The Studies on the Practical Execution of Taiwan Commercial Shipping Associated With the Cases of Stowaway.Ko, Chai-lin 01 September 2008 (has links)
Captain is a key player for controlling the commercial shipping and has the major role in dealing with the occurrence and process of stowaway case. His decision on handling the stowaway is often complicated by the unnecessary legal issues if it is not following the normal process such as the violation of unlawful action on processing the stowaway issue. The stowaway case always has been a serious problem in commercial shipping. It often causes unnecessary legal issues for shipping owner and captain because of unwise decision from the ship captain.
Since the occurrence of 911 terrorism in 2001, International Ship and Port facility Security Code (ISPS Code) has adopted more restrict security code on the prevention of stowaway, but it has indirectly resulted in the tendency toward underground and better organized shipping stowaway crime. This change has also provided guidance for captain¡¦s decision on the process of stowaway case.
The present study illustrates two important stowaway cases occurred at Taiwan commercial shipping lines. One is related to liner, the Maersk Dubai, and the other is for tramp, the Well Pescadoies. The present study made comparison on both case handling processes and their treatments on stowaways and the problems of derived legal actions resulting from the unwise and unnecessary actions from the ship captains. The study adopted the person to person interview results and discussion with ship captains, literature search, and case legal documents for analyzing the possible process problem of stowaway associated with both cases.
The present study summarized the precautionary approaches and guidance for ship owner and captain on the prevention of stowaway and the requirement of ISPSC code including related IMO convention, protocol, and regulation. Other main concerns are how to promote the shipping security including the duty of captain and the interests of shipping owner.

Dovoz zboží do EU s důrazem na námořní přepravu kontejnerů / Import of goods to European Union with focus on seaborne container transportMilková, Andrea January 2008 (has links)
The diploma thesis describes seaborne transport of goods in general, and furthermore specifies the current dilemma of existing cartels - conferences - in this industry. I also describe containerization, general situation on container transport market with a hint of latest information about this market. Next chapter describes legislative rules of European Union that shape import of goods to Union. As it was not possible to describe all of them, I concentrate only on those rules involving import of containers. The goal of researching EU import legislation was to familiriaze myself with all activities and information, which an importer must take care of and possess, before he gets in touch with a shipping carrier about the transport itself. I managed to mention the most basic and important points, which importers of goods must apply.

Specialförbandsoperationer i en modern marin kontextAgge Hagberg, Adam January 2021 (has links)
The use of special forces has increased rapidly due to terrorist threats, hybrid and irregular warfare. This has also resulted in an increased need for special and conventional forces to cooperate. Pirate attacks outside the horn of Africa and the bombing of USS Cole demonstrate how these asymmetrical threats also have an impact on the naval arena. The aim of this thesis is to understand how the six principles in McRaven’s special forces theory can explain the outcome of the rescue operation during the Maersk Alabama Hijacking in 2009, where DEVGRU (United States Navy Special Warfare Development Group) and conventional naval forces cooperated and managed to successfully liberate Captain Richard Philips. These findings will contribute to assess the critical prerequisites of success for special forces operations in the modern naval environment and evaluate if these operations can be explained by existing special forces theories. The result of this study shows that McRavens theory can explain the outcome of the rescue of Philips, were the principles of surprise, simplicity and security had large significance. The rescue operation also shows that cooperation between DEVGRU and the US navy vessels were essential for the operational success.
