Nya krav på miljöbedömningar av planer och program : En väg mot effektivare samhällsplanering och hållbar utveckling?

Den 21 juli 2001 trädde Europaparlamentets och rådets direktiv, om bedömning av vissa planers och programs miljöpåverkan, i kraft. Syftet med direktivet var att säkerhetsställa en hög nivå på miljöskydd, genom att utföra miljöbedömningar på vissa planer och program som kan antas medföra en betydande miljöpåverkan. När ny lagstiftning ska implementeras brukar det vanligtvis uppkomma implementeringsproblem och det var något som jag misstänkte skulle uppkomma även i detta fall. Syftet med uppsatsen är därför att ta reda på hur arbetet har fortlöpt med att implementera de nya bestämmelserna som har haft sin upprinnelse från EU:s direktiv. Informationsflödet kring de nya bestämmelserna har också studerats. För att uppfylla syftet utfördes en intervjuundersökning med tre tjänstemän på olika administrativa nivåer för att ta reda på deras uppfattning om problem respektive styrkor med de nya bestämmelserna som härrört från EU:s direktiv, samt hur de tyckte att informationsflödet kring de nya bestämmelserna hade fungerat. Två analyser utfördes sedan i uppsatsen: en jämförande analys där svar från min intervjustudie sattes i förhållande till fem ståndpunkter som jag valt ut från regeringens proposition Miljöbedömningar av planer och program 2003/04:116, samt en analys där tre nyckelbegrepp inom implementeringsteorin har satts i förhållande till intervjuresultaten. Vissa av ståndpunkterna i regeringens proposition visade sig vara väl optimistiska, i alla fall i förhållande till intervjusvaren. En del implementeringsproblem verkar också vara ofrånkomliga, framförallt var respondenterna missnöjda med hur informationsflödet kring de nya bestämmelserna hade fungerat. De nya bestämmelserna kan säkerligen bidra till en mer hållbar utveckling men jag tror att det kommer att ta tid innan bra rutiner för att arbeta med dem har hittats.

The smoking dragon : A study of how China frame their climate change policy

In the international climate change negotiations it has been hard to find a sustainable agreement about how to address the anthropogenic impacts on the climate. This is because the issue is very complicated and comprises many social and economic aspects. Because of the struggling in the international negotiations is it necessary to analyze how the climate change issue is understood in different regions and countries of the world. The purpose of this thesis is to analyse how actors within the climate policy sphere in China frame the climate change issue. In the near future, China will become the world’s largest emitter of carbon dioxide and with a population of 1.3 billion people; China is one of the key countries in the international climate negations. The thesis analyses how two key actor groups - decision makers and scientists connected to the Chinese climate change administration - frame the climate change issue in semi-structured interviews. The respondents frame the climate change issue as a large obstacle for a future Chinese development, both economically and socially. To address climate change in China the respondents think that technology innovations and transfer of technology from the developed countries will be very important. Therefore the respondents think it is vitally important to continue with the international climate negotiations in the future.

Stone walls in agricultural land are incorporated in the general protection of biotopes. They are protected because they provide a habitat for endangered species. Therefore it is illegal to carry out proceedings in an area that is included in the protection of biotopes. In order to do that, exemption is needed which can only be granted if there are special reasons. The essay stipulates what these special reasons are. In an exemption errand the interest for nature conservation must be weighed against a public or a private interest. Administrators have varying opinions on how the interest for nature conservation, contra individual and public interests shall be evaluated. The interest for nature conservation has a lower value if the wall lacks endangered species or if stone walls are common in the area. But a lower value, in itself, can never be considered as special reasons. When it comes to a public interest, it must be an important one in order to bring about an exemption. Examples of important public interests are animal and health protection. Private interests are often constituted by the desire to improve the farming profitability. This is however rarely considered as an “unforeseen situation”, and therefore - according to preparatory work - it is not judged as special reasons. One conclusion is that the County Administrative Boards need improved guidance. Another conclusion is that exemption shall be used restrictively. Exemptions are not supposed to solve all problems due to protection of stone walls in agricultural land. They ought to be the solution when no other reasonable alternatives can be found.

2008-05-26 Bedrock heat as an energy source The sun has warmed up the bedrock and this heat can be used for warming up houses. Approximately 100 – 200 meters down in the bedrock the temperature of the heat is stable. This is a source of energy that can be used by installing a heat pump system. The ground source heat pumps are low maintenance and can last for many years. There is also a pollution risk for the groundwater and therefore the wells in the area. Before the ground source heat pump can be installed the municipality need to give permission, according to the environmental code. To install the system without permission is a crime against the environmental code. A requirement when applying for permission to install the heat pump system is to get the neighbours to agree with the place for the bore hole. The neighbour can appeal against the environmental and health authorities’ decision to give permission to install the ground source heat pump system. However there needs to be more research done regarding the environmental effects that may occur in the future, if the ground source heatpump system continues to increase as rapidly as today.

Preventive action in the protection of the Baltic Sea : Do the HELCOM Baltic Sea Action Plan and An Agenda for the Baltic Sea Region – Baltic 21 advocate preventive action in protecting the Baltic Sea?

The Baltic Sea is a sensitive and unique ecosystem that has been strongly affected by human activity in the area. It is an important cultural and natural resource that contributes with several economic benefits. Among the many documents aiming to protect the Baltic Sea, this thesis concerns two of the action plans; An Agenda for the Baltic Sea Region – Baltic 21 and HELCOM Baltic Sea Action Plan, which are two of the most recognised documents aiming at protecting the Baltic Sea area. The two documents was analysed using three different types of text analysis. As the main goal in all environmental protection is to urge preventive action in protecting the environment, the two documents will be analysed with the aim of investigating whether preventive action is advocated in the protection of the Baltic Sea, even though the region is threatened and have many problems from an environmental point of view. The two documents differ structurally as their approaches differ. The HELCOM Baltic Sea Action Plan (BSAP) has an ecosystem approach, whiles the Baltic 21 has sustainable development as its primarily approach. The results of the study further show that preventive action is advocated in both documents. However, the BSAP presents a cleared preventive approach and suggests more preventive action than Baltic 21. Baltic 21 lack a clear connection to the Baltic Sea and instead focus in the whole Baltic Sea area. There are few clearly preventive action presented in the protection of the actual Baltic Sea in Baltic 21. Instead the Baltic 21 shows a vague argumentation and few actions aiming at preventing environmental harm to the Baltic Sea.

Air Pollution, Politics, and Environmental Reform in Birmingham, Alabama 1940--1971

This dissertation contends that efforts to reduce air pollution in Birmingham, Alabama, from the 1940s through the early 1970s relied on citizens who initially resisted federal involvement but eventually realized that they needed Washington's help. These activists had much in common with clean air groups in other U.S. cities, but they were somewhat less successful because of formidable industrial opposition. In the 1940s the political power of the Alabama coal industry kept Birmingham from following the example of cities that switched to cleaner-burning fuels. The coal industry's influence on Alabama politics had waned somewhat by the late 1960s, but U.S. Steel and its allies wielded enough political power in 1969 to win passage of a weak air pollution law over one favored by activists. Throughout this period the federal government gradually increased its involvement in Alabama's air pollution politics, culminating in the late 1960s and early 1970s with the enactment of environmental laws that empowered federal officials to pressure Alabama to pass a revised 1971 air pollution law that met national standards. After the passage of this law, but before the appointment of an air pollution control board to enforce it, a federal judge temporarily shut down Birmingham-area industries at the request of the Environmental Protection Agency, the first time that the agency had used such emergency powers. Over time, grassroots activists in Birmingham came to the realization that their efforts were doomed to fail, or at least to be significantly delayed, without the aid of the federal government. For nearly twenty-five years after the enactment of the 1945 smoke ordinance, supporters of air pollution control wanted the state government to deal with the problem of air pollution, with the federal government only providing technical expertise and funding for scientific research. But with their defeat in the 1969 legislative session, when the industry-backed air pollution bill passed, clean air campaigners in Alabama realized--and publicly stated--that only pressure from Washington would force Montgomery to clean up Alabama's air.

Human enlargement and improvements are following the same scheme as the world economies, and have through the same structure damaged and overexploited the ecological systems of the Earth, leading to a progressive degradation of its biodiversity. The need for protected areas is now inescapable when it comes to restoring species while sustainable development and prevention of damaging the environment have become prominent. It is now even more important that the awareness of an actual impact of our living standards on the ecological system has been established. International and more specifically European Laws have been established to prevent and ensure species of all kinds to live in a safe and preserved environment, but the question of their effectiveness has to be asked and nuanced. In that respect the issue of bird species is one of major importance as they are victims of human development. Within the European member states the problem is coming from the inability of some of them to implement and apply European laws because all do not agree on the terms of a protection provided for bird species.

Park Access and Distributional Inequities in Pinellas County, Florida

Although environmental justice research has traditionally focused on environmental disamenities and health hazards, recent studies have begun to examine social inequities in the distribution of urban amenities such as street trees and parks that provide several direct and indirect health benefits to local residents. This thesis adds to this knowledge by evaluating distributional inequities in both distribution and access to parks in Pinellas County, the most densely populated and one of the most racially segregated counties in Florida. An important objective was to determine if neighborhoods with lower levels of park access are more likely to contain a significantly higher proportion of racial/ethnic minorities and low-income residents. The analysis uses precise locations of parks, street network data, and block group level census socio-demographic information. Parks are classified into three categories based on park size (acres). For the first research question, park service areas are constructed to determine the socio-demographic composition of residents closest to each park based on a 400-meter walking distance along the road network. Park service areas allow the calculation of potential park congestion, in acres per person, and the analysis of statistical associations between socio-demographic characteristics and park acreage. The results indicate less congested parks and higher acreage for racial/ethnic minority residents and those below poverty level, with respect to White residents and those above the poverty level. The second research question examines inequities in the geography of park access as measured through the creation of network-based buffer zones based on walking distances from each park. Statistical analysis, including basic comparisons and a multivariate least squares regression, indicate significantly lower accessibility to parks for residents who are Hispanic and 65 or more years in age. Parks are significantly more accessible to neighborhoods containing a higher proportion of individuals in poverty, vacant houses, and those within the cities of Clearwater or St. Petersburg. This research contributes to a growing body of literature on park inequity by using walking distances on local streets to define park service areas and focusing on an urban area (Pinellas County, Florida) that has not been examined in past studies of environmental justice.
