Problematika osobnosti pachatele v kriminologii / The Issue of an Offender's Personality in Criminology

Poučenská, Dominika January 2019 (has links)
The Issue of an Offender's Personality in Criminology Abstract The aim of this master's thesis was to describe the issue of the offender's personality in criminology. The first part of the thesis deals with the definition of basic terms, criminological theories and the offender's personality from the perspective of general knowledge, and then from the perspective of forensic psychology. The second part deals with the issue of economic crimes, mainly defines the concept of economic crime, describes the Czech legal regulation of economic crimes, deals with the causes, prevention and specific characteristics of the economic crime offenders. In the third part of the thesis, I try to apply my acquired knowledge to a specific case of the economic crime offender. Since the offender's personality has a significant role to play in clarifying the causes of crime, many criminological theories have emerged over the course of history to clarify what causes criminal behavior. These theories focus on biological, psychological, sociological factors, etc. Each individual has a personality which is unique. Some elements of our personality can't be affected, e.g. temperament, other are created and changed during the course of our lives, e.g. elements that determine our character. The motivation behind every offense also plays...

Dynamický model všeobecné rovnováhy a odhad dopadů environmentální politiky zaměřené na podporu biopaliv v České republice / The Dynamic CGE Model and Analysis of Impacts of Environmental Policy

Píša, Vítězslav January 2016 (has links)
The thesis evaluates three revenue neutral mixes of political measures aimed at the support of utilization of biofuels in the Czech Republic. The dynamic computable general equilibrium model with three aggregated sectors and two types of households is applied for evaluation of relevant environmental and economic impacts. The hypothetic price subsidy of utilization of energy biomass in production of the first generation biofuels fulfilling sustainability criteria is chosen as the basic supportive tool. The revenue neutrality is satisfied via adequate increase in tax rates in three different alternative scenarios (via labor tax, motor fuel tax, and standard value added tax). The results indicate that at the current price level of crude oil even relatively high level of price subsidy is not sufficient in fulfilling the emission and biofuel share targets presumed by European Commission. Therefore, for attaining the biofuel share target high percentage first generation biofuels and second and third generation biofuels have to be utilized. Furthermore, for the fulfilling of emission targets other alternative fuels have to be utilized as well. The results finally reveal that environmentally most efficient mix is the price subsidy compensated via an increase in the motor fuel tax, economically most...

Dopady ekonomické krize na divadlo v ČR / IMPACTS OF ECONOMIC CRISIS TO CZECH THEATRE

Chrdle, Milan January 2014 (has links)
This master's thesis describes the real impact of the financial crisis on the theatre. Both on the theatre as a discipline, and on the individual theatre groups. In the first part, the work points out the general causes of the financial crisis. It also describes its influence on the economy of Czech republic and associated revenues of the state budget. On the example of Prague's and selected regional theatres, the paper tries to define the impacts of the economic recession, and describes methods how theatres are dealing with an unfavourable situation. One part of the thesis consists of a questionnaire survey carried out among the representatives of theatre subjects, as well as among the audiences. The work deliberately avoids comparisons with the impacts of the financial crisis on other theatres in other countries, as the conditions of their existence are diametrically opposed, regardless of the crisis.

Německo, Francie a krize Eura. Najde německo-francouzský pár společné východisko? Konvergencí a rozdíly z francouzsko-německého krizového řízení / Germany, France and Euro Crisis. Will Germany and France find a common solution? Convergences und divergences in the German-French crisis management

Audiová, Kristýna January 2014 (has links)
This diploma thesis deals with the topic German-French cooperation on crisis management in the eurozone. Germany and France, represented by chancellor Merkel and president Sarkozy, cooperated together very closely during the crisis and contributed significantly to the further deepening of European economic and monetary union. The aim of this thesis is to analyze and compare the features of the German and French European policy and the German and French ideas about the functioning of economic and monetary union. Secondly, to examine the progress of the German- French cooperation on finding crisis solutions. And finally to define convergence and divergence in the crisis management of both countries. Due to different ideas about economic policy - the German ordoliberalism and French concept called Gouvernance économique - both countries were forced to make mutual concessions. The most important compromises within the anti-crisis measures are the bailouts to indebted countries, European rescue funds or tightening budgetary discipline of European countries by using the fiscal pact. Nevertheless, there are still areas in which both countries disagree, primarily the Eurobonds and other measures to support economic growth. The last part is devoted to the question of German models implementation into the EU and the...

Bid rigging ve veřejných zakázkách / Bid rigging in public procurement

Kohútová, Zuzana January 2014 (has links)
The thesis provides for a comprehensive legal overview of bid rigging and its manifestation in public procurement. Bid rigging is defined as coordination of competitors in tenders which is not necessary and which is executed when these competitors submit bids according to the conditions agreed among them. The thesis briefly sums up available information on occurrence of bid rigging with emphasis on the only two cases of bid rigging that have been identified, proved and sanctioned in the Czech Republic. This information suggests that despite the fact that the risk of bid rigging is higher at certain markets, notably markets with limited number of competitors present thereon, it may take place in any market. Bid rigging is further analysed as a prohibited agreement distorting competition which always distorts or prevents competitions and as such is considered one of the most serious anti- competitive practices capable of causing immense economic damage. A separate chapter tackles bid rigging in public procurement. This chapter analyses legal basis of prohibition of bid rigging in public procurement, its impact on principles of efficiency, effectiveness and expediency, and points out factors that may support occurrence of bid rigging. With regards to this analysis, the thesis formulates several...

Tumpachová, Kateřina January 2015 (has links)
This diploma thesis deals with trademark in competition. It analyses the position of the trademark owner from the point of view of rights provided by the legal system in connection with his trademark ownership. The aim of the thesis is to answer the question which rights are granted to the trademark owner by the trademark law, which rights are granted to him by the unfair competition law and to depict mutual correlation of those two legal branches from the mentioned point of view. In order to achieve these targets the thesis is divided into three chapters. The first chapter deals with the trademark owner rights, where it analyses the regulation of these rights in Czech legal system, i.e. provision of act -No. 441/2003 Sb. on trademarks, considering European directives on trademarks (No. 89/104 and 2008/95/ES). This is followed by the judicature of the Supreme Court of the Czech Republic and of the Court of Justice of the European Union explaining these legal provisions. The provisions of Council Regulation on the Community trade mark (No. 207/2009) and Paris Convention for the Protection of Industrial Property are also mentioned. For the purpose of further explanation the second chapter brings an analysis of the competitor's protection by the unfair competition law from the provisions relevant for...
