Aspects of the sentencing process in child sexual abuse cases

This thesis investigates current sentencing practices relating to the diverse, complex and emotionally laden phenomenon of child sexual abuse. It focuses on relevant legislative provisions, on case law and on an empirical study conducted amongst regional court magistrates. Trends, developments and problems are analysed and possible solutions to the main problems identified are investigated. The thesis concludes with proposed guidelines regarding the sentencing process in child sexual abuse cases. Such guidelines address general and specific principles, the use of victim impact statements, the increased recognition and use of behavioural science in the sentencing phase with regard to both the victim and the offender, and relevant aggravating and mitigating factors. The guidelines are an attempt to give some structure to the current haphazard approach adopted by the courts with regard to harm experienced by the victim. They are also aimed at assisting experts to provide more effective and reliable pre-sentence reports. Further, the thesis attempts to provide clarity concerning the factors that are considered to be aggravating or mitigating in the offence category, child sexual abuse, as well as with regard to the weight that should be attached to them. In addition, recommendations are made for the purpose of possible law reform and further research in relation to the regulation of judicial discretion through the introduction of formal sentencing guidelines, victim impact statements and the accommodation of behavioural science in the sentencing process pertaining to sexual offenders. This proposal is based on current South African sentencing practices as reflected in the consolidation of local judgments scattered over many years in different law reports and, to some extent, on English, Canadian, Australian and American sentencing practices as researched in this study.

It was found that the largest percentages of perpetrators were the siblings of the victims.

Studies indicate that every second a child is raped in South Africa. Therefore, Child Sexual Abuse requires abstained approaches to be fastened, solid knowledge foundation and understanding. Failure to respond precisely and treat sexually abused children with sensitivity and professionalism (SAPS officials, healthcare practitioners and the judiciary) limit chances for a successful prosecution and victory to conquer psychological impairments on victims. Therefore, this research explored experiences in the Criminal Justice System (CJS) in the treatment of and response to child sexual abuse. The study was confined to Polokwane Policing Cluster (PPC) involving a sample from the South African Police Services (SAPS), the Department of Justice (DOJ) and the Department of Social Department (DSD). This qualitative study adopted non-probability purposive sampling. Initially, the researcher targeted a population of fifteen (15) officials within the PPC who work directly with cases of CSA. However, two officials were not willing to form part of the study. This research was guided by the following objectives to: 1. Determine responses of the CJS to children as victims of sexual offences within the PPC; 2. Establish the protection of psychological well-being of children as victims of sexual offences in Polokwane Policing Cluster; and 3. Review regulatory legislative frameworks addressing the treatment of children as victims of sexual offence in Polokwane Policing Cluster. Moreover, this study examined causes and impacts associated with CSA. The study further reveals consequences of CSA and offer suggested mechanisms stemming from selected participants whom, among others include, but not limited to the following: using the legislative framework approach; the Constitution of the Republic of South Africa, 1996; protection of children‟s rights and broad statutory approaches for the treatment of sexual offence victims.

Afrikaans text / Kreatiwiteit is die sentrale tema van hierdie navorsing. Die doel van die navorsing was om die relevansie en waarde van kreatiwiteit in spelterapie met seksueel-misbruikte kinders in die multi-kulturele konteks van Suid-Afrika, te ondersoek en te beskryf. Die navorsing is vanuit „n konstruktivistiese epistemologiese fundering en „n eksistensieel-fenomologiese paradigma gedoen, deur uitgebreide teoretiese en empiriese navorsing. Die teoretiese navorsingproses het eerstens op die holistiese impak van seksuele misbruik op kinders, te midde van hul spesifieke verhoudings- en omgewingskonteks gefokus. Dit het duidelik geword dat seksuele misbruik ernstige trauma by kinders veroorsaak, wat alle modaliteite van die kinders affekteer. Die voorkoms van komplekse posttraumtiese stresversteuring, vanweë langdurige seksuele misbruik, is teoreties beskryf en ook empiries bevestig. „n Sintese van gestalt-, persoonsgesentreerde en logoterapeutiese teorieë, is deur die navorser ontwikkel om die traumatiese nagevolge van die seksuele misbruik kreatief aan te spreek in spelterapie. The goal of the research was to explore the value of creativity in play therapy with sexually abused children in the multi-cultural South-African context. The research was done from a constructivistic epistemological foundation and existential-phenomological paradigms. Extensive theoretical research was supported and substantiated by empirical research. The theoretical research process focused on the holistic impact of sexual abuse on children in and as part of their specific context (field). It became clear that sexual abuse implies severe trauma for the child, and affects all of their modalities, and their functioning in their field. The impact of severe and ongoing sexual abuse on children, as complex post-traumatic stress disorder, was described to clarify their therapeutic needs. A synthesis of gestalt-, person-centred- and logotherapy to address the traumatic after-effects of sexually abused children creatively in play therapy, was developed and described and motivated in the research paper. The concept of creativity was defined and extensively explored an applied in the context of therapy with sexually abused children. Creativity as a cognitive process, a problem solving process, and an artistic process is explored and applied in this context. The value of creative activities, the challenges of being a creative therapist, the supportive role of the supervisor and the systems in society, was explored and described. The empirical research process was done in a participatory way in the form of a multiple case study. Five therapists followed a therapeutic process, according to the guideline, guidance and supervision of the researcher, with a child who had been severely sexually abused. The results from the research confirmed the value and necessity of creativity in dealing with the severe trauma of sexually abused children and bridging gaps in a multi-cultural setting. The theoretical framework of the researcher and a guideline for creative therapy with sexually abused children was tested in the empirical research process, and could be refined and finalised. Summary in Afrikaans and English / Although the rights of children in South Africa are being regulated by legislation, statistics prove that statutory services on behalf of children annually increase. Scientific accountable information regarding the child can be obtained by the assessment of the child. The purpose of this investigation was to identify the gaps in the existing assessment guidelines, as well as the needs of social workers regarding assessments. The sequential exploratory strategy was utilized, as quantitative data supported qualitative findings. The investigation showed that minimal assessment literature is available in South Africa and internationally, although assessment is the basis evidence of the social worker. The biggest gap in assessment guidelines is that assessment does not carry weight in the court. There is a need for social workers to be trained in relevant assessment skills based on a specific frame of reference. Gestalt therapy can provide a suitable theoretical frame of reference for assessment, and can serve as scientific foundation for social workers during the statutory process. A framework for an assessment guideline was thus proposed. / Ten spyte daarvan dat die regte van kinders in Suid-Afrika deur wette gereguleer word, bewys statistiek dat statutere dienste aan kinders jaarliks toeneem. Educator's knowledge of and opinions on child sexual abuse

Sexual abuse of children occurs at a very high rate and most of the victims are young children who have never been taught about the possibility of being abused. Victims of abuse are not equipped with appropriate knowledge and vocabulary to enable them to explain properly when they experience abuse. Acquisition of a vocabulary and understanding of the concepts of sexuality would assist children in recognizing, resisting and reporting sexual abuse. The young age at which abuse occurs makes the study at primary school level important and relevant. There is little literature on how child sexual abuse can be identified, addressed and handled by schools or what unique role the school should play in the management of child sexual abuse cases. Educators are in a position to identify sexually abused children because of their close and ongoing contact with school-going children. Therefore, young children place a great deal of trust in their teachers and look to them for protection when they feel unsafe. Teachers are trained to observe changes in the appearance and progress of individual children. Therefore, they can also assist in uncovering and reacting appropriately to disclosures of abuse. The study was conducted in poor, disadvantaged, rural primary schools in a part of the North West Province. There is a limited access to social work services in rural areas and therefore, educators are considered to be appropriate people to educate children about sexual abuse issues because children spend most of their time at school. There is a relationship between educators, parents and children which creates a proper channel of communicating information about sexual abuse of children. That is, educators are in a position not only to educate but also to reinforce what children have learnt at home. Educators' role have been limited in the identification and dealing with sexual abuse cases and therefore, there is a need to empower them with appropriate knowledge and skills to enable them to handle sexual abuse cases at school level successfully. / Psychology / M. Text in Afrikaans / This study is about the provision of a prototype court preparation programme for the primary school child that had been sexually assaulted. The programme is developed from a Gestalt approach. Literature regarding several existing court preparation programmes was studied and compared in order to identify certain themes for the child's preparation. Knowledge regarding the court, procedures and the functions of the various role players was conveyed to the child with emphasis on the child's role as witness. The research strategy utilised in the study was that of the intervention research and specifically the D&D-model that comprises six phases. The study incorporates the first three phases plus the first step of the fourth phase. Semi-structured interviews and focus groups were utilised to establish which themes could be addressed to support the child towards being a credible witness.
