Ochrana oběti trestného činu / Protection of a victim of a criminal offenceHorňák, Lukáš January 2018 (has links)
This diploma thesis deals with the issue of protection of victims of crime. In the first chapter, by using the findings from the field of victimology, it describes victim as a phenomenon and also the process of victimisation while focusing on its causes and the negative impact it may have on victims. The author also summarizes the recent findings regarding the victims' needs. Lastly, some of the most common misconceptions about victims and their impact on the perception of victims are explained. The second chapter addresses the victim from the viewpoint of the law. Firstly, it examines the role which the EU plays in enhancing the standing of victims in the criminal procedure and also outside of it. Secondly, it examines the Act on victims of crime adopted in the Czech Republic. The Act on victims of crime and the particular rights of victims which are provided for in the Act are analysed in the second chapter with the use of the current findings in the field of victimology. The author also explains the main critiques of the Act such as the counter-productive wording of the right to receive information or a threat of corroding the criminal procedure as a whole. On the other hand, the benefits of the Act are also pointed out, such as reducing the threat of a secondary victimisation of victims, which...

Between contract law and restrictive practicesJacomino, Faustine 16 July 2018 (has links)
Control of contractual balance is one of the markers of contemporary contract law. Such control is grounded in several basic concepts: some authors refer to morality, while others invoke contractual justice or its economic relevance. Applied to imbalance between professionals, the tools implemented to ensure this control reveal the existence of objective control of the contracts’ expected balance. Although the subjective balance sought by the parties is not set aside, it is overshadowed by the determination of a kind of objective balance motivated by a will both to protect the weaker party and to promote a certain vision of the economy, and commercial exchanges. In this respect, restrictive practices law is an integrative discipline in which it is possible to combine protection of the weaker party with protection of the market. The influence of this discipline on common contract law and, conversely, the “civilization” of competition law under the influence of common law help better understand the mechanism of such objective control of contractual balance. This research aims to describe the objectification of identification criteria for contractual imbalance and the ways of remedying it. To this end, common contract law and law governing restrictive competition practices will be compared to shed light on such control in both these areas. More specifically, this thesis proposes to thwart phenomena of superimposition of and competition between existing systems for the objective control of contractual balance in both these disciplines through precise identification of their fields of application and their respective purposes. It also aspires to describe the functions of such objective control for both the parties and the market by emphasizing the need to examine these contracts by taking into consideration together both their micro and macroeconomic dimensions.

Examining Orders of Protection: An Analysis of the Court System in a Rural Tennessee County.Anderson, Jaclyn 09 May 2009 (has links) (PDF)
To provide safety to domestic violence victims, law reform efforts provided victims with a civil remedy in which a judge orders the abuser to stay away from the victim.
The research uses 1 rural county judicial system data to evaluate protective orders. Findings indicate that 42% of petitions are dismissed by petitioner's request or failure to prosecute. Moreover, court fees are not recouped in 79% of the cases.
Logistic regression analysis indicate that an intimate relationship between the parties and payment of court costs by petitioner increased the probability of dismissal of petition upon petitioner's request; use of a gun and request to protect children increases the probability of applying the Brady Act; stalking and the issuance of the order of protection without social contact increased the probability of violations.

Les obligations conventionnelles nées du divorce / Conventional obligations originating from divorceTargues, Isabelle 05 July 2017 (has links)
The phenomenon of conventionalisation of family law and more precisely the role assigned to individual will in divorce has been increasing exponentially. As the sources of conventional obligations are multiple, it appears essential to define the variouselements that make up this specific group. Contracts are not the only source of conventional obligations. This last category should include all conventional legal acts which can be defined as expressions of will intending to produce legal effect. In divorce law, the voluntary agreements spouses are allowed to conclude in order tosettle the patrimonial and extra-patrimonial consequences of their separation are numerous. The growing importance given by law to individual will in order to settle the consequences of divorce calls for the examination of the genuine qualification ofspouses’ agreements. The analysis of the conventional obligations originating from divorce demonstrates that common law contracts flourish in divorce law while, at the same time, divorce agreements develop on the fringes of the guiding principles of contract law. Regarding these conventions, judges’ interventions add to individual willso as to reach perfect agreements. Eventually, in a context where individual freedom is promoted, common law contracts are a privileged tool for spouses who wish to organize themselves the patrimonial consequences of their separation. However, matrimonial public order legislation remains and cannot be dissociated from the extra-patrimonial field. In this regard, it should be noted that the general theory of the law of obligations does not intend to endanger the status of persons which must inherently remain inalienable.
