Voting rights of recognised Geneva Convention refugees in their countries of asylum

This thesis concerns persons recognised as refugees based on the criteria set by Article 1A(2) of the 1951 Geneva Convention Relating to the Status of Refugees (CSR1951) and residing in a Contracting State. It appraises the exclusion of CSR1951 refugees from participation in elections of their countries of asylum pursuant to a citizenship voting qualification, which most countries set. It is emphasised that, since neither the CSR1951 refugees nor their country of asylum know when or indeed whether cessation of CSR1951 refugee status may occur, their exclusion may last for an indeterminate period of time. CSR1951 confers on recognised refugees a host of civil, social and economic rights in their country of asylum; voting rights are absent. Concomitantly, while the International Covenant on Civil and Political Rights (and regional human rights treaties) pronounce that all persons are entitled to have their rights respected, protected and promoted, Contracting States are permitted to reserve two rights for their (full) members: the right to enter and remain in their country, and the right to vote in its elections. The central claim of this thesis is that recognised CSR1951 refugees are a special category of non-citizen residents, due to their unique political predicament. They are unable to participate in elections of their country of origin, do not enjoy its diplomatic protection and consular assistance abroad, and – most fundamentally – are unable or unwilling, owing to a well-founded fear of persecution, to return to it for an indeterminate (and potentially protracted) period. It is submitted that recognised CSR1951 refugees should be entitled to vote in elections of their countries of asylum, notwithstanding general citizenship qualifications imposed by these countries. At present, treaty law does not require countries of asylum to enfranchise their recognised CSR1951 refugees. Hence, this thesis explores a gap in international refugee law and international human rights law between de lege lata and de lege ferenda; it is an exercise in ‘progressive development of the law’. Its inquiry is located in the international domain, and concerns, in principle, any Contracting State which admits and recognises CSR1951 refugees. References to national or regional practices serve solely an illustrative purpose.

An investigation into nation building through the national anthem in Zimbabwe : a sociolinguistic approach

Includes bibliographical references (leaves 171-177) / The study is an investigation into nation building through the national anthem in Zimbabwe. It takes a sociolinguistic dimension where the languages used to sing the national anthem in Zimbabwe are interrogated. The impetus behind the study is that Zimbabwe introduced a new language policy through the constitution where sixteen languages are officially recognised. While citizens look forward to the use of their languages, national symbols such as the national anthem still exist in dominant languages, at least officially. The study therefore sought to find out the views and language choices of citizens when it comes to singing the national anthem. This purpose was fulfilled by eliciting data through questionnaires which were distributed to four areas where marginalised languages are spoken. Participants were drawn from Plumtree, Gwanda, Hwange and Binga. Apart from questionnaires, focus group interviews were conducted with language activists who participate in language associations. Individual interviews were conducted with academics in the area of language. The conceptual framework of the study is nation building which is underpinned by four tenets, while the theory that guided the study is Bourdieu’s theory of social practice. The conceptual framework and theoretical framework were chosen to allow the study to investigate nation building in relation to the sociopolitical context which determines the use of languages in different spheres in Zimbabwe. The study extricates that language is politically malleable and at the same time has the potential to make or break the nation. Respondents were of mixed views concerning the non-use of their languages in the national anthem, bringing out the hegemonic tendencies. The findings of the study show that language is a form of identity and a strong tool of nation building. However, language policies which are not clear tend to confuse the citizens and there is need for the political elite to be involved in the implementation of such policies. The Ni-Vanuatu RSE-Worker : Earning, Spending, Saving, and Sending

<p>In April 2007, New Zealand (NZ) launched the Recognised Seasonal Employer (RSE) scheme.  The scheme allows for unskilled workers from the Pacific Islands to enjoy the benefits of seasonal work in NZ’s horticulture and viticulture industries for up to seven months at a time.  One of the articulated objectives of the scheme is to advance the effects on development in the countries of origin of the workers, for which remittances have been stressed as key-benefits. Although previous data and interviews concerning these aspects are marginal, all studies indicate clear benefits for Pacific Islanders.  In contrast, this study provides the novel insight to the individual views and perceptions of the earning, saving, spending and remittance possibilities of 23 Ni-Vanuatu RSE workers in June of 2008.  The findings indicate an absence of autonomy among the individual RSE workers to decide over and manage the spending of their respective incomes, along with negative implications on the potential for workers to send remittances while working in NZ.  Identified as the primary cause of this outcome, is the dual and simultaneous role that NZ based companies, on the one hand, can play as recruitment agents in Vanuatu, and on the other hand, as pastoral care agents in NZ.  This twofold capacity creates a middle hand situation that severely restricts the possibilities for the workers to access their wages while in NZ.  The conclusion therefore holds that, in this example of 23 Ni-Vanuatu RSE workers, the degree of remittances depends on the type of employment governing the participation of the workers in the scheme, as opposed to the individual spending and saving patterns, differences in earnings, or differences in the availability of work of each worker respectively.</p> / <p>I april 2007 så startade Nya Zeeland (NZ) sitt Recognised Seasonal Employer (RSE) program.  Programmet tillåter lågutbildade arbetare från Söderhavsöarna att erhålla fördelaktigt säsongsarbete i NZ:s jordbruks industrier med upp till sju månader per arbetsperiod. An application guideline for the fair value accounting of biological assets

Reporting in terms of the principles of IAS 41, or equivalent, did not result in comparable financial results in the industry. This is mainly due to valuation challenges experienced and the significant costs of these valuations, contributing to the theoretical gap addressed in this study, where the cognitive theory was applied to determine how to improve the consistency, validity and reliability of the fair valuing of biological assets. The knowledge gap is a result of the inconsistent application of the requirements of IAS 41 which results in incomparable financial results which impairs the decision-making of the users of such information. The results of the study were analysed and contextualised to develop an application guideline to assist the financial statement compilers to present results to users that will enhance their decision-making. This guideline is the result of an investigation on the industry trend and standards on how to value, disclose and report on biological assets in the annual reports; an assessment of the valuation challenges experienced, the valuation factors considered and the frequency thereof; an analysis of the valuation inputs applied and a contextualisation of the various users’ expectations when these financial results are assessed. Such assessment included an inductive content analysis, further grounded theory contextualisation and grouping of the results into a guideline that was tested on various users to ensure the usefulness and validity thereof. The purpose of the study and the developed guideline is to determine how to improve the consistency, the validity and the reliability of the fair valuing of biological assets to derive at informing, comparable, decision-enhancing balances in a cost efficient manner when detailed information is presented. / Centre for Accounting Studies / D. Fair value accounting of biological assets in the public sector was introduced with the adoption of the public sector specific accounting standard, Generally Recognised Accounting Practice (GRAP) 101. The public sector currently uses different bases of accounting: public entities and municipalities must use accrual accounting and apply the principles of GRAP, while government departments report on the modified cash basis. Furthermore, public entities do not consistently apply the requirements of GRAP 101. This lack of a uniform basis of accounting has a negative effect on the comparability of financial information. This study identified the challenges facing the public sector in the application of GRAP 101, specifically regarding the fair value accounting of biological assets. The successful implementation of GRAP 101 by a public entity, AsgiSA-EC, was used as a case study to clarify the fair value accounting challenges in the reporting of biological assets in the sector. / Business Management / M. The linguistic impact of the symbiotic relationship between amaNdebele and amaXhosa on the isiXhosa language and the amaXhosa culture in the Mbembesi area of Zimbabwe

The study sought to investigate how the symbiotic relationship between amaXhosa and amaNdebele impacted on IsiXhosa language and amaXhosa culture in Mbembesi area in Zimbabwe. The study was conducted where two ethnic groups of amaXhosa and amaNdebele coexist. Language policies in the past have disadvantaged amaXhosa by treating the language as a minority language which led to its marginalisation at school and in public life. Dynamic Social Impact Theory was used to explain the concept of the evolution of language. Language contact, language change, and bilingualism are the main terms that were discussed in relation to what happened to the two languages of study. The case study was descriptive in nature. The participants were purposefully selected according to what the researcher desired to achieve. The data were collected through interviews with heads of schools in Mbembesi, teachers, elders and youths of the community. Document analysis was also employed when the Indigenous Languages syllabus and teachers’ schemes were observed. The pupils were given a topic on which to write a short composition in IsiXhosa and IsiNdebele to ascertain if indeed IsiNdebele had impacted on IsiXhosa. A comparison between IsiXhosa of Mbembesi and that of South Africa was made as a way of verifying if there has been a change from the original IsiXhosa that is spoken in South Africa. The two ethnic groups’ cultural activities were also studied as a way of investigating the level of impact in their way of life. After administering the research instruments, the findings revealed that there is a level of impact on IsiXhosa language and amaXhosa culture through their contact with amaNdebele. The terminology in the two languages has overlapped as well as their cultural lives. The Zimbabwean 2013 Constitution has tried to raise the status of IsiXhosa by making it officially recognised but it seems to be still functioning at community level as before. IsiXhosa is still not learned at school although it was introduced in 2013 in the two pilot schools but which discontinued in 2016 reverting to IsiNdebele citing lack of teaching and learning materials. The recommendations from the study include: that the teachers should be trained in IsiXhosa at institutions of higher learning; that amaXhosa educated personnel should spear-head the writing of teaching and learning materials and that the language should be used in public life so that its speakers maintain their identity. / Linguistics and Modern Languages / Ph.
