The aim of my thesis is to consider the usage of PPP method by the reconstruction of the object of former prison in town Uherské Hradiště using the methodology of the Ministry of Finance of the Czech Republic. In the theoretical part the description of the PPP method and its features is given. In the practical part the simplified financial model for project is counted. The outcomes of the model should be taken from the public sector point of view as the basic source for making decision if PPP method is the most efficient for this project.

Předmětem diplomové práce ?Odpovídají rozdíly českých a britských Public Private Partnership rozdílným potřebám jejich ekonomik?? je analyzovat Public Private Partnership procesy v České republice a Velké Británii, a to z hlediska institucionálního a legislativního zabezpečení. První část diplomové práce podává ucelený obraz o spolupráci soukromého a veřejného sektoru formou PPP. Druhá část se zabývá vývojem a současnou situací v České republice v oblastech legislativního a institucionálního uspořádání PPP procesů. Třetí část je obdobou druhé části, je zde ale analyzována Velká Británie. Poslední kapitola Rozdíly v procesu Public Private Partnership/Public Finance Initiative ve Velké Británii a v České republice směřuje k naplnění hlavního cíle diplomové práce, tedy nalezení rozdílů mezi českými a britskými PPP a jejich zdůvodnění s ohledem na potřeby ekonomik.

V první části je popsána teorie k oblasti dálniční infrastruktury, faktory umožňující její optimální využití, se zaměřením na odpovídající financování, formy veřejného, soukromého a veřejno-soukromého zabezpečení.V druhé části je provedena analýza koncepce Public Private Parnership a komparace s konvenčním financováním dálniční infrastrukuty. V závěrečné části jsou formulována doporučení nezbytných podmínek pro úspěšnou realizaci projektů Public Private Partnership, zahrnující transparentnost projektů, potřebu podpory od vlády, rozdělení rizik, zakotvení právního rámce. Jsou zdůrazněna omezení použití koncepce Public Private Partnership a nenahraditelnost konvenční veřejné zakázky pro páteřní sítě dopravní infrastruktury.

Le sujet porte sur le partenariat, son avènement et ses portées juridiques, de sorte que le champ temporel de cette approche descriptive et analytique couvre à la fois la veille et l'aube du troisième millénaire. Ainsi, cette approche afférente au partenariat au sein du système international se base notamment sur les instruments juridiques pré-onusiens à savoir le pacte de la SDN, et ceux onusiens, à commencer par la charte des Nations Unies et la déclaration du millénaire, ayant généré les objectifs du millénaire pour le développement. Ces deux instruments et bien d'autres ayant une nature thématique et dogmatique, sont évalués et surtout affinés par des documents de nature nettement plus pragmatique, notamment le document final du sommet mondial 2005. Par ce moyen, la nature juridique est mieux conjuguée avec les retombées socioéconomiques au niveau mondial. Par conséquent, la thèse tente une modélisation du partenariat, notion récente et peu consensuelle, apportant ainsi du pragmatisme sur le plan notionnel et empirique du droit du développement. / The subject deals the partnership, its emergence and its juridical range, as the temporal scope of this descriptive and analytical approach, covers both, the eve and the dawn of the third millennium, therefore, this approach related to the partnership within the international system, based especially on the pre-United Nations instruments in particular the pact of the League of Nations, and the united nations instrument, especially the Charter of this organization and the Millennium Declaration, which generate the Millennium Development goals In particular, the eighth goal, related to establishment of a global partnership for development. These two instruments and more others with dogmatic and thematic kind, are evaluated and refined by much more pragmatic documents, that is the, 2005 world summit outcome document, so the juridical nature is better combined with worldwide socioeconomic impact and its applications on a regional, multilateral and bilateral partnership . Thus, the thesis tries modeling the most consensual guidelines partnership, this recent and little consensual notion.

Les partenariats d'innovation en droit de la commande publique / The innovation partnerships in public procurement law

Les marchés publics sont devenus des instruments des politiques de l’innovation. Dans cet esprit, les directives européennes de 2014 relatives aux marchés publics introduisent un nouveau marché public de « partenariat d’innovation » qui a été transposé en droit interne par le décret n°2014-1097 du 26 septembre 2014 portant mesures de simplification applicables aux marchés publics. Ce nouveau marché combine la recherche et l’achat de fournitures, services ou travaux nouveau, innovants et qui sont indisponibles sur le marché. Le présent travail a pour objet, d’une part, de démontrer l’originalité contractuelle du partenariat d’innovation qui se rapproche de la réalité économique et concurrentielle du marché et, d’autre part, l’illusion d’une nouveauté au sein des procédures de passation des marchés publics, dans la mesure où cette procédure se rapproche des procédures existantes comme le dialogue compétitif et les anciens marchés négociés avec publicité et mise en concurrence. De même, le partenariat d’innovation soulève de nombreuses interrogations dont la réponse suppose à la fois des clarifications des textes juridiques relatives à la délimitation de l’innovation, le régime juridique de la propriété intellectuelle, la répartition du risque, etc. ; et de l’introduction d’une réelle innovation procédurale afin de fluidifier la passation d’achats publics innovants / Public procurement is being seen increasingly as an instrument of innovation policy. With this in mind, the new 2014 European Union directives on public procurement introduces a new public procurement contract of « innovation partnership », has tranposed into national law by decree n° 2014-1097 of 26 september 2014, which concerns simplification measures applicable to public procurement contracts. This new market combines the researche and purchase innovative product, service or works and that are unavailable on the market. This present work aims firstly to demonstrate the contractual originality of the innovation partenschip approaching the economic and competitive reality of the market and, on the other hand the illusion of a novelty in the public procurement procedures, insofar as this procedure approximates the existing procedures notably the competitive dialogue and the former markets negotialted with publicity and competitive tendering. Similarly, the innovation partnerschip raises many questions of legal status of intellectual property, the distribution of risk, and so on, and the introduction of a genuine innovation procedure of fluidfication of the procurement of innovative public procurement

The socialization process begins in the childhood and it continues for a lifetime, where the individual is "socialized again" every day. It is learned how to live in society, to adapt to new situations, to talk, to react to the problems, where to go and how to arrive. It is acquired culture, he/she becomes professional and it is done leaves of an organization. The objective of this study is to analyze that it sorts things out if he/she gives the process of professional socialization in the extent of an education institution and a business organization, making the use of a case study accomplished in these organizations, located in it is Worth of Paraíba, SP. For elaboration of this study he/she got ready a questionnaire, looking for to identify characteristics to justify the importance of the partnership company/school. Later the this data collection, her far-se-a interviews, with the intention of deepening the knowledge regarding the information obtained through the questionnaire. After the data collection, the analysis of the information will be accomplished, that will make possible the supply of answers to the problem proposed for investigation. Soon afterwards, it will be made the nterpretation of the obtained data, for a wider sense of the answers to be sought, being interconnected the other theoretical knowledge, previously studied. It intends to end, after this study, that the sum of cooperative efforts between school and company will contribute in some way to the process of the individuals professional socialization, promoting an earnings in learning that can bring benefits to the organizations and the society. / O ser humano torna-se homem por meio da interação com os outros. O processo de socialização inicia-se na infância e prossegue por toda a vida, e o indivíduo é "ressocializado" a cada dia. Aprende-se a viver em sociedade, adaptar-se a situações novas, a conversar, a reagir aos problemas, para onde ir e como chegar. Adquire-se cultura, torna-se profissional e faz-se parte de uma organização. O objetivo deste estudo foi analisar de que maneira se dá o processo de socialização profissional no âmbito de uma instituição educacional e de uma organização empresarial, fazendo o uso de um estudo de caso realizado nessas organizações, localizadas no Vale do Paraíba, SP. Para elaboração deste estudo, preparou-se um questionário, buscando identificar características que justifiquem a importância da parceria empresa/escola. Posteriormente a esta coleta de dados realizou-se a análise dos diários e fez-se um questionário aberto, com o intuito de aprofundar o conhecimento a respeito das informações obtidas nas análises anteriores. Após a coleta de dados, foi realizada a análise das informações, a qual possibilitou o fornecimento de possíveis respostas ao problema proposto para investigação. Em seguida, foi realizada a interpretação dos dados obtidos, pela qual se procurou um sentido mais amplo para as respostas, interligando-se a outros conhecimentos teóricos, anteriormente estudados. Concluiuse, após este estudo, que a soma de esforços cooperativos entre escola e empresa contribuirão para o processo de socialização profissional do indivíduo, promovendo um ganho em aprendizagem, que poderá trazer benefícios às organizações e à sociedade.

Silent Partnership in the Age of Smart Technology

abstract: Smart technology is now pervasive in society and has partnered with people on every level, yet its social and cultural implications are easily overlooked by the majority. In this thesis, I work on building a silent partnership between humans and smart technology and creating smart devices/systems as silent partners by revealing the complexity of smart technology and tackling the current issues of unilateral transparency, a lack of negotiation, and the dynamic of the sense of control. This work draws on varied fields such as critical cultural studies, science and technology studies (STS), media studies, information studies, sociology, psychology, and design and consists of three main themes: materiality, politics, and affect. In addition, I utilize theoretical frameworks such as posthumanism, actor-network theory (ANT), assemblage, materialism, and affect theory to analyze the underlying factors and relationships among human and nonhuman actors such as technology companies, governments, engineers, designers, users, as well as infrastructure, algorithms, and smart devices/systems. No contexto atual do ambiente empresarial, a gestão da cadeia de suprimentos surge como um veículo através do qual as empresas podem obter vantagem competitiva. As empresas passaram a ser instadas a alterar o modelo tradicional de relacionamento distante e de curto prazo - mercado puro, com seus fornecedores, por uma relação colaborativa de longo prazo - parceria. A literatura relevante sobre parceria destaca uma série de atributos e características que devem estar presentes neste tipo de relacionamento, para que as empresas possam atingir os resultados a que se propuseram. Nesta pesquisa, desenvolve-se uma análise da literatura relevante em gestão de cadeia de suprimentos e gestão de relacionamentos, e apresenta-se um modelo conceitual, desenvolvido por Mohr e Spekman e revisitado pelo autor, que expõe os fatores associados a parcerias de sucesso. Um estudo de caso foi realizado, durante o ano de 2006, mostrando a evolução do modelo de relacionamento entre fabricante e fornecedor, em uma indústria aeronáutica brasileira, buscando verificar a presença ou não das características do modelo apresentado. O resultado do estudo gera a percepção de que, embora tenha havido uma evolução no relacionamento fabricante-fornecedor em direção ao modelo colaborativo, ainda existe um bom caminho a ser trilhado pela empresa para atingir a relação de parceria preconizada pelo modelo referencial utilizado neste trabalho. / In the current context of enterprise environmental, supply chain management appear as a vehicle through which a company can get competitive advantage. Companies started to be pushed to change the traditional far away and short term relationship model - arm\'s length - with their suppliers for a long term collaborative relation - partnership. The relevant literature about partnership points out a series of attributes and characteristics that should be present in this kind of relationship in order to allow companies to attain proposed results. This research develops an analysis of relevant literature concerning supply chain management and relationship management, and provides a conceptual model, developed by Mohr and Spekman and revisited by this author, that shows the factors associated with successful partnership. A case study is dropped, during 2006, showing the evolution of such buyer-supplier relationship model, in a Brazilian aerospace industry, searching to verify the presence or not of those attributes presented in the conceptual model. Results from the study generates a perception that, although have been noticed an evolution on buyer-supplier relationship toward the collaborative model, there is a long way ahead to meet the partnership referenced at the conceptual model presented in this study.

Le droit français et le droit libyen reposent sur des principes foncièrement différents. Le premier, fondé sur la laïcité, prône l'égalité homme-femme. Le second, de tradition religieuse n'est pas favorable à ce principe, la prédominance masculine en est le trait caractéristique. Cette distinction se voit tout au long de notre étude. Dans une première partie nous traitons les différentes formes de couples que connaissent les deux systèmes ainsi que les effets de nature aussi bien personnelle que patrimoniale qui en résultent. Cela comprend notamment l'exercice de l'autorité parentale et la contribution aux frais de ménage. Dans la seconde partie, il est question de la dissolution du couple et des conséquences qu'elle produit, personnelles comme patrimoniales. Malgré les différences entre les deux systèmes, on observe des difficultés de part et d'autre relatives à l'existence et à la dissolution du couple. Le système français est très attaché aux principes de liberté, égalité ; le système libyen est d'avantage protectionniste. D'une manière générale, les unions conjugales sont toujours le reflet d'une culture et des évolutions dans une société. / The author deals with different forms of marital unions in French and Libyan law. The main questions treated in the thesis are the consequences of marital life and its dissolution.
