Právní a ekonomické aspekty digitálních měn se zaměřením na měnu Bitcoin / Legal and economic aspects of digital currencies with a focus on the Bitcoin

The aim of this thesis is to describe the basic functional principles of digital cryptocurrencies and its economical and legal aspects. Digital cryptocurrencies are young and dynamic phenomenon in financial transactions, which represents an alternative to the traditional national currencies. This thesis is divided into three main parts. In the first part the digital currencies and its function is discussed, the economical aspects of digital currencies and its impact on the theory of money are the main theme of the second part. The final, third part is discussing the legal aspects of digital currencies within the Czech legal system. The first part of this thesis introduces digital currencies, the operation of the whole system and also the basic terminology related to the digital currencies, which is necessary for understanding the subject. These essential aspects and features are being mostly illustrated on the case of the oldest and most famous digital currency - bitcoin - in favour of clarity. The second part of this thesis is discussing the economical aspects of digital currencies. The opening of this part is dedicated to the terminology, particularly terms "money" and "currency". Stablecoins: the possibility of a cryptocurrency becoming the future means of payment / Stablecoins: möjligheten att en kryptovaluta blir framtidens betalmedel

The emergence of stablecoins and their current implementations share many similarities to the American free banking era. This was an era with economically inefficient money and payment systems, where banks issued private money that were fully redeemable in theory but not always in practice. As of today, parts of the monetary and payment systems can also be considered inefficient, and a digital currency such as a stablecoin could provide significant improvements in areas such as cross-border payments, financial inclusion, as well as contribute to a more robust monetary system.  This thesis aims to help contribute insights into how the future payment systems may look like, with a specific focus on stablecoins and central bank digital currencies (CBDCs). The emergence of the two technologies are closely interlinked, and are currently in an early state of coexistence. This qualitative study investigates the sentiment regarding the future development of stablecoins and their possible continued coexistence with CBDCs. Semi-structured interviews were held with participants from three categories of the Swedish corporate landscape; cryptocurrency innovators and investors, state representatives, and corporate representatives. The main conclusions were was that in the short term, regulations will be a key enabler for continued stablecoin development. There is currently a lack of clarity and guidelines which is making it hard for generally accepted stablecoins to be established. Furthermore, the general consensus is that stablecoins and central bank digital currencies will co-exist in the future monetary system in the long-term, where each technology will have different use cases. / Framväxten av stablecoins och dess nuvarande implementationer delar många likheter med den amerikanska ”free-banking” eran. Detta var en tidsepok med ekonomiskt ineffektiva pengar och betalsystem, där banker emitterade pengar som skulle vara fullt inlösningsbara teorin, men inte alltid i praktiken. Även idag kan delar av penga- och betalsystemen anses vara ineffektiva, och en digital valuta såsom en stablecoin skulle kunna bidra med betydande förbättringar inom områden såsom utrikesbetalningar, finansiell inkludering, samt bistå i utvecklingen av ett mer robust pengasystem. Denna uppsats ämnar bidra med insikter om hur framtidens betalsystem kan se ut, med ett specifikt fokus på stablecoins och centralbanksvalutor (eng. central bank digital currencies, CBDCs). Framväxten av de två teknologierna är nära relaterade, och för närvarande samexisterar dessa i ett tidigt stadie. Denna kvalitativa studie undersöker sentimentet kring den framtida utvecklingen av stablecoins och dess möjliga fortsatta samexistens med centralbanksvalutor. Semi-strukturerade intervjuer hölls med deltagare från tre kategorier av svenskt näringsliv: innovatörer och investerare inom kryptovalutor, företrädare för staten, samt bolagsrepresentanter. De huvudsakliga slutsatserna var att på kort sikt kommer regleringar vara viktiga för att möjliggöra fortsatt utveckling av stablecoins. I dagsläget saknas det klarhet och riktlinjer vilket gör det svårt för en generellt accepterad stablecoin att utvecklas. Vidare så är den generella uppfattningen att stablecoins och centralbanksvalutor kommer samexistera i framtidens betalsystem, då de båda teknikerna kommer ha olika användningsområden

Virtuella valutor : riskanalys av nya betalningsmedel / Virtual Currencies : Risk Analysis of New Means of Payment

Historien om betalningsmedel vänder under 2010-talet blad och börjar på ett nyttkapitel. Nästa steg i den monetära utvecklingen sker när de virtuella valutorna ökar ianvändning. Den virtuella valutan Bitcoin introducerades av Satoshi Nakamato år2009 och är en digital valuta, vilket innebär att den inte är kopplad till någon fysisktillgång med rättslig innebörd. När ett nytt betalningsmedel introduceras ärfundamentala faktorer gällande samhällets acceptans och nyttjande ett ekonomisktpussel. Hur kommer det sig att individer byter verkliga varor mot en papperssedel, ettmynt eller en elektronisk signal? Att inneha och aktivt använda nya betalningsmedelsom virtuella valutor medför risker som många inte är bekanta vid. Organisationeroch konsumenter som öppnar upp portarna för nya betalningsmedel måste ha kunskapom dess konsekvenser, både positiva och negativa. Studien syftar till att belysa derisker som uppstår när nya betalningsmedel som Bitcoin gör entré. Forskningsfrågankring vilka risker innehav och nyttjande av virtuella valutor medför besvaras genomen kvalitativ analys av främst forskningsartiklar. Vår studie tyder på att riskerna kringvirtuella valutor som Bitcoin relaterar till förtroende för betalningsmedlet. De flestariskerna uppstår vid innehav av Bitcoin och relaterar inte till tekniska faktorer. / The history of means of payment is taking new shape during the 2010:th decade andstarts on a new chapter. The next step in the monetary evolution will take place oncevirtual currencies become more frequently used. The virtual currency called Bitcoinwas introduced by Satoshi Nakamoto in the year of 2009 and is a digital currency,which means that it is not connected to a physical good with a forensic purpose.When a new mean of payment is introduced fundamental factors regarding theacceptance of society and utilization becomes a financial puzzle. How can it be thatindividuals exchange physical goods for a paper bill, a coin or just somethingelectronic? To possess Bitcoin and to use new means of payment on a frequent basisbring risks many users are not familiar with. Organizations and consumers whomopen up their gates to new means of payment need to gain knowledge ofconsequences both positive and negative. The purpose of this study is to highlight theaforementioned risks, which arise from the fact that new means of payment likeBitcoin is introduced. The research issue regarding which risks may arise frompossession and usage of virtual currencies are concluded by a qualitative analysisresearch containing mostly scientific articles. Our study depicts that the risksassociated with virtual currencies like Bitcoin, are all somehow related to the trust forthe specific mean of payment. Most risks arise from actually possessing a Bitcoin andhence not as much related to the technological element.

Aktuální trendy v bezkontaktním placení, přínos Apple a analýza trhu ČR včetně preferencí spotřebitelů / Actual trends in contactless payment, contribution of Apple and analysis of market in the Czech Republic including consumer preferences

The main objective of this work is to analyze current trends in contactless payments and consequently implement it on the Czech market. On this base this thesis deals with several wearable devices. Furthermore on this base is also working in the application part, where is one of the secondary objectives of the work to determine consumer preferences on the market of the Czech Republic. One of the secondary objectives is create a brief summary of the history of payment cards and within the sociological aspect to find a certain analogy in introducing innovations in the field of payments towards current trends in contactless methods. Within the secondary objectives there are simultaneously defined key assumptions forms of payment for success on the market. The following section focuses on electronic payments. Specifically, it deals with trends in electronic payment services, where for its implementation aren´t required the physical presence of the card or chip. Furthermore there are analyzed alternative paths in the current payment methods, namely peer-to-peer platforms. On these platforms is based shared economy, which also represents an interesting potential for the possible development of payment field. Chapter with alternative methods for cashless is finished by analyzing digital currencies. The hypothesis of this thesis is whether Apple can have an impact on the area of contactless payments and how it can affect the entire sector. Part of the hypothesis is the claim that Apple manages to change the area of contactless payments, such as happenede in the music industry with iTunes and then in the telecommunications industry with a revolutionary iPhone. Potential benefit of Apple is defined by the method of description. Potential contribution of Apple Pay is characterized by logical deduction base on previous relationships. Conclusion is by quantitative research method, namely through the consumer research, assessed consumer preferences in the Czech Repulic and is also evaluated the hypothesis of potential benefits of Apple contactless payments.
