Legal access to our musical history: an investigation into the copyright implications of archived musical recordings held at the International Library of African Music (ILAM) in South AfricaMcConnachie, Boudina January 2009 (has links)
This thesis explores the South African Copyright Act No. 98 of 1978 as it pertains to the archived holdings at the International Library of African Music (ILAM) situated at Rhodes University, Grahamstown, South Africa. The purpose of analysing this law is to advise and assist ILAM in fulfilling royalty payment obligations as stipulated in a contract signed between ILAM and the Smithsonian Global Sound (formally Global Sound Network) in 2001. In order to clearly comprehend the scope of the royalty payment clause in the Smithsonian Institution’s contract with ILAM, this research includes an examination of: the history and nature of South African copyright as a sub-structure of intellectual property; specific internationally documented copyright infringement cases; the recording and documentation practices of Hugh Tracey (ILAM’s founder and director from 1954 to 1977); the contract between Global Sound Network and ILAM; and contentious issues surrounding collective ownership and indigenous knowledge. In conclusion, this research suggests equitable solutions to ILAM’s copyright concerns and proposes the Eastern Cape Music Archiving Project (ECMAP) as a practical vehicle to assist the South African Department of Trade and Industry in implementation of the South African Intellectual Property Amendment Bill (2008) if, and when, it is passed.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / Este trabalho analisa questões relacionadas a interação entre ciência e os valores de acordo com o modelo de desenvolvimento científico apresentado por Hugh Lacey. É realizado um exame das principais questões relacionadas ao ideal de uma ciência livre de valores, que possui raízes na defesa da autonomia científica feita por Galileu Galilei; o lugar que estes valores (cognitivos e não-cognitivos) ocupam e seu grau de influência dentro da pesquisa científica. Uma comparação entre as noções de paradigma e estratégia propostas por Thomas Kuhn e Hugh Lacey, respectivamente, são apresentadas, bem como as posições de Helen Longino como representante de um fazer científico feminista. Esta dissertação também apresenta o estudo de caso acerca da implantação e uso das sementes transgênicas. Mais do que um simples exemplo, o estudo de caso apresentado por Lacey abre oportunidade para a pluralidade de estratégias na ciência como principal modo de alcançar o bem estar de todos. / This paper discusses issues related to interaction between science and values according to the scientific development model presented by Hugh Lacey. It is carried out an examination of the main issues related to the ideal of a free science of values, which has roots in the defense of scientific autonomy made by Galileo Galilei; the place that these values (cognitive and non-cognitive) occupy and their degree of influence within the scientific research. A comparison between the notions of paradigm and strategy proposed by Thomas Kuhn and Hugh Lacey, respectively, are presented as well as Helen Longino positions as representative of a feminist scientific work. This thesis also presents a case study on the implementation and use of transgenic seeds. More than a simple example, the case study presented by Lacey opens opportunity for several different strategies in science as the main way to achieve the welfare of all.

The social biography of ethnomusicological field recordings : eliciting responses to Hugh Tracey's 'The Sound of Africa' seriesLobley, Noel James January 2010 (has links)
This thesis is an ethnographic analysis of a collection of field recordings of music from sub-Saharan Africa: The Sound of Africa series made and published by Hugh Tracey between 1933 and 1973. I analyse the aims, methods, value and potential use of this collection, now held at the International Library of African Music (ILAM), in order to address a gap in the ethnomusicological literature and to begin to develop a critical framework for an evaluation of field recording and aural ethnography. An archival analysis of the collection enables me to trace the scope and intended uses of Tracey’s recordings. Identifying a primary intended audience that has not to date been engaged, I argue for the need to develop a new way to circulate recordings among a source community that has never before been reached through institutional archival practice. I use a small sample of Tracey’s archival Xhosa recordings and develop a method of sound elicitation designed to take the recordings back to urban Xhosa communities in the townships located near ILAM. By circulating archival recordings using local mechanisms in township communities, rather than institutional archival methods, I assess the potential relevance of historical recordings to an urban source community more than fifty years after the recordings were made. Having collected and analysed contemporary Xhosa responses, I consider the limitations and the potential for the recordings to connect with indigenous audiences and generate value. I argue that non-analytical responses to historical recordings may contribute to ethnographic understanding, to people’s own sense of Xhosa identity, and to archiving practice in future. Such responses may help increase our understanding of the relationships between music collectors in the field and the people recorded, whether fifty years ago, today or in future.

One of the first Czech research papers on self-publishing. Even though unsuccessful and forbidden authors could publish a book on their own in the past, the current phenomenon of self-publishing can be arranged on-line in just a few clicks and for much cheaper. Self- publishing began to spread since circa 2005 - in the Czech Republic and abroad simultaneously. This thesis shows how the development has unfolded differently in the Czech Republic and in the USA, which is considered the cradle of this technology. The first chapter of this thesis analyzes the history of book publishing and many different ways to publish a book, and defines self-publishing. The second chapter shows how the new technologies and media influenced the expansion of self-publishing. The third chapter analyzes and puts into context some of the Czech and the American self-publishing portals, and compares the providers of these services. Many professionals - editors, authors, and literary critics - criticize self-publishing for its amateurism and low quality content, which this work takes into account as well. This paper also documents some of the rare cases of self-published authors, who managed to succeed despite the tough competition from traditional publishing houses. The subject of this dissertation is W. H. Auden's use of the Jungian psychology of individuation and the Kierkegaardian theology of existence. Its purpose is to demonstrate the importance of Jungian and Kierkegaardian thought in poetry written during 1939 through 1942, the first four years of Auden's residency in the United States and the first four years of his return to the church. The purpose is achieved by applying a paradigm encompassing both psychology and theology to an analysis of Jungian and Kierkegaardian thought in the principal sonnets of "The Quest" and to a detailed explication of two longer poems, New Year Letter and For the Time Being.
