Mravnostní kriminalita a její prevence / SexualCrimes and TheirPrevention

The submitted diploma thesis deals with sexual offences and their prevention. At the beginning of the thesis, a theoretical basis and a historical overview of the subject are mentioned. The topic is enlarged on various aproaches to ethics and morals in history. Subsequently a legal regulation of these criminal offencesis descibed, not onlythe Czech criminal law, but also the international law and EU legislation. A significant attention is given to the analysis of the elements of sexual crimes, as well as to a statistical data analysis and suggested preventi on measures. The thesis also gives a detailed descripton of types of victims and petrpetrators, especially of the ones who are involved in aforementioned crimes.

Master's thesis is focused on computer crime, with an emphasis on the process of investigation. New systematics in Czech computer crime terminology is offered. Within the thesis, cybercrime is perceived as a part of computer crime. Special attention is put on various aspects of criminalistics, as the topic of investigation itself is understood from the point of view of such science. Nevertheless, criminological findings are discussed likewise. Particular emphasis is put on a link between Czech legal regulation and expert literature from the fields of law, criminalistics, criminology and technology. Master's thesis is based on Czech literature, as well as English and French writings, in addition to national and international case law. The text itself is divided into three chapters. First chapter is introducing the issue of computer and cybercrime with selected criminological characteristics, including specifics of offending within the Internet. Second chapter discusses evidence of computer crime, the electronic or digital evidence, from the point of view of criminalistics. 1 Criminological aspects of crimes committed by legal entities Abstract The subject of this work is problematic of criminological aspects of crimes committed by legal entities, and the individual definition of a legal entity as a criminal offender. The institute of criminal liability of legal entities is relatively young, provided that the research in this field began in the second half of the 20th century. In the nowadays the research of criminal liability of legal entities is still actual topic, namely because it is massive, often concealed, sophisticated and dangerous phenomenon. The importance of research of this criminal activity grows in line with globalization of world economy and the growing importance held by the legal entities in society. The outputs of the researched issue can thus enable an adequate response to the crimes of legal entities and help create effective prevention programs. This work is divided into four parts. Thesis focuses on alternative sanctions as a way of solution of woman criminality. It describes woman criminality, its distinctiveness, by which this criminality differs from man criminality and it also introduces history of this field. It calls attention for special treatment of women, who are due to their anti-social behavior sent to prison and it lists specifics related to their imprisonment. It calls attention for problem of short-term imprisonment and need for finding alternative ways of offenders' punishments. It provides insight into the field of alternative sanctions and considering social role of woman it gives arguments for widening of applying alternative sanctions for this group of offenders. 107 Forms of crime committed by organized crime - Abstract The aim of this work was to map the range of criminal offenses and other criminal acts perpetrated by perpetrators of organized crime. Members and supporters of criminal organizations commit a large number of different offenses, primarily with the intention of obtaining illegal profits. However, some actions aim at legalizing previous revenues, establishing contacts in police, justice, and public administration, or to prevent these groups from being exposed. A specific crime may have multiple meanings in the overall strategy of the organized crime subject. Such an act is committed to both profits and cover- up (eg murder, extortion). This work is divided into three parts. The first part, consisting of Chapter 1, deals with the theoretical and legal definition of organized crime and other related concepts, such as organized groups and organized criminal groups. Basis: Statistical data of the Police of the Czech Republic show that secondary drug crime is widespread among abusers of addictive substances in the entire Czech Republic. The crime is mainly due to the need for financial resources for buying the addictive substance. As a result, every addictive substance abuser is perceived as a potential perpetrator of a crime. Aim: The aim of this diploma thesis was to find out the incidence of secondary drug criminality in the clients of the contact center DRUG - OUT Klub, z. s. in Ústí nad Labem, and to study the effect of selected influential demographic factors (gender, age, type of addictive substance, duration of addictive substance abuse). Methods and Research Sample: The research was conducted in the drug addiction treatment center DRUG - OUT Klub, s. z. in Ústí nad Labem using a questionnaire. The research respondents were problem abusers of opioids and stimulants. The research sample was selected with help of the institution. Every client of the contact center, who was a problem opioid or stimulant abuser, was over 18 years old, and agreed to be part of the research could participate. The theoretical part focuses on explaining the concepts and characteristics of the alcohol, crime, violent crime and the concept of alcohol as a criminogenic factor. There are the chapters specifically aimed at women and alcohol and women-murderess. The first part summarizes the essentials of what was published in this issues. The work is accompanied by several illustrative charts. The practical part focuses on qualitative research using methods of analysis of court files. This Master's Thesis examines the issue of criminal law in the Czech road traffic sector and crime prevention. The Thesis tackles the basic concepts of traffic law and traffic accidents, which are the most visible results of traffic offenses, that cause damage to life, health and property. The problem of traffic accidents is their unpredictability, as no driver wants to cause them voluntarily. However, these are often the result of the driver's own behaviour. The Thesis offers a new approach to the issue of traffic accidents where the most common cause of accidents is the violation of traffic regulation. In my assessment, the driver's distraction, recklessness towards other drivers and a poor driving technique figures among the key factors. This statement is proved by an analysis of existing accident statistics and their comparison with the drivers' actual behaviour. The highest number of criminal offenses, such as manslaughter, personal injury or property damage is linked to the consequences of traffic accidents. These offenses are committed in most cases by gross negligence. This thesis deals with legislation with the task of dealing with environmental crime in the area of illegal trading of flora and fauna in the Czech Republic. Of key importance for this thesis is the examination of domestic criminal legislation, it is supplemented by an excursion into related regulations of international law and European Union law. Introduce also the actual phenomenon of illegal trading of fauna and flora, its characteristic features, historical development, the articles most frequently traded, and other specific features that are typical of this type of illegal human activity. The theoretical bases of the thesis are enhanced by an examination of related practice in the form of practical examples, court rulings, and statistical data. Finally, this thesis also contains a few proposals for improving the existing legislation and raises some objections to practical application.
