<p>This study examined if social distance, i.e. in- vs. out-group membership, had an effect on moral judgments of acts vs. omissions. 164 participants judged the morality of acts vs. omissions of lethal harm, that affected an in- vs. out-group member of the participant, in order to save five other people. The results showed that acts of lethal, but utilitarian, harm were judged more immoral than omissions of equivalent harm. It was also shown that if the victim was an in- group member of the participant the behavior was judged more immoral than if the victim was an out-group member of the participant. However, the acts and omissions of harm were not judged differently when the victim was an in.- vs. out-group member of the participant, indicating that this kind of social distance might not influence the moral judgment of acts and omissions.</p><p> </p>

Translating from Practitioners to Patients : Adaption for a new type of readershipLundberg, Turid January 2013 (has links)
The aim of this paper is to analyse the ways in which a Swedish translation of an English text intended as a manual for health practitioners needs to be adapted in order to function as an informative text aimed at patients, their families and other laymen interested in the subject. Focus lies on adaption of terminology, style, and target reader perspective. For this paper, selected parts of an English source text were translated into Swedish, and different adaptions prompted by the change in genre, intended target reader and purpose of the text were noticed and subsequently analysed. In the analysis, it became clear that translation of terminology can be treated through addition, omission or generalization where subject specific terms are not relevant for the intended readers. Under the subject of style, formality level defined through the usage of nominalizations and passives was analysed, and here, modulation and transposition proved useful for adapting the formality level to better fit the purpose of the text. Under the category of target reader perspective, omission, generalization and modulation of different kinds were translation strategies used to turn the focus from the intended ST reader to the intended TT reader. Defining or re-defining the subject of different actions was also necessary to shift the perspective from one intended group of readers to another. Finally, the analysis showed that different kinds of adaption may be purposeful in different situations.

Abstract The aim of this essay is to find out what kinds of adaption are necessary when translating an English text from a specialist book into a text that will suit Swedish students in upper secondary school. In order to obtain the data needed for the study I translated a part of a chapter from the book North American Indian Wars by Richard H. Dillon. The analysis focuses on how to make the target text as clear and unambiguous as possible for the intended readers and what methods can be used to reach this aim. The analysis shows that one kind of adaption that had to be made during the translation process mainly consisted of additions and omissions. The additions were made in order to clarify certain passages in the source text that otherwise could have been difficult for the target readers to understand. The omissions, on the other hand, were often made due to the fact that some of the words or phrases in the source text are very specific and may refer to things that may be unknown to the target readers. In some cases such words or phrases could be omitted without making the target text lose any vital information, and in some cases they had to be exchanged with an explanation or a word that would be easier for the intended readers to understand. Apart from addition and omission of information, Vinay and Darbelnet’s procedures of modulation and equivalence were used in order to make the target text accessible to the target readers. The analysis shows that obligatory modulation had to be used due to differences in point of view between English and Swedish, whereas optional modulation was used to suit the target readers’ level of attainment. The analysis also shows that Vinay and Darbelnet’s procedure of equivalence was very useful when translating idioms, metaphors and similes in order to make the target text easy to understand for the target readers.

O objetivo deste trabalho é analisar o controle de constitucionalidade por omissão exercido pelo Supremo Tribunal Federal. Para tanto, foi realizado um estudo empírico com base no exame de um conjunto de ações diretas de inconstitucionalidade por omissão e mandados de injunção julgados pelo STF entre 1988 a 2009. A partir do exame dos mecanismos de proteção judicial contra a omissão do legislador, procura-se analisar a judicialização dos casos envolvendo as omissões legislativas e investigar o modo como o STF decide estes casos. Os dois tipos de controle constitucional por omissão previstos na Constituição Federal o concentrado e o difuso são objeto de análise na presente dissertação, atentando-se para as particularidades de cada um. No primeiro caso, o foco está nas causas e resultados da judicialização da política promovida pelos legitimados para a propositura das ADO. O perfil dos demandantes e a saliência das questões levadas à apreciação do Tribunal são fatores que contribuem para explicar a ampla judicialização protagonizada pelos partidos políticos. Já no segundo caso, o estudo está focado nas decisões concessivas de mandado de injunção e a sua relação com a efetividade das normas constitucionais. Nesse contexto, verifica-se que, embora o STF tenha sido muitas vezes chamado a se manifestar sobre as omissões inconstitucionais, foi apenas recentemente que ele optou por concretizar o direito dos demandantes, garantindo eficácia plena às normas constitucionais até que o legislador supra a omissão. O exame dos julgados do STF revela que o descumprimento (non compliance) de suas decisões declaratórias da omissão é um dos fatores que levam à adoção de uma postura mais propositiva do Tribunal, momento em que ele passa a determinar a regra aplicável ao caso concreto, sem necessariamente criar normas. Por esta razão, conclui-se que o Supremo Tribunal Federal concretiza o pedido do impetrante sem exercer um papel ativista, uma vez que ele não influi diretamente na atividade do legislador. / This thesis aims at examining the way the Brazilian Supreme Court (Supremo Tribunal Federal STF) handles legislative omission in matters involving constitutional issues. For this, we performed a research based on analysis of a series of STF decisions on legislative omission lawsuits (direct actions of unconstitutionality by omission and writ of injunction) from 1988 to 2009. By examining the constitutional protections against the absence of a regulatory provision that disables the exercise of constitutional rights, this study attempts to offer a diagnostic of the dynamics presiding Judicary actions in politically loaded issues and to investigate the ways the Court decides such cases. There are two types of legislative omission control express in the Constitution concentrated and diffuse which are analysed in detail. In the first case, the focus is on the causes and results linked to the judicialization of politics. The profile of the plaintiffs and the salience of issues are factors leading to the prominent role played by political parties here. In the second case, the study focuses itself on the injunctions granted by the Court and their connection to the efficacy of constitutional norms. This paper suggests that only recently the STF has decided to start granting injunctions guaranteeing that plaintiffs exercise specific, non-statutory rights until the Legislature remedies the omission on the matter. It also suggests that non compliance with the Courts previous rulings on legislative omission has been a key factor in the more resolute stance recently adopted by the Court, when it comes determining the rule applicable in this case, without playing a role of rule-maker. In conclusion, this study holds that the Courts actions are not a chapter of judicial activism insofar it does not directly interfere with the substance of legislative action.

A presente pesquisa intenciona, a partir do estudo teórico da composição e estruturação dos casos de omissão inconstitucional no Brasil, demonstrar que não há um padrão decisório no enfrentamento destas questões: ora o Tribunal adota postura dialógica multilateral, permitindo a emanação da norma faltante pelo órgão responsável mediante a cooperação com os demais poderes, ora adota postura unilateral, justificada pela garantia dos direitos fundamentais. Assim, ao identificar na jurisprudência do Supremo Tribunal Federal a diversidade adotada pelo Tribunal quanto à eficácia de suas decisões em sede de controle da omissão legislativa inconstitucional, e mediante a análise crítica destes casos, a proposta que se defende é a de que o método dialógico multilateral consubstancia a técnica mais eficaz e legítima para a resolução destes casos. Tem-se em vista que, ao permitir a deliberação política necessária para emanação de um ato normativo abstrato, a técnica prioriza o fortalecimento das instâncias políticas e de representação popular. O estudo dos casos do Fundo de Participação dos Estados (FPE) e da criação, incorporação, fusão e desmembramento de Municípios, julgados pelo Supremo Tribunal Federal, visam reforçar a hipótese de pesquisa, já que a complexidade quanto à composição dos interesses envolvidos impõe a utilização desta via dialógica. Nos casos de omissão legislativa inconstitucional, portanto, a atuação da Corte brasileira sugere a manutenção do diálogo entre Judiciário e demais poderes em busca de soluções eficazes, justas e legítimas a toda a sociedade. Diante desta postura, se coloca como imperativo necessário para a melhor disciplina dos casos de omissão legislativa inconstitucional a regulamentação legislativa de seus instrumentos principais, a Ação Direta de Inconstitucionalidade por Omissão e o Mandado de Injunção, para uma maior clareza e transparência quanto aos limites da Corte brasileira e do Parlamento nestas questões. Além de dar suporte à atuação do STF, a regulamentação da eficácia das decisões em controle de constitucionalidade por omissão permite a previsibilidade e o controle destes pronunciamentos. / This study intends to identify the methodological diversity in the jurisprudence adopted by the Brazilian Supreme Court related to the effectiveness of the decisions in the area of controlling unconstitutional legislative omission. It is possible to see in the study of these cases that there is a standard in decision-making when addressing these issues: either the Court adopts multilateral dialogical approach with other powers, enabling emanation of the missing norms by the responsible agency, or it adopts a unilateral approach, justified by the guarantee of fundamental rights. It will be argued that the multilateral dialogical method is presented as an effective and legitimate technique, since it allows the political determination required for the emanation of an abstract normative act and the proper legislative process, strengthening the political and popular representation bodies. The case studies of the State Participation Fund (FPE) and the creation, merger and dismemberment of municipalities judged by the Brazilian Supreme Court reinforce the research hypothesis, for its complexity in the composition of the interests involved. In the case of legislative omission unconstitutional, the Brazilian Court action reinforces the maintenance of dialogue between the judiciary and other branches in search of effective, fair and legitimate solutions to all of society. Therefore, stands as imperative need for better discipline cases of legislative omission unconstitutional the legislative regulation of its main instruments, the direct action of unconstitutionality by omission and Writ of Injunction (Mandado de Injunção), for greater clarity and transparency as to the limits of the Court Brazilian and Parliament on these issues.
