Este trabalho dedica-se ao estudo crítico dos condomínios horizontais fechados como manifestações de não-lugares na cidade de Goiânia, no período de 1990-2006. A abordagem é tributária do pensamento de autores que se dedicaram a compreender a cidade contemporânea, destacando-se as reflexões do antropólogo Marc Augé (1994). Essa nova forma de morar, em regiões metropolitanas, imprime no tecido urbano uma configuração morfológica, cujos sinais expressam-se em elementos arquitetônicos tais como: as portarias, os sistemas de segurança, os muros e os elementos paisagísticos, como os lagos e os bosques. Os condomínios horizontais fechados, paraísos de classe média e alta, são constituídos por paisagens bucólicas e pitorescas, que os associa aos resorts e parques temáticos. Orientam-se pelos princípios do New Urbanism, movimento de origem norte-americana, cujas influências localizam-se no século XIX, na concepção da cidade-jardim e do movimento city beautiful. / The dissertation describes a critical study of enclosed residential housing estates based on the idea of condominiums as non-places. The focus of this study was condominiums in the city of Goiânia, Brazil built during the period of 1990-2006. It discusses the hypotheses of authors who dedicated their work to understand the contemporary city. Particular attention is paid to the reflections of the distinguished anthropologist Marc Augé. This new form of living in metropolitan areas presents a new morphologic configuration in the urban space characterized by architectural elements such as: manned main gate, security systems, perimeter walls, areas of leisure and gardens/lakes. The closed condominium is a paradise for the middle and high classes which are widely regarded for their high standard of living but are also typified by the artificial existence such as that founded in holiday resorts and thematic parks. They follow the principles of the New Urbanism, a movement of North American origin and inspired on the 19th century, in the conception of the garden-city and the city beautiful movement.

The impact of estate planning on the effectiveness of estate duty as a wealth tax in South AfricaOstler, Luise Marie January 2013 (has links)
The thesis examined the current system of the taxation of wealth in South Africa with an emphasis on the taxes that apply upon the death of the taxpayer. The focus of the research was on the problems associated with estate duty, namely the issue of double taxation; the alleged cumbersome administration of the tax and the limited revenue that it brings in; it’s questionable efficacy due to extensive estate planning on the part of taxpayers while they are still alive and its lack of uniformity with other wealth taxes. An interpretative research approach was followed which involved analysing documentary data. The conclusions that were reached were that estate duty as a wealth tax in South Africa has been rendered ineffective due to the inherent problems associated with its application, namely the fact that double taxation exists, not only in the context of capital gains tax, but also in that taxpayers resent being taxed upon death after having paid income tax during their lives. The perceived unfairness that is associated with estate duty has caused the creation of a secondary industry of estate planning, with the aim of minimising estate duty, which industry has resulted in the ineffectiveness of estate duty and its limited revenue. No evidence could be found regarding the Treasury’s assertion that estate duty is a cumbersome tax to administer. The final conclusion reached was that the current estate duty regime needs to be overhauled preferably by extending the current system of capital gains tax and abolishing estate duty, with due consideration being given to the consequences associated therewith.

After Jagiellonian dynasty ascended to the throne of Bohemia and especially at the time of permanent absence of the King in the land, the political ambitions of the estates of Bohemia, particularly the lords and knights, intensified. The estates strived, among other things, for codification of the land constitution which they succeeded in the beginning of the 16th century when the King issued the so-called Land Constitution of Vladislaus II. (Vladislavské zřízení zemské). At the same time, the estates also made an inventory of archives of the Crown deposited at Karlštejn castle, which is known as the Matouš of Chlumčany's Registry of Ten Coffers (Registrum desíti truhlic). These documents prove the power of bohemian nobility, who attempted to consolidate their position in judicial and administrational system of the country. At the same time they represented themselves as co-responsible political unit, alongside the King, which works for the good of the Kingdom and the whole Lands of the Bohemian Crown. My diploma thesis pursues the gradual growth of power of the bohemian nobility, who wanted to consolidate their position not only at the expense of royal cities, but also of the power of the King himself. The South African concept of freedom of testation is one of the most absolute concepts of freedom of testation in westernised legal systems. It is suggested that the South African concept of freedom of testation is a memento of capitalist patriarchy. As the South African legal system practices a nearly absolute concept of freedom of testation, capitalist patriarchy has maintained masculine control of property in South Africa and perpetuated the systems of male dominance prevalent in South Africa. Freedom of testation allows for wealth to pass from one male to another. It also allows entrenched gender roles to continue by excluding women from inheriting. Die spesifieke probleemareas met die interpretasie van artikel 2(3) word uitgelig en
in detail bespreek. Daarna maak ek 'n aanbeveling dat 'n handtekening of merk op
'n testamentere geskrif 'n drempelvereiste moet wees alvorens 'n hof dit kan
kondoneer. Ek sluit af met 'n opinie oor hoe die artikel in die toekoms geinterpreteer behoort te word. / The dissertation is about the way in which the courts handle testamentary writings
which do not comply with the formalities of a will. Firstly I discuss the position before
the implementation of section 2(3). Thereafter I discuss the recommendations of the
law commission. Then I discuss the implementation of section 2(3) which empowers
the court to legalise a document which does not comply with the formal requirements
of a will.
The specific problem areas with regard to the interpretation of section 2(3) are
highlighted and discussed in detail. Thereafter a recommendation is made that a
signature or a mark on a testamentary writing must be a prerequisite before a court can

This thesis appraises the tax burden of real estate in the Czech Republic and is divided into two parts theoretical and analytical.The first part introduces the taxes in general development of taxes in the Czech Republic and basic terms and laws related to real estate in the Czech Republic.The second part compares the situation in the Czech Republic with foreign countries. It includes an analysis of individual real estate taxes and describes the ways of paying taxes in terms of length and difficulty of the process. Examples of situations in the Czech Republic where there is a need to pay taxes are also outlined in this analytical part.An assessment of a family house for tax purposes is executed on the basis of the author´s choice of real estate. The tax value of the chosen real estate in the Czech Republic is subsequently compared with taxes in Slovakia, Austria, Germany and Poland. The tax calculation of immovable assets and real estate taxes are implemented and described. All knowledge of the present day situation and a reflection concerning the future of real estate taxes in the Czech Republic are summarised at the end of this thesis.

O presente trabalho tem como objetivo compreender as transformações da área urbana do município de Monte Alegre de Minas, em razão da construção dos conjuntos habitacionais (Pedra Branca, J.Tolendal e Primavera) por intermédio do Programa Minha Casa, Minha Vida (PMCMV). Este estudo tem em relação à ciência geográfica uma significativa importância, pois, o mesmo poderá contribuir para a compreensão das transformações que o espaço das pequenas cidades sofre diante da implantação desse tipo de empreendimento. Para a realização do mesmo, optou-se metodologicamente pela pesquisa bibliográfica e pela documental referente às políticas de produção de moradia no Brasil e o papel do Estado, a importância das pequenas cidades na rede urbana, assim como a legislação brasileira com abordagem nos direitos dos indivíduos, ressaltando a moradia digna como um desses. Outro instrumento metodológico foram as análises empíricas nos três conjuntos habitacionais com intuito de conhecer a realidade observada por meio de fotografias e imagens satélites, pois os mesmos se localizam em áreas distintas da cidade. Além disso, utilizaram-se recursos tecnológicos para elaboração de mapas de localização do município e dos conjuntos. E por fim, foram coletadas informações por meio de depoimentos livres das famílias que foram beneficiadas pelo programa e também daquelas que residem em áreas próximas desses locais. Concluiu-se, então, que o PMCMV tem assumido relevante papel no que se refere à minimização de um dos problemas mais críticos da contemporaneidade brasileira, o déficit habitacional e a incorporação do mesmo em Monte Alegre de Minas, resultando na modificação do espaço (físico e funcional), pois algumas áreas inicialmente apresentavam apenas 40 (quarenta) residências, todavia com o interesse imobiliário e pelo fato de estarem localizadas em uma área mais próxima do centro da cidade, transformaram-se em conjuntos com mais de 200 (duzentas) residências, com a presença de um pequeno comércio e de serviços de atendimento básico (área de lazer e creche de educação infantil) que atendem até mesmo os outros bairros. / The objective this work is to analyze the changes in the urban area of the municipality of Monte Alegre de Minas due to the construction of the housing complexes (Pedra Branca, J Tolendal and Primavera) through the My House, My Life program. This study has a great relevance in relation to the geographical studies, since it can contribute significantly to the understanding of the transformations that the space of the small cities suffer before the implantation of this type of enterprise. In order to carry out this study, methodological choice was made for bibliographical and documentary research concerning housing production policies in Brazil and the role of the State, the importance of small cities in the urban network, as well as Brazilian legislation with an approach to the rights of individuals, emphasizing decent housing as one of these. Another methodological instrument was empirical analysis in the three housing complexes in order to know the reality observed through photographs and satellite images, since they are located in different areas of the city, in addition, technological resources were used for the elaboration of location maps Municipality and set. Finally, information was collected through free testimonials from the families that benefited from the program, as well as from those living in areas near those sites. It was concluded that the PMCMV has assumed a relevant role in minimizing one of the most critical problems of the Brazilian contemporaneity the housing deficit and its incorporation in Monte Alegre de Minas resulted in the modification of the physical and functional space, because some areas initially had only 40 (forty) residences, but with real estate interest and because they were located in an area closer to the central area of the city, they became groups with more than 200 (two hundred) residences, with the presence a small local commerce and basic care services (leisure area and kindergarten) that serves even the other neighborhoods. / Dissertação (Mestrado)

This dissertation theses addresses the phenomenon of the unregistered mark for goods and services in accordance with trade mark law of the Czech Republic, while taking into consideration the given scope of EU law and its comparison with the legal protection of applied trade marks in the framework of the "passing-off" doctrine of the legal systems of the United Kingdom of Great Britain and Northern Ireland. While the subject of trade marks has already been thoroughly established in juristic theory and has also become commonplace in legal practice, the institute of the unregistered trade mark has not yet to be comprehensively examined, and as such it presents significant difficulties in applied practice, as it bears no solid legal foundation, and in the context of the regulations of trade mark law it is always possible to identify specific special entitlements arising from the existence or application of unregistered trade marks, whereas the nature of their verbal formulations and systematic classification presents difficulties in the interpretation and application of such entitlements. The basis for this reasoning is namely the historical evolution of the phenomenon of the unregistered mark in trade mark law in Austrian, respectively in subsequent Cisleithania, and its reception and evolvement within Czechoslovak law as the legal predecessor to the Czech Republic. The goal of the research presented herein is to identify answers to the underlying theoretical questions concerning unregistered marks of fundamental significance to applied practice, and in so far as they concern the nature of the unregistered mark as perceived by trade mark law and its definitional attributes, terms of origin, duration, and expiration of unregistered marks, or more precisely as they concern rights to them, as well as the terms and scope of disposition with unregistered marks, namely in so far as they in turn relate to transfer or conversion and the grant of license or other temporary right of use. Subsequently, the establishment of answers to the aforementioned questions addresses the problem of the absence of an explicit legal principle to the phenomenon of the unregistered mark and the interpretation difficulties offered in the poorly formulated laws and subsequent fluctuations in legal practice. This problem is examined within the legal setting of the Czech Republic as a democratic nation with a market economy, in which holds true the classic legal rudiment of "that which is not prohibited by law is permitted", and in which hold true the fundamental and indefeasible rights of man, a component of which is the right to freely pursue economic activities and possess property within a framework of restrictions favouring the preservation of the rights of others as set forth by the law.
