Estimating disparities in the treatment of foreign nationals in the criminal justice process in the Czech Republic / Odhad disparit v zacházení s cizizími statními příslušníky v trestním procesu v České RepubliceVávra, Jan January 2016 (has links)
This thesis examines the effect of foreign nationality on the outcomes of criminal process in the Czech Republic. Foreign citizens are overrepresented by 2% compared to their share in population in all stages of the criminal process, suggesting possible discrimination by domestic authorities. Using rich case level datasets from 2005 to 2015 observed gaps are decomposed to part explained by a difference in the objective characteristics of the cases and unexplained part, suggesting possible inequality of treatment. Foreigner gaps in probability of charge, probability of conviction, probability of imprisonment, length of the sentence and probability of release from prison on parole are decomposed. Majority of observed disparities in the outcomes can be attributed to higher involvement of foreigners in more serious crimes compared to nationals. Unexplained disparities remain in probability of imprisonment and probability of release on parole, suggesting possible unequal treatment in these two outcomes.

Over the years 2000, whilst the security-based referential is going through globalisation, and unlike the preventive dynamics in place for the past decades of decentralization, the legislator gradually provides childhood protection services with coercive administrative tools which restores it back to dealing with dangerous children.Whilst the outbreak of neoliberalism positions problem-stricken individuals as responsible for their condition and submits support attribution to meritocratic principles, parental educational difficulties are assimilated to deviance through a security-driven logic, and each family member goes from the status of a victim who needs support to a status of guilty individual who needs sanctioning. This therefore implies that there is only one step to take for the problematic to become a controlling measure and for the follow-up to become corrective measure of behaviours. In view of the tightening of migrating politics and in this context of exacerbating racialisation and ethnicisation of the social issue, foreign families who evolve in ZUS (« Sensitive Urban Zones ») have to submit their behaviors to dominating norms and to ideologized value systems. To a greater extent than anyone else, foreign parents, whether they are in a regular or irregular situation, must provide the conditions of an educational security for their child within a structurally organised context of social and administrative unsecurity. And to a greater extent than for anyone else, the professional in charge of childhood protection must think his action according to the statutory contingencies of each family member and see to the fact that the support measure doesn't become a stigmatism which comes on top of skin colour, origins or even living in an area within an institutional and political context which is under pressure.

The diploma thesis deals with the issue of labor migration into the Czech Republic in the years 2003 -- 2013 and verifies the hypothesis that the amount of the labor immigrants into the Czech Republic is increasing. The theoretical part defines the basic concepts related to migration, and since labor migration has the biggest impact on the labor market, it must also deals with the theory of the labor market For a deeper understanding of immigration there are explained economic theories, which deal with this issue. The legislative measures of the host country is an important factor for immigration, and therefore this topic devoted an entire chapter. The biggest added value of this work brings the fifth chapter, which deals with foreigners on the Czech labor market. The hypothesis was confirmed only partly because the number of immigrants was growing only until 2008. After that began the economic recession and many foreigners left the country, which was also caused by changes in legislation. However, economic growth is again expected influx of immigrants, and also due to the fact that the Czech government supports by its projects legal employment of foreigners in our country.
