No Reino Português o sistema assistencial acompanhou a evolução do modelo europeu, estruturado nos valores do Cristianismo, em que couberam à comunidade as respostas para os problemas sociais. Com base na filosofia das Luzes, além de questões de cunho técnico-científico em busca do progresso econômico, ou com a garantia das fronteiras territoriais, nota-se após a transferência da Corte para o Brasil, e principalmente após a Independência, um despertar para a realidade social brasileira, em que ação do Estado na intervenção na questão assistencial esteve ligada não só à preocupação de que esse cuidado não caísse sobre si, mas também à política de manutenção da ordem tradicional. Pensando nisso, essa pesquisa procurou conhecer o comportamento do Estado monárquico constitucional brasileiro diante dos .socorros públicos. no momento da organização de suas bases jurídicas e administrativas. As principais fontes que a fundamentaram foram as Leis e Decisões de Governo do Império do Brasil de 1822 a 1834, cuja análise permitiu dimensionar as mudanças na concepção das obrigações do Estado e o discurso que ele próprio produzia de si, tornando explícita a estreita relação entre pobreza, desordem, trabalho e o desenvolvimento de uma moral, logo, a intimidade da questão da assistência com os interesses do Estado. / Political and social realities are determining factors in the explanation of the predominance of certain charity and social assistance models. In the Portuguese Kingdom the social assistance system followed the evolution of the European model, based on Christian values, in which the community was in charge of responding to social problems. Based on the Enlightment philosophy, apart from technical scientific issues in search of economic progress or guarantees for territorial frontiers, after the transfer of the Royal Court to Brazil and especially after Independence, an awakening is observed as to Brazil.s social reality, in which State agency in social assistance issues was tied not only to the preoccupation that such care would not be devolved to the State itself but also to the policy of maintaining traditional order. With such in mind, this research seeks to reveal the behavior of the Brazilian Constitutional Monarchy as to public social aid at the moment of organizing her legal and administrative foundations. The main sources that grounded these were the Leis e Decisões de Governo do Império do Brasil de 1822 a 1834 (Laws and Decisions of the Government of the Empire of Brazil from 1822 to 1832), the analysis of which enabled dimensioning the changes in the conception of the State.s responsibilities and the discourse it produced on itself, revealing the tight relation between poverty, disorder, work and the development of a moral, therefore, between the intimacy of the social assistance issue and the concerns of the State.

O estudo que apresentamos tem como finalidade investigar a ideia kantiana de uma educação cosmopolita. Compreendendo o contexto maior no qual se inserem as reflexões de Kant acerca da educação, a saber, a Ilustração do Século XVIII, procuramos diferenciar a proposta kantiana de educação por seu caráter cosmopolita. Em um primeiro momento, traçamos, baseados na noção de clima de opinião, um breve panorama da Ilustração e sua estreita relação com a questão da educação. Em um segundo momento, refletimos acerca da relação entre Rousseau e Kant no que se refere à educação, mostrando as convergências divergências existentes. Nos apoiando da distinção entre educação privada e pública, intentamos mostrar como Kant se opõe à Rousseau ao defender a educação pública, e como esta defesa nos ajuda a compreender a opção de Kant por uma educação com viés cosmopolita. Em um terceiro momento, apresentamos de um ponto de vista geral a concepção de educação kantiana, analisando sua relação com a filosofia da história, uma vez mais com a intenção de realçar a característica cosmopolita. Por último, apresentamos um quadro dos cosmopolitismos kantianos e debatemos como a educação cosmopolita pode ser vista como uma necessidade para Kant. / Our study aims at carrying out an investigation of the Kantian idea of a cosmopolitan education. Contextualizing Kants proposal of a cosmopolitan education within the broader scenario of the Enlightenment movement, we try to differentiate Kants education for its cosmopolitan trait. Firstly, we draw a short panorama of the Enlightenment and its relation with education, based on the concept of climate of opinion. Then, by contrasting Rousseau and Kant, we try to show their diverging proposals of education, based on a distinction current and the history of education between a private and a public education. By showing Kants support of a public education, we try to indicate that this very bias is a way of demanding a cosmopolitan education. In a third moment, we sketch Kants conception of education, then analyzing its relation with his philosophy of history. As a conclusion, we will try to summarize Kants cosmopolitanisms in order to debate Kants cosmopolitan education as a necessity.

Au siècle des Lumières, la physiocratie constitue un paradigme attractif qui propose un modèle universel et original de réforme de la société d’Ancien Régime. À compter des années 1760, les idées portées par cette doctrine politique, économique et juridique circulent à travers tout le continent européen et sont accueillies avec plus ou moins d’attention par les souverains et les élites éclairées. Les propositions du mouvement emportent l’adhésion de certains grands d’Europe et suscitent l’enthousiasme de nombre d’intellectuels, diplomates et administrateurs étrangers. Ouverts à l’esprit du temps, plusieurs monarques et ministres de haut rang décident de recourir à la physiocratie dans le cadre de leurs réformes du droit commercial, de la fiscalité, de l’organisation du travail, de l’agriculture, de l’administration territoriale ou de l’instruction publique. De même, la théorie du despotisme légal conjuguée au triptyque jusnaturaliste « liberté, propriété, sûreté » offre un modèle propice à la régénération de l’État et à la reconnaissance des droits fondamentaux. Or, dans d’autres contrées européennes, la physiocratie est reçue avec scepticisme ou indifférence par certains princes, ministres ou penseurs souvent proches du pouvoir. Bien qu’en quête de solutions réformatrices, ces gouvernants ne recourent alors qu’avec parcimonie aux préceptes de l’école, quand ils ne les rejettent pas purement et simplement au prétexte de leurs effets pernicieux pour l’ordre social traditionnel. / During the Age of the Enlightenment, physiocracy established an attractive paradigm which proposed an original and universal model of reform of society under the Ancien Régime. From the 1760s onwards, the ideas carried by this political, economic and legal doctrine spread across the entire continent of Europe and attracted the attention to a greater or lesser extent of sovereigns and the enlightened elites of the day. What the movement proposed had the support of a number of crowned heads and aroused the enthusiasm of many of intellectuals, diplomats and foreign administrators. Certain monarchs and ministers were very much open to the spirit of the time and they decided to use physiocracy within the framework of their reforms of commercial law, taxation, the organization of labour, agriculture, territorial administration or education. Indeed, the theory of legal despotism combined with the three natural rights of “liberty, property and security” offered a suitable model for the regeneration of the State and the recognition of fundamental rights. Yet in some European countries, physiocracy was greeted with scepticism or indifference by other princes, ministers and thinkers who were often close to those in power. Although these rulers were looking for reformist solutions, they resorted only sparingly to the precepts of the school, when they didn’t reject them outright, the pretext being the pernicious effects of such precepts on traditional social order.

This thesis deals with the issues of military deserters from the imperial-royal army at the period of the enlightened absolutism, thus during the reign of Maria Theresa and her sons Joseph II and Leopold II. Based on written as well as printed sources, originated mainly from the activity of the supreme provincial offices of the Kingdom of Bohemia at this time, an explanation on the questions of deserters' punishments, their limited pardons and mutual exchanges, made between the Habsburg Monarchy and her allies, has been offered. Moreover, the attention has been paid to the state's approach to the inhabitants that either provided aid to the deserters, or vice versa participated in their pursuit and capture. The last part of the text has been devoted to the registries of military deserters who originated from Bohemia, with the main emphasis on the Seven Years' War, because these registries have been preserved mostly for this conflict. Firstly, it presents a series of cultural references and some practices of the Portuguese censorship with readers during the period of the Enlightened Reformism. On one hand, there were the corporate theories of power from the Second Scholastic, the millennium beliefs and the anti-scientificism, and, on the other hand, the Enlightenment and the main characteristics of the Portuguese Enlightened Reformism, since the rule of marquis of Pombal until that of the Regent Prince D. João VI. Secondly, it focuses on the practices censorship and the Crown in relation to books - that is, the prescribed and prohibited use which evaluated the parameters that established censorship and their modifications under the Enlightened Reformism. Also it accompanies the controlling practices and the diffusion practices that affected the circulation and the possession of books and examines the concession of licenses for the reading of prohibited books. Finally, it incorporates the uses of books in the Portuguese-Brazilian world through, the analysis, lastly, of the distribution of the possession of books and the composition of libraries and the conceptions identified and formulated by the readers themselves. This dissertation aims to contrast the differences between Montesquieu¡¦s and Quesnay¡¦s thoughts of China Despotism theory, to analyze the methodology and epistemology used by the two scholars to demonstrate and observe traditional China despotism, and, to expound and examine the description of traditional China despotism in Montesquieu¡¦s and Quesnay¡¦s thoughts. Montesquieu was a rare one among Enlightenment philosophers who profoundly discussed China Despotism in the eighteenth century. In the elaboration of Montesquieu¡¦s China Despotism, there were lots of contradictions in De L'espirt Des Lois. Traditional China government was depreciated by him. From the empirical induce methodology, positivism epistemology and ontology¡¦s point of view, this dissertation tries to deeply analyze and research Montesquieu¡¥s China Despotism. At the time, there were also some Enlightenment Philosophers who have a different view of China Despotism. The representative was a Physiocrat ¡V Francois Quesnay. In his Le Despotisme De La Chine, he marked traditional China government positively. Quesnay, who developed his view based on the same empirical facts about traditional China according to the eighteenth century¡¦s Jesuits, travelers and businessmen and with the same natural science methodology, had totally different views and thoughts about China Despotism from Montesquieu. This dissertation has a detailed study and review on these differences.
Questions will be explored in this dissertation are as below. Did the natural science methodology and epistemology of Montesquieu¡¦s and Quesnay¡¦s China Despotism strengthen the judgment of how they valued traditional China government? Were there pre-judgments in their so-called neutral and objective denouncement about the way they researched China Despotism in the empirical induce methodology and epistemology? Were Montesquieu¡¦s and Quesnay¡¦s judgments about China Depotism enhanced by the natural science methodology and epistemology a kind of western centralism? Did they, in the name of neutral and objective empirical induce methodology and epistemology that could not reason non-western value, refuse and devaluate other non-western value? This dissertation has a deeply reflection on these from the ¡§paradigm¡¨ and ¡§incommensurable¡¨ methodological concepts of Thomas S. Kuhn¡¦s.
If Montesquieu¡¦s China Despotism was the main point of western culture, was the way Quesnay observed traditional China government presenting a different value in the west culture and there were still some admiring this kind of value? Was this kind of evaluation neglected by recent Chinese intellects? This is a serious problem worthy of reconsideration and reflection.

Explaining financial scandals : corporate governance, structured finance and the enlightened sovereign control paradigmBavoso, Vincenzo January 2012 (has links)
The explosion of the global financial crisis in 2007-08 reignited the urgency to reflect on the origins and causes of financial collapses. As the above events kick-started an economic meltdown that is still ongoing, comparisons with the Great Crash of 1929 started to abound. In particular, the externalities that a broad spectrum of societal groups had to bear as a consequence of various banking failures highlighted the necessity of a more inclusive and balanced regulation of firms whose activities impact on a wide range of stakeholders.The thesis is centred on the proposal of a paradigm, the “enlightened sovereign control”, that provides a theoretical, institutional and substantive framework as a response to the legal issues analysed in the thesis. These stem primarily from the analysis of two sequences of events (the 2001-03 wave of “accounting frauds” and the 2007-08 global crisis) which represent the background upon which modern financial scandals are explained. This is done by highlighting a number of common denominators emerging from the case studies (Enron and Parmalat, Northern Rock and Lehman Brothers) which caused financial instability and scandals. The research is grounded on the initial recognition of theoretical themes in the field of corporate and financial law, which eventually link with the more practical events examined. This parallel enquiry leads to the investigation of two heavily interrelated spheres of law and finally highlights more practical legal issues that emerge from the analysis.Through this multifaceted approach, the thesis contends that the occurrence of financial crises during the last decade is essentially rooted in two main problems: a corporate governance one, represented by the lack of effective control systems within large public firms; and a corporate finance one identified with the excesses of financial innovation and related abuses of capital market finance. Research conducted in this thesis ultimately seeks to contribute to current debates in the areas of corporate and financial law, through the proposals of the “enlightened sovereign control” paradigm.

Le réchauffement climatique représente un enjeu prégnant auquel les entreprises répondent, entre autres, par la diffusion volontaire d’informations sur leurs émissions de gaz à effet de serre (GES). Trois études empiriques, traitant pour chacune d’elle une dimension de la stratégie mise en place par les firmes à cet égard, sont menées. Elles sont toutes trois réalisées à partir du programme Carbon Disclosure Project. La première étude identifie deux étapes séquentielles conduisant à la diffusion d’informations sur les GES : la production puis la diffusion sélective. À partir d’un échantillon mondial, une analyse coûts-bénéfices identifie les différents déterminants de ces deux décisions et invite à considérer de manière plus fine le processus de diffusion volontaire. La deuxième étude examine l’influence de la gouvernance interne sur la qualité des informations carbones diffusées, en distinguant la gouvernance spécifiquement dédiée à l’environnement de la gouvernance générale. Les analyses mettent en évidence, dans le contexte américain, le rôle contingent de la gouvernance spécifique puisque son rôle ‒ positif ‒ est modéré par la gouvernance générale dans laquelle elle s’insère. La troisième étude s’intéresse finalement à l’utilisation concomitante de deux canaux de diffusion. Il s’avère qu’une partie des entreprises françaises étudiées adapte les indicateurs diffusés sur les GES au canal et à l’audience ciblée. Afin d’assurer la crédibilité des données, la traçabilité de l’information est par ailleurs renforcée. L’ensemble de ces résultats contribue à la compréhension de la façon dont les besoins des parties prenantes sont gérés par les entreprises. Notre connaissance de l’environnement informationnel créé par ces dernières autour du changement climatique s’en trouve ainsi améliorée. / Global warming is nowadays a significant issue. Firms respond to this challenge by, among others, voluntarily disclosing information about their greenhouse gas (GHG) emissions. Three empirical studies, each dealing with one dimension of the disclosure strategy, are conducted. They are all based on the Carbon Disclosure Project program. The first study identifies two sequential steps leading to information disclosure: information production and selective disclosure. A costs-benefits analysis is performed on a global sample in order to identify the different determinants of the two decisions and calls for a finer consideration of the disclosure process. The second study examines the influence of internal corporate governance on the quality of carbon information disclosed. Environmental-specific governance is distinguished from general governance. In the American context, analyses show that the role of the environmental-specific governance is contingent: its positive influence is moderated by the general governance context. The third study focuses on the concurrent use of two disclosure channels. It appears that French firms adapt the content of their GHG emissions indicator to the channel and the target audience. To ensure data credibility, information traceability is sustained in this case.Overall, this dissertation contributes to our understanding of the way stakeholders’ needs are managed by companies. Our knowledge of the informational environment created by firms about global warming is thus improved.
