nous interrogerons sur la mise en pratique des textes normatifs qui donnent lieu à la création et à l’aménagement des centres de séjour surveillé dans la région R2 au cours des premières semaines chaotiques de la Libération. Une seconde partie porte sur l’organisation des campsdans tous ses aspects : les recherches de financement, le quotidien des internés, le ravitaillement et le transport, l‘état sanitaire, le recrutement du personnel et la sécurité des camps. La troisième partie propose une étude des populations internées ainsi qu’une approche sociologique constituée à partir d’un échantillon de 624 internés des centres de séjour surveillé de Saint‐Mitre (Bouches‐du‐Rhône), de Sorgues (Vaucluse) et de Saint‐Vincent‐les‐Forts (Basses‐Alpes). Avec lafin de la Seconde Guerre mondiale, cette thèse explore enfin la dissolution des camps et les nouvelles affectations de ces lieux, tout en abordant la question du risque mémoriel. / The subject of this thesis deals with 16 administrative internment camps planted in the six departments of the Provence Côte d’Azur region between the liberation and December 1945. In this liberated, but economically sapped region that was still at war in its eastern parts until May 1945, we ask ourselves if administrative internment, as a tool for purification practically absent in the region’s historiography, is it disconnected from the real tensions of this territory or if, on the contrary, it crystallized them. First of all we ask ourselves about how the various texts for creating and transforming the guarded centers in the region R2 during the chaotic days of the liberation came about. In the second part there is the examination of the organization of the camps in all their aspects: looking for finance, daily life for the internees, the transport, state of health, the recruiting of the personal, and the security of the camps. In the third part a study is proposed of the population of internees as well as a sociological approach made up from a sample of 624 internees from guarded centers in Saint‐Mitre (Bouches‐du‐Rhône), in Sorgues (Vaucluse) and in Saint‐Vincent‐les‐Forts (Basses‐Alpes). With the end of the second world war, this thesis explores the dismantling of the camps and the new uses of these sites, addressing thequestion of the risks of memorials.

O objeto da PPP pode ser a prestação total ou parcial de serviço público por um parceiro privado; o desempenho, por parceiro privado, de atividade de competência da administração pública (precedida ou não pela execução de obra pública); e a realização, por parceiro privado, de obra para a administração pública para a esta ser alienada, locada ou arrendada. No tocante à modalidade patrocinada, a PPP nada mais é que uma concessão de serviço público ou obra pública que envolve, adicionalmente à "concessão comum" (aquela definida nos termos da Lei 8.987/95), uma contraprestação pecuniária do parceiro público (poder concedente) ao parceiro privado (concessionário). Este Trabalho de Conclusão de Curso (TCC) sistematiza as informações existentes sobre a PPP patrocinada, contextualizando a importância do instrumento e definindo as condições mais propícias para sua aplicação. O objetivo é situar a PPP patrocinada como uma alternativa viável para a realização de impreendimentos em infraestrutura e em inclusão social que sejam estrategicamente prioritários, mas cujo retorno financeiro seja desconhecido ou de baixa expectativa, em um cenário de restrição à realização de gastos públicos.

This limited scope dissertation deals with the protection against torture in international law. The mechanisms which have been established over the years to protect individuals against torture are analysed. The principles of international customary law dealing with torture and the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UNCAT) have been examined against the failure by States to honour their obligations under the Treaty and other legal normative rules. This required deep exploration of the definition of torture and how States can compromise the rule of law by manipulating the definition of torture as contemplated by the Treaty or other instruments. Examples from the former US government highlight the ways in which domestic laws can be used and are continued to be used to allow the use of torture. Measures by South Africa in joining the international community in the fight against torture are also discussed as a case study. While all efforts have been made by the South African system to adopt desirable frame works on the protection of individuals against torture, the lack of education on torture remains the down fall of the system. The dissertation clearly explains that universal jurisdiction applies in respect of torture and this is recognised by both treaty law and customary law. Indeed despite all the current measures in place the use of torture persists. The research clearly reveals that countries hide behind their own laws to perpetrate acts of torture. It is then recommended that proper implementation of the legal structures, informed of the objectives of the structures, is essential in completely eradicating torture. / Public, Constitutional, and International Law / LLM

Cujo objetivo principal consiste em analisar os discursos e encaminhamentos presentes nos embates, que resultaram na Resolução UNIV. Nº 17 de 9 de dezembro de 2013 da UEPG. Os objetivos secundários consistem em contextualizar a elaboração da atual resolução, através de investigações das articulações e manifestações, que contribuíram para que os Movimentos Sociais fossem ouvidos durante o Conselho de Ensino, Pesquisa e Extensão e do Universitário, que ocorreu no final do ano de 2013. Por último, analisaremos o desdobramento da atual resolução, a cartilha informativa sobre as políticas de cotas na UEPG. Para este fim, na fundamentação epistemológica, discutiremos sobre a temática das políticas de cotas, através do eixo teórico-metodológico da Análise Crítica do Discurso (ACD), baseando-nos em Fairclough (2005 e 2008), Van Dijk (2001, 2008 e 2005), Magalhães (2005), Ottoni (2007), Pereira (2011), Sales (2012), Resende e Ramalho (2005), Pagano e Magalhães (2005) e Marcuschi (2008). Também refletiremos sobre a relação entre discurso e poder dentro de um sistema social de desigualdade racial, pautando-nos em: Van Dijk (2001, 2008 e 2010), Muniz (2009), Oliveira (2006), Moita Lopes (2013), Rivas e Diez (2014) e Blommaert (2006). A metodologia impregnada foi de base qualitativa, a qual também envolveu Estudo de Caso, Pesquisa Documental e ACD. Desta maneira, apresentaremos as análises que realizamos em diferentes tipos de textos que registraram o Conselho Universitário de 2013. Em nossas considerações, apresentamos algumas conclusões baseadas em tudo o que discutimos durante nossas reflexões teóricas, onde avaliamos a trajetória que a presente pesquisa seguiu até então, junto com algumas considerações acerca dos resultados obtidos. / It will be introduced trough this dissertation, the research of the master program started in the first semester of 2015, in the Postgraduate Programs of the Language Studies, of the State University of Ponta Grossa (UEPG). Which key objective consists in analyzing the discourses and directions present, in the follow Resolution UNIV. N° 17 of 19th, December 2013 of the UEPG. The supporting objectives consists on the contextualization and elaboration of the current resolution, trough investigations of demonstrations that contributed for the social movements to be heard at the meeting of the Conference of Education, Research and Extension and the University, that happened by the end of 2013. In conclusion, we will analyze what followed the current resolution, the introductory textbook about quotas at UEPG. To do so, in the epistemology we will discuss about the theme of quotas trough the theoretical and methodological axis of the Critical Analysis of Discourse (CDA), based in Fairclough (2005 and 2008), Van Dijk (2001, 2008 and 2005), Magalhães (2005), Ottoni (2007), Pereira (2011), Sales (2012), Resende and Ramalho (2005), Pagano and Magalhães (2005) and Marcuschi (2008). Also, we will be reflecting about the relation between discourse and power within a social system of the racial inequality based in, Van Dijk (2001, 2008 and 2010), Muniz (2009), Oliveira (2006), Moita Lopes (2013), Rivas and Diez (2014) and Blommaert (2006). The impregnated methodology was of qualitative base, which also implicated in Case Study, Documentary Research and CDA. By this mean, we will be introducing the analysis that we realized in different kind of texts that registered the the University Conference of 2013. In our considerations, we introduced some based conclusions in all that was discussed during our theoretical reflections, where we evaluate the trajectory that the present research followed until then, along with some conclusions of the obtained results.

importância, obtidas ao longo da história com base em grandes sacrifícios. Nesse contexto, a Emenda à Constituição n. 45, de 08 de dezembro de 2004, dentre outras
inovações, acrescentou ao rol dos direitos fundamentais elencados no art. 5, da nossa Carta Magna, o direito à razoável duração do processo e aos meios que garantam a celeridade de sua tramitação, bem como passou a exigir que nos recursos extraordinários seja demonstrada a repercussão geral das questões constitucionais discutidas no caso. Esse instituto foi regulamentado pela Lei n. 11.418, de 19 de dezembro de 2006, que, contudo, não exauriu totalmente a matéria e deixou lacunas que demandam alguns questionamentos acerca de sua aplicabilidade, recaindo sobre o Supremo Tribunal Federal o papel de selecionar quais temas se enquadrarão nessa nova ordem, isto é, cujos interesses ultrapassam a individualidade de cada uma das partes envolvidas nos casos concretos, o que poderá resultar no surgimento de conflitos entre o pensamento do Pretório Excelso e os interesses das partes, fazendo com que a rapidez na prestação jurisdicional oriunda de mais um dos mecanismos de filtragem processual, eventualmente possa

The role of express submission to jurisdiction under the Brussels I Regulation, Brussels I (Recast) and the Hague Convention on Choice of Court AgreementsMelamu, Seapei Diana 14 July 2015 (has links)

(International Commercial Law) / This essay seeks to look at the role of express submission to jurisdictjon under the Brussels I Regulation,lthe Brussels I (recast) Regulation2 and the Hague Convention on Choice of Court Agreements.3 The express submission to jurisdiction under the three instruments mentioned in the previous sentence refers to the situation in which parties to an international commercial contract include in their contract a court of their choice to govern any disputes that may arise between them. This designated court may or may not be situated in a country that is a member of the three instruments mentioned above. The purpose of this thesis is to determine what will occur when the court chosen is from a country that is not a member of either of the three instruments mentioned. We will first look at express submission and the role it plays in determining which court has jurisdiction. This section on express submission will provide the definition of express submission in the context of a contract which incorporates a choice-of-forum agreement between the parties who are engaged in an international commercial transaction. The thesis will view the role of submission in a common-law and civil-law country in light of express submission by contract. Finally, a distinction will be made between an exclusive and non-exclusive jurisdiction clause. A brief discussion ofthe Brussels Convention4 (The Convention) will be provided in order to present the fact that the Convention only applies when a choice-of-forum agreement in a contract has assoned thejurisdiction to a court of a country which is a member of the Convention. The Convention would not apply when a choice-of-forum agreement in a contract has assigned jurisdiction to the court of a country which is not a member to the Convention. ln order to determine whether the position has changed since the enactment of the Brussels I Regulation (Regulation) with regard to choice-of-forum agreements that designate jurisdiction to the court of a country in a nonmember state of the Regulation, provisions relating to express submission clauses will be discussed. A further discussion will be provided to ascertain whether the enactment of the Council Regulation (EC) No 4412001 of 22 December 2000 on jurisdiction and the recognition and enforcement ofjudgments in civil and commercial matters.

December 8, 2004, among other innovations, added to the list of fundamental rights listed in art. 5, of our Constitution, the right to a reasonable duration of the process and means to ensure the speed of its course, and began requiring in the extraordinary is that the passing of the issues discussed in the constitutional case.
This institute was regulated by Law No. 11,418 of December 19, 2006, which, however, not exhausted all the matter and left gaps that require some questions about its applicability, a burden on the Supreme Court's role to select which themes are put in this new order, that is, whose interests go beyond the individuality of each
party involved in specific cases, which could result in the emergence of conflicts between the thought of Praetorium Exalted and interests of the parties, causing the
