Governance in Nunavut

The settlement of aboriginal claims has been on the northern policy forefront for the past two decades. At long last the settlement of these claims may be imminent. This dissertation examines a series of political-administrative strategies designed to assist in establishing a Native form of governance in light of the recent signing of the agreement-in-principle respecting aboriginal claims settlements in Nunavut, the Inuit territory in northeastern Canada. To date, research directed in the area of Native claims primarily focuses upon normative and legal foundations for the claims, the unique cultural and environmental dimensions, and the quantification of actual entitlements in the form of cash and land transfers. However, the critical and complex area of post-claims models of governance has largely been ignored. Drawing upon the public administration literature as a theoretical base, I explore a number of models that provide a means through which the distinctive aspects of aboriginal society, economy, and culture, can be maintained, while at the same time recognizing the need for continued active Native participation in the Canadian federation. In particular, primary research conducted in northern Canada serves as the catalyst for the ensuing discussion. In addition, a comparative methodology is used to highlight the negative experiences of the Alaska claims settlement, the experiences of other Canadian Native groups, and models adopted in other parts of the world. / Ph. Legal Associations: Modern United States Indian Policies and their Seventeenth-Century Antecedents

After establishing its first permanent colony in North America, the English government in the seventeenth-century began creating a legal context for their relationship with the Native Americans living in close proximity to the colonists. In a similar fashion, the United States government, immediately following independence from Great Britain, focused on developing policies to address its legal relationship with the Native American nations that resided within and on the borders of the United States. By examining the statutes, treaties, and court rulings regarding North American Indians used by both the United States and England, this thesis will highlight the close similarities that exist between modern federal policies and seventeenth-century English policies. Each chapter focuses on an important modern United States Indian policy and then presents corresponding evidence from seventeenth-century legal sources. / Master of Arts

The Comanche Indians presented a major challenge to the Republic of Texas throughout its nine-year history. The presence of the Comanches greatly slowed the westward advancement of the Texas frontier, just as it had hindered the advancing frontiers of the Spaniards and Mexicans who colonized Texas before the creation of the Republic. The Indian policy of the Republic of Texas was inconsistent. Changes in leadership brought drastic alterations in the policy pursued toward the Comanche nation. The author examines the Indian policy of the Republic, how the Comanches responded to that policy, and the impact of Texan-Comanche relations on both parties.

Indians and underdogs: notions of identity and the symbolic language of resistance in coastal Ecuador

This thesis examines identity as a process, how it is a reflection of, or reaction to, social, economic, and political circumstances. Identity is examined, through an ethnographically informed analysis, as it is represented, contested, and focused in the visual discourse of a small population. The research suggests that identity manifests at specific and strategic moments within the symbolic practices of resistance in coastal Ecuador. Grievances to economic and political power structures are acted out in clear-cut identity terms, or motifs, and function to organize diverse interests into social action. The study illustrates two identity motifs that are commonly asserted in the local context: depictions of being indigenous and of being the underdog. In the quantitative section, both OLS regression and hierarchical linear modeling show that the level of regional economic development has a significant negative correlation with public trust in the central government, controlling for individual factors. Qualitative analysis suggests that traditional culture and the flow of political information affect people’s trust in government when they interact with economic development. In places where economy is underdeveloped, traditional culture has a larger impact and the flow of political information is less free. By contrast, in places where economy is more developed, traditional culture has a weaker effect and the flow of political information is freer. / Putting the finding of the cross-sectional analysis into a dynamic perspective, it is suggested that the development of local economy may in the long run weaken local residents’ trust in the central government. More specifically, assuming that the present situation continues, as more and more regions experience economic growth, local residents may develop weaker confidence in the central government. The aim of this thesis is to reveal the need for a principled framework that would establish an effective implementation of the aboriginal peoples' right to self-government in Canada. In recent decades, many agreements instituting the right to self-government of First Nations have been concluded between the federal and provincial governments and aboriginal peoples. It then becomes important to evaluate the attempts of the two existing orders of government and the courts of Canada as regards the right to self-government and assess the potential usefulness of the two's efforts at defining and implementing the right. Firstly, the importance and legitimacy of the right to self-government is recognized through its beginnings in the human right norm of self-determination in international law to the establishment of the right in Canadian domestic law. Secondly, an evaluation of the principal attempts, on behalf of the governments and the courts, to give meaning and scope to the aboriginal right to self-government, which culminate in the conclusion of modern agreements, reveals their many inefficiencies and the need for a workable and concrete alternative. Lastly, the main lacunae of the negotiation process, the main process by which the right is concluded and implemented, and the use of the courts to determine the scope and protection of the right to self-government, are revealed. An analysis of European initiatives to entrench the right to self-government, mainly the European Charter of Self-Government and its established set of principles that guide the creation of self-government agreements, are also used in order to propose a viable option for the establishment of a principled framework for the aboriginal right to self-government in Canada.

The Whiteman's Seminole White Manhood, Indians And Slaves, And The Second Seminole War

This study demonstrates that both government officials‟ and the settlers‟ perceptions of the Seminoles and Black Seminoles in Florida were highly influenced by their paternalistic and Jeffersonian world views. These perceptions also informed their policies concerning the Seminoles and Black Seminoles. The study is separated into three sections. The first chapter covers the years of 1820-1823. This section argues that until 1823, most settlers and government officials viewed the Seminoles as noble savages that were dependent on the U.S. Furthermore, most of these individuals saw the Black Seminoles as being secure among the Seminole Indians and as no threat to white authority. The second chapter covers the years of 1823-1828 and demonstrates that during this time most settlers began to view Seminoles outside of the reservation as threats to the frontier in Florida. This reflected the Jeffersonian world view of the settlers. Government officials, on the contrary, continued to believe that the Seminole Indians were noble savages that were no threat to the frontier because of their paternal world view. Both groups by 1828 wanted the Seminoles and Black Seminoles separated. The final chapter covers the years of 1829-1836. It argues that by 1835 both settlers and government officials believed that the Seminoles and Black Seminoles were clear threats to the frontier because of the fear of a slave revolt and the beginning of Seminole resistance to removal. Most of the shifts in the perception of the Seminoles and Black Seminoles by government officials and the settlers were the result of their white gender and racial world views that then in turn affected their policies towards the Seminoles and Black Seminoles
