'The centre cannot hold': resistance, accommodation and control in three Australian call centres

Drawing upon case studies of three organisations operating six call centres in Australia, this thesis explores the manifestations and interplay of employee resistance and accommodation in response to five facets of employer control: electronic monitoring; repetitious work; emotional control; the built environment; and workplace flexibility. Accommodation refers to the ways workers protect themselves from and adapt to the pressures that make up their day-to-day experiences of work. Accommodation, unlike resistance, which implies opposition to control, may superficially resemble consent to control. I argue that resistance and accommodation are not polar opposites; rather they are both reflections of the conflict and tensions that lie at the heart of the employment relationship. At the study sites, employees utilised resistance and accommodation both separately and concurrently. An explanation of these seemingly contradictory responses and of the links among accommodation individual resistance and collective resistance lies in the concept of ???self???. In this thesis, ???self??? refers to workers??? perceptions of fairness, dignity and autonomy. I examine how these notions frame worker discontent and promote employee solidarity. ???Everyday resistance???, a concept first developed by Scott (1985) in relation to peasant struggles, is employed to highlight the existence of subterranean struggles in workplaces that otherwise appear to be harmonious. At the study sites, everyday resistance was a multi-faceted, widely employed strategy whose strength lay primarily in its immediate impact. There was, however, no necessary sequential development from accommodation, through everyday resistance to overt, formal forms of conflict. What was evident was that multiple responses to employer control could co-exist and inhibit or promote one another. But it was through organised collective resistance that more formalised gains were made and widely held grievances addressed. I suggest that, although everyday resistance may lay the groundwork for more formal struggles, one should not conclude that traditional collective resistance is ???genuine??? resistance and everyday resistance is simply a second-best prelude to it. Although conflict is always present, its intensity differs. If we are to understand the complexity of worker responses to managerial control, we need to expand the theoretical frameworks within which we analyse and interpret conflict.

Electronic workplace surveillance and employee privacy : a comparative analysis of privacy protection in Australia and the United States

More than a century ago in their definitive work “The Right to Privacy” Samuel D. Warren and Louis D. Brandeis highlighted the challenges posed to individual privacy by advancing technology. Today’s workplace is characterised by its reliance on computer technology, particularly the use of email and the Internet to perform critical business functions. Increasingly these and other workplace activities are the focus of monitoring by employers. There is little formal regulation of electronic monitoring in Australian or United States workplaces. Without reasonable limits or controls, this has the potential to adversely affect employees’ privacy rights. Australia has a history of legislating to protect privacy rights, whereas the United States has relied on a combination of constitutional guarantees, federal and state statutes, and the common law. This thesis examines a number of existing and proposed statutory and other workplace privacy laws in Australia and the United States. The analysis demonstrates that existing measures fail to adequately regulate monitoring or provide employees with suitable remedies where unjustifiable intrusions occur. The thesis ultimately supports the view that enacting uniform legislation at the national level provides a more effective and comprehensive solution for both employers and employees. Chapter One provides a general introduction and briefly discusses issues relevant to electronic monitoring in the workplace. Chapter Two contains an overview of privacy law as it relates to electronic monitoring in Australian and United States workplaces. In Chapter Three there is an examination of the complaint process and remedies available to a hypothetical employee (Mary) who is concerned about protecting her privacy rights at work. Chapter Four provides an analysis of the major themes emerging from the research, and also discusses the draft national uniform legislation. Chapter Five details the proposed legislation in the form of the Workplace Surveillance and Monitoring Act, and Chapter Six contains the conclusion.

The aim of this diploma thesis is to describe and explain the main features of implementation practice of house arresting in the Czech Republic and consequently propose possible ways out in relation to subsequent (and successful) continuing of implementation procedure. In terms of theory there are reflected approaches of criminal law, criminology, penology, sociology and public policy. Within the research work, the space had been given to those participants immediately concerned and affected with house arresting agenda - judges, prosecutors, probators, ministry officers (Ministry of Justice), attorneys, watchdog organizations and experts on criminal law from academic sphere. House arresting had entered valid legal regulations in connection with new criminal law effectual since 1.1.2010. This new regulation substituted the pristine penal code. In new criminal law is significant shift of accent from tangible to formal conception of culpability. By the analysis of key participants of objective policy, identification of possible goals, adumbration of solution options is finally formulated optimal version. In terms of this version are reflected possibilities of evaluation and monitoring. Essays on the Economics of Policing and Crime

There is growing demand for reforms to the U.S. criminal justice system. Nevertheless, there are significant questions and relatively few answers. This dissertation studies multiple U.S. criminal justice system issues using detailed administrative data from Cook County, Illinois: Does policing the police increase crime? Does the composition of a police officer's academy cohort influence their future outcomes? Is pretrial electronic monitoring an attractive alternative to pretrial release and detention? To answer these questions, I use administrative data from Chicago and Cook County, Illinois, on the Chicago Police Department, Cook County Jail, and Circuit Court of Cook County, and a range of econometric methods. In Chapter 1, I study the effect of pretrial electronic monitoring (EM) as an alternative to pretrial release and pretrial detention (jail) in Cook County, Illinois. EM often involves a defendant wearing an electronic ankle bracelet that tracks their movement and aims to deter pretrial misconduct. Using the quasi-random assignment of bond court judges, I estimate the effect of EM versus release and EM versus detention on pretrial misconduct, case outcomes, and future recidivism. I develop a novel method for the semiparametric estimation of marginal treatment effects in ordered choice environments, with which I construct relevant treatment effects. Relative to release, EM increases new cases pretrial due to bond violations while reducing new cases for low-level crimes and failures to appear in court. Relative to detention, EM increases low-level pretrial misconduct but improves defendant case outcomes and reduces cost-weighted future recidivism. Finally, I bound EM's pretrial crime reduction effect. I find that EM is likely an adequate substitute for pretrial detention. However, it is unclear that EM prevents enough high-cost crime to justify its use relative to release, particularly for defendants who are more likely to be released. Chapter 3, joint with Bocar Ba, studies and differentiates between the effects of oversight and outrage on policing. Previous studies estimating the impact of police oversight on crime rely on major policing scandals as shocks to examine the impact of oversight on crime. We argue that the simultaneous effect of public outrage on officer behavior and crime contaminates these results, and we provide a conceptual framework that distinguishes between oversight and outrage. We identify two events relating to unexpected court rulings in Chicago that increased oversight and caused a decline in reported misconduct but had virtually no public reaction. Despite the decrease in reported misconduct, crime and officer activity were unaffected. We contrast this with a major policing scandal, after which we find both a rise in crime rates without an equivalent increase in arrests and a decline in officer stops and use of force. Our results suggest that police oversight can reduce misconduct without increasing crime.

Compliance measurement-guided medication management programs in hypertension : a systematic review

Objectif principal: Il n’est pas démontré que les interventions visant à maîtriser voire modérer la médicamentation de patients atteints d’hypertension peuvent améliorer leur gestion de la maladie. Cette revue systématique propose d’évaluer les programmes de gestion contrôlée de la médicamentation pour l’hypertension, en s’appuyant sur la mesure de l’observance des traitements par les patients (CMGM). Design: Revue systématique. Sources de données: MEDLINE, EMBASE, CENTRAL, résumés de conférences internationales sur l’hypertension et bibliographies des articles pertinents. Méthodes: Des essais contrôlés randomisés (ECR) et des études observationnelles (EO) ont été évalués par 2 réviseurs indépendants. L’évaluation de la qualité (de ce matériel) a été réalisée avec l’aide de l’outil de Cochrane de mesure du risque de biais, et a été estimée selon une échelle à quatre niveaux de qualité Une synthèse narrative des données a été effectuée en raison de l'hétérogénéité importante des études. Résultats: 13 études (8 ECR, 5 EO) de 2150 patients hypertendus ont été prises en compte. Parmi elles, 5 études de CMGM avec l’utilisation de dispositifs électroniques comme seule intervention ont relevé une diminution de la tension artérielle (TA), qui pourrait cependant être expliquée par les biais de mesure. L’amélioration à court terme de la TA sous CMGM dans les interventions complexes a été révélée dans 4 études à qualité faible ou modérée. Dans 4 autres études sur les soins intégrés de qualité supérieure, il n'a pas été possible de distinguer l'impact de la composante CMGM, celle-ci pouvant être compromise par des traitements médicamenteux. L’ensemble des études semble par ailleurs montrer qu’un feed-back régulier au médecin traitant peut être un élément essentiel d’efficacité des traitements CMGM, et peut être facilement assuré par une infirmière ou un pharmacien, grâce à des outils de communication appropriés. Conclusions: Aucune preuve convaincante de l'efficacité des traitements CMGM comme technologie de la santé n’a été établie en raison de designs non-optimaux des études identifiées et des ualités méthodologiques insatisfaisantes de celles-ci. Les recherches futures devraient : suivre les normes de qualité approuvées et les recommandations cliniques actuelles pour le traitement de l'hypertension, inclure des groupes spécifiques de patients avec des problèmes d’attachement aux traitements, et considérer les résultats cliniques et économiques de l'organisation de soins ainsi que les observations rapportées par les patients. / Objective: Whether interventions including measurement and correction of patients’ attitude to antihypertensive medication can improve hypertension management is unclear. Methods: Randomized controlled trials (RCT) and observational studies (OS) were assessed by 2 reviewers independently. Quality assessment was performed with the Cochrane risk of bias tool and evaluated in a four-point continuum. A narrative data synthesis was performed due to significant heterogeneity among studies. Results: 13 studies (8 RCT, 5 OS) involving 2150 hypertensives were included. Short-term BP improvement under CMGM in complex interventions was revealed in 4 studies of low-to-moderate quality. Regular feedback to the treating physician seems to be an essential component of CMGM and may be effectively mediated by a nurse or a pharmacist and via telecommunication. Future research should follow accepted quality standards and current guidelines for the treatment of hypertension, include specific groups of patients with compliance problems and consider clinical, economic, patient-reported and organizational outcomes.

A presente tese tem por objetivo central investigar a legitimidade da adoção do monitoramento eletrônico como sanção autônoma no sistema de justiça penal brasileiro. Para tanto, parte-se da perspectiva do controle social formal no contexto das sociedades tecnológicas e de riscos, no qual a prisão e o monitoramento estão inseridos, e traça-se um paralelo entre as sanções penais adotadas ao longo do desenvolvimento do Direito Penal e a evolução da sociedade. Enfocando o instituto do monitoramento eletrônico de presos, a tese aborda seu conceito, origens, espécies, evolução tecnológica, finalidades, modelos e aspectos constitucionais, tanto no Brasil, como em outros países. A partir de uma análise crítica de seu tratamento normativo, a nível federal e estadual, formulam-se proposições com o objetivo de preservar os direitos individuais dos monitorados, garantindo-se a idoneidade do sistema de monitoramento eletrônico como espécie de sanção penal, em harmonia com as finalidades preventiva e retributiva da pena, mas sem se descurar da sua potencialidade como instrumento de redução da superpopulação carcerária brasileira. / The objective of the present dissertation is to investigate the legitimacy of adopting electronic monitoring as a stand alone sanction in the Brazilian system of criminal justice. The concept of formal social control in the context of technological risk societies, of which detention and monitoring are intrinsic parts, allows a parallel to be drawn between the penalties adopted throughout the evolution of society and the development of the Criminal justice system. This dissertation analyzes the concept of electronic monitoring of detainees, the origins of this practice, and its types, technological evolution, purposes, models and constitutional aspects in Brazil as well as in other countries. Based on a critical analysis of the normative aspects of electronic monitoring at the federal and state levels, proposals are formulated in order to safeguard individual rights while ensuring the suitability of the system as a type of criminal sanction in keeping with the preventive and retributive purposes of justice. The potential presented by this type of sanction as a means to reduce prison overpopulation in Brazil must not however be overlooked.
