Procréation assistée et filiation : enjeux et solutions en Suisse et au Québec

En janvier 2007, à 28 ans, Louise Brown est devenue maman. Trente ans, c'est le temps qu'il faut à une génération pour se renouveler. C'est aussi le temps, si bref à l'échelle de l'histoire, pour que les bouleversements induits par la science et les moeurs au ~e siècle modifient profondément le visage de la famille et de son ciment le plus intime, la filiation. Ce travail rend compte de la manière dont le droit appréhende ces changements dans des sociétés occidentales de plus en plus tiraillées entre leurs racines judéo-chrétiennes et leurs aspirations technologiques. Il cherche à comprendre la place du droit dans les nouveaux édifices familiaux et à évaluer la qualité des solutions que celui-ci propose face aux enjeux multiples et complexes de la procréation assistée. Il s'attache pour ce faire à l'examen de deux juridictions partageant un héritage commun à bien des égards, mais suivant des voies normatives différentes : la Suisse et le Québec. À ce titre, il définit des outils conceptuels nécessaires à la compréhension de la notion de filiation; il rend compte de la façon dont le droit a manipulé ces outils en régissant l'établissement de la filiation, la preuve de la filiation et la procréation assistée à proprement parler; et il conclut par une évaluation critique des solutions envisagées dans les deux systèmes étudiés. Il met ainsi en exergue les enjeux de la procréation assistée pour le droit de la filiation et la grande palette de solutions législatives envisageables. Il démontre que deux systèmes de droit peuvent traduire des préoccupations partagées par des dispositions diamétralement opposées. En particulier, l'égalité, la liberté et le bien de l'enfant se concrétisent selon des conceptions distinctes. L'attachement aux institutions se manifeste à des degrés variables. Les innovations scientifiques sont accueillies avec un enthousiasme plus ou moins soutenu. Tous ces facteurs sont les détenninants des familles suisse et québécoise, qui, pour s'être longtemps ressemblées, prennent aujourd'hui des chemins différents...mais pas irrémédiablement irréconciliables. / In January 2007, at the age of 28 years, Louise Brown became a mother. Thirty years is the necessary time for a new generation to bloom. It is a short period on the scale of human history, but it was enough to provoke the huge changes induced by science and manner evolutions during the XXth century and deeply modify the face of the family and its most intimate cement: the filial status. This work presents the way in which Law apprehends these changes in Westem societies that are increasingly tom between their Judeo-Christians roots and their technological aspirations. It seeks to understand the place of Law in new family structures and to evaluate the quality of the solutions that Law proposes to take the multiple and complex risks of assisted procreation into account. With this intention, it sticks to the examination of two places sharing a common heritage to many regards, but having different normative ways: Switzerland and Quebec. To do so, it defines conceptual tools that are necessary for the very meaning offilial status to be understood. It accounts for the way in which Law handles these tools by goveming the establishment of the filial status and its proof as weIl as assisted procreation. It concludes by a critical evaluation of the solutions under consideration in the two systems studied. It thus highlights the risks of assisted procreation for Law and the large pallet of possible legislative solutions. It shows that two systems can translate shared concems into diametrically opposite norms. In particular, equality, freedom and the best interest of the child are principles concretized according to distinct designs. The attachment to the institutions appears with variable degrees. The scientific innovations are accommodated with a more or less constant enthusiasm. Sequence of Power: Ritual Controversy over the Zhaomu Sequence in Imperial Ancestral Rites in Song China (960-1279)

abstract: This dissertation explores the history of ancestral rituals and the related political controversy in the Song China (960-1279). Considering the pivotal role played by ancestral rites in shaping Chinese identity and consciousness, this study contributes to a better understanding of how ancestral ritual has been politicized in Chinese history as a specific cultural apparatus to manipulate politics through theatrical performance and liturgical discussion. Through a contextual analysis of a variety of Song scholar-officials and their ritual writings, including memorials, private letters, and commentaries on the ritual Classics, this study demonstrates that Song ritual debates over the zhaomu 昭穆 sequence--that is, the positioning of ancestral temples and spirit tablets in ancestral temples with preparation for alternation or removal--differentiated scholar-officials into separate factions of revivalists, conventionalists and centrists. From a new perspective of ritual politics, this study reveals the discursiveness of the New Learning (xinxue新學) community and its profound influence on the Learning of the Way (Daoxue 道學) fellowship of the Southern Song (1127-1279). It examines the evolution of the New Learning fellowship as a dynamic process that involved internal tension and differentiation. Daoxue ritualism was a continuation of this process in partaking in the revivalist approach of ritual that was initiated by the New Learning circle. Nowadays, the proliferation of ritual and Classical studies crystallizes the revitalization of Confucianism and Confucian rituals in China. Taking zhaomu as a point of departure, this project provides a lens through which modern scholars can explore the persistent tension between knowledge and power by rethinking the modernization of ritual and ritual politics in contemporary China. / Dissertation/Thesis / Doctoral Dissertation History 2015

Perfil do comportamento materno-filial de ovinos da raça Santa Inês e sua influência no desempenho dos cordeiros ao desmame / Maternal-offspring behavior in Santa Inês sheep and its influence on lamb weight at weaning

O presente estudo investigou o perfil comportamental de ovinos entre o parto e a primeira mamada dos neonatos e sua influência sobre a sobrevivência e peso ao desmame dos cordeiros. O experimento foi conduzido em uma criação comercial de sistema intensivo, ao longo de três estações de parição, entre junho e novembro de 2006. Foram acompanhadas 216 ovelhas gestantes da raça Santa Inês e os 306 cordeiros nascidos. As observações comportamentais de ovelhas e cordeiros foram realizadas em períodos de 12 horas, através do método direto e em amostragem focal a cada 5 minutos. Para as mães, foram analisadas as variáveis postura (PTM), atividade (ATM) e tempo para tocar a cria (TTC). Os comportamentos avaliados nos cordeiros foram postura (PTC), atividade (ATC), tempo para ficar em pé (TEP) e tempo para mamar (TPM). Foi também estudada a influência do tipo (simples, duplo ou triplo) e duração do parto (TP e DP) sobre a manifestação dos comportamentos materno-filiais e desempenho dos cordeiros. As análises foram conduzidas através do pacote estatístico SAS®. O modelo adotado para avaliar a relação entre as variáveis foi o General Linear Model, através do procedimento GLM. As ovelhas recém-paridas despendem seu tempo principalmente com comportamentos voltados à formação de um vínculo exclusivo com a cria e com cuidados importantes para a sobrevivência imediata do cordeiro. Já os cordeiros, após aptos a se levantarem e se locomoverem, priorizaram a ingestão do colostro. A rapidez das ovelhas em iniciar os cuidados maternais (TTC=1,4863±8,3587 segundos), a baixa ocorrência de comportamentos antagônicos à cria e a agilidade dos cordeiros para se levantar (TEP=20,8797±17,6991 minutos) e mamar (TPM=46,0726±27,7284 minutos) são indícios da adaptação comportamental da raça Santa Inês a condições extensivas de criação. Os cuidados maternais realizados entre o nascimento e a primeira mamada do cordeiro influenciaram em sua agilidade, medida através do tempo para ficar em pé (P<0,01) e para mamar (P<0,01). A atividade da mãe interferiu no peso do cordeiro ao desmame (P<0,05), tendo os que receberam cuidados mais adequados apresentado um melhor desempenho. Sob as condições deste estudo, a agilidade do neonato não interferiu no peso ao desmame. Também não foram verificados efeitos do comportamento materno ou neonatal sobre a sobrevivência dos cordeiros até o desmame. Cordeiros nascidos de partos múltiplos ou longos apresentaram menor agilidade neonatal (P<0,05). O peso ao nascer sofreu forte influência do tipo de parto (P<0,01), sendo maior para filhotes nascidos de partos simples. Da mesma forma, o tipo do parto influenciou também o peso ao desmame dos cordeiros (P<0,01). / The present study investigated sheep maternal-offspring behavior from birth to first suck and its influence on lamb survival and weight at weaning. The experiment was conducted on a commercial intensive system flock, from June to November, 2006. Data were collected on 216 Santa Inês ewes and their 306 newly-born lambs. Focal animal observations were carried out every 5 minutes, in 12-hour periods. For the ewes, the variables analyzed consisted on posture (PTM), activity (ATM) and time to touch the lamb (TTC). The behaviors analyzed for the lambs were posture (PTC), time to stand up (TEP) and time to suck (TPM). The influence of birth type (simple, double or triple) and labor length, litter size and weight at weaning were also considered. The analyses were conducted through the SAS® statistical package. The model adopted to evaluate the relation between variables was the General Linear Model through the GLM procedure. Immediately after parturition, ewes spent their time mostly with behaviors directed to bonding with the neonates. Newly-born lambs, soon after succeeding in standing up and walking, prioritized colostrum ingestion. The short time required to start maternal care (TTC=1.4863±8.3587 seconds), the low incidence of negative behaviors against the lambs and the neonatal agility to stand (TEP=20.8797±17.6991 minutes) and suck (TPM=46.0726±27.7284 minutes) are indicatives of behavioral adaptations to extensive conditions. Maternal behaviors influenced neonatal agility, measured through time to stand (P<0.01) and to suck (P<0.01). Maternal activity influenced lamb weight at weaning (P<0.05), so lambs that received more adequate care were heavier. Under this study conditions, neonatal agility did not interfere on lamb weight at weaning. Effects of maternal and neonatal posture or activity on lamb survival up to weaning were not verified either. Lambs born from multiple or long births showed less neonatal agility (P<0.05). Lamb birth weights were influenced by the litter size, being singles born heavier (P<0.01). Labor conditions also influenced lamb weight at weaning (P<0.01).

The Efficacy of Child Parent Relationship Therapy when Conducted in an Online Format on Levels of Parental Acceptance

Children’s mental health is a topic of concern, not only in the escalating number of children who meet diagnostic criteria for disorders, but also for the practitioners desiring to treat them effectively. Parental involvement in treatment results in more favorable outcomes with longer treatment gains observed, thus reducing mental health issues. An additional factor in children’s mental health is the effect of levels of parental acceptance toward the child. Parental acceptance is a positive outcome that has been observed in previous studies conducted with Child-Parent Relationship Therapy (CPRT). There are many reported barriers to seeking treatment for mental health issues, including time, cost, distance, and access. Online therapies have been found to reduce or eliminate most barriers to treatment, and is a preferred format for certain populations. To date, however, there have been no studies conducted on whether CPRT is effective in increasing levels of parental acceptance in an online format. Eight participants from around the world completed the ten-week CPRT training in an online format. Levels of parental acceptance were measured by the Porter Parental Acceptance Scale (Porter, 1954; PPAS) in self-reported pre- and post-treatment assessments. A perception survey was also conducted to assess participants’ perception of the process of an online parent training format, including benefits and challenges. This mixed-methods study found that an online version of CPRT does significantly increase parental acceptance levels. Participants also reported positive perceptions of the online training format. Positive themes reported in the survey responses related to convenience, community, access, and user experience.

Adapting Filial Therapy for Families who have a Child with a Life-Threatening Illness

Utilizing a collective case study design, I examined and described the filial therapy (FT) process and adaptations discovered to be necessary and unnecessary in working with families who have a child with a life-threatening illness in the hospital setting. Data from a total of 7 parents was utilized, including those who terminated early, in order to gain a greater understanding of adapting FT for families who have a child with a life-threatening illness and their participation patterns. The parents attended 10 one- to two-hour FT sessions. The data was analyzed to examine for themes, patterns and relationships intrinsically with each case participant, as well as across cases. Analysis indicated that parents with a child with a life-threatening illness had great difficulty committing to attend FT; and a high rate of attrition occurred for those who did commit. A theme regarding flexibility was found to be of eminent importance in a variety of manifestations including therapeutic methods, session format, location and time of sessions, and intense vs traditional FT. Therapeutic adaptations in flexibility found to be important including openness to cathartic and personal parenting sessions, tolerance of forgetfulness, and lowering typical therapeutic concerns of dependency in the relationship. An inability for parents in this situation to benefit from intense FT methods was also noted. Changes noted in the child of focus included increased confidence, increased cooperation in the medical setting, increased communication with the parent and with medical staff regarding medical issues, and increased communication with the parent regarding personal feelings and issues. Changes noted in the parents included increased confidence in parenting skills, increased awareness of the child's perceptions of the environment, increased tolerance in allowing the child to struggle in and out of the medical setting, with both emotional and physical pain in order to gain coping skills, increased ability to allow the child to empower self, and increased abilities in limit setting.

School-based child parent relationship therapy (CPRT) with low income first generation immigrant Hispanic parents: Effects on child behavior and parent-child relationship stress.

This quasi-experimental study examined the effects of child-parent relationship therapy (CPRT) with low income first generation immigrant Hispanic parents. Forty-eight parents were randomly assigned by school site to the experimental group (n=24) and to the no treatment control group (n=24). A two factor (Time x Group) repeated measures analysis of variance was performed to examine the effects of group membership (experimental, control) and time (pretest, posttest) on each of the six hypotheses. Dependent variables for the Spanish version of the Child Behavior Checklist (CBCL) included Externalizing Problems, Internalizing Problems, and Total Problems. Dependent variables for the Spanish version of the Parenting Stress Index (PSI) included Child Domain, Parent Domain, and Total Stress. Results indicated that from pre-test to post-test, parents who participated in the CPRT treatment group reported a statistically significant improvement on their children's behaviors at the alpha .025 level (Internalizing Problems p< .001; Externalizing Problems p< .001; Total Problems p<.001) when compared to children whose parents did not participate in CPRT. Partial eta squared (ηp2) further indicated that the effects of CPRT treatment on the experimental group compared to the control group from pre-test to post-test was large (ηp2 = .56; ηp2 = .59; and ηp2 = .68, respectively). Similarly, results indicated that from pre-test to post-test, parents who participated in the CPRT treatment group reported a statistically significant improvement on parent-child relationship stress at the alpha .025 level (Child Domain p< .001; Parent Domain p< .001; Total Stress p< .001) when compared to parents who did not participate in CPRT. Partial eta squared (ηp2) further indicated that the effects of CPRT treatment on the experimental group compared to the control group from pre-test to post-test was large (ηp2 = .39; ηp2 = .51; and ηp2 = .42, respectively).

Filial Therapy with Israeli Parents

The purpose of this study was to determine the effectiveness of an intensive version of the Landreth (2002) 10-week filial therapy model as a method of intervention for children of Israeli parents living in Israel. This study was designed to determine the effectiveness of intensive filial therapy training in (a) reducing internalizing behavior problems of Israeli children; (b) reducing externalizing behavior problems of Israeli children; and (c) reducing overall behavior problems of Israeli children. A second purpose of this study was to determine the effectiveness of intensive filial therapy training with Israeli parents in increasing the parents' (a) empathic responsiveness with their children; (b) communication of acceptance to their children; (c) allowance of self-direction by their children; (d) involvement in their children's play activities; (e) feelings of efficacy as parents; and (f) reduction of parental stress. The experimental group consisted of fourteen Israeli children who their parents received nine intensive Filial Therapy training sessions within a five week period and had seven parent-child play sessions. The non-treatment comparison group consisted of thirteen Israeli children whose parents received no treatment. Parents in the study completed the Hebrew version of the Child Behavior Checklist, the Parenting Stress Index, and conducted pre-test and post-test play sessions for the Measurement of Empathy in Adult-Child Interaction. Multivariate Analysis of Covariance revealed the children in the experimental group significantly reduced external behavior problems. The results also revealed the parents in the experimental group significantly reduced parental stress and significantly increased communication of empathy to their children.

The Effectiveness of Child Parent Relationship Therapy (CPRT) for Fathers

High levels of quality father involvement in childhood are associated with children's socio-emotional, cognitive, and behavioral wellbeing. However, fathers can experience difficulty in building positive relationships with their kids due to work-life balance, lack of relational experience, and other life stressors. The purpose of this study was to assess the effectiveness of child-parent relationship therapy (CPRT) on fathers' parental empathy, parental stress, and child behavior problems. Though an abundance of literature exists to support the efficacy of CPRT, this was the first study to include a randomized controlled design with an all-male sample. This was also the first CPRT study to include both English and Spanish speaking fathers with intervention offered in both languages. Participants were 30 fathers (22 English, 8 Spanish; 53% Latino, 40% Caucasian, 7% Asian) with children between the ages of 3 and 10 (60% male, 40% female; 57% Latino/a, 37% Caucasian, 6% Asian). Fathers were randomly assigned to the experimental group (CPRT) (n = 14) or waitlist control group (n = 16). Results from 2 (Group) by 2 (Time) repeated measures ANOVAs did not yield statistically significant interaction effects on the dependent variables. However, results indicated a statistically significant main effect for time on each dependent variable with large effect sizes. Results of the paired samples t-test post hoc analyses indicated a statistically significant change over time for the experimental (CPRT) group and a non-statistically significant change over time for the control group on all dependent variables. Findings of this study support previous studies on the effectiveness of CPRT, but also indicate a need for future research to more accurately determine the effectiveness of CPRT for fathers compared to a waitlist control group.
