Om rättssäkerheten i instans- och processordningen : ur ett svenskt asylrättsligt perspektiv

<p>Den 1 Mars 2006 ersattes den gamla UtlL (1989:529) av en ny UtlL (2005:716) med stora förändringar i instans- och processordningen. De grundläggande kraven på denna var att öppenheten i asylprocessen skulle öka, att de sökande skulle ges ökade möjligheter till muntlig förhandling vid överklagande av asyl- och medborgarskapsärenden, att processen skulle bestå av en tvåpartsprocess och att instans- och processordningen skulle utformas så att kraven på skyndsam handläggning uppfylldes.</p><p>I denna uppsats har rättssäkerheten för den asylsökande vid prövning av dess asylärende i den nya instans- och processordningen undersökts. Huvudfrågan lyder som följer; säkerställs rättssäkerheten i Sverige för skyddssökande vid prövning av asylärenden i den nya instans- och processordningen?</p><p>Utredning i den här uppsatsen leder till slutsatsen att rättssäkerheten i svensk asylrätt är beroende av att rådande rättsprinciper moderniseras. Offentlighetsprincipen måste tydligare särskiljas från sekretessen. Domstolarna måste beläggas med hårdare sekretesskrav och Migrationsverkets meddelandeskyldighet måste klargöras så att den sökande alltid kan få besked om skälen bakom ett beslut.</p> / <p>On March 1, 2006, the former alien’s act (1989:529) was replaced by a new alien’s act (2005:716) with major changes in the order of authority and the order of process. When the new alien’s act was developed the fundamental requirement in the legislation consisted of an increased openness in the asylum process where the applicants were to be given the possibility to verbal negotiation while appealing asylum and citizenship dossiers. Furthermore the procedure was to be comprised of a two party process and the order of authority and the order of process were to be formulated so that the requirement of rapid processing was met. This essays main issue is; is the legal security ensured for persons seeking asylum in Sweden when investigating their dossiers in the new order of authority and the new order of process?</p><p>The investigation leads to the conclusion that the legal security in the Swedish asylum right is depending on the modernization of prevailing court principles. The principle of free access to official records must be separated from secrecy and stricter demands of secrecy must be imposed on the courts. Finally the Swedish Migration Board's obligation to keep the applicants informed of the reasons behind a decision must be clarified.</p>

Dans le cadre du développement international du mouvement du libre accès aux publications scientifiques, cette thèse analyse plus précisément la situation française dans le contexte européen. Cette analyse a été menée à travers une démarche de recherche-action, au sein d’un groupe d’acteurs du Groupement français des industries de l’information (GFII) concernés par le libre accès.Nous cherchons tout d’abord à mettre en évidence les forces motrices du développement du libre accès en nous appuyant sur une méthodologie prospective développée au LIPSOR/CNAM.Les résultats nous ont conduit à contribuer à la conception d'un site d’information dont la finalité est l'affichage des politiques des éditeurs nationaux en matière d'auto-archivage afin d'accompagner les pratiques de dépôts au niveau national. L’analyse prospective a en effet révélé l’importance des embargos pour les équilibres financiers des éditeurs.De façon plus distanciée, nous amorçons également une réflexion sur l’impact réel du libre accès sur deux moteurs semblant jouer un rôle croissant dans l'économie de la connaissance, à savoir la créativité et l’interdisciplinarité. / Within the framework of the international development of open access to scientific publications, this thesis analyses more precisely the French situation in the European context. This analysis was carried out through a process of action research within a group of actors of the French Professional Group for B to B Information and Knowledge (GFII) who are concerned by open access.At first, we seek to highlight the driving forces behind the development of open access by relying on a method of prospective developed by LIPSOR/ CNAM.The results led us to contribute to the design of an information website whose purpose is to display the national publisher policies on self-archiving practices in order to support the development of new deposit practices at the national level. The prospective analysis has indeed revealed the importance of embargo periods for the financial balances of the publishers.By adopting a more distanced point of view, we initiate a new reflection about the real impact of open access on two important driving forces which seem to play an increasing role in the knowledge economy, namely creativity and interdisciplinarity.

The topic of this thesis is project and documentation for montane recreative komplex, which is situated in Loučná nad Desnou. The object is located in land-registered area Kouty nad Desnou. In this region is famous ski slope and from the hotel is nice view on this ski slope. The montane hotel respects criteria of protected landscape area Jeseníky. Architectonic plan is designed with respect to mountain scenery. In the hotel are 18 rooms with possibility 9 extra beds for 51 guests. There is a option to visit restaurant all-day. This restaurant is part of the hotel. Recreative zone is situated in north part of the hotel and this zone is devided into two parts. First part, is public and serves for all guests. This zone includes pool with whirpool bath, sauna and steam bath. Second zone is private. This zone provides privacy in massage rooms or in rooms for aromatic bath. The object is devided into four floors. Three floors are overground and one floor is underground. In the second and thirds floors are hotels rooms and rooms for clean-up and employees. First overground floor containes restauration with kitchen, coffee-bar, main hall with reception and all recreation zone, which passes to the second floor. Basement is consists of air handling units, technical rooms and housed mass garages with 21 places. Main entrance to the hotel is from south-eastern side and it is open space which passes to gallery. Type of constructional system is reinforcement framework. It is made of monolithic pillars placed on reinforcement column base with beam PEIKKO DELTABEAM. On this beam are located reinforcement ceilings elements SPIROLL. Fulfil brickwork is SILKA covered by combination of heating EPS with MW, ISOVER TWINNER with 200 millimetre thikness. Roof is combination of double cover flatbed roofs and single cover flatbed roofs. In the second floor is roof with posibility to walk to a terrace. Project was process in program ArchiCAD like BIM. The scope of this diploma thesis is design and processing of the project documentation of the guesthouse along with coffee shop. The proposed object of this thesis is located in the village Čeladná next to the golf course Prosper Golf Resort Čeladná, in the location designated for mixed constructions. One of the double-storeyed, non-cellular object with roofed surface and steep roof. The object is based on the base stripes made of plain concrete and on the reinforced concrete flaps. Carrying, perihepral and dividing walls are designed on the Velox systém. The same systém was used to design roof constructions. In the rooms with excessive width are filled with reinforced concrete columns. Part of the guesthouse and second floor of the coffee shop is designed with ventilated facade with wood paneling ThermoWood. The object is divided in two parts with common entrance section. One part of the coffee shop has ability to handle capacity of 70 guests. Part of the double-storeyed coffee shop is hygienic facilities, kitchen, room for employees, warehouse and mechanical ventilation. Second part of the object is the guesthouse with flat of the manager of the guesthouse. The guesthouse consists of room with hygienic facilities for 18 people, including barrier-free room. The rooms are divided in the first floor on separate units, the rooms with hygienic facilities and the apartments in the second floor has two rooms, kitchen and hygienic facilities. For the next parts of the guesthouse is warehouse clean and dirty laundry and shared kitchen. The whole first floor is designed as barrier-free. In front of the object is the parking lot for 21 cars, which 3 of the parking places are for the cars of the disabled.

This master´s thesis deals with a draft of a health centre building in Chlumec nad Cidlinou. The centre is situated on a corner building site with barrier-free access near the city centre. The building is designed with simple functional lines ground on foundation strips with flat green roof. The perimeter walls, internal load-bearing and shear walls are from vertically perforated T&G block bricks. Internal non-load-bearing prefab walls are coated with plasterboard. Ceiling constructions and an attic are made of monolithic reinforced concrete. The building envelope is insulated with mineral wool. Most of the perimeter walls are coated with breathable facade made of lacquered galvanized lamellas and minor part of walls is compositely insulated and plastered with a scratched facade plaster. The health centre building is notionally divided into two masses with a three-storey west part and two-storey east part of the building. Both parts are mutually connected by vertical communication space with elevator looped by counter clockwise three-flight staircase. Ambulant health care will be provided in total 9 consulting rooms, 3 ambulant care offices and private clinic with 3 consulting rooms. Independent business of the commercial area and café provide the additional function. The master´s thesis also includes assessments in terms of fire risk, energy saving and heat protection, acoustics and vibrations, lighting and sunlight.

The thesis is focused on some questions stemming from the limitations of the right to free access to information in connection with the implementation of classified information protection in the context of activities of state security organizations. The basic legislation covering this area has been summarized. Further, the thesis explores theoretical as well as practical procedures and principles aimed at minimization of both real and potential threats to individual rights and basic principles of the open society in cases of performance of such sorts of limitations. Besides, some examples of the solutions carried out in certain countries and in addition several decisions of the European Court on Human Rights are mentioned. Finally, the contemporary status of the matter in the Czech Republic is examined.

Diploma thesis describes the design and processing of project documentation of the multifunctional building. The multifunctional building is located in the central part of the town Náměšť nad Oslavou. The building has 4 floors. It is partly cellared building with flat roof and walkable terraces. This building is consisted of 2 functional parts, the first part is designed for living and the second one is designed for contact with the customer. There are shops and offices. The first floor is wheelchair accessible. In the basement there is a technical background of the building and cellars for housing units. In this multifunctional building we can find 13 residential units and five offices. All of the floors are connected with staircase and lift. The Carpark and the private garden with playground are also part of this residential area. This building is based on concrete blocks. Load-bearing, peripheral walls and connecting walls are made of ceramic blocks. A monolitic ceiling construction is the combination of the iron and the concrete. Two types of insulation are used in peripheral walls. The first one is called ETICS, external thermal insulation composite system, made of polystyrene. The second type of insulation is facade cladding system where the main insulation layer is made of mineral wool. The insulation layer is replaced by XPS polystyrene where facade is in contact with the ground. Facade cladding panels are made of cement and wood fibers called Cembrit.

This Master’s thesis deals with the design and elaboration of project documentation for the construction of a multifunctional building in Pardubice. The building is located on plots No. 2426/35 and 2426/36, in the cadastral area of Pardubice. It is located in an area close to the city center. There used to be barracks in this place. The outline of the house is "bitten" L-shaped. The building consists of civic amenities, where there are Alza showrooms, musical instrument showrooms, cafes, rehabilitation centers and massage centers. Another part are offices. All floors are barrier-free. The building has no basement. The main arterial communication of the house passes through the hall, which goes diagonally through the building. This corridor connects the individual establishments, technical facilities, stairs, elevator, and parking lot behind the building. Movement between individual floors is ensured by a monolithic staircase and an elevator. The building also includes a parking area for cars, access road and another garden with space for outdoor seating. The building is based on strip foundation and pad footing foundation made of plain concrete. The load-bearing structures are made of ceramic and brick blocks and columns. The building has a longitudinal compositional system. The ceilings are designed as reinforced concrete slabs. The exterior walls are plastered with thermo-insulating plaster. The walls in the roof entrance section are contact-insulated with mineral wool. In the place of the plinth, the insulation is made through extruded polystyrene. The roofing is designed as a single-skin flat roof with rainwater outlet/roof outlet. Next to the land there is a local road.
