Amalgamating tribunals: a recipe for optimal reform

The last decade has seen numerous proposals to reform existing tribunal systems in jurisdictions throughout the common law world. Across the board, there have been proposals to adopt generalist tribunal models in preference to smaller, specialist tribunal systems, and to achieve these changes through the process of amalgamation. The most significant recent developments to occur in Australia have taken place in Victoria and NSW during the past five years. Legislators in these States have chosen to amalgamate a number of smaller, specialist tribunals into larger, generalist bodies. In 1997 the NSW Parliament passed legislation amalgamating a number of specialist tribunals to create the Administrative Decisions Tribunal (ADT); comparable legislation was passed in Victoria in 1998 to create the Victorian Civil and Administrative Tribunal (VCAT). There were concurrent attempts to implement similar reforms at federal level. In 1998 the Commonwealth government announced its intention to amalgamate four Commonwealth merits review tribunals to form one �super Tribunal� � the Administrative Review Tribunal (ART). The Bills containing these proposals were ultimately defeated in the Senate, however the Australian Government remains convinced of the benefits of amalgamation at federal level. Similar reforms have been proposed in Western Australia, Tasmania and the United Kingdom. This thesis argues that these reforms are taking place in the absence of data about their likely implications, and without a thorough understanding of the objectives that generalist versus specialist tribunal systems can realistically achieve. This ill-considered or �over-hasty� trend towards amalgamation raises a number of questions which have not previously been addressed in academic or policy-making circles. An obvious question is whether or not an amalgamated tribunal model is more effective than a series of smaller, specialised tribunals in delivering administrative justice, in other words, whether there is any net gain to be had from a government�s decision to amalgamate. The less explored, but equally important, question addressed in this thesis is how the process of amalgamation should be approached in order to realise the maximum potential benefits that an amalgamated tribunal can bring. That is, to ask what are the ingredients of an optimal amalgamation. This is not a question about whether government decisions to pursue amalgamation are intrinsically worthwhile or beneficial for stakeholders. Rather, it is about how government decisions to amalgamate should best be implemented. This thesis proposes a way of differentiating between good and bad amalgamations, that is grounded in theory and informed by experience to date. The proposed approach is to assess the effectiveness of amalgamation processes using relevant measures drawn from an analysis of organisational theory literature: � Legislation � the legislation establishing an amalgamated tribunal needs to ensure the tribunal will have appropriate independence, powers, processes, membership and structure. � Political commitment � those responsible for proposing and planning an amalgamation need to provide appropriate funding and support for the process and for the establishment of an autonomous, self-directed tribunal. � Organisational structure � the structures put in place need to be appropriate, integrated and flexible, and should promote cohesion and interaction. � Process and procedure � the processes and procedures adopted in an amalgamated tribunal need to capitalise upon the opportunities provided by amalgamation, as well as being appropriate, efficient and able to balance the needs of a range of stakeholders. � Organisational culture � an organisational culture which counters natural tendencies towards disjunction will assist members and staff to identify with a newly amalgamated tribunal and to implement initiatives that will improve its performance. � Leadership � effective leadership plays an important role in ensuring a smooth transition from specialist to amalgamated tribunal, and engendering commitment from members and staff. Broadly speaking, these factors fall into the four categories of law, context, organisation and people. It is argued that attention must be paid to all four of these ingredients in order to achieve optimal tribunal reform. The thesis tests this proposition by examining the three most advanced tribunal amalgamations so far, namely, the Commonwealth ART, the NSW ADT and VCAT in Victoria. It is argued that the fate of the Commonwealth ART proposal proves the importance of a solid, generally endorsed legislative foundation in creating a viable amalgamated tribunal. The importance of context, organisation and people is borne out by qualitative research into the amalgamation experiences in NSW and Victoria. The fact that the NSW and Victorian governments decided to pursue policies of amalgamation at the same time provided a unique opportunity to compare the success or otherwise of two concurrent attempts at amalgamation in different jurisdictions. This thesis finds that the unfavourable political context in NSW prevented the ADT from realising its potential. In contrast, the VCAT experience highlights the benefits of paying careful attention to the wide range of factors that can contribute to a successful amalgamation. Of most relevance are the initial scale of an amalgamation, the political �will� behind its implementation, the appointment of a core of full-time members, and the creation of an open institutional culture which facilitates the sharing of information. In short, the thesis concludes that the successful construction and consolidation of a tribunal post-amalgamation requires that the necessary ingredients of optimal tribunal reform � legislation, context, organisation and people � are thoughtfully addressed.

The development of a knowledge network framework to support knowledge mobilisation in IT project oriented change management

Although there has been rich research conducted into the interrelated issues and factors among change management (ChM), knowledge management (KM) and project management (PM), most existing studies attempt to understand the role of KM in ChM and PM in general. Given the fundamental role played by KM in supporting IT project-oriented change management, the topics of knowledge networks and mobilisation across knowledge boundaries are relatively unexplored. Recent developments in KM have heightened the need for more understanding on four main issues: 1) insufficient knowledge traceability based on the relationships between knowledge elements and key factors; 2) most decision issues in PM are related to uncertainty, complexity and implicit ambiguity, particularly with regard to systematics and interrelatedness within project decisions; 3) lack of procedural knowledge to provide strategic direction for managing multiple IT projects; 4) lack of ‘lessons learnt’ documentation in knowledge bases. To address these issues, this research attempts to analyse KM, ChM and IT project management from a more integrated perspective, and investigates the development of a change management knowledge network model (CMKNM) in IT projects to facilitate knowledge mobilisation across organizational boundaries. The study employs a practice-based perspective by adopting both deductive and inductive approaches using an exploratory case study strategy. Empirical data were collected from semistructured interviews and company documents. A combination of thematic analysis and comparative analysis has been employed to analyse the data collected across seven public organisations, private organisations, and international companies. Results are obtained from the empirical study on the key factors influencing knowledge mobilisation in IT projectoriented change management, knowledge networks and connections. The results identified organisational factors and their influence on knowledge channels and knowledge networks. The CMKNM allows key knowledge mobilisation factors to be aligned with each other. Connections between knowledge networks allow knowledge to be mobilised by tracing knowledge channels to support ChM decisions. The study contributes to organisational and KM theories regarding organizational strategy, organisational culture, organizational capacity, knowledge network externalities, knowledge network intermediaries, and knowledge network infrastructure.

Chefers syn på ledarskapets roll vid större förändringsarbeten : En studie inom två organisationer. / Leaders opinion on the role of leadership during periods of major change : A survey within two organisations.

Syftet med denna studie är att kartlägga viktiga faktorer för ett pedagogiskt ledarskap vid större förändringsarbeten. 14 personer i ledande ställning inom två olika organisationer har intervjuats för att besvara studiens frågeställning: Hur beskriver chefer faktorer av betydelse för ledarskapet vid större förändringsarbeten? Syfte och frågeställning har valts utifrån tesen att större förändringsarbeten är en komplicerad pedagogisk praktik vid vilken ledarskapet är ett av de viktigare verktygen för genomförande och framgång. Studien grundas på en kvalitativ ansats och vid intervjuerna har använts ett semistrukturerat intervjuunderlag. Studien visar att intervjuade chefer anser att kommunikation är den viktigaste faktorn för ett ledarskap vid tider av större förändringsarbeten. Kommunikation rankades högst med betyget 4,3 av 5 möjliga, tätt följt av delaktighet som gavs betyget 3,9. På tredje plats rangordnas transparens/öppenhet (betyg 2,7) och på fjärde plats rangordnas tydlighet (betyg 1,9). Övriga framröstade faktorer, vilka rankades lägre, var coachning/handledning, chefs tilltro till de anställda, chefs egen tro på förändringen m.m. Samtliga intervjuade personer med ett undantag gav uttryck för samstämmiga ledarskapsfilosofier som grundar sig i det transformativa ledarskapet. Detta faktum  skulle kunna förklara det samstämmiga resultatet. Samstämmighet framkom trots att personerna arbetar inom två skilda organisationer, en politisk och en industriorganisation. Endast en person, som arbetar inom industriorganisationen, bedömdes vara en transaktionell ledare. Samtliga chefer hade någon form av ledarskapsutbildning.

O desenvolvimento da presente tese tem por motivação central investigar como organizações que possuem ações de sustentabilidade buscam disseminá-las e incorporá-las ao longo de suas cadeias de suprimento. Para tanto, com uma nova definição para sustentabilidade em cadeias de suprimento (SCS), agora assumida por uma abordagem institucional efetivada por um processo socialmente construído, bem como a proposição do conceito de Lógica Institucional da Sustentabilidade (LIS) a partir de quatro dimensões de análise: Sequência de eventos; Empreendedorismo institucional; Mudança de estrutura; e Prática de sustentabilidade, esta tese apresenta contribuições tanto no contexto teórico como no empírico. Com uma essência propositiva, assume-se como questão de pesquisa: Como a Lógica Institucional da Sustentabilidade é constituída e praticada por organizações em cadeias de suprimento, em relação aos impactos no ambiente e na sociedade? Baseando-se nesta, tem-se como objetivo central de pesquisa: Analisar a promoção da Lógica Institucional da Sustentabilidade em Cadeias de Suprimento, a partir da proposição de um framework teórico e estudos de caso no Brasil e no Reino Unido. Por meio de uma pesquisa qualitativa conduzida com um método abdutivo, foram utilizados quatro estudos de caso como suporte à pesquisa, duas organizações no Brasil (uma indústria e uma agroindústria) e duas no Reino Unido (uma indústria e uma universidade). Assim, com uma análise processual, baseando-se nos resultados da análise de conteúdo, foram utilizados vários instrumentos de coleta de dados no sentido de validar o framework teórico para representar como a LIS se aplica à cadeia de suprimento. As análises seguem as quatro dimensões já mencionadas, bem como nove macro práticas e um conjunto de 21 micro práticas. Os casos foram analisados individualmente a partir das ações de sustentabilidade realizadas, pela formação do campo organizacional que os circundam, pela promoção da LIS ao longo do período de pesquisa, bem como a partir de uma análise institucional. Características peculiares foram identificadas nos diferentes casos, todavia a partir de uma aproximação dos resultados ficou visível que no caso do Brasil existiu um nível de esforço interno mais evidente por parte das organizações, o que se reflete na efetiva existência de estratégia e prática de sustentabilidade. Já no que se refere ao Reino Unido, as motivações identificadas possuem um caráter mais externo, com a observação da prática de sustentabilidade em muitos momentos limitada, ao se seguir o framework proposto. Outros resultados são destacados, como é a questão de grupos de trabalho identificados para buscar e efetivar a sustentabilidade dentro das organizações e em suas cadeias de suprimento, o que teve contribuição direta na validação do framework. Quanto as análises institucionais, percebe-se forte legitimidade em todos os casos dentro de seus campos organizacionais, o que ratifica como efetiva a definição aqui proposta. Com base nos resultados e nas construções teóricas, identifica-se originalidade e ineditismo nesta pesquisa, principalmente por avançar na discussão sobre o processo de implantação da sustentabilidade em cadeias de suprimento, ainda pouco considerada na literatura. Além disso, entende-se ser possível modificar o foco excessivo, e constante, apenas em performance e discutir o processo de mudança necessário para se esclarecer o papel das organizações quanto à sustentabilidade. / The main motivation to develop this thesis dissertation is to identify how companies are incorporating and widespread sustainability through the supply chain. Thus, the thesis presents a set of contribution in both theoretical and practical perspectives considering a new definition for supply chain sustainability (SCS), which is understood as an institutional approach achievable by a socially-constructed process, and a proposition of Institutional Logic of Sustainability (ILS) according to the following dimensions: Event sequencing; Institutional entrepreneurism; Structure overlap; and Practice of sustainability. Based on a purposeful viewpoint, the research question is: How the Institutional Logic of Sustainability is created and practiced from organisations through the supply chains, according to impacts on the environment and society? Further, the main objective of research is: Analyse the promotion of Institutional Logic of Sustainability in supply chains, from a theoretical framework and case studies in Brazil and in the UK. From a qualitative approach and an abdutive method, it were used four case studies to support the empirical research, in which two companies are Brazilian (an industry and an agro industry) and two are British (an industry and an university). Based on a processual analysis, according to the content analysis, it were used different data collection methods to validate the theoretical framework which represent the ILS applied to supply chains. The analysis were conducted using the four dimension presented already, as well as nine macro practices and 21 micro practices. All case studies were analysed individually considering: sustainability activities, the organisational field observed, the promotion of ILS during the time analysed, and last but least the institutional analysis. The results present some particular characteristics in all case studies, however from the approach among the results it is possible to highlight in one hand that in Brazil the internal motivation was more evident, which is identified in the strategies and the practices of sustainability in the companies. On the other hand, in the UK, the external motivation was more highlighted in which the practice of sustainability is limited in some moments, according to the proposed framework. Moreover, other results could be presented as the working groups identified in three case studies to achieve the sustainability internally and in the supply chain. These results have a huge contribution to validate the framework. Further, the institutional analysis indicates that the legitimacy is strong in all case studies, which ratify the definition proposed in this thesis. Based on this results and the theoretical contribution it is possible to identify originality and novelty in the research, since the thesis advances in relation to the implementation process of sustainability in supply chains, which is rare in the literature. Moreover, the thesis presents a shift from the excessive, and frequent, focus on performance for a discussion of process of change, which is necessary to understand the role of companies in the sustainability debate.

Readiness of an engineering support services organisation for the implementation of a performance management system

Implementing a performance management system is a change process that requires that readiness for change is established as a pre-requisite. This study reports on the relationship between readiness for change and the implementation of a performance management system; that is the extent to which readiness for change influences the implementation of a performance management system. The study was conducted in an engineering support services private sector organisation with a footprint across South Africa. A random sample was drawn from the target population. A multiple regression analysis was subsequently conducted. The findings of this study reflect that readiness for change influences the implementation of a performance management system. Also, reflected in the findings is that the factors of readiness for change influence the implementation of a performance management system, namely business unit climate; job/task requirements; motivation to change; the personal impact of change; the emotional impact of change and change processes. In addition, the findings reflect that there is a statistically significant difference in readiness for change by tenure and by business unit. / Industrial and Organisational Psychology / M. Com. Further, the main objective of research is: Analyse the promotion of Institutional Logic of Sustainability in supply chains, from a theoretical framework and case studies in Brazil and in the UK. From a qualitative approach and an abdutive method, it were used four case studies to support the empirical research, in which two companies are Brazilian (an industry and an agro industry) and two are British (an industry and an university). Based on a processual analysis, according to the content analysis, it were used different data collection methods to validate the theoretical framework which represent the ILS applied to supply chains. The analysis were conducted using the four dimension presented already, as well as nine macro practices and 21 micro practices. All case studies were analysed individually considering: sustainability activities, the organisational field observed, the promotion of ILS during the time analysed, and last but least the institutional analysis. The results present some particular characteristics in all case studies, however from the approach among the results it is possible to highlight in one hand that in Brazil the internal motivation was more evident, which is identified in the strategies and the practices of sustainability in the companies. On the other hand, in the UK, the external motivation was more highlighted in which the practice of sustainability is limited in some moments, according to the proposed framework. Moreover, other results could be presented as the working groups identified in three case studies to achieve the sustainability internally and in the supply chain. These results have a huge contribution to validate the framework. Further, the institutional analysis indicates that the legitimacy is strong in all case studies, which ratify the definition proposed in this thesis. Based on this results and the theoretical contribution it is possible to identify originality and novelty in the research, since the thesis advances in relation to the implementation process of sustainability in supply chains, which is rare in the literature. Moreover, the thesis presents a shift from the excessive, and frequent, focus on performance for a discussion of process of change, which is necessary to understand the role of companies in the sustainability debate.

“Hej då Landstinget!” : En kvalitativ studie om tolkandet av kommunikationen i samband med organisationsförändringen inom Region Uppsala

This study focuses on how the internal communication within Region Uppsala and their administrations has been conducted and perceived during 2017 as the organisation went from being the county of Uppsala to becoming Region Uppsala. The goal and the research questions have been to understand how internal stakeholders interpret the strategic change communication from the management of Region Uppsala and how the management also interpret their own communication. The study relies on three main questions which has been - What goals have the management of Region Uppsala had with the communication during the change? - How has the management of Region Uppsala interpreted the communication during the change? - How has internal stakeholder interpreted the communication during the change? The study uses Laurie K. Lewis (2011) studies of organisational change as a theoretical framework while the study also has a perspective on communication as sense making and constitutive of the organisation, which has helped to clarify the meaning of strategic communication. The methods being used has been qualitative interviews as well as a qualitative content analysis of printed material. The results from the empirical data shows that it is within the interpretation of communication that meaning is created and that meaning can differentiate depending on the interpretation. This study contributes to the field of strategic communication and strategic communication during change.

Planning for Information Systems Development : A Framework for supporting the management of Success Factors

In the information systems development process there are important success factors. By doing an extensive literature survey we have found that these factors emerge mainly from organisational issues concerning the objective of the process and the stakeholders.One factor - to discuss the system, its subsystems and to define the system's boundary - is a prerequisite for all the others. Factors emerging from the objective are mainly about the objective being well analysed and defined, being accepted among the stakeholders and meeting business objectives. Factors emerging from stakeholders are mainly about involving the right stakeholders in the process, achieving a positive attitude and taking care of their needs about knowledge and confidence. Based on this we have developed a framework aiming to guide organisations in what considerations they should make before the project begins. As a result of our framework there will be both a clear objective, which support the business mission, as well as positive stakeholders to support the information systems development process.
