Role ústavního soudnictví při udržování politické stability v zemích Latinské Ameriky / The Role of Constitutional Courts in Maintaining Political Stability in Latin AmericaLanghammerová, Šárka January 2020 (has links)
This thesis concerns the role of constitutional courts in maintaining stability in the country. The thesis first of all introduces the connection between the concepts of stability, security and democracy. With the help of the general theory of disputes and conflicts formed by Shonholtz and the definition of the various roles that courts can play with respect to a political system, this thesis attempts to outline how courts can contribute to security and stability in the country or how they, on the contrary, can disrupt it. In the practical part, the thesis focuses on the region of Latin America. Using the examples from selected countries (Bolivia, Venezuela and Argentina), this work tries to demonstrate the effect of decisions of constitutional courts on stability and security. Crucial in the assessment of their stabilization role is if the courts are able to evoke civic trust in a democratic system and if they have the ability to protect the system effectively. The role of courts in selected cases is assessed using the functional analysis.

- 1 - Determination of the state border between Czechoslovakia and Poland Abstract This thesis deals with the question of determination of the state border between Czechoslovakia and Poland. The first chapter deals with issues related to the formation of both states and the concept of common borders, which were prepared by leading members of the Czechoslovak political representation during the World War. This chapter also deals with the presentation of the territorial requirements of Czechoslovakia at the Paris Peace Conference and related diplomatic negotiations in the context of this peace conference. The second chapter focuses on the issue of Těšínsko, which may have become the most important aspect of border disputes between the two countries concerned. The individual subchapters discuss in detail the establishment of Czechoslovak and Polish authorities in this area, their mutual negotiations, as well as the subsequent military engagement. However, special attention is given to the issue of following diplomatic negotiations, the planned referendum and, finally, the decision of the Conference of Ambassadors, as a result of which the disputed territory of Těšínsko was divided. Social networks have very quickly become a popular channel for politicians to communicate information to their constituents. The thesis deals with the question, if the social network communication affects the election results. It also monitors the activity of selected candidates for the post of MEP before the elections in 2019. Their posts on Facebook and Twitter are then analyzed to find a possible relationship between the activity of candidates on social networks in the period from April 23rd to May 23rd, 2019 and the outcome of the European elections. At the same time, it also fact-checks the candidates' practical statements.

Precis The Political philosophy of John Gray touches a number of topics and also has gone thrue a couple of modifications. However this thesis aims to show that there can be found a consistent political doctrine of agonistic liberalism in Gray's thought that arises from his critigue of rationalistic theories of liberalism. Agonistic liberalism is based on the naturalistic ethical theory of value-pluralism which Gray adopted whit some modifications from Isaiah Berlin. On the ground of incommensurability and uncombinability of some values within individuel lives as well as within life forms Gray comes to conclusion that the conflict of values is ineradicable part of our lives. And that's the reason why any legel or political theory cannot set up a set of liberal principles that could claim universal validity. That is why Gray sets up the concept of modus vivendi, political ideal of coexistence of individuals, groups and societies based on mutual toleration. With regard to the rational indeterminacy of conflicts over values, according to agonistic liberalism these conflict has to by resolved by political means.

The thesis follows the political development of the Lebanese Shia movement Hezbollah from its radical beginnings in the 80th, through the first political success in the early years of the 90th, to the contemporary situation. Hezbollah is an example of phenomenal transformation to the politically powerful entity with its own political party and significant power, which was often stronger than a real power of Lebanese government. The aim of the paper is to highlight the dynamic process of transformation of terrorist movement into a political party. The process is operationalized at two levels than. The analysis follows the external nature of the Lebanese political system allowing the transformation of Hezbollah; the interior follows the development of participation of Hezbollah. The process of transformation is depicted not only during key parliamentary elections in 1992, but also in the context of subsequent political developments, which resulted in a dominant position of Hezbollah in the Lebanese government. The text also embedded Hezbollah to the overall context of the Shia fundamentalist movements and the author tries to provide the potential outlines for its further development. The three years lasting postwar period in Czechoslovak history, sometimes denoted as the "Third Republic", still deserves attention of the historical research in the Czech Republic. The 1947 autumn political crisis in Slovakia is undoubtly one of the most important issues of that historical period. The aim of this thesis is to point out the sources, the process and consequences of this political crisis that is nowadays recognized as a "litmus paper" of the following "coup d'etat". First parts of the thesis analyse the collapse of the nondemocratic regime of the Slovak Republic as well as the framework of the political system of Czechoslovakia and its main features. The following part deals with circumstances of the general elections that took place in May 1946, elections, that resulted in a quite unexpected win of the Democratic Party in the Slovak part of Czechoslovakia. The phenomenon of political correctness is a fairly complicated phenomenon which creates a lot of controversy and draws a lot of attention. Despite the fact that political correctness was in the United States discussed mainly in the 1980s and 1990s, it does not mean the topic of political correctness is already out of public life. The author asks why political correctness is criticized, focusing on the question of education and through literature research - both secondary nad primary - comes to the conclusion that it is mainly due to unintended consequences of the phenomenon, chiefly through limitations imposed on the freedom of speech - either real or perceived, and also generally having a chilling effect on public discourse or lack of tolerance towards dissent. At the same time, cultural polarization of American society manifests itself quite strongly in the debate about universities. The polarization keeps the debate in a stalemate as neither side of the debate - liberal or conservative - seems to be willing to reconsider its position.

This diploma thesis "Application of the theory of the process of forming coalitions of regional councils in the Czech Republic after the elections in 2008 and 2012" discusses the process of establishing regional coalitions in the region of the South Moravian and the Central Bohemia. The aim is to answer the question of what form of the regional coalitions formed during the regional elections. Furthermore, I was describe how did the process of establishing regional coalitions and what were the key factors, that decide the outcome of negotiations. For these reasons, this thesis analyzed the official declaration of election programs, performances by regional politicians in political or public debate. The intention of this thesis is through the use of a theoretical framework and analysis of documents, describe in detail the development process, which was formed coalition and identify possible strategies of individual actors.
