Přechod práv a povinností z pracovněprávních vztahů / Transfer of Undertakings

Transfer of Undertakings Abstract This thesis elaborates on the transfer of undertakings safeguarding employees, rooted in the European legislation in the Council Directive 77/187/EEC of 19 February 1977, replaced by the Council Directive 2001/23/EC of 12 March 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses. Firstly, the European legislation on the transfer of undertakings is briefly analyzed, including its historical transposition into the Czech legal system and an analysis of its interpretation in the case-law of the Court of Justice of the European Union. The analysis of this legislation focuses in particular on the general nature of this institute of transfer of undertakings and on its basic pillars, such as the automaticity of the transfer, the economic unit preserving its identity, the preservation of working conditions and others. The next part of the thesis analyses the Czech regulation anchored in Act No. 262/2006 Coll., the Labour Code, as amended until 29 July 2020, which is gradually compared with the regulation at the European level, highlighting the fundamental differences caused by the somewhat loose transposition of the European regulation...

The aim of this thesis is to present the phenomenon of academic peregrination from several points of view. It is first outlined as a specific topic of Czech historiography, which has been processed since the second half of the 19th century. Emphasis is placed on current research in a Central European perspective. Database projects that represent the current trend in the study of academic peregrination are presented in more details in the thesis. A separate part consists of a case study dealing with Czech and Moravian students at selected reformed institutes in the period 1575-1620. Detailed research was carried out on five institutes in present-day Germany and Switzerland - the universities of Basel, Heidelberg and Marburg, and the academies in Herborn and Geneva. The edited matrices of these institutions have become the main source of this part of the presented work. The student lists used so far proved to be insufficient and gap-free for the analysis. The work includes the updated and formally unified lists of Czech and Moravian students at selected schools in the selected period. The social origin of students in observed was also analyzed. The purpose of the thesis is to analyze the concept of the freedom of artistic creation and expression in the European Union law, in particular its recognition in primary law, above all in the Charter of Fundamental Rights of the European Union (Charter), and in the case law of the Court of Justice of the European Union (CJEU). Considering that interpretation of human rights and fundamental freedoms in the EU law is greatly based on constitutional traditions of EU member states and on the approach to these rights established within the Council of Europe, this thesis also deals with the conception of the freedom of artistic expression in constitutions of EU member states and in the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), as interpreted by the European Court of Human Rights (ECtHR). While relevant case law of the CJEU is only fragmentary, it refers systematically to the extensive case law of the ECtHR, which provides comprehensive theory of the freedom of artistic expression in Europe and provides for studying the evolution of the conception in time. This master theses deals with certain aspects of Czech as foreign language. It comprises of 2 parts. The first one is theoretical background and explains key concepts as e.g. migration, foreign pupil in czech school, teaching of foreign pupils, reading comprehension, characteristic of level A1 according to the Common European Framework of Reference for Languages. It introduces European language portfolio and vocabulary for level A1. The second part is focused on field research that was realised at primary school in Prague. For this qualitative research were chosen 10 pupils from Slavic and Non-Slavic countries. The aim of this research was gaining of compact information about chosen pupils by analysing their individual educational plan, interviews with pupils, teachers and headmaster, analysing their tests and observation. The reseach was concentrated on reading comprehension. 3 different texts were made. One from them was made according to vocabulary for level A1. The other texts were text from textbook and it's simplified version. Each text had a few questions that pupils had to answer. The results of two texts were compared and commented. We cannot say that if pupil is longer time in Czech environment, he or she has better command of Czech language. Comparison of two types of texts did not bring...

The criminal justice as well as the persons participating in criminal proceedings, they both are currently facing number of newly posed challenges and unanswered questions so far, due to the onward going integration of the European Union and much closer cooperation of the Member States, in the field of the Procedural Criminal Law. There have been established many new institutions within the field of the European Union in last few years and there were adopted many legal tools which directly influence the cooperation between the judicial and police authorities of individual countries. In connection with newly emerging forms of the crime and more coherent cooperation of the perpetrators of severe crime, the relevant authorities at the union level as well as at the national level encounter situations not being resolved at all, or which are specified by theoretical standards only and have not been put into practice yet. (anglicky) The aspiration of this thesis is on behalf of (more authentic) Eros problematic "to shake" literary science, not to say its method of interpretation, and so open another, more sensitive approach to art. As a tangle of starting points, I used the dubious theories of authors such as late R. Barthes, G. Didi-Huberman, H. Bloom, G. Bataille or S. Sontag. But especially, I delve into the studies of European literature in order to expose my own "wounds", no less violently classified into thematic chapters (Cosmogony, God of Love, Desire, Philosophy, Heart, Arrow, Wing, Game, Topos, Instinct, Orpheus and others). Therefore I introduce Eros as multifaceted phenomenon, in contrast to monological tendencies of dominant (platonic or Christian) erotic interpretations. Moreover - in polemics with Bataille's eroticism - I try to make Eros "the work".

The thesis deals with discourse surrounding the topic of the Greek debt crisis (GDC) in the online version of the British daily newspaper the Guardian (www.theguardian.com). The study builds on a bilateral division of the EU public discourse on the economic crisis, distinguishing between two opposing perspectives: "the Northern diagnosis" (DeGrauwe 2011: 5) prevailing in Germany and other creditor states, and 'the Southern opinion' on the situation held mainly by the debtor countries. The thesis examines the position of the Guardian in relation to this bilateral discourse framework. The Guardian represents a liberal, socially aware and traditionally EU-supportive newspaper that is published in a country which counts among the Europe's leading economic and political powers, a country that is also characterized by strong Eurosceptic tendencies. These aspects form a complex background with regard to the EEC/GDC discourse framework. There are factors supporting both "the Northern diagnosis" of the GDC and those suggesting inclination to 'the Southern opinion'. The analysis, dealing with a self-collected corpus (altogether 349 texts, 277 973 words) consisting of the Guardian online news on the GDC is situated - both theoretically and methodologically - in the field of Corpus- assisted discourse studies...

Legal regulation of the status of persons with special needs in the EU Asylum directives (Abstract) By the very nature of their status, applicants for international protection and recognized refugees are among the most vulnerable persons. Within this group, there is also a subgroup of persons with special problems, risks and needs that make them even more vulnerable. This subgroup of persons with special needs is provided special protection within the Common European Asylum System (CEAS). The foundation of this special protection consists of three legal acts commonly referred to as asylum directives - the Reception directive, the Qualification directive and the Procedural directive, adopted between 2003 and 2005 The legal status of persons with special needs is an important topic in the current discussion on the amendments to the Asylum directives and the general development of the CEAS system.
