A perda de bens e o novo paradigma para o processo penal brasileiro / Confiscation and the new paradigm of the Brazilian criminal procedure

A perda de bens, como efeito da condenação penal, também referida como confisco, consiste na transferência ao poder público do produto e do proveito derivado da infração penal, ressalvado o direito do lesado e do terceiro de boa-fé. O estudo cuidou de duas espécies de perda de bens no Direito Penal brasileiro: a perda clássica, que atinge os bens, direitos e valores, direta ou indiretamente, derivados da infração penal, ou seja, o patrimônio ilícito do condenado, e a perda subsidiária, que se resume na perda do patrimônio lícito do agente, em parcela equivalente ao patrimônio ilícito. A perda de bens é importante para a prevenção e repressão à criminalidade organizada, cuja atuação volta-se para a busca do lucro. O processo penal brasileiro possui mecanismos importantes para tratar dos efeitos decorrentes da perda e bens, tais como as medidas cautelares reais. Porém, boa parte de sua estrutura é voltada para o acertamento da culpabilidade e com a perspectiva de um crime comum. Convenções internacionais, que inclusive foram ratificadas pelo Brasil, deram um impulso mundial para a valorização dos aspectos patrimoniais oriundos da criminalidade organizada. Isso fez surgir um novo paradigma para o processo penal em todo o globo, que deve ser também inserido no processo penal brasileiro. Antes de mudanças legislativas, a valorização da perspectiva patrimonial impõe a necessidade do surgimento de uma nova cultura e mentalidade do operador do direito. Isso irá repercutir desde na investigação criminal até no destino dos bens perdidos. Não mais basta evidenciar a materialidade delitiva e a autoria para os casos que envolvem a criminalidade organizada, mas é preciso identificar e assegurar o patrimônio suspeito. É preciso instituir agências públicas com a finalidade específica de atuar para a preservação dos bens acautelados e para dar-lhes, com a declaração de perda, um destino social justo. No plano legislativo, é preciso instituir a perda alargada, com critérios legítimos e proporcionais, para que o patrimônio do imputado, desproporcional e sem comprovação lícita, também possa ser objeto de perda. Esse instituto projetado elimina a necessidade de se vincular o patrimônio do agente a alguma infração penal. Para a preservação do equilíbrio entre eficiência e garantismo, é preciso instituir, visando à aplicação da perda alargada, um procedimento penal autônomo e com critérios probatórios claros e adequados para o acertamento patrimonial. / The confiscation, as effect of criminal conviction, consists of the transfer to the government the product and the benefit derived from a criminal offense, subject to the right of the injured party and the third party in good faith. There are two kinds of confiscation in the Brazilian Penal law: classic confiscation, which affects the assets, rights and values, directly or indirectly derived from a criminal offense, in other words, the illicit assets of the convict, and the subsidiary confiscation, which is the forfeiture of the illicit assets of the offender, equivalent to illicit equity tranche. The confiscation of property is important for the prevention and repression of organized crime, whose performance turns to the pursuit of profit.The Brazilian criminal procedure has important mechanisms to treat the effects of confiscation of assets such as real precautionary measures. However, much of its structure is geared towards testifying the culpability and the prospect of a common crime. International conventions have even been ratified by Brazil, gave a global push for the appraisal of the aspects of equity derived from organized crime. This made a new paradigm for the criminal justice system to arise across the globe, which should also be inserted in the Brazilian system. Prior to legislative changes, the valuation of the equity perspective imposes the necessity of the emergence of a new culture and mindset of the lawyers, prosecutors and judges. This will play a decisive role in the criminal investigation as well as the final destination of the confiscated assets. A real evidence of a criminal offense and its authorship for cases involving organized crime is not enough, it is necessary to identify and assure the suspect equity. It is required to establish public agencies for the specific purpose of acting for the preservation of freezing assets and give them, with the confiscated assets, an equitable social destination. On the legislative front, it is required to introduce the extended confiscation with legitimate and proportionate criteria, so that the assets of the accused, disproportionate and without lawful evidence, may also be subject to confiscation. This institute designed eliminates the need to link the wealth of the agent with any criminal offense. To preserve the balance between efficiency and fundamental rights, it is necessary to institute, aimed at applying the extended confiscation, an autonomous procedure with clear and suitable evidentiary criteria for certifying the assets.

Processo de institucionalização da atividade de inteligência prisional : um estudo de caso sobre Israel

Este é um estudo sobre como se dá o processo de institucionalização da Atividade de Inteligência Prisional, ou seja, a incorporação institucional da prática da atividade de inteligência no âmbito prisional (AIP), considerando as variáveis da legitimidade e da efetividade. Com o objetivo de melhor compreender esse processo, a pesquisa verificou o caso específico da institucionalização da inteligência prisional israelense, seu contexto político, administrativo e da inteligência de segurança pública de Israel, bem como buscou determinar indicadores necessários a um processo de institucionalização de inteligência prisional eficiente e legítima. No processo em tela é realizada a contextualização do estudo de inteligência prisional dentro de uma análise mais ampla da área de inteligência, com o exame dos principais pressupostos teóricos a respeito do tema e o exame dos indicadores necessários a um processo de institucionalização da inteligência prisional eficiente e legítima. Para tanto, foi utilizado o método de estudo de caso único com pesquisa qualitativa (relatos dos entrevistados), observação participante (investigação nos estabelecimentos carcerários de Israel) e material teórico coletado em Israel (legislações, reportagens, artigos acadêmicos e pesquisas de opinião). A conclusão a que se chega é a de que a criação da AIP foi um fenômeno causado por atos intencionais, uma resposta às necessidades dos governantes (por meio do puro cálculo estratégico), com o objetivo principal de implementar seu domínio sobre a população carcerária, buscando informações sobre a atuação e articulação dos presos terroristas e resolvendo problemas informacionais relacionados à defesa nacional e da ordem pública. A efetividade foi preliminarmente comprovada pela demonstração, quanto ao seu impacto, de que a AIP tem condições de realizar a identificação e o acompanhamento dos presos e suas respectivas facções, de reduzir o crime organizado dentro e fora dos presídios, de antecipar crises e de neutralizar ameaças; quanto ao processo, possui uma complexidade organizacional bastante satisfatória e alto nível de profissionalização de seus agentes; no tocante à legitimidade, por sua vez, foi identificada estabilidade, bom desempenho institucional, existência de mandatos legais regulando a AIP e mecanismos de controle diversos. Porém, constatou-se problemas em relação à transparência/confiança de sua atuação, pois ela é considerada legítima quando o país se encontra em estado de guerra, de conflitos armados, com homens-bomba, terrorismo latente e ataques internos e externos que ameaçam a segurança nacional. Portanto, ela é justificada de acordo com a gravidade da situação, uma vez que se impõem medidas para neutralizá-la. Em tempos de relativa paz, a legitimidade é bastante contestada. Deduzimos que Israel demonstra uma maior preocupação com a eficácia da AIP do que com sua legitimidade (isto é, menos restrições sobre as fontes e a metodologia da Inteligência) e que há uma relação trade-off entre legitimidade e efetividade: o processo de institucionalização não apresentou equilíbrio entre a legitimidade, que nunca foi constante, e a efetividade, que se manteve como tal. A elaboração da presente tese levou à conclusão de que houve um efetivo processo de institucionalização da atividade de inteligência prisional israelense ao longo da trajetória que compreendeu o período de 2000 a 2010. / This is a study on the process of institutionalization of Prison Intelligence Activity, namely, the institutional embodiment of the practice of intelligence activity within prisons (IAP), considering the variables of legitimacy and effectiveness. In order to better understand this process, we studied the specific case of institutionalization of Israeli prison intelligence, its political and administrative context and the public safety intelligence of Israel, and as well we sought to determine indicators required for a prison intelligence institutionalization process effective and legitimate. It performs the contextualization of prison intelligence study within a broader analysis of the intelligence area, with the examination of the main theoretical assumptions on the subject and the examination of indicators required for a prison intelligence institutionalization process effective and legitimate. To this end, we use the method of single case study with qualitative research (reports of respondents), participant observation (research in correctional facilities of Israel) and theoretical material collected in Israel (legislation, reports, scholarly articles and opinion polls). We concluded that the creation of IAP was a phenomena caused by intentional acts, a response to the needs of rulers (through pure strategic calculation), with the main objective of implement their stranglehold on the prison population, seeking information on the performance and articulation of the arrested terrorists and solving problems related to national defense and public order information. The effectiveness has been preliminarily proven by the demonstration, as to its impact, that the IAP can perform the identification and monitoring of prisoners and their respective factions, reduce organized crime inside and outside prisons, anticipate crises, and neutralize threats. As for the process, it presents a satisfactory organizational complexity and high level of professionalism of its agents. With regard to legitimacy, we identified stability, good institutional performance, existence of legal mandates regulating the IAP and various control mechanisms. However, we found problems in relation to transparency/confidence of its performance, because it is considered legitimate when the country is in state of war, armed conflict, with suicide bombers, latent terrorism e internal and external attacks that threaten national security. Therefore, it is justified according to the gravity of the situation, since it imposes measures to neutralize it. In times of relative peace, legitimacy is quite disputed. We assumed that Israel demonstrates a greater concern with the effectiveness of IAP than with its legitimacy (i.e., fewer restrictions on sources and methodology of intelligence) and that there is a trade-off relationship between legitimacy and effectiveness: the institutionalization process failed to provide balance between legitimacy, which was never constant, and effectiveness, which remained as such. We conclude that there was an effective process of institutionalization of Israeli prisons intelligence activity along the trajectory comprising the years between 2000-2010.

Essays in International Trade and Political Economy

This dissertation consists of three independent essays which contribute to the literatures on International Trade and Political Economy. The first essay addresses questions related to the political economy of antidumping (AD). With the remarkable falling in tariff barriers that has characterized the post-World War II period, AD has become the most used non-tariff barrier (NTB).1 Studying the use of AD is thus of great importance, also because the restrictive effects of AD measures on trade can be sizable (see for instance Ruhl, 2014). Moreover, there is an increasing concern that AD has turned to be an industrial policy tool rather than a mean that governments can use to restore the “level-playing field” (Vandenbussche and Zanardi, 2008). This worry is in line with the findings presented in the first chapter of this dissertation, Bureaucrats or Politicians? Political Parties and Antidumping in the US, which shows that the adoption of ADmeasures in the US is heavily shaped by political parties’ interests. I focus on the voting behavior of the International Trade Commission (ITC), a US quasijudicial agency composed by six non-elected commissioners who are supposed to conduct (an important part of the) AD investigations in a fair and objective manner. Using a newly collected dataset containing all ITC commissioners’ votes on AD over the period 1980-2010, I show that political parties can affect the ITC voting behavior in two ways: by selecting ITC commissioners who have a similar stance on trade policy as their own (selection effect) and by influencing them while they are in office (pressure effect). While other studies have emphasised that Congress can put pressure on the ITC, the novelty of this work is to show that this pressure is party-specific. First, I show that Democratic-appointed commissioners are systematically more protectionist than Republican-appointed ones. This effect is sizable (the probability of voting in favor of AD is at least 8 percentage points higher for Democratic-appointed commissioners) and suggests that political parties can play an important role by influencing the choice of ITC commissioners who have a similar preferences on trade. This result is insensitive to several changes in the econometric specifications and to the use of different methodologies. Moreover, commissioners’ votes on AD depend on the trade policy interests of key senators (i.e. Trade subcommittee members) in the party they are associated to.2 In particular, whether (Democratic) Republican-appointed commissioners vote in favor of AD depends crucially on whether the petitioning industry is key (in terms of employment) in the states represented by leading (Democratic) Republican senators at the time. This result is robust to several checks also holds when controlling for any unobserved time-invariant characteristic of ITC commissioners (e.g. the state of origin) that could influence their votes on AD and be correlated with the pressure variables, i.e. when commissioner fixed effects are included in the specifications. In addition, the pressure effect can actually overcome the selection effect, making a Republican-appointed commissioner more protectionist than the average Democratic-appointed one. The second essay, Internationalization and Innovation of Firms: Evidence and Policy, analyzes the link between internationalization and innovation at the firm level.3 The evidence presented Chapter 2 shows that the degrees of involvement in internationalization and innovation activities are inextricably linked. However, the European policy context seems at odds with this evidence: trade-promotion and innovation-enhancing policies are largely unrelated and often carried out through various agencies (see EIM, 2010).4 Thus, understanding the interaction between internationalization and innovation can be crucial for policy makers, especially in a world which is increasingly characterized by global value chains.5 The interplay between internationalization and innovation is investigated in a unique, representative and cross-country comparable sample of manufacturing firms with at least ten employees (EFIGE), across seven European countries (Austria, France, Germany, Hungary, Italy, Spain, UK) for the year 2008. We find that firms in the sample at hand are quite active in both innovation and internationalization: 87% of firms devote resources to R&D projects, IT solutions, or patent/design/ trademark registrations, while 77% of our firms are active in international trade, cross-border outsourcing relations, or FDI. For modes of internationalization, there is a clear ranking of associated firm performance: FDI makers show the highest productivity, followed by outsourcers and traders. Innovation differences across modes are less clear cut. Moreover, defining internationalization (innovation) intensity as the number of internationalization (innovation) modes in which firms are involved, we show that firms with high innovation intensity tend also to show high internationalization intensity. Instrumenting innovation intensity by the share of firms that have benefitted from R&D financial incentives in a given (NACE 2 digits) industry-country pair and by the share of investment in R&D over the value added in the same industry-country pair, for the years 2002-2006, we are not able to find conclusive evidence of a causal effect of innovation on internationalization. Finally, a positive association between innovation and internationalization intensities appears at both firm level and country-industry (milieu) level, and at country level when average intensity is calculated disregarding the relative numbers of firms in the different industries. If country average intensities are computed weighting by firm numbers in the various industries, the correlation between innovation and internationalization intensities across countries appears weaker, suggesting that innovation matters more than internationalization for driving differences across countries. Based on the evidence we collected, we suggest a higher coordination/integration of internationalization and innovation policies at both the national and EU levels, and propose a bigger coordinating role for EU institutions, in order to reduce the current paradox of generally uncorrelated policies aimed at mostly correlated outcomes. The third essay, Cooperation Among Criminal Organizations: Evidence from Organized Crime in Italy, uncovers new facts about the behavior criminal organizations on the Italian territory. Since Becker (1968) the economic analysis of crime has especially focused on the behavior of individual offenders. Much less attention has been devoted to the activities of criminal organizations, especially from an empirical point of view. Nevertheless, organized crime is a prominent and alarming presence in the world economy: it destroys physical and human capital and deteriorates the business environment, ultimately lowering the growth potential of an economy (Acconcia et al. 2014; Pinotti, 2015). The third chapter of this dissertation contributes to the literature on economics of organized crime by shedding light on the interaction between domestic and foreign organizations in Italy, showing that the probability of cooperation among them depends both on the type of crime committed and on the presence of traditional (incumbent) organizations in some regions of the country. More specifically, cooperation between domestic and foreign criminal organizations is studied using a novel dataset containing information on their activities in the Italian territory during 2007-2010. Italian territory during 2007-2010. We first show that cooperation among Italians and foreigners is skewed towards specific crimes (e.g. counterfeiting activities). We then show that the presence of traditional (incumbent) organizations in some regions reduces the probability of cooperating. The aim of this thesis is the analysis of a cooperating defendant as a legal instrument of combating organized crime not only in the law regulations of the Czech Republic, but also in the laws of other European countries. This thesis also outlines the origin and development of this institution, both in the international context and in the context of the Czech legislation, including amendments and proposals de lege ferenda. In my work I am also comparing the Czech legislation with specific national legislations. I also mention some interesting legal cases that relate to these issues and present the views of the scientific capacities and respected experts. The thesis is divided into five chapters, which are complemented by introduction and conclusion. The first chapter deals with the historical development of the institute, both in the Czech Republic and in the territories of other states. The second chapter deals with the Czech legislation, the introduction of the institute, and amendments regarding also the laws outside of the Criminal Procedure Code. I also bring up some of the views of experts who evaluate the institute from various angles and express their opinion de lege ferenda. Zusammenarbeitende Angeklagte Diese Diplomarbeit befasst sich mit der Problematik des Instituts des "zusammenarbeitenden Angeklagten", dessen Regelung in die strafrechtlichen Vorschriften durch die Novelle des Strafgesetzbuches Nr. 41/2009 Slg. verankert wurde, die am 1. 1. 2010 in Kraft trat. Die Tschechische Republik reagierte hiermit auf die Aufforderungen der internationalen Organisationen, die die Aufnahme der für die Bekämpfung der organisierten Kriminalität nötigen rechtlichen Instrumente verlangten. Das Phänomen des "zusammenarbeitenden Angeklagten", bzw. des Kronzeugen ruft rege Fachdebatten hervor, denn es stellt ein kontroverses Thema dar. Die Straftäter können nämlich für ihre Zusammenarbeit mit den im konkreten Fall tätigen Organen mit bis zur vollständigen Straffreiheit belohnt werden. O presente trabalho tem como objetivo geral estudar o processo de negociação entre Brasil e Paraguai referente à temática dos ilícitos transnacionais e, mais particularmente, sobre a atividade contrabandista na Tríplice Fronteira. O cerne da pesquisa será pensar como o problema dos ilícitos transnacionais é enfrentado pelos atores políticos brasileiros que estão direta ou indiretamente relacionados com o controle e a formulação da agenda externa referente à temática. Com isso, é fito não apenas investigar os efeitos acarretados pela atividade clandestina na economia nacional. Mas também, analisar como a diplomacia e as instituições que trabalham com o tema - Ministério das Relações Exteriores; do Comércio Exterior, Indústria e Transportes; o Itamaraty; a Secretária da Receita Federal; as respectivas Embaixadas e, também; a Polícia Federal - estão reagindo frente a esse quadro de fortalecimento acelerado do crime organizado e, ainda, como se insere a questão do contrabando nas negociações entre Brasil e Paraguai. Primordially, the study she will focus the strategical positions and the principles defended for Brazil in relation to this thematic one, arguing questions as the Brazilian receiving to the multilateral proposals and the presentation of projects in the area, as well as the position and the consistency in the resolution of possible problems in the procedure of the bargain. Moreover, the inquiry will be effected leaving of three variable as: the consolidation of the Mercosul, the redemocratization of the countries in discuss and the expansion of the organized crime global. We judge to be these the basic factors that in will make possible them to elucidate at last on the incorporation of the subject in the bilateral agenda. We will try to detach the importance of a boarding politics in the treatment of the question of the organized crime, therefore even so threat of the old problematic that has coexisted the humanity to the long one of the years, in the present time, this phenomenon assumes transnational characteristics, with great performance.

Fraud targeting the elderly - A prize of our open society?

Fraud targeting the elderly has in recent years received more and more attention, although fraudulent behavior against the elderly only constitute a small part of all reported fraud offences the fact that perpetrators intentionally and systematically utilizing their vulnerability should be taken seriously. It is therefore considered important to expand the knowledge regarding elderly exposure to fraud, but not because of the volume of crime rather because of the particular vulnerability the elderly possesses. The present study intends to examine how perpetrators of fraud find the elderly victims and whether or not the principle of public access to information affects elderly exposure to this type of crime. The study has been conducted through semi-structured interviews with individuals from the Swedish police authorities, all with connections to fraud and crime against elderly in different ways. Trough the thematic analysis, it emerged that perpetrators find their intended victims with the help of websites that mass-publish personal information and that this mainly takes place within the framework of organized crime. The principle of public access to information therefore tends to be an important phenomenon to consider in the work of making elderly less suitable targets of fraud.

Efficacy of government strategies in the prevention and control of organised crime in Limpopo Province

Thesis (MPA.) -- University of Limpopo, 2017 / The aim of this study was to assess the effectiveness of the measures in the prevention and control of organised crime by government agencies based in Limpopo Province. The research was qualitative in nature and semi-structured interviews were conducted with 12 law enforcement officers from the DPCI, DSSL, SAPS, Home Affairs, SARS Customs and Excess, AFU, and the NPA PCLU. Data was analysed though thematic analysis. The results revealed that the government strategies in Limpopo still require concerted efforts in the prevention and control of organised crime. The government has identified measures to fight organised crime and has adopted the criminal justice response/ institutional and the legislative response to the crime. The measures taken by various units are found to be ineffective in dealing with organised crime since organised criminal networks are often flexible, dynamic, innovative and resilient. Furthermore, corrupt activities and collusions by law enforcement officers hinder the effective implementation of the strategies to control organised crime. The findings of the study show that there is coordination and communication among the law enforcement agencies such as the DPCI, SARS, Home Affairs, and the NPA PCLU, among others. This coordination is envisaged through intelligence, information sharing and interoperability. The study highlighted poor implementation of the multi-agency approach as one institution is expected to facilitate and lead the prevention of organised crime (which is the DPCI). The findings further highlight, for example, that the smuggling of illegal cigarettes is currently a challenge for the provincial government as a highly committed organised crime. The study recommends for the development, by the government, of an Organised Crime Threat Assessment in order to effectively recognise the need for responses, which should be based on a sound understanding of the nature and characteristics of the organised crime environment. In addition, it recommends for the development of an Organised Crime Response Plan to align efforts to identified critical organised crime threats. The study further recommends for the adoption, by the government, of relevant multi-agency approaches in addressing organise crime – both operational and policy or regulatory – which will underpin a whole-of-provincial government approach to organised crime. The thesis examines the results of the international commission against impunity in Guatemala (CICIG), founded in 2006 by an agreement between the government of Guatemala and the UN. It represents a unique tool of UN, connecting in its mandate national and international elements, whose singular goal is a fight against contemporary national crimes, in contrast to a more classical model of UN, which focuses predominantly on international or past crimes. The thesis tries to answer whether the level of corruption and presence of organized crime in the state institutions was lowered during the mandate of CICIG, whether the level of impunity was lowered at the national courts and how big of a role could be attributed to CICIG. The analysis is diveded into two parts. In the first one, based on a few key indicators, the institutional situation in crime prosecution in Guatemala is evaluated before and after the mandate of CICIG. In the second one, with the use of a process-tracing method, the role of CICIG in 3 key cases is analysed, especially concerning the power of its influence in Guatemala. A short discussion about the good and bad characteristics of the CICIG model concludes the thesis.

Temporary postponement of criminal prosecution Abstract The diploma thesis deals with the procedural institute of temporary postponement of criminal prosecution, while providing a complete analysis of situations in which individual forms of this institute can be used. Furthermore, the diploma thesis offers a basic digression into the issue of corruption and organized crime, with a special focus on legal instruments which are able to make the fight against these adverse criminal phenomena more efficient. The diploma thesis analyses in detail the process of application of temporary postponement of criminal prosecution, highlights the pros and cons of this procedure, while the work does not omit the process of enshrining this institute in Czech law or its legal predecessor. The thesis tries to answer the question of whether the temporary postponement of criminal prosecution is the most helpful and effective tool, and therefore, last but not least, it also deals with other options that can be considered as suitable alternatives to this institute.
