Policy professionals – a group of self-centered political influencers or party loyal political influencers?

This thesis examines the group of political advisors within the government offices of a right-wing and left-wing government, showing differences between the two in terms of recruitment. The political advisors, among many roles both inside and outside the government offices, fall under the category of policy professionals. The policy professionals are defined as a social group employed without being elected, but perhaps capable of affecting policies. With collected resumes of policy professionals inside the government offices, the backgrounds of the policy professionals are examined showing differences in the qualities valued most in recruitment between the two governments selected for the thesis. The political profiles ‘media-talent’ and ‘party democrat’ show what type of government metamorphosis is present on the basis of Bernard Manin’s theory of the representative democratic form of government. The results showed a majority of policy professionals belong to the party democratic profile representing Bernard Manin’s second metamorphosis. The growing group of media-talent profiles within both governments however show, that the metamorphosis might be in a state of change, moving towards the public democracy.

Nos últimos anos, o tema da representação política no contexto brasileiro adquiriu maior relevância na pauta nacional a partir das manifestações de rua que eclodiram por todo o Brasil em junho de 2013. A presente dissertação tem os objetivos de analisar o dever dos partidos de assegurar a autenticidade do sistema representativo sob a perspectiva intrapartidária e de verificar o significado da expressão “igualdade de oportunidades” no direito eleitoral e partidário brasileiro e sua aplicação. A metodologia adotada consiste em pesquisa qualitativa, por meio do método lógicodedutivo de abordagem. A coleta dos documentos e bibliografias foi realizada por meio de pesquisa em livros, periódicos, jurisprudências e artigos armazenados em arquivos públicos, bibliotecas e sites eletrônicos na Internet. O estudo mostra-se relevante em face da perda de confiança nos partidos políticos para a melhoria da democracia representativa brasileira, bem como a intervenção do Supremo Tribunal Federal na legislação eleitoral em nome de um chamado equilíbrio da igualdade política. Nesse contexto, resta à ciência investigar as causas da falha dos partidos políticos no cumprimento do dever de assegurar a autenticidade do sistema representativo e verificar o que se entende pela expressão “igualdade política”. O trabalho foi dividido em quatro capítulos. O primeiro capítulo tem a função de delimitar o horizonte de compreensão a respeito de conceitos e questões fundamentais ao tema. O segundo capítulo tem o escopo de analisar o dever dos partidos de assegurar o sistema representativo sob a perspectiva do princípio da democracia intrapartidária. O terceiro capítulo se ocupa em verificar o significado da expressão “igualdade de oportunidades” no direito eleitoral e partidário brasileiro e sua aplicação. The present dissertation aims to analyze the parties' duty to ensure Authenticity of the representative system from an intraparty perspective and to verify the meaning of the term "equal opportunities" in Brazilian electoral and party law and its application. The Methodology consists of qualitative research, through the logical-deductive method of approach. The collection of documents and bibliographies was conducted through research in books, journals, case law and articles stored in public archives, libraries and electronic websites. The study is relevant in the face of the loss of confidence in political parties to improve representative Brazilian democracy, as well as the intervention of the Federal Supreme Court in electoral legislation in the name of a socalled balance of political equality. In this context, it remains for science to investigate the causes of the failure of political parties to fulfill the duty of ensuring the authenticity of the representative system and to verify what is meant by the term "political equality". The work was divided into four chapters. The first chapter has the function of delimiting the horizon of understanding about concepts and questions fundamental to the theme. The second chapter has the scope of analyzing the duty of the parties to secure the representative system from the perspective of intraparty democracy principle. The third chapter is concerned with verifying the meaning of the term "equal opportunities" in Brazilian electoral and party law and its application. The fourth chapter deals with the analysis of the content of the last electoral reform carried out in 2015, as well as PEC from the Federal Senate nº 36/2016.

The decentralisation of powers and functions to local government under the 2016 Constitution of Zambia.

Department of Public Law and Jurisprudence / At independence in 1964, the United National Independence Party (UNIP)-led government in Zambia was, among other things, confronted with the challenge of transforming an inherited dual, undemocratic, racist and exploitative system of local government. Local government was a creature of national legislation, and thus did not have direct constitutional authority. Between 1964 and 1995, the government adopted several reforms aimed at democratising and improving the efficiency, effectiveness and responsiveness of the system of local government. However, local government remained a creature of national legislation. In 1996, local government was for the first time recognised in the Constitution as a tier of government. Article 109 of the 1996 Constitution of Zambia required the establishment of a system of local government whose details were to be prescribed by an Act of Parliament. The provision further provided that such a system shall be based on democratically-elected councils. Thus, the 1996 Constitution transformed local government from being a mere creature of central government into a tier of government. While the institutional integrity of local government in Zambia was enhanced, service delivery by local authorities remained poor.

Looking in the Mirror: Intra-Party Democracy and Party Politics in Southern Africa

Political parties serve as a link between the state and society. Being so, they have a fundamental role in the consolidation of democratic values. It then becomes important to understand their internal functions and character. The purpose of this thesis is to measure the levels of intra-party democracy within three opposition political parties in Southern Africa. Also, this thesis seeks to show whether authoritarian political culture has an affect on a democratic party's behavior. This thesis will strive to show that as party levels of intra-party democracy decrease, fracturing in the party increases. A qualitative case study was conducted on UNITA in Angola, the ANC in South Africa, and the MDC in Zimbabwe. A content analysis was performed on the parties' respective constitutions and official party documents, as well as other scholarly writings. This was paired with an historical analysis of the case states and parties. The parties were assessed along a determined framework for intra-party democracy: political environment, legal framework of the state and party, the inclusiveness of the party, and party economics. Inclusiveness of the party gauges membership participation, leadership competition, gender parity, and oversight. The ANC exhibited the highest levels of intra-party democracy, and has shown the most stability. The MDC was found to have the lowest levels, and has split multiple times in recent years. All the parties demonstrated a need to open leadership participation and create better oversight mechanisms. Political parties proved to be a critical element in a state's potential democratic development, and though there exists deficiencies, the political parties of this study seem committed in many of their functions to this goal.

Substancialmente influenciados pelo modelo de Robert Dahl, o conceito de democracia que elegemos a concebe em duas dimensões: Competição e Participação. Ao final da pesquisa, os partidos analisados são agrupados sob o viés da distinção ideológica, intuindo-se verificar se há diferença entre a esquerda e a direita no que concerne ao modelo de democracia interna que propomos e discutimos. / The intra-party democracy discussion is the origin of this work. Based in the systematic study of statutes from ten Brazilian parties, we talk about party organization, trying to identify how democratic structures and values turn into statutory rules. Substantially influenced by Robert Dahl model, the concept of democracy we elected deals with two dimensions: Competition and Participation. In the end of the research, the analyzed parties are grouped according to their ideological tendencies, so we can verify if there is any difference between left and right, regarding the proposed and discussed intra-party democracy model.
