The transformation of the role of the judiciary in the 20th and 21st centuries Abstract This work is about the fundamental questions of law, judges, society, and liberal democracy from theoretical social perspective. This study is mainly from the fields of state science and political philosophy. Due to the complexity of the topic, I decided to devote the first chapter to the philosophical starting points. The second and third chapters deal with the role of the courts as political actors. To a large extent, I deal with the criticism of this phenomenon. Important sections are those on the essence of democracy, policies and the role of experts in the process of governance. Equally important is the critical view of human rights inflation in modern societies. In the last chapter, I focus on the various forms of doctrine of judicial restraint, which I see as a realistic solution to the outlined problems. Frequently, the argumentation for criticizing the Judicial Restraint is the creation of a cartoons and its subsequent majestic defeat. I think that this approach is not fair, because in my opinion the judicial restraint can be debated objectively without prejudices and without a priori rejection. Comportamento reprodutivo e cooperação no ciclídeo neotropical Laetacara sp /

No entanto, as espécies neotropicais são pouco conhecidas em relação às africanas. A maior parte dos ciclídeos neotropicais exibe cuidado biparental com predomínio da monogamia (diferentemente dos ciclídeos africanos cujo cuidado intrabucal uniparental prevalece). Laetacara sp. é uma nova espécie de ciclídeo sul-americano encontrada em abundância em riachos bastante degradados. A ocupação desses ambientes pode ser favorecida pelas estratégias reprodutivas da espécie. Assim, neste estudo descrevemos o comportamento reprodutivo de Laetacara sp. para explorarmos sua importância na determinação do sucesso dessa espécie em ambientes degradados. Inicialmente, descrevemos as fases e as unidades do comportamento reprodutivo (Capítulo 1). Em seguida, quantificamos a cooperação entre machos e fêmeas ao longo do ciclo reprodutivo (Capítulo 2). O comportamento reprodutivo de Laetacara sp. é iniciado com a defesa territorial pelo macho e envolve a formação do casal, construção de ninho, acasalamento e cuidado biparental dos ovos e larvas no substrato. O cuidado parental foi dividido em Manutenção (ventilação e limpeza dos ovos e larvas) e Defesa (interações agressivas contra intrusos nas fases estacionárias e livre natante). Na fase pré-acasalamento, os machos investiram mais em defesa territorial, enquanto as fêmeas investiram mais em construção de ninhos. Na fase ovo/larva, as fêmeas permaneceram mais tempo próximas à prole do que os machos, sem diferir na fase seguinte. Porém, os pais permaneceram por mais tempo junto à prole natante, indicando que nessa fase os filhotes são mais vulneráveis. However, neotropical species are still little studied, in comparison to African species. Most Neotropical cichlids are monogamous and biparental care prevails (contrary to African cichlids where mouth brooding and uniparental care are the rule). Laetacara sp. is a new South American cichlid mainly found in degraded streams. Species occupation of such environments may be facilited by reproductive strategies. Thus, the aim of this study was to describe the reproductive behaviour of Laetacara sp. to evaluate its daptative value for living successfully in degraded environments. In a first step, the phases and units of reproductive behaviour were described (Chapter 1). In a second step, cooperation between males and females during reproductive cycle was quantified (Chapter 2). Reproductive behaviour of Laetacara sp. started with territorial defense by males and involved pair bonding, nest building, mating and biparental care of eggs and wrigglers on the substrate. Parental care was divided into Nurturance (fanning and cleaning eggs and wrigglers) and Defense (aggressive contests against intruders in the brood stationary and free-swimming phases). In the pre-spawning stage, males invest more in territory defense while females invest more in nest building. In the egg/larva phase, females remains close to the brood more than males, but time spent near the brood was similar for both parents in the free-swimming phase and higher than in the previous phase, which indicates higher vulnerability of the fry. <p>Denna uppsats är en undersökning av barns aktiva deltagande i rollek. Syftet är att försöka förstå vilka strategier barn i förskolan kan använda sig av för att nå ett aktivt deltagande i rolleken samt hur rollfördelningen sker i rolleken. Vi vill dessutom undersöka vilken syn förskolepersonal har angående barns samspel och deltagande i leken. Frågeställningarna för uppsatsen lyder; Vilka strategier kan barn använda sig av för att få en aktivt deltagande roll i rolleken? Vilka faktorer styr och ligger bakom rollfördelningen i leken? På vilka sätt fördelas rollerna i rolleken? Vi använde oss av två kvalitativa metoder för att genomföra vår undersökning. Dessa var skriftliga intervjuer via e-post och observationer med löpande protokoll. Resultatet visar att barn använder sig av olika strategier för att nå ett aktivt deltagande i leken. Vilka strategier barn använder kan bero på deras ålder, språkutveckling, social förmåga samt lekfärdigheter. ARBETSLEDARROLLEN - UR ARBETSLEDARNAS PERSPEKTIV / SUPERVISORS’ ROLE – FROM THE SUPERSVISORS’ PERSPECTIVE

This bachelor thesis is intended to point out differences within the supervisors’ role and contribute in making the role more attractive. At present the information about how the supervisors’ perspective varies on the supervisors’ role and the introduction to it depending on work experience and education is unknown. Further it was investigated why the supervisors’ role is seen as an entrance to the building industry and how to develop the role to encourage the supervisors to stay longer within it. In the collection of data we have been interviewing supervisors and studying literature. In total we have interviewed 14 supervisors in the region of Jönköping and the result of the literature study has subsequently been used to substantiate the outcome of the interviews. The selection of interviewees was partly based on the supervisors’ work experience and educational level but consideration regarding sex and age was also taken. The result showed that the supervisors experience their role as a diverse, social and coordinating role and the main work involves staking, preparation for upcoming activities, answering questions and solving problems that occur. Furthermore it appeared that the supervisors’ role varies in work tasks as well as what is considered positive, negative and difficult. Moreover varies the role in the vision of the leadership and the experience of response from co-workers. Although it also appeared that the variations may not always depend on work experience and education level but also on the supervisors’ personality. The supervisors, who have experience from being craftsmen, were considered to have several advantages, for example concerning practical understanding, detecting inaccuracies and delays and that they more easily get accepted by the co-workers. The result indicated that the supervisors are experiencing their first months in the role differently depending on work experience and educational level. Most of them also believe that there are opportunities for improvement concerning the introduction period. The supervisors who have experience from being craftsmen felt prepared for the role to a greater extent than those supervisors who have an engineering degree. It were primarily those with an engineering degree who feel the need of a mentor but the majority of the supervisors reckons that if mentorship is to be used the mentor should be working at the same place as the supervisor. In addition, it was shown that the supervisors enjoy their role but the supervisors who have an engineering degree see the role as more attractive than those with a background as craftsmen. Possible enhancements mentioned were improved wage development, increasingly greater responsibility, better economic planning and more variation in the types of projects and tasks. The conclusions drawn were that the supervisors’ role varies in the aspect of the role itself and of the experience from the introduction period as well as that there are certain requests for mentorship and that there are opportunities to introduce changes which may make sure that the supervisors remain longer in their role.

Petr Pavlík, Ph.D. PRAHA 2011 2 ABSTRACT Split-up of family is not a gender-neutral phenomenon. In most cases, children are confided to the care of mother after the split-up. The family law recognizes also other forms of care, but both joint-custody parenting is rarely used in the Czech Republic. However, there is a tendency to change the state affairs in recent years. Supporters and opponents of joint custody voice their arguments in the public sphere, but relatively little attention has been paid so far to those who are supposed practice joint custody parenting, the parents. That is why, the focus of my research has been a comparison of experience of mothers and fathers practicing joint custody of their children in the Czech Republic. Concretely, I wanted to study whether, similarly with foreign studies, the mothers and the fathers experience joint custody differently. For example, whether the fathers have received a bigger support from their family and friends than have the mothers and whether the fathers experience less financial stress than the mothers.
