The institutionalisation of effective rehabilitation programmes at Groenpunt Maximum Security Prison / T.S. Thinane

One of the biggest challenges facing the South African prison system today is the phenomenon of recidivism (repeat offences). In ninety four percent of all cases offenders re-engage in criminal activities after they have been released from prison. This means that the majority of prisons in South Africa are ineffective in terms of rehabilitating offenders during their time in prison. The contribution of this research revolves around an analysis of the rehabilitation arrangements that are prescribed by the DCS to all Government correctional institutions (prisons). The Groenpunt maximum security prison is used as a case study to establish why rehabilitation is ineffective and to identify ways and means to reduce recidivism. In this regard the rehabilitation arrangements at Groenpunt maximum security prison is measured against the prescribed governmental rehabilitation arrangements. The following main findings (problem areas) emerged out of this research: • At Groenpunt maximum security prison the prescribed governmental prescriptions for rehabilitation are not being adhered to; and • Participation in rehabilitation programmes is not compulsory for offenders at Groenpunt maximum security prison. The above trends render rehabilitation ineffective and stimulate recidivism upon release. In order to rectify the above situation the research highlights specific shortcomings in the rehabilitation arrangements of Groenpunt maximum security prison that needs to be rectified in order to reduce recidivism. This boils down to the development of an individual needs based approach to rehabilitation and making participation in rehabilitation programmes compulsory for all offenders. It is further envisaged that the recommendations relating to Groenpunt maximum security prison can also be applied to other prisons in order to reduce the rate of recidivism in all South African prisons. / Thesis (M. Transformative use of copyright material

This thesis concerns the ability of individuals to engage in transformative use of copyright expression without the permission of the copyright owner. Transformative use refers to the use of existing expression as an input into the creative process, resulting in the creation of new expression that, while still embodying elements of the original work, is original in its own right. This type of creativity is beneficial for society and should be encouraged. Individuals should have the ability to express themselves, and participate in the interpretation of their culture. My enquiry has shown that Australian law does not facilitate transformative use. Many forms of transformative expression are not currently permissible without the express permission of the copyright owner. Copyright theory, however, is not in accordance with such a prohibition on transformative use. I will suggest some legislative and judicial reforms to Australian copyright law that can have the effect of encouraging transformative expression, while at the same time providing an economic incentive to invest in creative expression and protecting the legitimate interests of creators in their works. The primary modification I suggest is that the definition of 'substantial part' in the Coypright Act 1968 (Cth) should be read, in accordance with the interests served by copyright, to allow a consideration of the context in which copyright material is taken. The seeds of such an approach are present in modern judicial interpretations; the discussion that follows attempts to show how such an approach accords with copyright theory, and why it should be preferred by the judiciary. Firstly, with respect to the economic rights, transformative uses of copyright material which are not substitutable for the original expression should not be found to reproduce a substantial part of the original. Secondly, questions of substantiality in the moral rights should be interpreted to protect authors from unreasonable commodification of their works. To the extent to which it is unclear how the right of integrity applies to the context in which a work is used, as opposed to the modification of the work itself, I submit that it should be interpreted such that authors have a right to object to the commercial association of their work with a position, product, or service against their will. Alternatively, I submit that legislative reform to include an open ended defence to copyright infringement could provide much needed flexibility in the Australian system. Such a defence could draw primarily on the US 'fair use' defence, but certain limitations of the US defence could be overcome in an Australian context. Again, as the theory shows, the primary consideration for infringement of the economic rights in transformative uses should be the degree to which the transformative use is substitutable for the original. Finally, I submit that the reasonableness defence to infringement of the moral right of integrity should be read in such a way as to ensure that the personal interests of authors does not interfere with the legitimate self-expression of future authors. I will show that the theory does not support moral rights to the exclusion of either the ability of future authors to self-actualise. The operation of the reasonableness defence should be clarified to ensure that the legitimate interests of both past and future creators are recognised.

Changing modal values through sustainable consumption of food

This thesis offers one step in a direction that will help consumers make better choices in response to a growing demand for a more sustainable living (Grant 2008, Pollan 2008). In a world of seismic economic, environmental and social change the need for a more sustainable way of behaving is rapidly becoming a priority for mere survival (Porritt 2006). Indeed, it has been suggested that the collapse of economic growth in 2008 has primarily been the result of a dependence on outmoded models of consumption (Hamilton 2003, James 2008). The first section of the thesis documents as a narrative the shift from a label design, which is the result of a research paper, to the launch of a food brand within a university community, which is the commercial outcome of research. The second section of the thesis is the study that examines a nascent label design consisting of a list of ingredients as semiotic triggers that inform the consumer about the product at the point of purchase. The methodology is drawn from mediated discourse analysis (Scollon 2005, Norris & Jones 2005) and multimodal discourse analysis where each mode is viewed as a system of representation with rules and regularities attached to it (Kress & van Leeuwen 2006). I focus on the nascent shift in modal values of packaging design within the site of engagement of a supermarket. The site of engagement is where mediated actions at moments in time and space occur (Norris & Jones 2005). These mediated actions are the focus of attention of the relevant participants (Scollon 2005), and operate at different levels of attention (Norris 2004). The third section contains the appendices.

How People Re-find Information When the Web Changes

This paper investigates how people return to information in a dynamic information environment. For example, a person might want to return to Web content via a link encountered earlier on a Web page, only to learn that the link has since been removed. Changes can benefit users by providing new information, but they hinder returning to previously viewed information. The observational study presented here analyzed instances, collected via a Web search, where people expressed difficulty re-finding information because of changes to the information or its environment. A number of interesting observations arose from this analysis, including that the path originally taken to get to the information target appeared important in its re-retrieval, whereas, surprisingly, the temporal aspects of when the information was seen before were not. While people expressed frustration when problems arose, an explanation of why the change had occurred was often sufficient to allay that frustration, even in the absence of a solution. The implications of these observations for systems that support re-finding in dynamic environments are discussed.

O filme Pinta (2013) tem direção do artista Jorge Alencar e “Dimenti - produtora cultural e ambiente de criação artística”. O estudo aporta-se na compreensão de que a obra artística contemporânea, pode não limitar sua materialização a uma determinada linguagem, e que a quantidade crescente de re-enactments do corpo na dança contemporânea, não se restringem só ao palco enquanto espaço cênico para a dança, mas em distintas intermediações que favorecem e produzem transformações e atualizações. A escolha do tema se justifica pelo interesse de aprofundar conhecimentos sobre as relações complexas da dança contemporânea e seus possíveis e inesgotáveis processos de sentidos, no intuito de elaborar princípios, técnicas e aspectos composicionais que ativam estéticas de obras passadas para o presente. A metodologia de trabalho é de característica qualitativa, com estudo de caso, utiliza entrevista semiestruturada, questionário e os registros videográficos de espetáculos e filmes utilizados para montagem de Pinta. Para referenciar discussões sobre re-enactment, dança contemporânea, hibridismo de processos compositivos foram acessados principalmente os textos dos autores Agamben (2009), Canclini (2008), Lepecki (2010), e finalmente para falar de corpo numa aproximação dos processos evolutivos que o corpo está envolvido com a memória, trazemos Greiner e Katz (2005). Ao analisar o processo de Pinta foi possível perceber que o filme produz um fluxo contínuo de memória a partir de materiais artísticos descontínuos, em ação para novas significações. Desse modo, é possível entender o re-enactment como uma prática de revisitamentos de desejos identificados tanto no artista como na obra, ambos são atingidos pelo desejo de presença.

Investigar como as re-existências epistemológicas e formativas, enquanto atos de currículo se manifestaram neste Curso constituiu-se, portanto, no problema de pesquisa que norteou esta investigação. A pesquisa teve como objetivo maior compreender as re-existências epistemológicas e formativas desses professores-estudantes aos atos de currículo constitutivos do Curso de Licenciatura em Física do Programa de Formação para Professores. Para tanto, optei pela abordagem de pesquisa qualitativa a partir do viés teórico-metodológico da etnopesquisa crítica e multirreferencial de inspiração fenomenológica, pelos princípios que apresenta, pela pertinência ao tipo de estudo realizado e aos seus propósitos. Dado o caráter idiográfico do contexto e dos sujeitos pesquisados escolhi desenvolver um estudo de caso de tipo etnográfico. No trabalho de campo fiz uso de dispositivos de recolha de informações que permitiram a “escuta sensível” (BARBIER,1990) dos sujeitos e a revelação do fenômeno através de suas narrativas, a saber: a “entre-vista” aberta, o questionário com perguntas semi-abertas, o grupo focal, cartas formativas, análise documental e “narrativas catárticas” (PAIM,2013). O estudo do fenômeno da re-existência como atos de currículo no âmbito da formação revelou o poder dos sujeitos em seus processos formativos de autorizar-se e instituírem-se como atores sociopedagógicos, assim como me remeteu a um exercício reflexivo sobre os atos de currículo e suas implicações na formação. As re-existências dos professores-estudantes aos atos de currículo confirmaram, portanto, a inseparabilidade do Ser e sua existência no processo formativo, bem como a responsabilidade dos atos de currículo na formação, algo que pouco tem sido pensado quando se discute esse fenômeno, daí a relevância desse estudo.
