Legální a nelegální práce cizinců v České republice / Legal and illegal work of foreigners in Czech Republic

The topic of this diploma thesis is legal and illegal work of foreigners in Czech Republic. Both legal and illegal work are related to the performance of dependent work. Therefore, the thesis begins with the definition of this term when the author describes the individual characters of dependent work stipulated not only by the law but also by applicable case law. At the end of the first part, several tests of employment which are helpful for the identification of the performance of dependent work are explained. The second part is devoted to the conditions of foreigners' stay and employment in the Czech Republic, divided into two groups of foreigners. Firstly, the citizens of the EU, EEA and Switzerland and their family members, especially regarding the free movement of workes stipulated by the Treaty on the Functioning of the European Union and the topic of posting workers in the context of the transnational provision of services. Secondly, the third-country nationals who may obtain a work permit, an employee's card, a blue card or a card of an internally transferred employee for the purpose of their employment on a certain working position within a certain employer, unless they have free acces to the czech labour market. Considerando o contexto político e social dessas décadas e recorrendo à Teoria das Representações Sociais, com base em Moscovici e Jodelet, pesquisamos, em textos verbais e não verbais elaborados ou selecionados pelos autores dos materiais em foco, a existência de representações do estrangeiro e a maneira como este é configurado pela palavra e pela imagem. Buscando as representações do estrangeiro, constatamos sua presença em todas as obras examinadas, sendo representado de várias formas e associado a vários contextos de origem. Verificamos que a representação do estrangeiro como imigrante foi a que ocorreu com mais frequência, sendo encontrada em todos os didáticos desde a década de 1960. Também apuramos uma incidência crescente da presença dos estrangeiros nos textos dos materiais didáticos ao longo do tempo, com uma ampliação do número de representações e dos contextos de origem associados a eles. Este estudo mostrou que os didáticos refletiram a posição do estrangeiro na dinâmica das relações sociais de cada época e deixou evidente a impossibilidade de se descolar a produção desses materiais da conjuntura histórica de seu tempo / This study focuses on representations of foreign individuals in texts comprised in eight textbooks of Portuguese for Foreigners published in Brazil in the years 1940, 1950, 1960, 1970, 1980, 1990, 2000 and 2010. Taking into account the political and social context related to each decade and applying the Social Representation Theory based on Moscovici and Jodelet, we searched for the representations of foreigners in the verbal and nonverbal texts selected or produced by the authors of the textbooks chosen for this research. We examined the way the foreign individuals were portrayed by word or image. As a result of our investigation, we found out that there were such representations in all the textbooks studied, being the foreigner represented in many ways and associated to various origins. We verified that the foreign individual was mostly represented by the figure of the immigrant, which was detected in all the referred textbooks from 1960 on. We also perceived that the presence of foreign individuals increased in the investigated textbooks over time, with an increment in the number of representations and origins associated to the foreigners. This study showed that the textbooks reflected the position of the foreign individual in the dynamics of the social relations of each decade. It also made evident the impossibility of detaching the production of such textbooks from its historical context

Positiv särbehandling på grund av etnicitet : En studie om den svenska oviljan att kategorisera människor och strukturell diskriminering

The purpose of this thesis is to investigate Sweden’s ability to adopt positive actions based on gender and ethnicity into national legislation, in regard to EU regulations. The possibility to use positive actions is established at an EU level by both treaties and directives. EU-case law narrows the practical use of the measure. Sweden has chosen to implement positive action based on gender but not ethnicity in their national legislation, despite the fact that the allowed extent to use it would have been the same. The purpose is further to gain a deeper understanding of the problems, as well as the beneficiary effects, that positive actions based on ethnicity could lead to. The thesis applies a combination of both legal method and sociology of law perspectives. Intersectional perspectives have been applied in the thesis to obtain further knowledge about the structural discrimination of ethnic minorities in Sweden. The thesis includes an investigation of the legal grounds of positive actions based on gender to enable comparisons but the main focus will be on positive actions based on ethnicity. The Swedish discussion on positive action based on ethnicity is mainly focusing on the problem of compiling statistics on people’s ethnicity, which may be a necessary consequence of the measure to achieve explicitness. The most obvious benefit with positive action based on ethnicity is that it aims to improve the situation on the labor market of disadvantaged groups. People with foreign ethnical backgrounds are systematically discriminated in the Swedish society and since Sweden currently is facing a great migratory movement, the need for measures against systematic discrimination grows. Dividing the population into different categories can lead to segregation rather than integration on the labor market. The problem arises when the will to create opportunities for foreigners contradicts the Swedish fear of categorizing people. Possible solutions with perhaps more long-term outcomes could be to increase employers awareness of the positive economic effects of diversity in the workforce and also to increase awareness among the Swedish population about the systematic discrimination of foreigners to change social norms.

The topic of the thesis is to analyse the employment relationships with a foreign component. Firstly, the thesis focuses on the employment of citizens of the Union within the territory of the EU countries and the rights of these workers. The next chapter provides an outline of the third-country nationals and concentrates on problems arising for the long-term residents who require staying in one of the EU countries for a longer period. Eventually, the last chapter of the thesis deals with the legislation in the Czech Republic which differentiates between the nationals of the EU and other (third-country) nationals. The purpose of this thesis is to provide an overview of the legal regulation of employment of foreign workers within the European Union and the Czech Republic.

This thesis deals with tourism services accessibility for foreigners in the Czech republic, which means each service language adaptation for foreign visitors. The term of accessibility is defined in the theoretical section as well as the way of application in tourism services and the evaluation criteria. Great emphasis was laid on tourism employees language facilities and foreign language information accessibility. The services analysis was made in Prague as the most visited tourism destination in the Czech republic and then in Třebíč, town with UNESCO listed sights. The main task was map out the present state of services in term of language accessibility which are offered to foreigners and propose possible ways of other development in the areas of tourism services where the accessibility is not completely solved.

Dans cette thèse, l’auteur cherche à répondre à la question suivante : pourquoi, dans quelles conditions, et avec quelles conséquences, l’hospitalité devient-elle un concept politique ? Cette thèse met au jour les façons dont différentes traditions politiques ont fait appel à ce concept pour déterminer comment la communauté politique doit se lier aux étrangers. L’hospitalité sert ainsi un double objectif : elle permet de préciser le statut des étrangers, et elle justifie l’équilibre pratiqué entre l’inclusion et l’exclusion aux frontières. L’hospitalité apparaît donc à la fois comme une solution historique particulière au problème de la légitimation des frontières des communautés politiques, et comme un outil de problématisation des relations qui s’instaurent entre les communautés et les étrangers. Émergent ainsi différents foyers de problématisation du concept. Dans une démarche d’abord généalogique, on peut ainsi distinguer la relation rituelle qui permet de canaliser l’étrangeté du nouveau venu, la relation réciproque qui rend possible un contrat avec les citoyens, la relation sociale qui fait de l’hospitalité un devoir de protéger les faibles, la relation juridique qui reconnaît des sujets de droit et la relation d’obligation formulée par l’hospitalité des philosophes du droit naturel. Dans un second temps, l’auteur procède à une reconstruction du concept pour notre modernité, en analysant la relation éthique formulée par une hospitalité inconditionnelle, une relation politique sans hospitalité avancée par la théorie politique post-rawlsienne, et la relation démocratique qui fait de la non-domination le but poursuivi par la justice migratoire. / In this dissertation, the author raises the following question: Why, how, and with which consequences does hospitality become a political concept? The author shows how different political traditions have used this concept in order to determine the way a political community should relate to foreigners. Hospitality serves a double objective: First, it helps determining the status of foreigners, then, it justifies the practical balance between inclusion and exclusion at the borders. Thus, hospitality appears to be both a historically bound solution to the problem of the legitimation of boundaries, and a tool for problematizing the relations between communities and foreigners. The author brings to light different moments of problematization of hospitality: In a first genealogical part, he determines a ritual relation, which allows to channel the strangeness of the newcomer, a reciprocal relation, which makes possible a contract with the citizens, a social relation, which defines hospitality as a duty to protect the weak, a juridical relation, which creates subjects of law, and a relation based on obligation, as it is conceptualized by natural law theorists. In a second normative part, the author proceeds in reconstructing a political concept of hospitality that could be compatible with modern values. He analyses an ethical relation, based on the idea of an unconditional hospitality, a political relation that dismisses hospitality, as it can be found in post-Rawlsian political theory, and a democratic relation, which bases migratory justice on non-domination.

THE LINGUISTIC LANDSCAPE IN CHINA: FOREIGNERS' ATTITUDES TOWARDS INACCURATELY TRANSLATED SIGNS

This study examined the attitudes of foreigners towards inaccurately-translated signs in China. Three categories of signs were explored, including menus, restaurants' names and product labels. The researcher studied foreigners' reactions when they saw inaccurately-translated signs, the foreigners' preferences toward the bilingual signs and the factors that probably affect foreigners' perspectives on the bilingual signs. The instrument was a questionnaire, with questions about participants' backgrounds and attitudes towards bilingual signs in China. The data was analyzed through descriptive, inferential, and content analyses. The results of the study showed that the participants' Chinese-culture backgrounds most affected their attitudes toward signs most--the participants who had more Chinese background had more willingness to accept inaccurately-translated English on signs. The English translation affected the participants' choices--better English translation could attract more customers. Otherwise, the factor of design and the quality of pictures affected the participants' choices as well.

The main goal of the thesis was to analyze the life situation of foreigners in the labour market within the district of České Budějovice. This goal has been achieved. The partial goal was to find the main reason why foreign nationals come to the Czech Republic from a country of provenance and to compare the education, professional qualifications and the experience of foreigners with the jobs done within Czech Republic. The basis of this thesis is aimed at evaluating the position of foreigners within the labour market and the possibilities of their integration. The questioning method (the technique of the questionnaire) and the method of document analysis (the technique of secondary data analysis) were both used within the framework of quantitative research in this thesis. The research complex consisted of foreigners listed in evidence at the employment office in České Budějovice. This Master{\crq}s Degree thesis may be utilized, in future, as source of information about foreigners within the labour market in České Budějovice and this thesis may also be used as an origin for the of mapping of problems with employment of foreigners in Czech Republic as a whole.

The diploma thesis Integration of Foreigners in the Czech Republic deals with the social integration of immigrants into Czech society with respect to structural, cultural, interactive and identifying dimensions. These are the crucial factors influencing their stay in the Czech Rebublic. The empirical part concerns perception of Czech reality through the eyes of selected foreigners from different countries living in the Czech Republic. Their findings are collected by qualitative research. During the interview, they provided detailed information about their stay in the Czech Republic and thus revealed issues which they deal with in the host country. It came out that a significant aspect of integration is not only the similarity of cultures but also foreigners' subjective feeling of integration.

This Master Thesis, "Pro-active immigration policy in the Czech Republic" discusses the principles of the current Czech immigration policy. The thesis analyzes the evolution of the pro-active immigration policy from 1990's to the present. The paper researches the reasons why people migrate and also summarizes the views on immigration policy from some of the most prestigious schools of economic thought. The main goal of this thesis was to analyze the four main programs of the Czech pro-active immigration policy -- the pilot project Selection of Qualified Foreign Workers, charity projects in Ukraine, the resettlement of refugees from Burma and the latest project, the Green Cards. The last chapter describes the basic pillars on which immigration policy should be standing. The chapter also addresses possible reform of the current immigration policy; the principle idea is to offer visas for purchase and thereby make the system more effective.
