Rights and obligations of employer and employee : a study in the light of South African labour law and the Shari'ah.

This thesis looks at the South African development of employment legislation, the provision of the contract of employment, and employee-employer relationship. It briefly examines the historical development of such relationship in South Africa and the most recent legislation. In addition, this thesis also examines existing Islamic literature on the employee-employer relationship and analyzes these principles. The precedence set by Muslim jurists and the juridical verdicts are critically analyzed and discussed. The overall findings of this research into Islamic and South African perspectives on employee-employer relationship will hopefully have implications for policy makers, Islamic scholars, non-governmental organizations and a whole range of stakeholders, both locally and internationally. / Thesis (M.A)-University of Durban-Westville, 2004.

(Holy Qur'aan, 49:13). / This thesis is laid down in accordance with GOD's order to connect civilizations with each other and to benefit from each other's experience and knowledge toward a much better future for humanity. / The thesis tries to reflect upon the opinions of Islamic Fiqh with regard to the contract of international carriage of passengers by air and e-ticketing in a manner that is understandable to both Fiqh oriented and Western Law oriented readers. Therefore, it has been designed to include three major Parts where the first introduces the Western Law oriented reader to Islamic Fiqh. The Second Part introduces the Fiqh Oriented reader to the world of tickets and travel documents. Finally, the third chapter concentrates on the issue of electronic ticketing. The present work deals with establishing of the exact meaning of the technical terms used by al-Kindi in the longest of his extant philosophical treatises, The Letter on the First Philosophy. On many occasions, however, when the meaning of a term appeared to be obscure in the Letter, the evidence of al-Kindī's usage of such a term has had to be brought forward from his other philosophical works in order to elucidate its meaning as accurately as possible. / Much attention has been paid to the original significance of the terms that are al-Kindī's translation of Aristotle's philosophical vocabulary. In some instances, when the difference between the Aristotelian usage and that of al-Kindī appeared to be crucial (as for example, in case of the terms ή κοvιή άίσθησις (the common sense), and al-ḥiss al-kullī (the universal sense), both usages have been given in a detailed exposition. / Whenever helpful to clarify the meaning of the terms, the definitions of philosophical terms given by al-Tahānawī in the Ka shshaf, have been included with the definitions proper to al-Kindī. / Most of the philosophical terms have been analyzed in their proper philosophical contexts, which allows not only elucidating more distinctly their meanings but also delineating the main themes of al-Kindī's philosophy.

Diyah as a third dimension to air carrier liability conventions

This abstract is written on the 11th of September 2006---the fifth anniversary of the 9/11 attacks on the World Trade Center and the Pentagon by Al-Qaeda. These attacks are taken to be a turning point in the relationship between Islam and the West. For the author, these attacks, the overwhelming counter-attacks by some of the western states on some Islamic states, as well as the endless Palestinian-Israeli disputes, are the result of misunderstanding and misconceptions that Islam and the West have of each other. / While politics and politicians are destroying means of communication amongst these nations by the creation of such a state of war, scholars should exert their best efforts to build bridges of understanding and tolerance. / This thesis is but a single brick in the much needed bridge of communication and understanding between the great civilisations of west and east. It seeks to show how the world's various legal traditions can benefit from each other. It attempts to do so by introducing the Islamic system of diyah and showing how it can interplay with and impact on the interpretation of international law. The example chosen is the existing set of air carrier liability conventions. 9/11 reminds us that attacks on air transport have been a chosen means of sowing conflict. / Yet peaceful use of air transport is among the most practical ties that bind the world together. Air carrier liability conventions render international air transport possible. The thesis shows how Islamic diyah can productively interact with these conventions. It can act as a median point at which the two extremes of the Warsaw System prescribing limited liability and the Montreal Convention prescribing unlimited liability can meet. The thesis shows as well how diyah can provide a useful methodology for integrating air carrier contractual and extra-contractual liability regimes. / To assist the reader unfamiliar with Islamic-fiqh, the thesis it is divided into two parts. The first is devoted to an introduction to Islamic-fiqh, and the second treats the interaction of diyah with the air carrier liability conventions.
