Electoral systems: critical survey

Ever since union - and before - black South Africans have been excluded from parliament, provincial councils and other law-making bodies. This means that blacks have never participated in the electoral process. The voting (electoral) system - its nature and workings - remained the sole preserve of white political parties and the Apartheid government of the day. As a result of a conjuncture of circumstances (as per Harare Declaration), the African National Congress and the apart0heid government are now engaged in talks. Hopefully this will ultimately lead to negotiations towards a new Constitution which will make provision for a single unitary, non-racial, non-sexist South Africa with universal franchise on one single common voters roll and one person one vote. Part of the process of constitution-making for such a South Africa, will be the working out of a system of voting, an electoral system, which would be appropriate for the country. The African National Congress has recognised the need for a multi-party system, the right of all other political forces and organisations to organise and to compete for power on the political terrain. The ANC also recognises that all parties enjoying significant support should have the right to be represented in a Constituent Assembly and parliament. The question which needs to be resolved is: What would be an appropriate electoral system to achieve the stated objec0tive? It is to place the issue before the people of our country and to ensure participation at the widest levels by all the organisa0tions of the people in the process of constitution-making (including formulating and/or agreeing upon an acceptable system of voting), that the African National Congress, Community Law Centre (University of the Western Cape) and the Centre for Development Studies have organised a conference to be held in the Western Cape on 2 - 4 NOVEM0BER 1990. This conference will not be a decision-making one. nor will there be any resolutions at the end of the conference. The objective is to facilitate meaningful discussions throughout the country. To facilitate this process, we present a discussion document entitled "ELECTORAL SYSTEMS: A CRITICAL SURVEY" which has been prepared by Professor KADER ASMAL, a member of the Constitutional Committee of the ANC and Professor of Law at Trinity College, Dublin. This monograph is the result of the extension of a Master's thesis which was submitted to the Department of Political Science of the University of Wisconsin in 1925. The present work is divided into three parts. The first four chapters which deal the legal procedure of Parliamentary elections in England embody the corresponding part of the original essay with some changes. The next four chapters which describe the working of the electoral system are entirely new additions and they were written after the author had spent one year in England in personal investigations. The last three chapters which treat the corrupt and illegal practices and the election petitions are the result of reconstruction from that part of the old dissertation which covers the same ground.

Rationalizing Voter Suppression: How North Carolina Justified the Nation's Strictest Voting Law

In recent years, there has been a dramatic increase in instances of Republican-dominated state legislatures proposing changes to election law that some see as protecting electoral integrity and others understand as intended to suppress votes of traditionally Democratic constituencies. This thesis is a detailed collection of the rationales used to justify these changes, as examined through a case study of North Carolina’s enactment of the omnibus Voter Information Verification Act of 2013 (VIVA). By also including the arguments proffered during the legislative process by opponents of the law, and after evaluating the merits of the arguments on both sides, I find the rationales used to justify the law’s provisions to be unconvincing and misleading. This study confirms the speculation that new election law restrictions are first and foremost a Republican attempt to gain partisan advantage. Given this conclusion, I offer suggestions as to what factors might eventually shift the current era of election law legislation from one of restrictions, to one focused on creating efficient, accessible, modernized electoral systems that inspire citizen confidence regardless of partisanship.

Rinkimų institutas yra labai svarbus elementas konstitucinėje demokratijoje. Demokratinėje visuomenėje suvereniteto šaltinis – Tauta, suteikia galią valstybės valdžios institucijoms. Formuojant politines atstovaujamąsias institucijas rinkimų būdu, reikia užtikrinti tam tikrų fundamentalių taisyklių laikymąsi. Pagrindiniai principai yra šie: visuotinė rinkimų teisė, lygūs rinkimai, laisvi rinkimai, slaptas balsavimas ir tiesioginiai rinkimai. Šių principų turinį sudaro smulkesni reikalavimai, kurių analizė yra svarbi siekiant suprasti principo esmę. Rinkimų principai suponuoja ne tik teises, bet ir tam tikras rinkėjo pareigas. Pagrindiniai rinkimų teisės principai yra dažnai vadinami Europos rinkimų arba konstitucinės teisės paveldu. Rinkimų teisės principai, kuriais vadovaujantis turi būti organizuojami ir vykdomi rinkimai, yra įtvirtinti įvairios juridinės galios nacionaliniuose teisės aktuose, taip pat tarptautinės teisės normomis. Tik įtvirtinimo nepakanka, turi būti sukurtas teisės normų aparatas, kuris padėtų užtikrinti šių principų įgyvendinimą ir apsaugą. Lietuvos Konstitucijoje ir rinkimų įstatymuose yra įtvirtinti visi šie principai. Stabilus apsaugos aparatas negali susiformuoti dėl dažnai keičiamų rinkimų įstatymų nuostatų. [toliau žr. visą tekstą] / Election law is the main element of the constitutional democracy. In democratic society the Nation, as the holder of suverenity, grants power to the authority institutions. Fundamental rules must be implemented during the formation of political representative bodies. Fundamental principles are: universal election, equal election, free election, secret suffrage and direct suffrage. These principles consists of narrower regulations, which are important for the nature of the main principle. Electors’ rights and duties originate from principles of the election law. Main principles of the election law are sometimes called Europe’s electoral or constitutional law heritage. These principles are the main rules for organizing and administrating the process of election. Constitutional democracy requires that national authoritues should povide effective legal basis to implement and safeguard these rules. These principles are regulated in the Constitution of Lithuania and election statutes. Well-established safeguard apparatus can not be created, since statutes are often changed. This research is focused on the content of principles of the election: it discloses and gives broader understanding of the compaund elements of the principles; the research focuses on the problems deriving from the implementation and safeguard of the main principles.
