Rethinking Turkey's Laicism In Light Of The Debates About Liberal NeutralityTasgetiren, Omer 12 August 2016 (has links)
The dissertation examines in detail the concept of neutrality in political theory literature and assesses the arguments of the defenders and critics of Turkey’s laicism in light of such an examination. After showing the weaknesses and problems in the arguments of various political actors in Turkey, the dissertation defends “modus vivendi liberalism” as a possible solution for the conflicts about Turkey’s laicism. In that regard, the dissertation argues that certain aspects of liberal political theory can be appropriated for Turkish politics for the sake of ensuring stability and peace even if there might be problems with the possibility and desirability of neutrality. The dissertation also discusses what can constitute Turkey’s modus vivendi and offer certain ideas about what may and may not ensure stability and peace in Turkey.

The purpose of this essay is, in a political philosophy perspective, to offer an illumination of John Stuart Mill¡¦s thoughts on modernity. In this essay, firstly, in the first chapter, I will try to elaborate the reason why I write this essay and take a perspective of history and political philosophy as my analytic viewpoint. Moreover, I also briefly introduce Mill¡¦s writings and the frameworks of this essay. In the second chapter, I describe the events, movements, and thoughts that gradually shape the modernity. From the standpoints of Weber, Hume and Romanticism, I also refer to one of the most important characteristics of modernity in political philosophy: value pluralism. In Mill¡¦s thoughts, how to response to the problem derived from value pluralism is my most important discourse. In the following chapter, I offer an exposition to detail Mill¡¦s discourses on modernity, focusing on his utilitarianism and liberalism. I mainly discuss how Mill¡¦s principles of utility and liberty response to the problem derived from value pluralism. I also discuss two contemporary thinkers¡¦ thoughts to find Mill¡¦s discourses on modernity, namely John Rawls and John Gray. In the fourth chapter, I assess and review the criticisms on Mill¡¦s discourses on modernity. In the conclusion chapter, I briefly go through the major viewpoints of this essay.

In this study, John Gray&rsquo / s theory of value-pluralism is critically analyzed. Gray&rsquo / s modus vivendi, based on Isaiah Berlin&rsquo / s criticism of monism, is a theory that aims to create the conditions in which peace and diversity in late-modern societies can be protected. Gray argues that a legally pluralistic system where
collectives have autonomy is more serving to peace than its liberal alternatives. This study argues that Gray fails to achieve its goal of promoting diversity. This is due to the fact that Gray&rsquo / s theory does not recognize &lsquo / personal autonomy&rsquo / and &lsquo / right of exit&rsquo / as standards for a legitimate regime. It is argued in this study that without &lsquo / personal autonomy&rsquo / and &lsquo / right of exit&rsquo / , legally pluralist systems curb the conditions that makes diversity possible and thereby work at the expense of diversity rather than for diversity.

Precis The Political philosophy of John Gray touches a number of topics and also has gone thrue a couple of modifications. However this thesis aims to show that there can be found a consistent political doctrine of agonistic liberalism in Gray's thought that arises from his critigue of rationalistic theories of liberalism. Agonistic liberalism is based on the naturalistic ethical theory of value-pluralism which Gray adopted whit some modifications from Isaiah Berlin. On the ground of incommensurability and uncombinability of some values within individuel lives as well as within life forms Gray comes to conclusion that the conflict of values is ineradicable part of our lives. And that's the reason why any legel or political theory cannot set up a set of liberal principles that could claim universal validity. That is why Gray sets up the concept of modus vivendi, political ideal of coexistence of individuals, groups and societies based on mutual toleration. With regard to the rational indeterminacy of conflicts over values, according to agonistic liberalism these conflict has to by resolved by political means.

Sharing the land: the formation of the Vancouver Island (or 'Douglas') Treaties of 1850-1854 in historical, legal and comparative contextVallance, Neil 18 March 2016 (has links)
Chapter I introduces the Vancouver Island or ‘Douglas’ Treaties of 1850-54, entered into between several Vancouver Island First Nations and Hudson’s Bay Company Chief Factor, James Douglas, acting as agent of the Crown. The written versions purported to extinguish the aboriginal title of the First Nations to their land. Recent research has indicated that these documents do not accurately reflect what was agreed between the parties at the treaty meetings. The goal of the dissertation is to ascertain the likely terms of the treaties. This task also posed my major research challenge, as very little contemporaneous documentation exists of the formation of the treaties. There are a number of first- and second-hand accounts reduced to writing long after the events described, but they have received little attention from scholars until now. Chapter II is devoted to a critical analysis and comparison of the extant First Nation and colonial accounts, from which I conclude that the treaties were likely agreements by the First Nations to share not cede their land. Chapter III makes a comparison with first person accounts of the Washington or ‘Stevens’ Treaties of 1854-55, entered into between

viii Native American tribes and the United States government. I conclude that these accounts
bolster the likelihood that the Vancouver Island agreements were sharing treaties. Chapter IV follows up on a fascinating connection between the written versions of the Vancouver Island Treaties and an agreement concerning land between the Ngai Tahu Moari of New Zealand’s south island and Henry Kemp, acting as agent of the Crown. The comparison provides a number of useful contrasts and parallels with the Vancouver Island Treaties. Chapter V describes the silencing of the Vancouver Island Treaties by the policies of successive governments, the inattention of scholars and the decisions of Canadian courts. Finally, Chapter VI reviews existing and potential categories of historical treaties between First Nations and the Crown. By analogy with treaty categories in international law and the work of political and legal theorists, I make the case for the Vancouver Island Treaties as examples of modus vivendi (interim or framework agreements). / Graduate / 2017-02-24

Cette étude s’applique à démontrer comment la relation documentaire peut être mise à l’épreuve du pardon dans deux films mettant en scène des bourreaux. Comment est-il possible de concevoir un dispositif cinématographique éthique avec la participation d’anciens criminels ? C’est la question que se sont posée les cinéastes Avi Mograbi et Rithy Panh. L’objectif de cette recherche sera de relever comment le pardon intervient explicitement, mais aussi implicitement, dans la forme documentaire. Il s’agira de comprendre comment ces films, "Z32" et "S21 la machine de mort khmère rouge", s’élaborent socialement, politiquement et esthétiquement du tournage à la réception, afin de cerner le potentiel symbolique et performatif du pardon dans la reconstruction du lien avec autrui. / In this study we strive to show how the notion of relationship, conjured up by the documentary, is challenged by the act of forgiving in two films depicting executioners. Is it possible to conceive of a filmic project that would be at the same time ethical and include the participation of former criminals? Such is the question raised by the filmmakers Avi Mograbi and Rithy Panh. The purpose of our research will be to highlight instances where forgiveness unfolds, both explicitly and implicitly, in the documentary form. We will thus try to understand how the films "Z32" and "S21 la machine de mort khmère rouge" find a social, political and aesthetic existence, from shooting to reception. In this way the symbolic and performative potential of the act of forgiving will be revealed in its relation to the reconstruction of the bond with the other.

Previous issue date: 2017-08-11 / Nosso objetivo com este trabalho é desenvolver uma exposição da crítica que David Hume lança contra os céticos pirrônicos na obra Investigação Sobre o Entendimento Humano, mostrando que se mantém de pé à luz da contemporânea compreensão que se tem do ceticismo esboçado por Sexto Empírico no Livro I das Hipotiposes Pirrônicas. Veremos por qual argumento Sexto defende, ao pirrônico, uma vida sem crenças. Então cotejamos o trabalho de Sexto com, principalmente, as conclusões do debate travado entre Michael Frede e Myles Burnyeat (interpretações urbana e rústica) sobre a possibilidade de o pirrônico ser coerente com seu pirronismo, i. é, o modus vivendi pirrônico sem crenças, endossando a posição de Burnyeat sobre sua inviabilidade. Apresentaremos, ainda, uma bibliografia virtual pela qual Hume poderia ter-se educado sobre Sexto e seu pirronismo, objeções apresentadas por Julia Annas à compreensão de Hume do ceticismo antigo e, finalmente, ponderaremos a posição de alguns comentadores que veem no ceticismo mitigado de Hume, antes de tudo, uma espécie de pirronismo. Munidos dessas análises, na medida em que o cerne da crítica de Hume é a suspensão total das crenças pelos pirrônicos, como assim também a inescapável natureza humana calcada no mecanismo instintivo do hábito ou costume como gerador de crenças relativas aos objetos empíricos de nossos raciocínios, então, não se pode negar a validade da crítica de Hume. / Our goal with this work is to develop a exposition of the David Hume’s criticism against the Pyrrhonean Skeptics in the work An Enquiry Concerning Human Understanding, showing that it stands in the light of the contemporary understanding of skepticism outlined by Sextus Empiricus in Book I of Outlines of Pyrrhonism. We will see by what argument Sextus argues, in the side of the pyrrhonist, a life without beliefs. Then, we compare the work of Sextus with, mainly, the debate’s conclusions between Michael Frede e Myles Burnyeat (urbane and rustic interpretations) concern the possibility of the pyrrhonist engage coherently in his Pyrrhonism, t. is, the Pyrrhonean modus vivendi without beliefs, endorsing the Burnyeat’s position about it infeasibility. We will present, furthermore, a virtual bibliography by which Hume could have educated himself concerning Sextus and his Pyrrhonism, objections presented by Julia Annas against the comprehension of Hume about ancient skepticism and, finally, we will ponder the position of some commentators who see in the mitigated skepticism of Hume, first of all, a sort of Pyrrhonism. Armed with this analyzes, to the extent that the core of Hume’s criticism is the total suspension of beliefs by the pyrrhonists, as well as the inescapable human nature grounded in the instinctive mechanism of habit or custom as the generator of beliefs concerning the empirical objects of our reasoning, then, one cannot deny the validity of Hume’s critique.
