Protective therapy and preventive detention The Diploma thesis is concerned with two types of protective measures one being protective therapy and the other being preventive detention. The objective of this paper is to examine in a comprehensive manner the current law that concerns these two institutes of criminal law and to determine their faults and to include a supplemental recommendation. The paper also included a general overview of the protective measures according to the legal order of the Czech Republic. There are a compare and contrast of the penalties and interpretation of the legal terms as well as what both protective therapy and preventive detention have in common. Also, listed legislation for both institutes of preventive detention and protective therapy will be individually defined and under which conditions they are imposed. There is also stated the forms of the measures and their duration. The detention facilities in Brno and Opava are described as being a part of preventive detention. Legislation for the institute Terbeschikkingstelling (TBS) and forensic hospitals and how it deals with patients in the Netherlands also is mentioned. Este trabalho analisa os principais pontos controvertidos introduzidos pela Lei 12.403, de 4 de maio de 2011, no tocante à prisão preventiva, à luz dos modelos estrangeiros e do sistema interamericano de Direitos Humanos, sempre pautado pela busca de equilíbrio entre o garantismo e a eficiência. O principal objetivo do trabalho foi buscar subsídios para a interpretação das disposições internas controvertidas, pautando-se nos modelos e standards internacionais, com o intuito de se aprofundar o estudo do tema. Para se chegar ao contexto de edição da referida lei e melhor compreendê-la, analisam-se as influências que deram origem ao atual Código de Processo Penal e a sua fisionomia originária, que possuía, sobretudo no tema da prisão preventiva, contexto marcadamente autoritário. Após, são analisadas as diversas alterações pelas quais o Código sofreu em relação ao tema, sob o influxo de movimentos internacionais existentes no século XX, que culminaram com a edição da Lei 12.403. Em seguida, é analisada a Convenção Americana de Direitos Humanos, especialmente tendo em vista a jurisprudência da Corte Interamericana de Direitos Humanos, buscando verificar os standards internacionais relativos ao tema da prisão preventiva, de força vinculante e autoaplicáveis no direito interno. Também é analisado o direito comparado, buscando-se apoio em três países (Itália, Portugal e Chile), seja porque inspiraram diretamente a Lei 12.403, seja porque passaram por reformas semelhantes às introduzidas pela Lei 12.403. Com suporte na doutrina e jurisprudência destes países, clareiam-se diversos pontos controvertidos da nova Lei. Ao final, buscou-se apresentar algumas propostas para interpretação da prisão preventiva, sendo que, para tanto, foram propostos e analisados cinco modelos de prisão preventiva atualmente existentes no ordenamento nacional (prisão preventiva originária, derivada, esclarecedora, sancionatória e protetiva). / This work analyses the main controversial issues introduced by the Law 12.403, enacted on May 4th, 2011, regarding preventive detention in the light of foreign models and the Inter-American Human Rights System, always guided by the search for the balance between efficiency and the system of guarantees. The main objective was to seek grants for the interpretation of the controversial internal rules, always focusing on models and international standards, in order to deepen the study of the subject. To understand the context of the Law 12.403 and understand it better, we analyse the influences that gave rise to the current Criminal Procedure Code and its original physiognomy, which had, especially, on the issue of custody, a markedly authoritarian context. After, the text analyses the different changes the Code suffered, under the influence of international movements in the twentieth century, culminating in the enactment of the Law 12.403. Then, this work analyses the American Convention on Human Rights, especially in the view of the jurisprudence of the Inter-American Court of Human Rights, seeking to verify the international standards related to the subject of preventive detention, which is binding and self-applicable internally. It is also analysed the comparative law, seeking support in three countries (Italy, Portugal and Chile), either because they directly inspired the Law 12.403 or because they went through similar reforms as those introduced by the Law 12.403. Supported in the doctrine reforms and case law of these countries, many controversial aspects of the new law are lightened up. At the end, we present some proposals for the interpretation of the provisional detention, and, the five detention models currently existing in the national law (original, derived, clarifying, punitive and protective detention), are analysed.

Current research on girls and delinquency has brought to awareness the often
stressful and traumatic lives of girls. Furthermore, the last three decades have seen an
increase in the proportion of girls entering the Juvenile Justice System and an increase in
the proportion of girl’s court ordered to attend military structured treatment programs.
Developed with boys in mind, many researchers in the area of female delinquency believe that military structured treatment programs are less effectiveness for girls. Thus,
the goal of the current study is to consider the experience of girls in a military structured
residential treatment facility. Additionally, this study sought to answer the following questions posed by the administrative personnel of this program:
1) Why do staff members report more difficulties when working with the girls?
2) Why are girls more emotionally labile than boys?
3) What changes can be made to the program to increase girls’ success in the
program?
Participants in this study were referred to a military structured residential treatment program. At the time of the study, four girls, ages 14 to 16, participated in the
study. In addition to the girls’ participation, staff members including drill instructors,
program officers, teachers, health professionals, and administrative staff participated in the study. The current study utilized an ethnographic approach to explore and identify information that may be useful in better understanding the research questions. The
Listening Guide Method (Brown & Gilligan, 1992) was utilized to conduct a narrative analysis of the interviews with both the girls and staff members.
Results demonstrated that while in the program, services provided were uneven in both scope and quality. For example, lack of training among staff members resulted in missed opportunities to teach the girls necessary skills that would enable them to tolerate emotional distress while in the program and at home. In order to better meet the needs of
the girls, it is recommended that this program strive to integrate both military and therapeutic programming, and educate and train all its staff members in the delivery of gender-responsive programming. / text

In this thesis we will describe the ways in which detainees have dealt with
their experience of detention using various coping skills. Through using the psychological theory of the hardy personality and combining this with various theological categories, we will see how they could deal with the stress of detention. In this way then it is hoped that their experiences will serve as the beginning of a local emergent theology of detention experiences. We will look at how they exercised commitment, and this will be examined by the role which faith plays as an agent of commitment. Faith will be interpreted as a symbol. We will, therefore, look at the role that dreams and visions, reading scripture, praying, and worshippinq played in helping the detainees deal with the stress of detention. The control component of the hardy personality will be dealt with by showing how by exercising forgiveness, creating justice, and using community, detainees were able to feel they had control in this stressful situation. The hardy personality theory is based on an existential theory that says that life is constantly changing. We will see how Christian detainees are able to cope with change by challenging their situation through the use of a theology of hope. In concluding this study of detention we look at the real evil of detention. We will, therefore, look at the negative effects of detention that these detainees were subjected to as part of their experience of detention. We will look at the psychological categories of dread, dependency, and debility. These categories are seen as companion parallel concepts to commitment, control, and challenge. Having done this, and bearing in mind that one of our aims in doing this study is to see if we are able to provide some ideas towards a pastoral model for dealing with the past hurt of detention, we then look at the Truth and Reconciliation Commission and the challenges it poses for the churches. The research was conducted with teenagers who are fulfilling socio educational deprivation of liberty at Centro de Atendimento ao Menor (CENAM), located in Aracaju (SE), aiming to understand how the relationship of incarcerated adolescents with mathematical knowledge is. It is observed in several studies that the discipline of mathematics is considered difficult to learn, but this knowledge is of great importance, because its use is a constant and essential requirement not only for the understanding of reality as to the construction of citizenship. This research was characterized as a guided study in the theoretical framework of the relationship with Saber (RS) as well as research on the relationship with the mathematical knowledge. Methodologically, this study enrolled in a context of a case study and has been a qualitative approach. The study subjects were internal adolescents enrolled in classrooms within this unit from 1st to 4th stage (defined as grade 1 /2 year to 4 th grade / year 5), in the form of teaching EJA - Youth and Adults. Also resorted to four (4) polyvalent teachers (one on each phase) and a pedagogical coordinator. It is noteworthy that the main subject of this research are the teenagers. For data collection we used semi-structured interviews with adolescents, the questionnaire for teachers and educational coordinator, application of balance of knowledge, analysis of the records of pedagogical supervision of adolescents and free observation. The research has shown that school for students / home is an important place for learning, even when in practice it is not observed when considering the age / grade discrepancy of these subjects. Regarding Mathematics, teenagers love this discipline, but this binding estimates, especially at the discretion of its usefulness in everyday life and the contents that represent numbers, like the four operations. This limitation of content in mathematics is understandable, as these teens did not exceed the school year as the regular age. At the same time it is interesting the relationship between recognition of mathematics, and how they use this knowledge to learn everyday situations. When we put the issue of school within a socio educational unit of deprivation of liberty, the teens relate the opportunity to leave the ALA to have a little freedom going to the classroom, they cannot have a relationship of desire in learning, performing the same tasks with dedication. There is no differentiation between the relationship of students / inmates and the mathematical knowledge within an inpatient unit compared with mathematics learned in school free of deprivation. These students continue to highlight this mathematics as a subject of greater interest in their learning, always mediating this importance with the increased possibility of applicability in everyday life. / A pesquisa foi desenvolvida com adolescentes que estão cumprindo medida socioeducativa de privação de liberdade no Centro de Atendimento ao Menor (CENAM), localizado no município de Aracaju (SE), objetivando compreender como se constitui a relação dos adolescentes privados de liberdade com o saber matemático. Observa-se em várias pesquisas que a disciplina de Matemática é considerada de difícil aprendizagem, contudo este saber é de grande relevância, pois sua utilização é uma exigência constante e imprescindível não só para a compreensão da realidade como para a construção da cidadania. Essa pesquisa se caracterizou como um estudo pautado no quadro teórico da Relação com o Saber (RS) assim como em pesquisas sobre a relação com o saber matemático. Metodologicamente, esta pesquisa se inscreveu num contexto de estudo de caso e realizou-se numa abordagem qualitativa. Os sujeitos da pesquisa foram os adolescentes internos matriculados nas salas de aula dentro desta unidade da 1ª à 4ª etapa (entende-se 1ª série/2º ano a 4ª série/5º ano), na modalidade de ensino da EJA- Educação de Jovens e Adultos. Recorremos também a 4 (quatro) professoras polivalentes (uma em cada etapa) e a uma coordenadora pedagógica. Vale ressaltar que os sujeitos principais desta pesquisa são os adolescentes. Para coleta de dados utilizamos entrevistas semiestruturadas com adolescentes, questionário para os professores e coordenadora pedagógica, aplicação do balanço do saber, análise das fichas de acompanhamento pedagógico dos adolescentes e observação livre. A pesquisa demonstrou que a escola para os alunos/internos é um espaço importante de aprendizagem, mesmo quando, na prática, isso não é observado quando considerada a defasagem idade/série destes sujeitos. Em relação à Matemática, os adolescentes gostam dessa disciplina, mas vinculam essa estima, principalmente, ao critério de sua utilidade no dia a dia e aos conteúdos que representam números, como as quatro operações. Essa limitação de conteúdos na Matemática é compreensível, pois esses adolescentes não ultrapassaram os anos escolares conforme a idade regular. Ao mesmo tempo é interessante a relação entre o reconhecimento da Matemática, e a maneira como eles utilizam o conhecimento deste saber para situações cotidianas. Quando colocamos a questão da escola dentro de uma unidade socioeducativa de privação de liberdade, os adolescentes relacionam a oportunidade de sair da ALA para ter uma pequena liberdade indo para a sala de aula, não conseguem ter uma relação de desejo na aprendizagem, mesmo executando as tarefas com dedicação. Não existe diferenciação a respeito da relação dos alunos/internos com o saber matemático dentro de uma unidade de internação em comparação com a Matemática aprendida numa escola livre de privação. Estes alunos continuam destacando essa a Matemática como uma disciplina de maior interesse em sua aprendizagem, sempre mediando essa importância com a possibilidade maior de aplicabilidade na vida cotidiana.

The assumption was made that detention administrators can supply relevant input to study.

Protective therapy and preventive detention Abstract The aim of the diploma thesis is to provide a comprehensive description of protective measures with an emphasis on two specific protective measures, namely protective treatment and security detention. These are criminal sanctions that are the result not only of a criminal offense, but also of an otherwise criminal offense. The basic function of these measures is not only to protect society from dangerous persons who have committed harmful acts on the basis of their mental disorder, sexual deviance or dependence on alcohol or other addictive substances, but also therapeutic effect on the personalities of these offenders so that their danger to society as minimized as possible and allowed them to return to normal life. The introductory chapters contain the basic characteristics of protective measures, their comparison with penalties and a brief description of the remaining protective measures, ie the institute will prevent things, prevent part of the property and protective education. The following chapter deals with the basic concepts that are closely related to both institutes, and whose understanding is crucial for grasping the whole issue.
