Positive obligations of state arising from Art. 3 of the European Convention on Human Rights focusing on persons with disabilities Absolute prohibition of torture and ill-treatment is clearly set in article 3 of the European Convention on Human Rights. When assessing particular obligations, which are arising out of it, we need to look deep into the European Court of Human Rights jurisprudence. The aim of this thesis is to analyse positive obligations of state arising from article 3 focusing on persons with disabilities. This is achieved also with the aid of various human right bodies such as UN Human Rights Committee, UN Committee on Torture or UN Committee on the Rights of Persons with Disabilities. Due to the fact that this area is not really covered yet, certain parts of this thesis are focused on defining important terms and putting them together. The approach is analytic with elements of comparison between the view of European Court of Human Rights and other relevant international human rights bodies. Změny azylového a migračního práva EU ve světle současné uprchlické krize / Changes of the EU asylum and migration law in the light of the current refugee crisis

This thesis deals with the proposed changes in the area of EU asylum and migration law in the light of the current refugee crisis. EU asylum and migration law are two separate areas between which there is a "close connection". The paper describes EU asylum and migration legal framework, then delimits the term "refugee crisis" and reviews recent measures taken or proposed by the EU. The thesis is divided into 3 chapters. In the first part of the paper the author follows up the legal framework which encompasses both international legal instruments (1951 Refugee Convention and others) and EU primary law and secondary acts. The second chapter is dedicated to analysis of the "refugee crisis", its crises factors, as well as to reflections on the characteristic of this crisis as a state of emergency. The last chapter, which is internally divided into two subchapters, concerning asylum and migration law, relates to particular measures taken by the EU during the crisis. Soudní rozhodnutí v oblasti DPH a jejich vliv na tvorbu legislativy / The Case of Law in the Field of Value Added Tax and its Impact on Legislation

Harmonization of tax systems of the European Union member states has been going on since 1950s. This trend is followed to this day in order to achieve one of the primary objectives of the European Union, single domestic market. The harmonization of tax systems allows free movement of capital, goods, and services. Value added tax is harmonized through the EU Directives that have unified tax object, tax base and partly tax rates. The Court of Justice of the European Union also plays a vital role in the harmonization, because the European case law complements the interpretation of the directives and creates a comprehensive impact throughout the harmonization. This thesis analyses the judgments of the Court of Justice of the European Union, which have been implemented in the VAT Act, and examines at the same time impact of the implementation. The first implementation took place in the amendment of the VAT Act in 2006. The biggest changes occurred in the amendment of the VAT Act in 2012 and it was mainly in the realm of the conditions for exemption from VAT without deduction and the possibility of claiming a deduction. Finally, time frame of the implementation was also researched, judging from the outcomes of the research, one can say that the Czech Republic responds quite flexibly to the publication of the European case of law and the implementation takes place shortly following verdict of The Court of Justice of the European Union.

Thesis deals with the issues of financing and operation of non-profit organisations focusing on the most widespread form - i.e. on civic associations. The theoretical part of the thesis includes the definition of non-profit sector, civic associations, including the characteristics of their legislation. Practical part discuss the question of funding in the specific context of the civic association Elim, Christian society for evangelism and deaneries in Písek in the monitored years 2004 - 2008. There are examples of sources of funding the civic association Elim Písek, which is a subsidy from the Ministry of Education, Youth and Sports of the Czech Republic, the Regional Office of South Bohemian Region and grants from European Union funds.

Proměny postavení Evropské lidové strany v Evropském parlamentu / Changes of position of European People´s Party in the European Parliament

The thesis is a study devoted to the changes of the Group of the European People's Party in the European Parliament (EPP) with focus on the situation after election in 2009. The main aim of the thesis is to find an answer to the question, whether the position of current EPP has been weaken after the election of 2009 and after the split of ED. This is reached through comparison current EPP's position with its position in legislative period 2004 -- 2009. In order to verify or to disprove this question we apply various points of view. First, we analyze historical development of political groups and their legal conditions. Afterwards, we deal with development of EPP Group to its current form and define its fundamental characteristics. The basis for the analysis of change of EPP's position after election in 2009 is the description of the EPP's situation after this election. We compare the position of EPP (EPP-ED) in both mentioned periods by means of four indicators (size, number of mandates, occupation of key posts, coherence and loyalty in voting and ability building coalitions). Resulting evaluation of single indicators provide us with the answer to the question, how the EPP's position has changed after election in 2009.

The diploma thesis regarding The Legal Aspects of Mandatory Vaccination and its European Context was created in order to map the legal regulations of mandatory vaccination in the Czech Republic and to describe the repressions of unvaccinated children in the Czech Republic and in other member states of the European Union. Part of the thesis consists of a jurisprudence research of The Constitutional Court of the Czech Republic, The European Court of Human Rights and The Court of Justice of the European Union related to the field of mandatory vaccination. Special focus is given to the comparison of the number of mandatory vaccinations in the member states of European Union as well as to the comparison of their legislations. The fundamental question reflected in the diploma thesis is the one of the human rights of individuals guaranteed by the European Union, international conventions and national legislations of the states and the possibility for them to be limited in order to protect the public health. In the thesis, there are listed and described the human rights affected by the whole concept of vaccination and also the conditions that have to be fulfilled in order to allow the human rights to be restricted. For this purpose the cases from legal practise serve as a support. In addition, there is a chapter regarding the promotion of newly developed vaccines for voluntary vaccinations, which reveals the marketing tools used for this purpose. For a better understanding of the field of mandatory vaccination, there is included a chapter titled The Insight of Expertise Necessary for the Interpretation and Application of Law. This chapter completes the aspects of mandatory vaccination from the medical point of view, lists the mandatory vaccinations in the Czech Republic and member states of the European Union and the vaccines used for performing the vaccinations. The next part deals with the program period 2014 - 2020 where the most attention is dedicated to the field of youth unemployment. It is within this very period that the company PROSTOR PRO, o.p.s. is going to implement its next project. The recommended field of focus for future projects is based on established and supported areas as well as questionnaire surveys.
